78 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held In the CO"cil Chambers, in the City Hall, in said City, on October 25, 1922, at 7:30 o'clock P.M. Meeting called to order by President Weeks. Roll Oall:, Present: Weeks, Cook, Erickson, Frank, Lemmon, Miner. Absent:- Witzke. Motion by Erickson second by Cook carried that the minutes of the meeting held on `October 20, 1922, be approved. Alderman Witzke came. in at this time and took his Chair: A. H..Clerjens, as Attorney for Mrs. Margarite Jorgensen, opposed the assessment Made'against the property of Mrs. Jorgensen for the Fourth Street Southeast sanitary sewer, and after a discussion of the reasons for the said assessment, President Weeks referred the matter to the Sewer Com- mittee and the City Attorney. Mayor C. D. Brown stated before the Common Council that he stood ready to follow their recommendations as to the number of Policemen that t shall be i retained in servicei _ i President Weekq stated that this was the time. and place fixed for a hearing on the grading of,Ninth Place Southeast, and asked if there was any one present who wished to be heard. There was no one present who wished to be.heard in regard to the grading of Ninth Place Southeast. ; President Weeks announced that this was the time'and place fixed for a hearing on the levying of special assessments for the paving and curb- ing of Ninth Avenue Southwest from the south line of Eighth Street Southwest to the center line of Ninth Street Southwest, and asked if there was any person present who wished to be heard in any matter concerning the said paving and curbing. There was no person present who wished to be heard in any matter concerning the said paving or curbingii The report of the Clerk of the Municipal Court for the week ending October 23, 1922, showing fines collected in the amount of $40100 and Sept- ember, 1922-, fees collected from Olmsted County in the amount of $8.10, was read, and President Weeks referred the same to the City Attorney. The appointment of Charles Burns as Special Policeman at the local National Guard Armory, without pay, was read, and motion by Witzke second by Cook carried that the same be placed on filei The application of T. A. Perkins for a hotel bus license was read, and motion by Frank second by Erickson carried that the same be granted pro- vided that the said automobile shall not be used in local taxi or jitney servi cep The application of Edith French for a taxi license, and the appli- cation of Edith French for a transfer of taxi license No. 19 which covered a Dodge Sedan to a seven -passenger Buick .automobile having Minnesota State 779 License Noi B 92741, were each separately read, and President Weeks referred the same to the License Committee: The application of Blakely and Kennedy for a permit to place and maintain a sign on the building known as.229 Broadway,Street South, was read, and motion by Frank second by Erickson carried that the said permit be granted and that the amount of the -bond to be given be fired at the sum of $2000.00 with the provision that the installa- tion of the said sign be made under the supervision and. subject to the approval -of the Building and Electrical Inspector�of said City. The application of Maass and McAndrew Company, Inc: for a license to connect with sewers and drains, was read, and motion by Frank second by Cook carried that the said license be granted: The bond of Maass and McAndrew Company, -Inc: covering license to connect witl sewers and drains within said City with Ernest Maass and Fred E. Maass as sureties thereon, each in the amount of $$1000 00, was read, and Motion by Witzke second by Miner carried that the said sureties be accepted and that the said bond be approved and .placed on file. The report of the Minnesota State Board of Health covering their recent investigations of the sewer system .of this City, .was read, and motion by Miner second by Erickson carried that the same be placed on file; their recommendations in the matter being quoted as follows: "1. Intercepting sewers should be installed.by means of which all of the sewage from the city and from the State Hospital for the Insane can be conducted to a single sewage treatment plant: 2. The city should acquire a tract of land North of.the city, East of the Zumbro River and West of. Broadway Street, on which to • construct a sewage treatment plantij A tract of 10 to 20 acres should be acquired for this purpose sqd should -be so located that no part of the plant will be less than 1/4 of a mile from the nearest dwe lling+i The initial sewage treatment plant should consist of settling tanks of the Imhoff type, through which the sewage may be passed for the purpose of removing the settlable solids. The clarified effluent may be discharged into the Zumbro River: A preliminary design and estimate of cost should be prepared at an early date in order that the proportionate cost the State should bear -may be determined and the necessary appropriation for this purpose socured at the legislative session begin- ning January, 1923" Final estimate, preparedtby• Charles H. Armstrong, City Engineer, lh favor of Ormond and Feller for the paving and curbing of Ninth Avenue Southwest, as above des- cribed, shoifving the sum of $6454.80 which will become due the said contractors, filed for_ the purpose of arriving at the costs of the said improvements, was read, and motion by Miner second by Etiekson carried that the same be placed on file: Motion by Witzke second by Miner carried that the City Attorney be instructed to include in his resolution,to be drafted for the purpose of submitting.to our State Senator and Represent ativeps an outline of needed legislation,a request that they use their influence toward changing the requirements as'regards the collection of special assessments by either making provisions for the collection of interest on delinquent amounts remaining unpaid after June first .each year, or requiring that they be paid in full on or before June first each year in order that they be exempt from a penalty which would be added to those unpaid after that date .and further that consideration be taken toward the elimination of at least one of the registrations for General Election and the elimination of the registra- tion between the City Primary and the Charter Election: The recommendations of the Street and Alley Committee that the :request of the Rochester Telephone Company to set poles in Eighth .Street r ;Southwest and Eighth Avenue. Southwest, per their former request, be granted with the understanding that the said poles are subtject to removal . upon the .order of the Common Council, was read, and motion by Witzke second by Cook carried that the said recommendations be accepted and that the said permission be. granted with the provision that the i4stallation of the said poles 'be done under the supervision of the City Engineer; Alderman Cook, as Chairman of the :;Lighting Committee, stating that he concurred entirely with these recommenda- itions. '! Alderman Frank introduced, a resolution designating polling places within the City of Rochester, Minnesota, which was read: Upon motion by Erickson second by Cook, and all voting in favor l'thereof, President Weeks declared said resolution duly passed and adopted. Alderman Erickson introduced a resolution ordering.that Ninth Place Southeast be graded to an established grade and.,to the full width of the ,;street, viz, fifty feet, from :the west line of Third Avenue Southeast to the Vest end of said Ninth Place Southeast, ordering the City Engineer to prepare ,;plans, profiles, , specifications and estimate of cost for the said improvement ?and resolving that the cost of this improvement shall be paid by special assess- ments levied according to law, which was read: Upon motion by Erickson second by Miner, and all voting in favor :thereof, President Weeks declared said resolution duly passed= and adopted Plans, profiles, specifications and estimate of cost, prepared by 'Charles H. Armstrong, City Engineer, for the construction of a City Warehouse :to be situated on the east 50 feet of Lot 2 and the South 28 feet of the East .50 feet of Lot 39 in Block 102, Willson's Addition, were submitted to the Common Council and were considered by them, the City Engineer's estimate of cost, for the said warehouse b$ing $9788098 Alderman Witzke introduced a resolution adopting said plans, pro- files, andespecifications, ordering the said estimate of cost placed. on file and ordering advertisement for bids to be received and opened by this Common Council at a meeting thereof to be held at 2 o' clock, P.Me on the 6th day of November, 1922, which was read: i Upon motion by Miner second by Frank, and all voting in favor there - ;of, President Weeks declared said resolution duly passed and adopted: Alderman Miner introduced a resolution appropriating $583.35 from 781 the General Fund and ordering payment made to the Bulletin Publishing Company as pay- ment for official printing from July 27, 1922, to September 20, 1922, as per invoices dated October 20, 1922, which was reads Upon motion by Lennon second by Frank, and all voting in favor thereof, President Weeks declared said resolution duly passed and adopted. Alderman Cook introduced the following resolution which was read: Be it resolved by the Common Council of the. City of Rochester: i That said Common Council does hereby assent to and approve the levy of taxes to the. amount 'of Two biu died ninety six thousand fourteen and 87/10.0 ($296014487) Dollars for general school purposes, made by the Board of Education of School District Noi 8 in said City, on the 21st ,day of September, 1922, on the taxable i property in said School District Nos 8.
