I I �I II Motion by Case second by Erickson carried that the minutes of i 21 the meetings held on November 1 November 7, 9 , v ber 14, 1921, November 16, 1921, November 25, 19219 November 28, 1921, and ,December 5, 1921, be each !- !I' approved. 0. C. Ronken and H. O. Christensen, as members of a Committee ! from the Olmsted County Bar Associatgon, requested action of the Common I ' Council that would provide for a local municipal court and fora local small debtors court in place of the present Justice Court, and said that !� they came before the Common Council withit practically the unanimous recom- mendation of the Olmsted County Bar Association that these changes be { !� made; there being only one dissenting vote. !Ili l" Motion by Miner second by Olson carried that the Chair appoint - I a a Committee to confer and work in conjunction with 'the Olmsted County Bar � !'! Association in the matter of establishing a local municipal court and a local small debtors court, and President Weeks accordingly appointed 4 Aldermen Case Erickson Frank Miner Olson and Witzke as members of , , !' the said Committee. , ! Joyce and Dr& Wo Fe Blei- I } it fuss asked'that the Common Council make arrangements for the salary and -appointment of a Child Welfare Nurse after January 19 1922, and explained II � the great need for continuing this work • their reason for coming g , r c ing to the Council for this salary appropriation being that although this has pre-viously been handled by the . Olmsted County Chapter of the Red Cross, they cannot longer maintain this service as the response to the last Red Cross ! Roll Call will not warrant the expense. I . Motion by Olson second by Frank carried that the matter of ' I .. �j creating of the office of a Child Welfare Nurse and the necessary" appro- • •4 ' -Y I priation be referred to the City Attorney, and that he make report at the next meeting of this Common Council. - jl E. C. Domaille, of Zamzow and Domaille, asked that the Common s Council take action to prohibit L. Van Tassel from operating his jitney buses over and upon the territory for which they were recently licensed. �i He said that his firm only asked for the privilege to operate upon the !lid; streets for which they were licensed, but that Mr.•. Van Tassel, since they !i were licensed on First Street Southwest and Second Street Northwest, has persisted in operating one of his buses just ahead of their schedule, and said that under the present competition only one line can exist on the. revenue received, so either Van Tassel will have to be prohibited to oper- ate there or be compelled to give the required service. Motion by Witzke second by Frank carried that the City Clerk be instructed to notify the Chief of Police to order L. Van Tassel not -to oper- ate either or any of his jitney buses on First St. S.W. between Second Ave. S.T. and Sixteenth Ave. S.W., the vote on said motion being, Ayes: Frank, Viner, �4 Witzke, Weeks. Nays: Case, Erickson, Olson. i ?. E. Dunford asked if the Mankato Construction Company were obligated to give preference to home labor in the construction of the Northwest District Sanitary Sewer, and explained thpt ' $is, reasons for inquiry on this subject was that he had been laid off from their work.. and an outsider hired. in hi,s stead. He was advised that the Mankato Construction Company have filed an agree- ment that they will employ local labor as much as possible so to do. Motion by Miner second by Frank carried that the City Attorney be instruct- ed to notify the Mankato Construction Company to comply with their agreement as to the employing of home labor. , Oscar T. Giere, City Assessor, asked that the Common Council give favorable` consideration to his claim of $376*90 which isnow in the hands of the City Attorney for report thereon. The following report of the City Attorney on the claim of Oscar T. Giere was read, and motion by Miner second by Erickson carried that the same be placed on file& ti ' t "Report of City Attorney on thet claim of Oscar T. Giere for $376.90 cover- .i • ing office expenses and clerk hire in re the 1921 assessment. To the Honorable Mayor and Members of the .Common Council, t Gentlemen: The above question, is one of both law and fact as I see it. I shall take up the legal.side only of the matter in this report. Section 295 of the City Charter provides in part that,,. { 'No officer's salary shall be increased or diminished during his term of offices'. The same section also provides that, 'The Common Council may at any time fix the compensation of any officer or committee for any extraordinary service performed.' Under the City Charter it would be illegal to pay Mr. Giere any more money for services rendered by him as City Assessor duri�ig the current year unless the Common Council, acting under Section 295 of the City Charter, were of the opinion by a majority of the members of that body that Mr. Giere, acting as City Assessor, rendered or performed some extraordinary service in so doings Respectfully submitted, James T. Giere, City Assessor, that he file an itemized sworn statement of the extra expenses which he had to incur in making the 1921 assessment o4f the City; the said statement to show the date, item and amount for each expenditure made, all voting in favor thereof except Alderman Witzke, who voted, ."Nay". ' The report of the City Weighmaster for the month of November, 19219 show- ing fees collected in the amount of $39.30, was read,' and motion by Olson second by Prank carried that the same be referred to the Finance Committee. The November, 1921, report of the City Engineer was read, and motion by j Olson second by Erickson carried that the same be referred to the Street and Alley Committee. f 352 i O The November, 1921, report of the Health Officer for -the City Farm, showing receipts in the amount of $779.34 and disbursements in the i amount of �541.15, and a balance on`hand of $2103.48, was read, and motion by Miner second by Case carried' that the said -report be placed on file. The November, 1921, report of the City Treasurer showing $316,371:22 as being on hand,was read, and motion by Case second by. Erickson carried. ,that the same be placed on file. The report of the Building and Electrical Inspector for the month i of November, 1921, showing the sum of $14.25 as having been collected for Electrical inspection. fees, and $76.00 as having been collected for Build- ing inspection fees, was read, and motion,by Witzke second by Erickson carried that the said report be referred'to the Finance Committee. The report of the Public Utility Board, Water Department, for the month of November,. 1921, showing receipts in.the amount of $3434.52, and disbursements in the amount of $32.11w57, and the report of the Public a Utility Board, Electric Department, for the month of November, 19213, show- ing receipts in'the amount of $26,172*96 and disbursements in the amount of $66,387430, were each separately read, and motion by Witzke second by Erickson carried that the same be placed on filew The applications of Claude L. Bogart, John L. Eaton, Arthur S. Domke and Howhrd Paul Campbell for 1922 drivers' licenses, were each separately read, and motion by Witzke second by Frank carried that each of the said licenses be granted. An application of C. D. Brown -for a license as milk producer and milk distributor of raw milk, was read, and motion by Witzke second by Erickson carried that the said license be granted& • The following report of the Health Officer for the month of November, 1921, was read, and motion by Erickson second by Case carried that, the same be placed on file: -4 1 • -HEALTH DEPARTMENT Rochester, Minnesota. t To the Honorable Mayor ands the :Common Council: For the month of November the following report is submitted: Vital Statistics Births --------23 Deaths ---------7 (Male 15,female 8) Stillbirths - - - - 0 ` Communicable Diseases Chickenpox - - - - 2 Typhoid (Source undetermined) This is an unusually ,low communicable disease rate for November. Colds and bronchitis are not reportable tho they are communicable and many cases of these existed during the months One case of suspected scarlet fever was released after 10 days quarantine4 Complaints are occasionally received concerning the rubbish boxes on various down town street corners. H. Armstrong, City Engineer of the City of ' Rochester, for the construction of a Rip Rap ,Wall at the North approach of the concrete bridge across Silver Creek on Eleventh Avenue Northeast, in said City of Rochester, be and the ,game are - i hereby adopted asand for the plans, profiles and specifications for the said improvement; and that the estimate of cost of said improve- ment .reported to said Common Council be and the same is hereby ac- i cepted and ordered filed in the office of the City Clerk. Be it further resolved by said Common Council: That the City Clerk of . said City be and he is hereby ordered end directed to advertise for bids as provided by law for furnishing a all materials and doing all the work for making the said improvement. 359 Bids for said improvement shall. be .received and opened by said Common Council at a public meeting thereof to be held at 2 O'clock P.Vo on January 3rd, 1922, at the Council Chambers in the City Hall ..in said City. Swanson, Superintendent of the Electric Light Plant, that he appeer_ before a meeting of this Common Council which is to be held at 2 o'clock P.T+R on January 3, 1922, for the purpose of explanation of the reason for the great increase in the cost of public lighting and why a flat rate charge of t75..00 per month is made for each section of the so-called ornamental lighting. Alderman Miner introduced the following resolution,which was read: Be it resolved by the Common Council of the City of Rochester: That the sum c ,' `�7500.00 be and the game is hereby appropriated from the General Fund of said City and ,temporarily transferred to the Fire Protection Fund of said City for use in said Fund..
