President Weeks announced that this was the time and place fixed for a hear- ing on the opening and laying out of an extension of Fifth Avenue Southeast between Tenth Street Southeast and Eleventh Street Southeast, and to the mode of the assessment for the cost thereof, etc:, and asked if there was any one present who wished to be heard in any matter concerning the said street openings There was no one present who wished to be heard: The following report of costs was read, and motion by Witzke second by Frank carried that the same be accepted and placed on file: - "August, l4 , 1922: Honorable Mayor and Common Council - City of Rochester, Minne sot ac Gentlemen: I respectfully report the following as being the costs of opening Fifth Avenue Southeast between Tenth Street Southeast and Eleventh Street Southeast (Job #405): Award made by Commissioners. for taking. of lands as confirmed by t'he Common Council of said City.on July 3rd, 1922, $2918500 Award made by Commissioners for taking of buildings as confirmed by the Common Council of said City on July 3rd, 19229 Commissioners" services in, condemnation of said lands and buildings, Official publications of condemnation proceedings, Cost of blue prints, Cost of tearing down house and hauling away debris, Estimated cost of making street passable for traffic, Tot al 100600 15s00 32e22 1a13 38120 125100 i $29496 55 ; Less Barn sold to J. Wright, City Clerki" Alderman Miner introduced a resolution levying special assessments for the cost and expense of laying out and opening a public street over, through and across the following premises situate in the City of Rochester, Olmsted County, Minnesota, to -wit: A strip of land 66 feet in width with 33 feet in width on the east and west sides of. a center line described as .follows, to -wit: Commencing at a point in the center of Fifth Avenue Southeast and the south line of Tenth Street Southeast and running southerly to the north line of Eleventh Street Southeast on a line to intersect 700 :the center line of Fifth Avenue Southeast at the south line of Twelfth 'Street Southeast, which was ready Upon motion by Miner second by Frank, and.all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted The application of L: S. McGuire for a license to peddle rubber trouser belts on the streets of said City for a period of one day, August 159 1922, was read, and motion by Frank second by Miner carried that the said license be granted at a fee of $5:00 for one daye The following report of the Deputy Health Officer was read, and President Weeks ordered that the same be placed on file: "Report of the Health Department to the City Council for the month of July, 1922 x Resident living births - - - - - - - - - - - - - 19 Resident deaths- - - - - - - 5 The following contagious diseases came under the observation of the Health Office: Diphtheria,.carrier, - - - - - - - - - - - 1 Chi ckenpox - - - - - - - - - - - - - - - - 2 Measles - - - - - - - ---------2 (one an imported case) ` Scarlet Fever ------ - --- -- :- - (one imported) Tuberculosis - - - - - - - - - - - - - - 1 Health conditions during the month were unusually good as shown by low .disease rate, both for communicable disease on the reportable list and for ,others: The July death .rate is the lowest for several years, for a midsum- mer month: The comfort of patA ent s An ho spit al s would be promoted if the, city ;would place "quiet zone" markers on streets adjoining hospitals, as is done ;in most other cities. Rochester owes much of her prosperity to people who ,come here in search of healthi We have hundreds in sick beds, many acutely ill and unquestionably much unnecessary suffering is occasioned them by the noises of street traffic, night and days At present there is little if any ::di`scrimination in favor of hospitals by drivers of trucks, wagons, or other Of - commercial vehicles: There is nothing on the streets to point out to Out, ,town drivers that they are passing places where the sick are being eared fore Are not our sick visitors entitled to this consideration? ` Respectfully Submitted, W. The report of the Milk Inspector for the weeks ending July 29, 19221 ,,and August 59 1922, was read, and President Weeksordered that the same be !.placed on file: a _ Ii 701 The report of the City Weighmaster for the month of July, 1922,. showing fees collected in the amount of $lOa40:, was read, and President Weeks ordered that the same be referred to the Finance Committees . t The following communication was .read, and motion by Miner second by Cook carried that the Mayor and. City Clerk be authorized, and directed to execute, the travell- ing expense authorization blank mentioned therein: "MINNESOTA STATE BOARD OF HEALTH Division of Sanitation* Universit.V Campus MINNEAPOLIS August 11, 1922 Dr We Fi, Bleiruss, Deputy Health Officer, Rochester, Minnesota, i Dear Dr: Bleifhss: We have your letter of August loth requesting that Mr: Childs go to Rochester for the purpose of co;isulting with you and your city engineer relative to the' matter of sewage disposal@ We are enclosing a circular and traveling expense authorization blank, which are self explanatory: This investigation will be undertaken as soon as possible after this authorization blank has been returned to use We have a considerable amount of work on hand at this time - aid cannot promise an immediate investigation, however, this matter will be taken care of as .soon as possiblei -Yours very truly, He A: Whitt a�er, JAC/a y Director." Alderman Witzke introduced a resolution deeming'it expedient and necessary that sanitary sewers be constructed in parts of Eighth Avenue Southwest and Eighth. .Street Southeast and fixing a public hearing at 2 o'clock P:M@ September 5, 19229 which was read& Upon motion by Witzke second by Miner, and all voting in favor thereof, President Weeks declared said resolution duly passed and adopted: Alderman Cook introduced a resolution deeming it expedient and necessary that Second Avenue Northwest be graded to an established grade and to the fall width of the street from the North line of Fifth Street Northwest to the north rail of the mkin track of the Chicago aAd Northwestern RiRii Company's tracks, and fixing a public hearing At 2 o'clock PiM© September 5, 1922, which was ready Upon motion by Miner second by Frank, and all voting in favor thereof, Pres ident Weeks declared said resolution duly passed and=adopted: Alderman Frank introduced a resolution fixing 2 o'clock P.Me September 5, 1922, as the date for the levying of special assessments for the cost and expense of the construction of that part of the Southwest District Trunk Line sanitary sewer which is known as Project No@ 5, which was read. Upon motion by Witzke second by Miner, and all voting in favor thereof, President Weeks declared said resolution ' duly passed and adopted: Alderman Witzke introduced a resolution appropriating $22.23 from the Gener- 702 al Fund and ordering payment made to , he Safe -Cabinet Company 'for final pay- .;went on contract for furnishing the steel filing equipment for the vault in the office of the City Clerk, which was read Upon motion by Cook second by Miner, and all voting in favor there- of, President Weeks declared said resolution duly passed and adopted@ Estimate Nos 1, prepared by Charles H. Armstrong,I. City Engineer, in favor of Ormond and Feller for the paving and curbing of Ninth Avenue South- west, showing the sum of $1266e16 as being due the said -contractors,, was read, and motion by Lemmon second by Miner carried that the said estimate be accepted and placed on file; Alderman Miner introduced a resolution appropriating $1266116 from the Permanent Improvement Revolving Fund and ordering payment made,tp Ormond and Feller as payment of Estimate Noi 1 for the paving and curbing of Ninth 'Avenue . Southwest. from the south line of Eighth Street Southwest to the center line of Ninth Street Southwest, which was read. Upon motion,by Miner second by Witzke, and all voting in favor ;thereof, President Weeks declared said -resolution dVly passed and adopted: Estimate Nos 2, . prepared by Charles H. Armstrong, City Engineer, in favor of Hayes -Lucas anal Green on contract for the furnishing of 1000 barrels of Portland cement showing the sum of $614s46 as being due the said contractor, was read, and motion by Cook second by Frank carried that the said estimate be accepted and placed on files Alderman Miner introduced a resolution appropriating $614s46 from the Street and Alley Fund and ordering payment made to Hayes -Lucas and Green as payment of Estimate No. 2 on contract for furnishing. 1000 barrels of Portland cement, which was reads Upon motion ,by Frank second by Lemmon, and all voting in favor thereof, President Weeks declared said resolution duly passed and adopted. Motion by Witzke second by Cook carried that the sum of $100:62 be appropriated from the Sewer Fund of said City and paid to the .Permanent Im- provement Revolving Fund of said City for the City of Rochester's share • of the Pburth Avenue Southwest sanitary sewer (Job Nos 408 Assessment NQs 378). Alderman Lemmon introduced the following resolution which was read: Whereas, the Common Council . of the City of Rochester, Minnesota, on the 27th day,of July, 1922, passed.an ordinance providing for and regul- ati4g,the collection of garbage in. the City of Rochester, Minnesota, and the disposal thereof, and said ordinance was approved by the Mayor of said City on the,28th day of July, 1922, and was officially published as provided by law, and; Whereas, Section-5 of said ordinance above mentioned provides in Part that the Common Council of said City shall on or before ten days from the passage,'- approval and official publication. of said ordinance advertise for bids for the collection and disposal of the garbage to be 703 E collected in said City under tthe provisions of this ordinance; Therefore, Be it and 'it is hereby resolved -by said Common Council: That the City Clerk of said City .of 'Roehester be and he is hereby directed to advertise for bids as provided by law for the collection and disposal of the garbage of saicl City°of .Rochester'under and in accordance with the provisions of i the ordinance herein iaentioned:; _ { Bids for the said collection and disposal shall be received and Gpened by the Common Council at a public meeting thereof to be held at 2 o'clock P M* on Septemb- er 5th, 1922, at the Council. Chambers, in - the. City . Hall, in said City: Each bid must be accompanied by a certified check for at least ten percent (10%) of the amount of the bide The right is reserved to reject any and all bids Upon motion by Lemmon second by Cook, and all voting in favor thereof, Pres- ident Weeks ,declared` said resolution duly passed and adopted: Motion by Witzke second by Cook carried that the Police Committee 'be instruct- ed to notify the Chief of Police that certain sight-seeing buses and transportation companies' automobiles are being used in local taxi service contrary to the provisions' of the licenses covering the said automobiles: The following ruling made by . the City Attorney was read, and motion by Lemmon second by Witzke carried that the same be accepted and placed on'file: "Report of City Attorney on payment of fees for alcohol permits. Rochester, Minne sot a, August 14th, 1922: Members of the Common Council of the City of Rochester,. Gentlemen: You inquire as to whom the fees should go to for the permit to possess alcohol in the City of Rochesters Section 5 of Chapter 455,. Session Laws of Minnesota for 1919 provides in part that 'A fee of two ($2:00) Dollars shall be paid by each applicant to the offic- ial issuing any such permit before the same shall be issued19 and Section 1119 City Charter provides that •All fees paid to the City Clerk by private individuals for filing and recording papers and for other servioes,, as allowed, by law, shall. go to said City {,Clerki v It appears upon reading the above that it is the intent of the State law axed: the City Charter that the fee paid for the permit to possess ethyl alcohol should go to the official issuing such permit and in this case that official is the City Clerk. Watson Co. $95s55; Elmer Giem, $@50s i Motion by Witzke second by Frank carried that the Mayor and City Clerk be authorized and directed. to .extend theinvitation of the City of Rochester to the Walther League that they hold their 1923 State Convention in this City: Motion by Witzke secgnd by Cook carried that the City Attorney be instructed to notify the C.G:W:RiN Coi, and the C: N.W:Ry Company that they shall forthwith repair all. railroad crossings over public streets and avenues within said City& I? Motion by Frank second by Witzke .carried that the City Engineer be instructed to prepare plans, profiles specifications and estimate of cost for the construction of a City Warehouse on the City owned property lying ,south and east of the mill race and west of Broadway Sheet South: Motion by Miner second by Witzke carried that the City Engineer 'be instructed to suture the necessary labor and materials .and cause Second 'Street Southeast to be gravelled between Eleventh Avenue Southeast and the :Section Line next East:, Alderman Lennon introduced the ,following -resolution which was ';read: Be it resolved by the Ca®mon Council of ,the City of Rochester: That the Public Utility Board of the City of Rochester be and it is hereby authorized and directed to install .a 4" water main in Broad- way Street South from the hydrant south of the Central Fire Station across the proposed atch over the mill race a distance of 108 feetc f s j� upon motion by Witzke second by ,Miner, and all voting in favor (thereof, President Weeks. declared said resolution duly passed and adapted.
