Minutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, in the Oity Hall, in said City, on
October 199 1921s at 8 o'clock P.M '
Meeting called to order by President Meeks: '
Roll Call: Present: Weeks, Case, Erickson, Frank, ?Miner, Olson, Witzke:
Absent: None
Motion by Case second by Frank carried that the minutes of the meeting held
on September 269 1921, be app zvved z
Motion by Case second by Vitzke carried that the City Engineer be instructed
to employ automobile trucks for the hauling o:r gravel for the approaches to the City,
on the basis of1.00 per yard; and that he Deep the necessary check on the yards de-
livered
President Teeks stated that this was the time and place fixed for a hearing

or, the mode of assessment for the cost thereof, etc,,,for the opening of a public
street described as follows, and asked if there was any one preeent who �rished to be he
heard in any matter concerning the opening of the said street:
Corrmiencing at a point Four and one-half (41) feet !'Est of the Northwest corn-
er of Block Six (6), in Elliottl*s Re -Subdivision of Curmings' Addition to the City of
Rochester, Minnesota, for place of beginning; running thence due North parallel with

The following objection was read, and motion by Olson second by Erickson
carried that, the same be 'placed on file:

The undersigned, Chicago & Northwestern Railway Company, owner of the right
of way abutting upon the East and West sides of Sixth Aven»e, Northwest in the City of
Rochester, Minnesota, as opened and laid outs appears specially and objects to the
assessment of the cost and expense of said improvement, or any part, thereof, upon or
against the said land owned by its or any part thereofi upon the special grounds
following, viz:
1; That there is no warrant in law for assessing said property of this
objector in any stun whatever

There were no other communications concerning this matter nor
were there any persons prc;;ent rho wished to be hearth
President Weeks stated that this was the time and place fixed
for a bearing as to the confirmation of the sprinkling. assessments for
the season of the year 1921 which were levied by -!;his Common Council on
October 10, 1921, and asked if there was any one present who wished to be
heard in aY4 matter concerning the said sprinkling assessments:
There was no one present who wished to be heard.

At the -,pecial meeting of the Board of Educeuion, held at the High School
Building at 5:00 P.M, Friday, Oct; 14th, 19219 the following resolution was unanimous- i
ly adopted:
HE IT RESOLVED, by the Board of Education of School District Number Eight
(8) in 01 nst ed County., Minnesota, being the school district included In the limits of
the City of R-ochester, Olmsted County, Minnesota, that there be, and iss hereby levied,
upon all taxable property in said district a special school tax of Two Hundred Sixty
One Thousand,* Three Hundred Twenty Five Dollars (��261,325 00) and an additional Twenty
eight Thousand, Eight Hundred Twenty two and 18/100 Dollars (028,622,18) for extras as
listed below, for the use of said districts and the clerk of the said Board of Educe-
t on is hereby instructed to notify the' Common Council of said( City of Rochester,
Minnesota, and to request their approval of the said tax levy in accordance with the
provisions of the City Charter:

and after a discussion pf the same, a motion by Olson, second by Erickson
carried that the same be accepted and placed on file:

on the basis of 15 weeks at a sum of $50.00 per week for salary, and 025.00 per week

we, the undersigned, having been ordered by the Common Council to Investi-
gate the above claim report as follows:
Haying visited the place where, Mr, Goodenough was injured- and examined the
intersection of the alley with Second Street Southeast we cannot s-ee our wary clear to
concur with Mr. Coodenough in his contention that the condition of the street at the
r above mentioned_ intersection was the cause, either directly or indirectly, of the
accident at that time,
We, therefore, recommend that his claim against the City of Rochester for

Mr. Martin Reffron asked the Common Council for an expression as to whether
/ or rot it was their intention to makea charge against Saint Mary's Hospital for their
interest in the
proposed sanitary sewer system for the northwest part of the City, and
if so, what the amount shall be.

of the City, it has been found that the total of caht?,,t can be 1 evi ed against the abutt-
ing property and the proceeds from the 025, 000.00 Sewer Bond issue recently authorized
'a will make a total which will be in the neighborhood of 020,000.00 less than the total

cost of the two projects, and naturally certain Qf the local interests

Motion by Miner second by Olson carried that the administration
Of Saint Mary's Hospital be notified that they shall, on or before Kovemb-
er 1, 1921, notify this Common Council 'as to vfi_ether or not they. will aid
in the construction of the proposed sanitary sewer system for the North-
west part of -this City and to wr.at extent, in order that this Common

Council may, on November 79 19219 when the bids are opened for the con-
struction of the said sewer system, know whether to proceed further in the
construction of certain parts of said sewer system or not.
Motion by Olson second by Erickson carried that the Finance
�! Committee be directed to work in conjunction with the Committee composed

of the City Engineer and the City Attorney, who were heretofore designated

as a Committee to confer ti4'ith the administration of Saint Mary's Hospital
j and the Kahler Corporation as to what their contribution is to be to,vard

the improvement and extension of. the sanitary sewer sys-t em of this City.

Motion by Olson second by Erickson carried -that the City Clerk
be instructed to request of the Treasurer of the•Roehester Fire Depart-
ment Relief Association that he file an itemized statement showing the
present loans from the Funds of said Association, and that he be specif-
ically instructed to comply with the State law in regard to the invest-
ment of these Funds as it applies to' past investments and to future in-
vestments. -
The report of the Public Utility Board, Water De}3artment, for
the month of September, 1921, showing receipts in the amount of $33340599
and disbursements in the amount of $6,140.62; and the report of the Pub-
li o Utility Board, El ectri a Dep artm wbv for the month of Sept ember, 1921,
showing receipt8 In the amount of .$220155 46, and disbursements in the
amount of $4490720-799 were each separately read, and motion by Olson

The reports of the Milk Inspector for the weeks ending October

The following petition was ready and motion by Case second by
Erickson carried that the permission requested therein be granted:

WHEREAS, the Common Council of thb City of Rochester, at a meeting thereof
duly held on October loth, 19219 after due notice given and hearing had as provid-
ed by law, did duly pass and adopt a resolution ordering that a sanitary sewer be
constructed in the following named streets and avenues in the City of Rochester:
That sanitary sewers be constructed in said City as follows:
Commencing at a point in the center of Second Avenue Northwest six feet
north of the center of Third Street Northwest and running southwesterly to a point'
20 feet West of the center line of Second Avenui Northwest and twenty feet south

direction, did* on the 19th day of October, 1921, duly file in the

for the said improvements and did report to the said Common Council
an estimate of the cost and expense of said improvements;
THEREFORE, Be it and it is hereby resolved by the said Common
Council of the City of Rochester:
That the plans, profiles and specifications for the improvements
above described so filed in the office of the City Clerk by the said

Be it further resolved by the said Common Council:
That the whole cost and expense of constructing each of the said sewers in
said parts of the above mentioned streets and avenues& in the manner above men-
tioned, according to the plans, profiles and specifications for the sane on file
in the office of the City Clerkq shall be assessed against each lot, piece or
parcel of land benefited by each said improvements, without regard to the cash
valuation of said lands, ratably and in proportion to the special benefits cow-
ferred upon each said lot* piece and parcel of laud by the said Improvements

Be it further resolved by said.Cammon Council:

That a meeting of said Common Council will be held at 2 o'clock P.Mj on
November %th, 1921, at the Council Chambers in the City Hall in said City, at
which meeting all persons interested in said improvements above described may
appear and be heard before said Coaammon Council in relation to the said improve-
ments or to the mode of assessment for the cost and expense thereofs, or any other
matter or objection relating to said improvements$ . or air of then, upon which
they may desire to be heardo
The City Clerk is directed to prepare lists which shall contain a description
of each and all of the properties abutting _upon each of the said improvements and

lists, together with a notice of the time and place of the meeting and hearing,

above mentioned* he shall cause to be published once in the official paper of
said City at least ten (10) days prior to the date of said meeting and hearing.
Be it further resolved by said Common Council:
That the City Clerk of said City be and he is hereby ordered and directed to
advertise for bids as provided by elaw for furnishing all materials atd doing all
the work for making said improvements.
Bids for each improvement shall be received and opened by said Common Council
at a public meeting thereof to be held at 2 o'clock P.M on November7th, 1921i at
