{ Minutes of an addourned regular meeting of ,the Common Council of
lithe City of Rochester, T,Iinnesota, held in the Council ,Chambers, in the
City Nall, in said City, on October 9th, 1922, at 7:30 0' clock P.M.
Meeting called to order by President Weeks.:
Roll Call: Present« Weeks, Cook, Erickson, Fra4k, Lemmon, Witzke
Absent: Miner.,
J. F. Stellmaker asked that arrangements be made to compel the
'Properties auhich are now connected to his sanitary sewer service at the
corner of Second Street Northwest and Fifth Avenue Northwest to removo
their connections to a service of .their own' • `
Charles Ti. Armstrong. City Engineer, submitted a plan ,which
would remedy the condition,. and also submitted the folloWi4g communication
which was read; motion by Witzke second by Funk being carried that the
said plan and communication be each accepted and placed on file:

I beg to call your attention to the matter of the sanitary
sewer service connecting Lot 1 in Block 1 in Cummings Addition and the
West 41 feet of Lot 1 in Block 55, Original Plati The conditions are.
critical ar..d. must be remedied+ The original service was made from the
manhole in Fifth Avenue Northwest to the house located on the west a3 feet
,of Lot 1, Cummings Addition.
Later this service was tapped between the house and street
and carried south and east to the east 47 feet of Lot 1, Block 1, Cumm-
ings Addition, and _ a•lso carried east across the alley to the west 41 feet
of Lot 1 in Block 55, Original Plat.
The conditions are such that the sewage from the east runs
into the cellar of the house on the west 93 feet of Lot 1, Block 1, Cv_mm-
ings Addition, and I have prepared a plan to remedy the situation and am
submitting the some for your consideration and estimate the cost as fol-

Motion by Witzke second by 211rank carried. that the above mention-
ed plan for the change in the sewer service of the Stellmaker, Roth and
Jennings properties, as prepared by Charles H. Armstrong, City Engineer,
be approved by this Common Council, and that the said City Engineer be
instructed to notify the property owners concerned that they shall. within
jthree days at their own expense make and construct the changes according-
Ily or the same will be made and done and charged to the properties bene-
fited under and in accordance with local ordinances made and provided for
such cases`

they being rePinded for the cost of installation of water mains in Sunny Side Addition,
and were advised that the Committee was not yet ready to make a. report, and too that
the matter should be presented to the Public Utility Board instedd of the Common Coun- .
cil as such questions are wholly for the consideration of that Deprlrtment.
Otto W. Riess offered lands lying west of the City dumping grounds and east
o'f the Zumbro River for sale to the 'City of Rochester, and President Weeks referred
the matter to the Public Grounds Committee.
The Application of Charles Grassle �br a hotel bus license was read, and
motion by Frank second by Erickson carried that the same he granted,, provided that the
said automobile shall not be used in local taxi or jitney service.
The applications of `W L. Eaton for two taxi, licenses were each separately
read, and motion by Frank second by Erickson ebrried that the same be granted.
The application of I. D. Mbrris for a driver's license was read, and motion
by Frank second by Cook carried that the same be granted.
The application of Dan Bahmer for a�license.to solicit business for his
boarding- and rooming house at 422 Third Avenue Southwest, was read, and motion by k
Frank second by Witzke carried that the said license be granted.
The -report of'the Clerk of the Municipal Court for the week ending October
?, i_922, showing; fines collected intthe amount of $1500 and civil fees collected. in
the amount of 11)8.50, was •read, and President reeks referred the same to the City
i
Attorney.
The report of the Health Officer for the City Farm for 'the month of September
1922, showing receipts in the amount of $1686422 and disbursements in the amount of
$2114,94,. and a balance on hand in the amount of I$1,i68, was read, and President Weeks
ordered that the same be placed on filei
Motion by Lemmon second by Frank'carried that the sum of $100 00 be appro-
priated from the Seder Fund and ordered paid to Frances May Gooding in payment of
easement for right of way for the Sixth Street Northwest surface drainage sewer.
An easement given by Frances May Gooding to the City of Rochester, Minnesota,,
covering right of may for, the Sixth Street`Northwest surface drainage sewer, was read,
and motion by Erickson second by Witzke carried that the same be accepted and placed
on record. s
The favorable report of the Street and Alley Committee in the matter of
placing cinders on 10-2 Place Southeast from Third Avenue Southeast to 300 feet west,
was read, and President Weeks ordered that the same be accepted and placed on file.
The favorable report of the Street and Alley Committee in the matter of the
grading of Ninth Platte Southeast was read, and President Weeks ordered that the same
be accepted and placed on filer
The recommendation Of the Street and Alley Committee that the Chicago Great
Western Railroad Company be notified to repair and replank their street brossings at
once or suffer the consequences of the enforcement of the provisions of their local
franchise, was read, and President Weeks ordered that the same be accepted and placed

The recommendation of the Street and Alley Committee that the side -
Walk line be moved out eight feet north along the south side of Fourth Street
;'Northwest from Third Avenue Northwest to Fifth Avenue Northwest to save the
trees which are . in the present sidewalk line, was read, and President Weeks
ordered that the same be placed on files
The. recommendation of the Water Committee that water mains be laid
in First Street Southeast between .Thirteenth Avenue Southeast and Fifteenth
,:Avenue Southeast, providing that the Public Utility Board is financially able
to do it,, was read, and President Weeks ordered that the same be accepted and
Placed on file.
The report of the Street and Alley. Committee to the effect that

Motion by. Witzke second by Erickson carried that the City Clerk be
instructed to bill all Departments of the City of Rochester, Minnesota, for
the 1922 sprinkling and flushing along their properties4
President Weeks referred the matter, of the designation of polling,
places within the City of Rochester, Minnesota, to the Public Grounds Commit-
tee.
The September, 1922, general balance sheet of the City of Rochester,
Minnesota, prepared and submitted by the City Clerk, was considered by the
Common Council, and motion by Witzke second by Cook carried that the same be

The September, .1922, trial balance, etc., of the Public Utility Departments,
prepared and submitted by' the Secretary of the Public Utility Board, were each consid-
ered -by the Common Council, and President. Meeks ordered that the same be accepted and

ing privy vaults and removing,filthy material and rubbish during the period, May 10,

Alderman Erickson introduced a resolution fixing 7:30 o4clock P.M4 on the
25th day of October., 1922, as the+ date for a hearing on, and the levying of special
assessments for the paving and `curbing of Ninth Avenue Southwest between the south
line of Eighth Street

which was read.
Upon mD%ion by Erickson second by Lemmon, and all voting in favor thereof,
President Meeks declared said resolution duly passed and adopted:
Motion -by Witzke second by Erickson carried that the City Engineer be
instructed to have four copies of his compilation of local house numbers bound in book!
form, one of the books to be.bound with every other leaf a blank leaf.
Motion by Cook second by Erickson carried that the City Clerk be authorized
to have ordinance book "A" rebound.
Alderman Cook introduced a resolution deeming it expedient and necessary that
Ninth Place Southeast from the west line of Third Avenue Southeast .to the west end of
the said Ninth Place Southeast be graded, and fixing 7:30 o'clock P*M* on the 25th d
of October, 1922, as the date for a public hearing thereon, which was read*
Upon motion by Miner second by Erickson, and all voting in favor thereof,
President Teeks declared said resolution duly passed and adopted.
The following claims were read, and motion by Miner second by Frank carried
that each be allowed and paid, and that the Mayor and City Clerk be authorized and
directed to draw warrants upon the City Treasurer and make payment accordingly:

Charles H. Armstrong, City Engineer, reported that Alderman Erick-
son and hie had investigated and found that the L: A: Hpffman property runn-
ing west of Twelfth Avenue Northwest between First Street_ Northwest and
Second Street Northwest, if extended, the said property being.in Cascade
Township and not within the limits of the City. of Rochester., Minnesota, is
connected to local sewer and water servicei
President Weeks referred the matter to the City Attorney and the
City Engineer with instructions to notify Mr.. Roffman that he shallri before
October 16, 19229 pay all we -ter Service charges and the proposed assessments
against his property for the Twelfth Avenue Northwest sanitary sewer, or
suffer immediate disconnection from the said local service,
Alderman Witzke reported that Mr. Twi ss had .made complaint against
the chicken yard maintained on the Zimmerman property at 217 Fourth Avenue
Northwest, and motion by Witzke second by Miner carried that the City Clerk
be instructed to request of the ,Health Officer that he cause the chicken
yard on the property st-217 Fourth Avenue Northwest.to be cleaned up and the
dead chickens be removed therefrom:
