Meeting called:to order by President Weekse
Roll Call: Present: Weeks, Cook, Erickson, Frank, Lemmon. Absent: miner,

Motion by Erickson second by frank carried that the minutes of the meetings
held on October 2, 1922, and October 9, 1922, be each approved.
President Weeks announced that this was the time and place fixed for a hear-
ing on the levying of special assessments for the cost and expense of grading Second
Avenue Northwest between Fifth Street Nbrthtiest and .the main track of the Chicago and
Northwestern Railway Company, and asked if there was any one present who wished to be

A remonstrance : from Brown, Somsen and Sawyer and George V.I. Granger, attorneys
for the Chicago and Northwestern Railway Company, opposing the assessment against their.
property for the cost and expense of this grading, was read.
A Mr. Garis, from the Engineering Department of the said Railway Company, made

the statement that this grading would cost his Company approximately $3175.00 ($225:00
for lowering team tracks, $1200.00 for lowering five.yard tracks, $20000 for drainage;
$1500.00 for crossings and $350 00 for gradingg) and was informed by the City Engineer,
that until this Avenue is paved there is no immediate necessity for making any of the
changes enumerated except to lower the team track.
Alderman Witzke came in at this time and took his Chair.
Motion -by Lemmon second .by Cook carried that the matter be referred to the

City Attorney for report, at the next meeting of this Common Councilor

Lion of the suggestions of the tax --payers of this City on any item.- in the proposed
1922 tax budget, and that this Common Council would be glad to hear any and all inter-
ested persons; hp explaining that this budget was submitted for public consideration
with the intention of securing an expression as to what expenditures should be elimin-
ated for the coming year:
W. W. Churehtll, for the Secretary of the Civic and Commerce Association,

presented a report from a meeting of the said Association held on October 19, 1922, for
consideration of 1922 tax matters, which was read; the said report setting .forth their;
recommendations as follows:

Cut out proposed $10,000.00 levy for creating fund for construction of the
new steel reinforced concrete bridge over the Zumbro River on Broadway Street North.
Raise the Library Fund levy from $650000 to $7300 00•

Investigate fire insurance rates.
Co-ordinate work of all social workers and nurses.
Devise and put , in operation means for effectively cleaning streets.

The Rochester Tefephone Company in 8, communication which was read
asked for permission to replace one pole on the north side of Eighth Street
Southwest, east of Tenth Avenue Southwest;to set one pole and one anchor on
the east side of Eighth Avenue Southwest south of alley 'south of Fifth
Street Southwest and one anchor north of second light pole north of Filth
Street Southwest, three poles and one anchor in the alley between Fifth
Street Southwest and Sixth 'Street ,Southwest from Eighth Avenue to Ninth
Avenue; one anchor east of the first present pole in the alley east of
Eighth Avenue Southwest between Fifth and Sixth Streets.
President Weeks referred the matter to the Street and Alley and
Lighting Committees.
President Weeks announced that this was the time and place fixed
for a hearing on the paving and curbing of a part of Eighth Avenue South-
west, and asked if there was any one present who wished to be heard.

This being the time and place fixed for the opening of bids for
the paving and curbing of Eighth Avenue Southwest from the south +line of
Eighth Street Southwest to the center line of Ninth Street Southwest,. the
following bids were opened and read, and President Weeks referred the same
to the City Engineer for recommendations;

of streets and avenues within said, City during the season of the year 1922, and asked
if there was any one present who wished to be,heard.

President Weeks referred the said bids to the City Engineer for
recommendations.
The applications of Will Adamson and S. E. Tompkins for licenses
as milk producers of raw milk, were each separately read, and motion by
Frank . second by, Cook 'carried that each of .the said licenses be granted4
The application of Mrs..E. Schafer for license to sell silk
knitted ties within said City for a period of three days, October 18, 20
and 210 1922, was read, and motion by Frank second. by Cook carried that the
said license be granted' at a fee of $5:00. per day.
The recommendation of the City Engineer that the contract for the
paving and curbing of Eighth Avenue Southwest, as above described, be a.war&
ed to the Utton. Construction Company, they being the lowest bidders, was
read, and motion by.Lemmon second by Erickson carried that t•he said recom-
mendation be accepted. and. placed on filei
The report of the City Treasurer for,the month of July, 1922,
showing the sum of 0254,325.57 as being on hand; the report, for the month
of AuTast, 1922, showing the sum of $216,826.04, and the report for the
month of September, 1922, showing the sum -of $197,877.18 as being on hand,
were each separately read, and President Meeks ordered that the same be
placed on .file.
The report of the Milk Inspector for the weeks ending October 7
and 14, 1922, was read, and President Meeks ordered that the same be -placed
on file.
The report of the City Weighmaster for the month of September,
1922, showing fees collected in the amount of .$24.20, was .read, and Presid-
ent Weeks orderedthat the same be referred to the Finance Committee.
The recommendation of the City Engineer that the contract for the
construction of the two steel reinforced concrete bridges, as above describ-
ed, be awarded to the Utton Construction Company, they being the lowest
bidders, was read, and motion by Erickson second by Cook carried that the
same be accepted" and placed on file

Alderman Cook introduced a resolution accepting the bid of the Utton Con-
struction. Company for the::. construction of a steel reinforced concrete bridge over Mayo

Run on Tenth Avenue Southeast and fixing the amount of the bond to be. given by said
contractor at the amount of $1200,;009 which was read..

President Weeks declared said resolution -duly passed and adopted.*

Alderman Erickson introduced a resolution accepting the bid of the Utton
Construction Company for the construction of a steel reinforced concrete bridge over
Mayo Run on Eleventh Avenue Southeast and fixing the amount of the bond to be given
by said contractor at •the ,amount of $1200 00, which was read.
Upon motion by Cook second by Frank, and all voting -in favor thereof, Pres-
ident Meeks declared said resolution duly passed and adoptedi
The report of the Building and Electrical Inspector for the month -of Septemb-
er, 1922, showing building.. inspection fees collected in the amount of $59100 and i

The report of the Clerk of the Municipal Court for the week ending October 9,
1922 showing fines collected in the amount of 4118745 and civil fees -collected in the

amount of $2.00, and the report of the Clerk of the. ftnicipaj Court for the' week ending
October 16, 1922, showing -'fines .collected in the amount of $80.00 and civil fees coll-
ected in the amount of f5i00, were each separately read, and President Peeks referred
the same to the City Attorney.
The application of the Rochester Ice and Fuel Company for permission to in-
stall a gasoline tank and 'pump in the boulevard along their property on First Avenue
Northwest between the C: and NOW* Ryi tracks and Fifth, Street Northwest, was read, and
motion by Frank second by Erickson 'carried that the said permission be granted with the
provision that the installation be made under the supervision of the City Engineer:
Summons and complaint in Robert D. Mussey and Archibald H. Logan vs. the City
of Rochester, Minnesota, to quiet their title to property formerly known as, Fifth
Street Southwest between Ninth Avenue Southwest 'and Tenth Avenue Southwest, were read,
and motion by witzke second by Frank carried that the same be referred to the City
Attorney.
Alderman Erickson introduced.a resolution determining to adhere to former
resolutions in the matter of the paving and curbing of part of Eighth Avenue Southwest,
as above described, which was read.
Upon motion by Erickson second by Lemmon, and all voting in favor thereof,
President weeks declared said resolution duly passed and adopted.
Alderman witzke introduced a resolution accepting the bid of the Utton Con-
struction Company for theT paving and curbing of Eighth Avenue Southwest between the
south line of Eighth Street. Southwest and the center` line of Ninth Street Southwest,
and fixing the` amount of the. bond to be given by said contractor at the amount of
$6000. 00, which was read.
Upon motion by Erickson second by Frank, and all voting in favor thereof,

The City Engineer orally. recommended) that in view of the,. fact that
the bid of Wm. C. Fraser and Son for the construction of a surface drainage
sewer in part of Eighth Street Southeast is 01381&50 under his estimate of the
cost of the said improvement that this said bid should be accepted, and further
orally recommended that the bid of Wm. C. Fraser and Son fbr the construction
of a surface `drainage sewer in part of Second Street Southwest be rejected, the
total of the Fraser bid being $654 75 and his estimate for this improvement
cost being $711(970.
Motion,by Erickson second,by Frank carried that the said recommenda-
,tion be accepted.

Wm. Ce Fraser and - Son for the- construction of a surface drainage sewer in part
of. -Second Street Southwest be rejected and that the City Engineer be instructed
to secure the necessary labor anal materials and cause a surface,. drainage sewer
to be constructed commencing at a point thirteen feet,_north of the Northeast
corner of Lot One, Block One, in, Fl ather' s Addition to the City of Rochester,
Minnesota, and running westerly to a point ten feet west of the. Southwest cor-
ner of Lot Twelve in A.' W.' Kutzky's. First Addition to the City of Rochester,
Minnesot a.

Alderman Witzke introduced a resolution accepting the bid of Wm. C.
Fraser for the construction of a surface drainage sewer commencing at a point
eighteen feet east of the west lt�e of Eighth Avenue Southeast and eighteen
feet south of the north line of .Eighth Street Southeast and running easterly
rive hVn.dred fifty feet to the left bank of Bear Creek, and fixing the amount
of the bond to be given by the said contractors at the sum of $1000.00, which
.was read.&

A petition asking that Second Avenue Southeast between Fourth Street
And -Fifth ,Street, Fifth Street Southeast, between First Place and Third Avenue
and First Place Southeast between Fourth Street and. Fifth Street be gravelled,
was read, and motion by Erickson second by, Lemmon carried that the City Engine -
or be instructed to secure the necessary labor and materials. and cause .gravel

of'Hayes-Lucas and Green for the furnishing of Portland cement, showing the sum of
$35.1 12 as being due the said contractor, was read,, and motion by Lemmon second by
Cook carried that the said estimate be accepted and placed on file
Alderman Cook introduced a resolution appropriating $351.12 from the Street
and Alley Fund and ordering payment ' made -to Hayes -Lucas and Green for estimate No. 4
on contract for the furnishing of Portland cement, which was .read.
Upon motion by Lelumon second by Cook, and all voting in favor thereof,

Alderman Frank introduceda resolution appropriating 090077 from the Park
Improvement Fund and ordering payment made to the Mayo Trust find for pay -rolls for
labor from August 19,.1922, to October 7, 1922, which was read.
Upon motion by Cook second by Erickson, and all voting in favor thereof,
President Weeks declared said resolution duly passed and adopted.
Alderman Lemmon introduced a resolution authorizing; and directing the Public;
Utility Board of said City to cause a four inch water main to be laid in Eighth Avenue,
Southwest between Eighth Street Southwest and Ninth Street Southwest, ohich was read.
Upon motion by Erickson second by-Lemmon, and all voting in favor thereof,
President Weeks declared said resolution duly passed and adopted:

Motion by W.itzke second by Lemmon carried that the City Attorney be instruct`
ed to notify the Judge of the District Court that the terms of office of the present
Charter Commissioners have expired:
Motion by Witzke second by Erickson carried that the City Attorney be in-
structed to draft a resolution to be submitted to our State Senator and Representative
calling. on them to use their influence toward legislation that will change the present
requirements that proposed Charter amendments shall be published for _thirty days in

three different papers ,of general local circulation to that of the publication for -ter -
days days in the official City paper only.
Motion by Witzke second by Erickson carried that the City Attorney be in- i
strutted to act with a Citizens' Committee and the State Fire Marshal in appearing
before the State Insurance Commissioner in regard to the lowering of the local fire
insurance rates and classification.

Alderman Erickson introduced a resolution accepting the changing of the
course of Cascade Creek across Seventh Street Northwest, and the paving of the alley
running North and South across Block 34 in Original - P1 at , as being done and completed
by Ormond and Feller in accordance with their contract, which was read.

Street and Alley Fiend for use of the Street and Alley Committee, which was read.

Motion by Witzke second by Erickson carried -that the Custodian of the City
Hall be instructed to place a lock and chain :-=om the radiator valve in the City Hall
garage so.that the same be not used except at his discretion*
Motion by Lemmon second by Erickson carried that the City Clerk be instruct-!

ed to request of the Mayor an expression as to whether he can reduce the Motorcycle
Patrolmen from three to:two and also that he confer with the Park Board as to whether
the services of the Patrolman in Mayo Park can be dispensed with or. not.

claim

claims were required in the lowering of his water service pipes, was read, and Pres-
ident Weeks ordered that the same be referred to the Finance Committee and the City
Engineer for report -at the next meeting of this Common Council.
Motion by Lemmon second by Erickson carried that the hearing in the matter,
