Minutes of a regular meeting of the Common Council of the City of Rochester,'

Alderman Lemmon came in at this time and took` his Chair.
1F. L. Mercer, as President of the Olmsted County Fair Association, asked for
$300.00 to apply on the cost of the fire works ust-d at the Fair Grounds on September
14, 1922
James` T. Spillane, City Attorney, ruled that the City of Rochester could not;

Dan Macken, speaking for Frank- Callaghan, asked that the' sidewalk line be

set out to save 'the trees along t'he south side of Fourth Street Northwest between
Fourth Avenue Northwest and Fifth Avenue Northwest:
President Meeks referred the matter to the Street and Alley Committee for
.report at the next meeting of this Common Council:
Grant L. Fellows, Assistant Manager of the Rochester Ice and Fuel Company,
asked that his company be granted permission to install a gasoline filling station and
tank in the boulevard along their property on First Avenue Northwest, but no action
was taken at this time as no formal written application was made.
C. F. Dillon submitted a check payable to T. B. Butler in the amount of $30.0(
to cover the expense which Mr. Butler was to in correcting the sanitary sewer connect-'
ions made for him. by Mr.' Dillon, and motion by Witzke second by Lemmon carried that the
application of C. F. Dillon for a license to connect with sewers and drains within I
said City be taken from the table and that license be'granted
The license bond of C. F. Dillon' covering license to connect with sewers and[
drains within said City with the Maryland` Casualty Company as surety thereon in the
amount of 81000000, was read, and motion by Cook second by Erickson carried that the
said surety be accepted and that the said bond be approved and placed on file. !
John D . Brown asked that a sidewalk be constructed along the Wint er' s proper;
ty on Ninth Street Northwest. I
President Weeks announced that this was the time and place fixed for a hear
ing on the proposed paving and curbing of a part of Eighth Avenue Southwest, and asked;

President Weeks referred the above bids to the City Engineer for
tabulation and comparison with his estimate on the cost of this improvement.

Alderman Witzke introduced a resolution levying special, assessments for

the cost and, expense of construction of a sanitary sewer in Eleventh Street Northwest
commencing in the center of the intersection of Second Avenue Northwest and Eleventh
,Street Northwest and running east along the center ,line of Eleventh Street Northwest
to a point 120 feet west of the west line of Broadway Street North, which was read.
Upon motion by Miner second by Frank, and all voting in favor. thereof,
President Weeks declared said resolution duly passed. and adopted.
The report of the City Engineer for the month of September, 1922, was reed,
and President Weeks referred the same to the Street and Alley Committee.
The .report of the. Milk Inspector for the weeks ending September 161, 23 and
309 19229 was read, and President Weeks ordered.that the same be placed on file.

259 1.922, showing fines collected in. the amount of $21:70, civil fees collected in
the .mount of '52100 and �gOiI5 as having been collected from. the County of Olmsted

Motion by Witzke second by Cook carried that each of: the above bids for the
construction of a surface drainage sewer in parts of Sixth Street Northwest and Third
Avenue Northwest be each rejected, and that the certified checks be returned to each
o.f the bidders, and. that the City Engineer be instructed to secure the necessary labor
�. and materials and cause a surface drainage sewer to be constructed in Sixth Street
i' Northwest from Cascade Creek to fiffeen feet dast ofrthe east line 'of Sdcond
Avenue Northwest, and in Third Avenue Northwest from thirteen feet north of
the center line of Sixth Street Northwest to twenty feet north of the center
lirre of Fifth Street Northwest.
A proposed budget for. the 1922 general tax levy prepared and sub-
mitted by the City Clerk, a proposed budget for the City. Fn,gineer's Depart-
ment� prepared. and submitted by him, and the proposed budget for the 1922
levy .for Independent School District Noi 8,,prepared and submitted by the
` Board of Education of the said School_ District, were each sepa,ra.tely read.,
and were discussed by the Common Council@

ed budgets be placed on file and that the City Clerk, be instructed to give a
copy of each of them to the lbeal newspapers for publication as news, with
information to the Public that this Common Council invites the consideration.
Of the 'Local tax payers on the various items, and that any person who may
desire to be heard in any matter concerning the said proposed budgets will be
`!given an opportunity to express himself at a meeting,of-this Common Council
which is to be held on October '20, 1922, at 7:30 o'clock P.M4

George W, Huney, L. peplinski, Charles Dzialowski. and others asked
that they be. refunded the cost of the installation of the water mains in
Sunny Side Addition, by credit to their account of the charges for the water
service as fast, as it is used and to an amount equal, to each lot 's prorata
share of the cost of the installation; the owners of the vacant lots to re-
ceive a certificate that they 'have that amount of- crater service to their
credits
Upon questioning Mr. Huney he stated. that he; made the. installation
of thepe water mains, and charged them to the various lots benefited, Rlith
no understanding anding from any Dbpgrtment of the City of po the st er, Minnesota,
that he or any of his purchasers would, ever be refunded the cost or any part
of it:
Motion by Miner second by Witzke carried that this matter be re-
ferred to the "dater Committee and the Public Utility Board for their consid-
eration and report to this Common Councils
J. J. McCain asked that cinders be placed on Tenth Street B, and
motion by Titzke second by Cook carried that the matter be referred to the
Street and Alley Committee a
The City Clerk submitted a report of the cost of construction of

file; the total cost of said improvement being shown as $533:31.
Petitions that a sanitary sewer be constructed and that water mains be laid
in IIrst Street Southeast between Thirteenth Avenue Southeast and Fifteenth Avenue
Southeast, were each separately read, and President Weeks referred the same to the
Sewer- and Water Committees:
A. petition asking that Ninth Place Southeast be graded to an established grade
and that sidewalks be constructed along each side of the said Ninth Place Southeast,
was read, and President Weeks referred the same to the Street and Alley Committees
The approval by the Industrial Commission of the State of Minnesot f. under
date of September 25, 1922, of the settlement, made by the City of Rochester, Minnesota,
with John Brumm for injuries received,.was read, and motion by Miner second by Frank

carried that the same be .accepted and placed on file,, part of the said approval being
quoted as follows:
"In juries consisted of (state exactly funtions or parts of body destroyed or impaired)
Prater on the knee resulting from cave in on sewer ditch
Rating of permanent partial disability Twenty-five (25 0) percent disability in the

The employe hereby acknowledges that he has received compensation during the healing

period of twenty-five (25) weeks as follows:
$18.00 per week for 25 weeks, total $450:00 and ten weeks additional at the rate of

$18 per week making $630 in all.
It is hereby agreed that the employe is entitled to and „shall receive compensation
under the schedule in Section 14, sub -section C. of said Act, for said injury from the
employer, beginning June.27th, 1922 at the rate of 118 per week for 33 and 314 weeks,
payable as follows: every two weeks." `
The sign maintenance bond of the Kahler Corporation covering the maintenance
of a sign on the Rochester Hotelwith J.I. Kahler and H. J.. Harwick as sureties thereon,
each in the amount of $15000-009 was read, and motion by Witzke second by Erickson car -
rigid that each of the said sureties be accepted and that the said bond be approved and

The application of Adolph Siemers for a license to peddle cabbages and pota-
toes within said City during the month of October, 1922, was read, and motion by Frank
second by Witzke carried that the said license be granted at a fee of $P5.00.
The application of A. YI. Zierath for a license to peddle watermelons within i
said 'City for a period of two days, September 23, 1922; and September 25, 1922, was
read, and motion by Frank second by Erickson carried.that the said license be granted
at a fee of $10,,000
The application of the Rochester Bus Line for a sight-seeing auto license
.was read, and motion by Frank `second by Cook carried that the said license be granted

The application of Otto Pi Maller for lir,ense covering an automo-
bile for use in the transportation 'of passengers between the City of Rochest-
er, Minnesota, and surrounding cities, towns and villages was read, and mo-
tion by Frank second by Cook carried that the said license be granted,provid-
ed that the said a,iitomobile shall not be used in °local taxi or jitney service
The applications of J. Paul Clarkson for licenses covering four
automobiles to be Wised i_nI they transportation of passengers between the City
of 'Rochester., Minnesota,, and surrounding cities, ,t.owns and villages, were ' each
separately read., and motion by Frank second by Erickson carried that each of
the said licenses be granted, provided that neither of the said automobiles
shall be used in local taxi or jitney service.
The application of Arthur Tott'ingham for a license covering an
automobile to be used in the transportation of passengers between the City
of Rochester, Minnesota,,and surrounding cities, towns and villages, was read,
and motion by Erickson second by Miner carried that the said license be
granted, provided that the said automobile shall` not be used in local taxi
ii or jitney services
The application of C. J. Plein for a license covering an automobile
to be used in the transportation of passengers between the City of Rochester,
Minnesota, and surrounding cities, towns and villages,' was read,, and motion'
by Frank second. by Lemmon carried that the said license be grabted, provided
that the said automobile shall not be used in local taxi or jitney service.
Motion by Ciitzke second by Erickson carried that the City Engineer
be instructed to secure the necessary labor and materials and cause Seventh

The report � of the Finance Committee to the effect that the City Weighmaster'i!s
reports for the month of. Aliril, May, June, July and August, 1922, had each been examin-
ed and found to be correct, and the report of the Finance Committee to the effect that
they'had examined the Building and Electrical Inspector's reports for the month of
April, May; June, July and August, 1922, and found the same to be correct with the

i ;exception that the fees shown for building permit No; 326 should be 14.00 in-
stead of .2.00, were each separately read, and motion by Nitzke second by Cook
carried that ee,ch of the sedd reports of the Finance Committee be accepted 'and

Building and Electrical Inspector be accepted 'and placed on file after further

Motion by Vlitzke second by Lemmon carried that the City Engineer be
'instructed to write to the City Engineer, or apme other =responsible person at
Cozad, Nebraska, asking that report be made as to the condition of the Stroud
dump wagons which Glass and Rowe offer at $150,00 each,= F.04'3 , the said City.
The following recommendation of the Street and Alley Committee. was
read, and motion by Lemmon second by Cook carried that the same be accepted and
placed on file, and that permission be granted with the provision that the
installation be made under the supervision of the City engineer:

and specifications for the paving and curbing of Eighth Avenue Southwest, as above
described, ordering the said estimate of cost placed on file, ordering advertisement

Alderman Witzke introduced a resolution adopting the above - mentioned plans,
profiles and'specifications for the construction of a surface drainage, sewer commenc-
ing at a point thirteen feet north of the Northeast corner of Lot 1, Block 1 in
Tlathers' Addition, and running westerly to a point 10 feet west of the Southwest
corner of Lot 121 in ?rutizky's Addition, o1rdering the Said estimate of cost. to be placed
on file. -and ordering advertisement for bids for furnishing all the, labor and materials

to be opened at 7:30 O'clock P.M: on October 20, 1922, which was read.
Upon motion by Coop second by Miner, and -all voting in favor thereof,
President Weeks declared said resolution duly passed and adopted
Motion by Witzlce second by Cook carried that the City Attorney be
instructed to notify the Chicago and Northwestern Railway Company and the
Chicago Great Western Railroad Company that they shall each guard their rail-
noad crossings in accordance with the lawsand ordinances made and provided:

instructed to notify the Chicago and Northwestern Railway Company and the.
Chicago Great Western Railroad Company that -he is' about to open Sixth Avenue
Northwest for traffic. a
Motion by Lemmon second by Erickson carried that the City Engineer
be instructed to secure the necessary labor and materials and cause Twelfth
Avenue Southwest to be gravelled between Center Street West and Second Street
Southwest
