Meeting called to order by President Weeks& i, �. Roll Call: Present: Weeks, Cook, Erickson, Frank, Miner, Leirmon, VAtzke. Absent: none. The report of the City Engineer for the month of November, 1922, was read, and. motion by Erickson second by Frank carried that:the same be referred to the Street. and Alley Committee: The sign maintenance bond -of the Nelson Motor Sales Company,with the Fidel- ity and Casualty Company as surety thereon, in the amount of $3000..00, was ; read, and motion by Erickson second by Cook Carrie¢ that the said surety be accepted and that the-- said bond be approved and placed on file. Tr.e report of the Division of. Sp6nitation of the State Board of Health cover- ing their. recent investigation of .the water supply of said City, was read, and motion uy Lemmon second by Frank carried that the same be accepted and placed, on file. The application of Lyle Atkinson for license as milk producer and milk distributor of raw milk, - and the application of M. J. Pierce for a license as producer of raw cream, were each separately .read, and motion by Frank second by. Witzke carried that each of said. licenses .be granted. The application of Blakely and Kennedy for permit to place and maintain a r < sign on their building known as 10 Third Street Southwest, was read, and motion by . Frank second by Witzke carried that the said permission be granted, that the amount of the, bond to be given be fixed at the sum of 01000.00, and that the installation of said sign be made under the supervision and subject to the approval of the Building t i.!:nd. Electrical Inspe etor The application .of T. Po Shaw for a license to solicit business for his boarding and rooming house at 114 Fourth Avenue Northwest, was read, and motion by Prank second by Co-ok carried that the same be granted* The application of M. W.. Cohen for a license to peddle home-made aprons and oriental goods. in said City for a period of one month from December 5th, 19229 to January 5th, 1923s was read, and motion.by Witzke second by Frank carried that the raid license be not grantedii . The following report was read,, and motion by Miner second by Witzke carried that the same be placed on file: , "Rochester, Minnesot as December 4, 1922. uon. Mayor and CommonCouncil, City of Rochester, Minnesota Gentlemen: , As per request of' the ' Common Council to test out the Multiplex Cement Air -Chamber and Chimney, we gave it a test with an oil fire .of 25 minutes'. duration and at the -end poured cold water --on it& It stood the test and did not cYiip or break, and would recommend it as . a very good chimney if all blocks are made the same as that; 2 one piece. r In regard to the fire insurance rate it would not make any differene in the insurance ratei Respectfully submitted, Wm. E.. Cudmore, . Chief of Fire Department." The report of the Chkirman, of the Street and Alley Committee to the effect that he had checked the November, 19 22, City Engineer's report and found the same to be correct, was read, and motion by Lemmon second by Cook carried that the said report be accepted and placed on file, and that the report of the City Engineer be accepted and placed on file. the License Committee that The recommendation olf J. Si Sibley be granted license to use and operate two pool tables in the basement of the building known as Nos 301 - 305 Broadway Street North, was read, and motion by Miner second by Lemmon carried that the said recommendation be accepted and placed on file, and that the said license be granteds Motion by Miner second by Erickson carried that the Mayor and City Clerk be authorized and directed to draw to Marguerite Evans a duplicate of warrant No,; 4456 for the sum of $1240 for her services. as Clerk of Election in the Third Election District., of the Second Ward of said City, on November 7th, 19229 acid :that payment be stopped on the original of said warrant Not 4456. ` Alderman Miner introduced a resolution appropriating $4666.68 from the Fire Protection Fund and ordering payment made to the First National Bank n f Rochester, Minee sot a, as final payment on the purchase price of the Ahrens - Fox Pumping Engine, $4166.68 thereof being for principal on note dated Dec- ember 22nd, 1920, and $50040 thereof being for interest on the said note for two years at 6%, which was .read6 Upon motion by Lemmon second by Erickson, and all voting in favor thereof, President Weeks declared 'said resoluiion duly passed and adopted. r Estimate Noi 1, prepared by Charles H. Alderrgan Cook introduced a resolution accepting the steel reinforced concrete bridge over Mayo Run in Tenth Avenue Southeast, as constructed by the Utton Construction Company, as done and completed according to the plans, profiles and specifications for the same, which was read: Final estimate, prepared by Charles H. Armstrong, City Engineer, in favor of the Utton Construction Company for the construction of a steel reinforced concrete bridge over Mayo Run in Tenth Avenue Southeast, showing the sum' of $112500 as being clue the said eontraetors, was read, and motion by Miner second by Frank carried that the said estimate be accepted and placed on file. , . Alderman Witzke introduced -a resolution appropriating ` 22074.00 from the Permanent Improvement bX.ind for payment to Heffron ,and Fitzgerald for estim- ate No. 1, on contract for the construction .of a. City warehouge, which was read. Upon motion by Miner second by Lemmon, and al], voting in favor thereof President Weeks declared said resolution. duly passed and adopted. Alderman} Erickson. introduced a resolutioA appropriating 1'1125.0.0 from the Bridge Fund and ordering `payment made to the_ Utton Construction Company for final estimate on contract for the construction of a steel reinforced concrete bridge over May Run on Tenth Avenue Southeast, which was read. t. Upon motion by Frank second by Cook, ..and all voting in favor thereof, President Weeks declared said resolution duly passed and adoptedr Alderman Miner introduced a resolution appropriating $267.6.06 from the Lighting Rind, and 013.12 from the Sewer Fund and ordering payment made to the Public Utility li ind of the City of Rochester, $2676.06 thereof being for November, 1922, public lighting, and $13 12 thereof being for electric poorer furnished for the Sewage Lift Station, which was ready Upon motion by Lemmon second by Miner, and Wii voting in favor there - oft President Weeks declared said resolution duly passed and adopted. Alderman Lemmon introduced the following resolution which was read: Be it resolved by the Common Council of the City of Rochester: That the City Clerk of said City be and he is hereby ordered and directed to request the Public Examiner of the State of :Minnesota to exam- ine the books and records of the City of Rochester, Minnesota, and to further request the said Public Examiner to begin such examination so as to complete the same at the end of the present fiscal year of said City and before the expiration of the terms of offices of all public officials con- cerned. Upon motion by Witzke second by Miner, and all voting in favor thereof , President Weeks declared said .resolution duly passed and adopted. Motion Eby Witzke second by Erickson carried that because of them not r making the proper connections, the City Clerk be instructed to bill the Chandler Plumbing and Heating Company for the labor required in digging up the William Rommel sanitary sewer service in Fourth Avenue Northwest. A petition that street lights be installed on Fourth Street Southeast, one about 350 -ee't east of Thirteenth Avenue, one at the intersection of Six- teenth Avenue and one about 400 feet east of Sixteenth Avenue, was read, and 'President Weeks referred the same to the Lighting Committee. Motion by Cook second by Erickson carried that -the City Clerk be instructed to request that the Public Utility Board connect the electric lights on the Seventh Street Northwest bridge. Motion by Lemmon second by bank carried that the City Clerk be in- struGted to request of the Public Utility Soard that they discontinue the blow- ing of the whistle on the electric power plant at 7 0' clock A.M.; all voting in favor thereof except Alderman Witzke who voted "Nay". 991 Motion by Lemmon second by Cook carried that Neffron and �Itzgerald be grant- ed the use of the east 32 feet of First Avenue Southwest between Second Street and the alley next north for a period of;ninety days from this date. Motion by Miner second by Erickson carried than the City Treasurer be instruct- ed to place $5000.00 from the Street and Alley deposit account into a savings account for that Fund. At 4 o'clock P.M; motion by Erickson second by Cook carried that recess be taken for one-half hour for the purpose of inspecting the grade proposed for the Eighth Avenue Southwest paving and curbing. At 4:30 o' clock P.M:, December 4th; 1922, pursuant ' to recess taken, Coun- cil again convened and were called to order by President Weeks. Absant:,Nonee The grade for .the Eighth Avenue Southwest paving and curbing was discussed, and it was unofficially agreed that the City.Attorney should draw up, the,neoessary papers to amend the contract, etc., to the extent t hat the grade for the west side of said paving for the first 150, feet north of the center line of Ninth Street Southwest shall be changed from the 6% grade to a 5:33 grade, that the next 50 feet be changed from 60 to $ o, and that the balance remain as established; that the grade for the east side for the first 150 feet north from the center line ofNinth Street Southwest be changed from a 6°' grade to 5d-, that the.. grade for ' the next 50 feet be changed from 67' to 8�,; that the next 300 feet remain the same as established;.- that the last 192 feet be chomoted from 10 42% grade to 10:6%; the said changes to be made upon all parties concerned making sworn agreement to the change, and that they will assume all expenses necessary in making such a change.
