705 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the. Council Chambers, in the City Ball, in said City, on August 21, 19221, at 8 o'cloex Pima Meeting called to .order . by President Weeks: Roll Call: Present: Weeks, Cook, Frank, Lemmon, Miner, Witzke: Absent: Erick- son3 I Motion by Witzke second by Prank carried that the minutes of the meetings held on August 7, 1922, and August 141, 1922, be each approved: 3 President Weeks announced that -this was the time and place fixed for a hear- ing on the levying of special assessments for the'following described sanitary sewers, and asked if there was any one present who wished to be heard in regard to either or any of them: A sanitary'sewer commencing at a point in the center of Second Avenue North-! west, six feet north of the center of Third Street Northwest and running Southwesterly to a point 20 feet west of the center line of Second Avenue Northwest and 20 feet south of the center of Third Street Southwest thence along a line 20 feet west of the center line of Second Avenue Northwest and Southwest to a point 20 feet south of the center line of Sixth Street Southwest,, etc*-,, also known as Project No; 4 ; ' f A sanitary sewer commencing in the center of Ninth Street Southwest and Sixth Avenue Southwest, and running North along the center line of Sixth Avenue Southwest to a point 100, feet south of the south line of Seventh Street Southwest, also ]fnown as Project Noa 6; A sanitary sewer commencing at the center of Ninth Street Southwest and Seventh Avenue Southwest and running north along the center line of Seventh Avenue Southwest to a point 100 feet south ofthe south line of,Seventh Street Southwest# also known as E Project Noa 7. There was no person present who wished to be heard in regard to the levying of special assessments for the cost and expense of the construction of either or any of the above'described sanitary sewers® , The following communications were read, and motion by Miner second by Witzke carried that the same be planed on file: Mr. A. F: Wright, City Clerk, _ City of Rochester: - Dear Sir: - " Rochester, Minnesota Augii2l', 1922i Herewith you will find a copy of a resolution passed by this Board at a special meeting held today: It is our desire that this matter be 'taken up by the.. City Common Council at as early a date as possible in order that we may file, our application for emergency i Coal with the State Fuel Administrator. For your information we would advise that .we have on hand sufficient coal for about thirty days, we have other coal on order from Illinois mines, but it is not 766 yet certain that the Federal Fuel, Administration will supply cars to the Illinois field for shipment to this district therefore it is necessary to order coal through ,the State Fuel Administnator, and we have his letter stating that if the coal. so ordered fails to arrive in time he will then be able to take care of us from his emergency supply which is now coming into the Docks at the head of the lakes& He will not call upon this reserve unless -conditions become acute. Crofoot Acting Sectyi V 11 Augi 21, 19220, WHEREAS on August 14th, this Public Utility Board of Rochester, recognizing the eaistance of an Emergency of National Scope petitioned the Mayor for authority to make Coal Purchases in such manner as might be poss- ible and Whereas the Mayor on August 15th, directed the Utility Board to "!make every reasonable provision for the protection of the interests of the City" and authorized us to "make purchases of coal in that manner which will best guaranted the service and the' good eaf all,''and Whereas the Governor of this State acting in conjunction with other State Governors and with the Federal authorities has taken action establishing a State and Federal Fuel Administration to regulate the dis- tributio,n of Coal so -long as the present shortage shall exist, and Whereas the method of operation of this Fuel Administration re- quires that orders for Coal placed with them shall be accompanied by the guarantee of some Bank or Trust Company for the immediate payment for all coal shipped upon the presentation of a statement of the cars shipped, giv- ing car numbers and weight and at the agreed upon "Hoover Fair Price" in the shippers district, such payment being obtained through the, medium of a sight draft on aforesaid Bank* Therefore be it Resolved that this Board ask, and it does hereby ask the authority of the Honorable Common Council to transfer the sum of seven thousand five hundred dollars (7,500) from the general funds of this Board to an Emergency Coal Fund to be used by the First National Bank in guaranteeing and paying such sight drafts as may be presented for coal supplied through the medium of the Fuel Administrations It being understood that the bank will serve as our agents in this matter and that upon receipt of the coal thus paid for the bills to be sub- mitted by the Bank will be paid to them in the customary and legal manner and that at the termination ..of the emergency the Bank shall return the bal- ance of this fund to the account from which it shall have been withdrawn, upon resolution of,,the, Utility Board directing such return+ The above is a correct copy of the resolution adopted by the J311- ity Board at a Special meeting held Aug: 21 1922a Horace M. We Schroeder, President: " Alderman Miner introduced the following resolution which was read: 9 Be it resolved by the Common Council of the City of Rochester: That the Public Utility Board of said City be and it is hereby authorized to transfer the sum of $7500.00 from the Public Utility Hind of said City to an Emergency Coal Fund as set forth in the resolution of said Board under date August 21, 1922; said Emergency Coal - Fund to 707 be used by The First National Bank of said City in guaranteeing and paying such sight drafts as may be presented to said'Bank for coal supplied to said Public Utility Board and at the termination of the present emergency the balance of said Emergency Coal Fund to be transferred to the Public Utility Fundi Upon motion by Witzke second by Cook, and all voting in favor thereof, Pres- ident -Weeks declared said resolution duly passed and adopted* The following communications were each separately read: "O FFI CE 0 F BUILDING AND ELECTRI CAL INSPECTOR of the City of Rochester, Minnesota August 16, 1922: Mayor C. D: Brown and City Council City of Rochester Minn: You ar* hereby notified and ordered to suspend all construction work, ! alterations repairs and .construction in or .on the building described as follows: i Hitching Shed situated on Lots (11) and (12) Block (102)t Willson Addition, City of M Rochester Mini, for the reason that said construction work does not comply with Sect-! ion (5) Five Relative to, Classification of Buildings of The Building code of the City j of Rochester, Minnesota@` Don E. Postier, Building ;and Electrical Inspector Remarks: This must be a building of the second class and application must be filed in this Office to construct this. Building." t The Honorable Mayor and Common Council, City of Rochester, Minnesotan "Rochester, Minn. August 21, 1922: Gentlemen: I would recommend that Section three (3) Article Two (2) of our Building Code be revised to read as follows: .'No work, except minor repairs costing les$ than25000, shall hereafter be done upon any wall, structure, or building except as hereinafter provided, without having obtained first a permit therefor.from the Inspector of Buildingsi However if said work is being done within the fire limits of the _City of Rochester, permission to do same must first be obtained from Inspector of Buildings:" i Respectfully submitted, Don E..Postier, Building and Electrical Inspector." A motion by Alderman Frank,that the City Engineer be instructed to tear down the recently constructed team sheds at the Public Hitching Grounds, received no second: A motion by Miner second by Lemmon that the City F:ngineer be instructed to finish the team sheds at the.Publie Hitching Grounds and leave them until June 1, 19239 lost by the following vote: Ayes: Lemmon, Miner: Nays: Cook, Frank, Witzke; President Weeks expressing a desire that record be made to the effect that his views in this ', I matter are in accordance with the majority vote on the motion: Motion by Miner second by Frank carried that the City Clerk be in- ,structed to request of the Building and Electrical Inspector that the team sheds which were recently constructed on the property owned by the City of Rochester, Minnesota, which lies east and south of the mill race and west of Broadway Street South, be allowed to remain as a temporary structure until June 1, 1923; this action being taken because of the fact that the farmers. are in need of such facilities, and there is no monet with which to make the improve- ment that will entirely comply with the Building Code of said City.. Motion by Witzke second by Frank carried that the City Attorney be instructed to draft an ordinance prohibiting the making of repairs to or the construction of any building within the fire limits of said City without first procuring a permit therefor from the Building and Electrical Inspector of said City. The 'application of G. Schwartz and Company for a sidewalk contract- or's license was read, and motion by Frank second by Cook carried that the said license be granted@ The sidewalk contractor's license bond ofG. The following report of costs was reads, and motion by Witzke second by Miner carried that the same be accepted and placed on file: "August 21, 1922.
