Minutes of` an adjourned .regular meeting of the°Common Council of
the City of Rochester, Minnesota, held in the Council Chambers, in the City
Hall, 'in said City, on November 14, 1921, at 8 O clock, P.11"
Mceting called to order by President Weeks.
Roll Call: Present: Meeks, Case, Erickson, Frank, IfUner, Olson,
Witzke. Absent: None.
President Weeks announced that- this was the time and place fixed
for a hearing on the opening of a`public street over and across the follow-
ing described lands, and asked Iftherewas any one present Who wished to be
heard:
CoRunencing at a point on the Wesb line of Fifth Avenue Northwest
where the. South line of Sixth Street Northwest would ittersect said 11,est
line of PZfth Avenue Northwest, if same were extended in a straight line;
and running West in a straight line with the South line of Sixth Street

Northwest to the Last line of Sixth Avenue Northwest; thence. North Sixty-
six (66) feet; thence East in a straight line along the North line of Sixth
Street Northwest, if the same were extended, to the (Vest line of Fifth
Avenue Northwest; thence South Sixty-six (66) fget to the place of beginn-
ing•
There was no-one preeent whp wished to be,heard in regard to the
opening of the public street over en.d across the above described lands.
The City Clerk reported that there had been no written objections
made to the award of the Commissioners made in the condemnation of the

The award of damages made by the Commissioners in the condemna-
Lion of lands necessary for..the opening of an extension of Sixth Street
Northwest, was read, and was considered by the Common Council.
Alderman Case introduced the following resolution which was read:
WHEREAS, W. H.'Hendricks, E. F@ Weber and C.. R. Stratton, the
Commissioners appointed on October loth, A. D. 1921, in and by resolu-
tion of the Common Council of the City of Rochester, Minnesota, to view

'. the lands and premises and to; assess the damages occasioned by the con-
demnation and taking by said City of Rochester for use as public street

the lands described in said resolution of appointment, to -wit:
Commencing at a point on the West line of Fifth Avenue Northwest

where the South line of Sixth Street Northwest would intersect said West line of
Fifth Avenue Northwest, if same were extended in a straight line; and running
West in a straight line with the South line of Sixth Street Northwest to the East
line of Sixth Avenue Northwest;' thence North Sixty-six (66) feet; thence East in
a straight line along the'North line of Sixth Street Northwest, if the same were
extended, to the`West line of Fifth Avenue Northwest; thence South Sixty-six (66)

WHEREAS, the said City Clerk on November ltt, 1921, did publish a notice to
all persons interested in said,lands, in the Rochester Daily Bulletin, the offic-
ial newspaper of said City, to 'the effect that said report and award of damages
had.been made and filed as aforesaid$ dnd that unless written objections were
made thereto by persons interested in said lands, the said report and award of
damages would be confirmed by the Common Council of said City of Rochester, at a
meeting of said Common Council to.be held at 8 o'clock P.M#,..on,November 14th,
1921, at the Council .Chambers in the City Hall of said City; and the said notice
was published in said newspaper for ten days prior to the date of the said meet-
ing held on November 14th, 1921;.
And, WHEREAS, the said Common Council duly met at said time and place and
heard and duly.considered all objections offered and interposed by persons inter-
ested in the said lands, and duly considered the said report and the award of
damages therein made by said Commissioners;
AND, WHEREAS, No written objection to the report of the Commissioners, or to
the award of damages made by said Commissioners, as set forth in said report,
were offered or filed by any person or party;
NOW THEREFORE, Be it and it is hereby resolved by the Common Council of the
City of Rochester, Minnesota;
That the said report of said Commissioners made and filed as aforesaid, and
the award of damages therein contained and set forth, be and the same are in all
things hereby approved and confirmed, and the said Common Council does hereby
approve and confirm the said report and award of damages$ as follows:
For the taking of lands extending West for the opening of an extension of
Sixth Street Northwest:
To Frances May Gooding: For the taking of that part of lands lying East of
Sixth Avenue Northwest in that part of the Northeast Quarter of Section 359 Town-
ship 107, Range 14� West, lying South of Mantorville Road and North of the Rail-
way, less the East i9l Acres of the South 10-2/3 Acres of the Northwest Quarter,

Commencing at a point on the West line of Fifth Avenue Northwest where the
South line of Sixth Street Northwest would intersect said West line of Fifth
Avenue Northwest, if same were extended in a straight line; and running West in
a straight line witli the South line `of Sixth Street Northwest to the East line �

That there is hereby appropriated from the Permanent Improvement Revolving Fund
the sums above stated and payment is hereby ordered to be made to the persons
above named for the taking of the above described real estate for use as a public

That there is hereby appropriated from the Permanent Improvement
Revolving Fund of said City the sum of $l5@00 for the payment to said

City Clerk of said City are hereby directed to draw warrants on the
City Treasurer for the said sums and. cause payments thereof to be made

thence Southerly in a straight line parallel with the East line of Fourth Avenue
Southwest, if the same were extended in a straight line to the intersection with
the North line of Ninth Street Southwest, if the same were extended Easterly in

A.`C. Gooding, Mrs. H. H: Witherstine, William Sykes and Daniel Macken, as
a Subcommittee from the City Planning Committee of the Civ1c and Commerce Associa-
tion, requested that the Common `Council appoint a Committee or Boavd for the purpose
of planning for the future physical development and improvement of this City, to
recommend zoning ordinances, control future platting of lands, etco, and suggested
that such Committee or Board should be composed of five to seven persons.
The report of the City Weighmaster for the month of October, 1921, showing

ing Officer of C Company, Fifth Infantry, M.N.Go, be granted a license .to operate a
roller skating rink in the local Armory for a period of one month, at a license fee of
$25.00 per monthi
The report of the City Treasurer for the month of October, 1921, showing
$201,354s81 as being on hand, was read, and motion by Miner second by Frank carried
that the same be accepted and placed on files
A communication from the Northwestern Association of General Contractors of
Saint Paul, Minnesota, calling attention to the Provisions of Chapter 274, Minnesota
Laws of 1921, was read.'and motion by Witzke second by Case carried that the same be
Placed on file.
The following, communication was read, and motion by Miner second by Frank
carried that the appointment mentioned therein be approved, and that the said communi-
cation be placed on file, the Mayor and "City Clerk being authorized to draw the nec-
essary warrants upon the City Treasurer for the payment. of salary during the period
mentioned, said salary to be on,the basis heretofore provided for as salary for Fire-
men in the Fire Department of said City:

The application of the L. A: Kepp Electric Company for an elect-
ricians' license was read, and motion by Witzke second by Case carried
that the said license be granted:
The electricians' license bond of the Fbster Electric Company,
with A. H. Fbster and George Morrison as sureties thereon, each in the
amount of $19000 00, was read, and motion by Witzke second by Erickson
carried that the said sureties be accepted, and that the said bond be
approved and placed on files.
The electricians' license bond of the Li Ai Kepp Electric Coke,
with William F. Leitz and James H. Seaman as sureties thereon, each in the
amount of 01,000.00, was read, and motion by Erickson second by Olson car-

After going over Mr. R L: Tollefson's request for a refundment on his
Broadway Street South sprinkling assessment, we consider the placing of an assess-
ment against the Fire Hall ,property would be of such little benefit to the individ-
uals fronting on that part of Broadway Street from the Central Fire Station to the
tracks of the Chicago and Northwestern Railway that it would not warrant a change in
the assessment and the trouble of making're fundment s on those payments which have

already been made,

read: WHEREAS, Fielding and Shepley, Inc., contractors, have fulfill-
ed their contract with the City of Rochester for the paving and curb-
ing of the following named streets and avenues in said City:
College Street from Dubuque Street to Central Avenue;
Central Avenue from Fifth Street to College Street; and
Cherry Street from Fifth Street to College Street.
THEREFORE, Be it resolved by the Common Council of the City of
Rochester:
That Fielding and Shepley, Inc., be and'they hereby are re -
'leased on their maintenance bonds' heretofore given to said City of
Rochester for the construction, completion and maintenance of the
paving and curbing on the streets and avenues above nameda

.agree to take at par and accrued interest $25,000 legally issued Electric Light bonds
of the City of Rochester, bearing 5% interest, due January 2, 1939, optional January .
29 1929, in part payment of the judgment which we understand they have secured
against the City of Rochester.
The balance of the judgment is to be paid them in cash together with accrued interest
until the date payment is, made. • •

'Be it, and it is hereby resolved that the Public Utility Board
accept the above judgment and authorize P4y7hent thereof, in the following
manner; That the unsold Hydro -Electric bonds aggregating $25,000.00 be
t-arned over to ' the plaintiff at par value with accrued interest to date, as
part payment of said judgement; that the balance thereof amounting to
050,397.34 plus interest from August fourth, 1921 to date of payment less
