Minutes of a regular ineeting of the Common Council of the City of Pochester, Minnesota, held in the Council Chambers, in the City mall, in said City, on December 5, 1921, at 2 o'clock, P.M: Meeting called to order by President Teeksf Roll Call: Present: Weeks, Ericksoh, Frank, Miner, Witzke. Absent : Case, Olsoni M. Heffron�of Heffron and Fitzgerald, said that the Building i and Electrical Inspector had stopped their men from working on the Com- fort Statio i, and Don Postier, Building and Electrical Inspector, explain ed that his reason for stopping the work on the Comfort Station vas be- cause they were not laying the brick in accordance with the plans and specs fi cations, i Harold H. Crawford, Architect, stated that while Winona brick i were specified for this building,they could not be used in laying the brf ek as shown on the plans . as one side o f, them is rough and the other side has two ridges running lengthwise of the brick, and that because of such a situation he authorized the contractors to lay a, solid mall in- stead, with frill understanding and agreement that there shall be no extra cost for the furring which it will be necessary to use in getting an air space between the solid brick wall and the plastering@ Alderman Olson came in at this time and took his Chair. Alderman Erickson introduced the following resolution which was read: Be it resolved by the Common Council of the City of Rochester, Minn.: i That the method of laying the brick in the exterior walls of j the Comfort Station in the City of Rochester be and the same is hereby changed from the detailed drawing as shown on the plans for j said Comfort Station, viz.: An 8" hollow brick wall to an 8" solid i brick wall, and the same to have furring, lath and ,plaster on the inside. Motion by Erickson second by Prank that said resolution be adopted as read: Roll Call: Ayes: Erickson, Prank, Miner, Olson, Witzke. Nays: None: President Weeks declared said resolution passed and adopted. Motion by Miner second by Olson carried that W. E. Cudmore, Chief of the Fire Department, be authorized to attend a meeting of the Executive Board of the State Firemen's Association to be held in Saint Paul, Minnesota, December 6, 1921; his expenses for the.trip to be paid by the City of Rochester, Minnesota. The following communication and application for license were each separately read, and motion by Miner second by Prank carried that the same be placed on file.: "Rochester, Minn. MINNESOTA: I hereby, submi-y ty schedule, providing Zamzow and DeMahle takes Third Avenue, Southeast, I will run on Second Street, Northwest, and give service to 16th Avenue, S.W., every half hour from 6:30 A M until eight thirty A.M. every' hour until twelve and every half hour from twelve to six, P.M. If Zamzow and I7eMahle do not want ,Third Avenue I can furnish almost the same schedule, with the* exceptions of morning, noon and night, which will be about o j trip J L Van Tassel" A. H. Clemens, Attorney -for L. Van Tassel, offered to enter into an agree- ment that in the event Mr. ,Van Tassel would be given the exclusive jitney service sights, during the balance of the life of his franchise, to operate on Center Street Nest, First Street Southwest and Second Street Southwest, the said agreement would b bound by a bond of $10,00000 conditioned that neither jitney bus owner would enter upon the other's territory, except under penalty of forfeiture of that amount, with the stipulation that the operation of sight-seeing automobiles mould be exempt from such re-striction, and his proposal further provided that each owner shall furnish E bond of $1, 000.00 running to the City of Rochester,, Minnesota, conditioned with the forfeiture features above set forth. Motion by • Witzke second by Frank .carried that the City Attorney be instruc ed to draft a resolution licensing Zamzow and Domaille to operate a tjitney bus line over a route described as follows, and that said jitney bus -should be operated over that said .route every thirty minutes daily between 6:30 o' clock . A.M. and 10:30 o'clock P.M.; all voting in favor thereof except Alderman Olson who voted, "Nays" Beginning at First Street Southwest and Broadway Street South; thence west on First Street Southwest to Sixteenth Avenue Southwest; thence north on Sixteenth Avenue Southwest to Center Street West; thence East on Center .Street West to Eleventh Avenue Southwest and Northwest; thence North on Eleventh Avenue Northwest to Second Street Northwest; thence East on Second' -Street Northwest to Broadway Street North; thence South to place of beginning,, and to detour on -any street `or Avenue in case above route becomes impassable@ The following communication was read, and motion by Witzke sec- 1 and by Frank carried that the same be referred to the Street and Alley Committee: "TO THE COMMON COUNCIL OF THE CITY OF RO CHESTER: We, the undersigned, resident free -holders, owning real s estate abutting on the proposed improvement, hereby propose and agree that in the event, that a Street be laid fifty (50) feet wide running North and South from Fourth Street S.E, to Eighth Street S,E. and be- . r tween and parallel to Eleventh and Thirteenth Avenues, at such point so r , that it takes seventeen (17) feet off the Erland Johnson property and thirty three (33) feet off the Durand and Moehnke property, such street to be in a straight line from North to -South, then, each of the under- signed agrees that he will dedicate to the City of Rochester for public use, all that portion of his property needed for the laying out of such street without the payment of damages or reimbursement therofor+ Dated, Rochester, Minnesota, December 1, 1921 Walter Ri edl - H. Roepke for an `electricians' license was read, and motiorf by Witzke second by Frank carried that the said license be granted ' The electricians' license bond of Fred A. ' Roepke with J. The application of C. J. Wilber for an electricians' license, was read, and motion by Erickson second by Witzke carried that the said r license be grantedr • The electricians' license bond of C. J. Wilber with Chris Roeder and John Toomey, Sri, as sureties thereon, each in the amount of 339 1,000.00 was read, and motion by Erickson second by, Witzke carried that the said sureties be accepted and that the said bond be approved,and placed on file. The report of the City Justice for the month of November, 1.921, showing fines collected in the amount of $2151009.and fees due him in the amount of 457.50, was read, and motion by Miner second by Erickson carried that the said report be referred to the City Attorney. The report5of the Milli Inspector for the weeks ending November 2.69 19219 and December 3, 1921, were each separately read, and motion by Erickson second by Miner carried ithat the same be placed on file. Alderman Witzke introduced the.following resolution which was read: Be it resolved by the Common Council of the City of Rochester: That a license is hereby granted to G. A: Zamzow.and E. C. Domaille, doing business under the firm name of The Rochester Bus Line, of the City, of Rochester to run and operate the* following described motor vehicle, to wit: One (1) ,Acme Bus, ,o;ie tqn and a half (12), sixteen passenger, truck No. 7132 State License No., X 8034; to operate and use said vehicle as a motor car ! i for carrying passengers for hire in said City of _Rochester for the period ending April 1st, 19229 under and according to the provisions of an Ordinance of said i • i City entitled, "AA;Ordinance providing for the licensing and regulating of motor vehicles travelling the. public streets of the City of Rochester, carrying pass- engers for hire, between certain definite points of termini within the City of Rochester." I ized to attend a meeting of the Executive Committee of the League of Minnesota i Municipalities to be held in Minneapolis, Minnesota, on December 15, 1921; his expenses for the trip to be paid by the City of Rochester, Minnesota. `Alderman Olson introduced an ordinance creating a City Planning Commission and prescribing its duties, 'which was given its first reading. Motion by Miner second by Erickson carried that the rules 'be suspended and that the said ordinance be given "its secondr. eading• and it tas given its second reading accordingly: Motion by Witzke sdoond by Frank carried that the rules be sus- pended and that the said ordinance be given its third and final reading, and it was given its third and final reading:.accordingly. Motion by Olson second by Miner that said ordinance be adopted as read: -Roll Call: Ayes: Erickson, Frank, Miner, Olson, Witzke4 Nays: None, President Weeks declared said ordinance duly passed and adopted. The report of.the Health Officer covering the transactions for the City Farm during the .month of November, 1921, was read, and motion by Vitzke second by Fran: carried that the same be returned for correction in. that the disbursements shown thereon totaled $541835 when the correct amount was $541:15s the receipts on the said report shoving a total of $779.34, and a balance on hand at. the end of November, 1921, of $2103:28. President Weeks at this time .excused Alderman Miner who left the Council Chambers. ..The report of the Building.and Electrical Inspector .for the month of October, 1921., showing the sum sof $125625 as having been collect- ed for electric inspection fees,' and $85.00 as having been collected for ,building inspection fees, was read, and motion by Olson second by Erick- son carried that the same be referred to the Finance Committees . The application of A. B..Disney, whose address is R.F,D4 Nos 5, Rochester, Minnesota, for .a license to peddle meats for a period of six months, was read, and motion by Witzke second by Frank carried that the ,said license be granted at a fee of $60:00 for the period of six months, The following application for license was read, and motion by Witzke second by ''rickson carried that the said license_ be granted; "To The Common Council of the city of Rochester, Minnesota: The undersigneds hereby. makes application to your body,, for license to move a two story frame building (dwelling) from #715 1st St. r N.W r*, in the city of Rochester, to 12th Ave:, and 2nd St . , N.Wa. in said --city, over and by the nearest route using streets and, avenues not pro- hibited to such uses I herewith tender bond in the sum of Five thousand ($5000.00) as required by ordinance, and license fee of Twenty five ($25000) Dollars Respectfully submitted, Wm.
