Roll Call: Present: Meeks, Cook, Kitzman, Lemmon, Newhouse, Roeder, Absent: Witzke. Motion by Lemmon second by Cook carried that the minutes of the meeting held on September 4th, 1923, be approved. The following communication was read, and motion by Newhouse second by Cook carried. that ,the same be accepted and placed on file: ' "Rochester, Minn., September 6th, 1923, To the Honorable. Mayor and Commoh 60uncil, City- of Rochester, Minnesota i Gentlemen: - You are hereby respectfully notified of the withdrawal of a certain application filed with ycu by the Standard Oil Company (Indiana) which application,g,,as a request for permission to erect and operate a drive-in gasoline service station in the City of Rochester on Lot 2 in Block 1 in Elliott Sub -division of the West half of Out lots -�Ii'4 and 5 in Cummings' Addition to the Town (now city) of Rochester, Minnesota. j The said application was filed with the City Clerk of the City (� of Rochester during the latter part of July or the first part of August, :! 19236 i' Very truly yours, STANDARD OIL COMPANY (INDTIWA) Per H. Mercer asked that restrictions be placed on the construct- ion of gasoline -filling -stations to the extent that they be prohibited in i residence sections of the City. i IVilliam Rieck opposed the proposed construction of a, gasoline filling station at the Southeast corner of the intersection of Fourth Street Southeast and Third Avenue Southeast. Motion by Lemmon second by Cook carried that the City Attorney i be instructed to furnish a written ruling as to v&ether an ordinance can be drafted .and enforced which will prohibit gasoline filling stations in residence sections. 1 . President Meeks announced that this was the time and place fixed 1 for a hearing on the construction of a concrete curb and gutter on Fourth Avenue Northwest between the north line of Center Street West and the tracks of the C,,G-.W.R.RoCo., and asked if there was any one present who ;I wished to be heard. There was no person present who wished to be heard. z �2-171 This being the time and place fixed for the opening of bids for the construct- ion of the above described curb and gutter, the following bids"were each opened and read, and motion by Lemmon second by Newhouse carried" that the same be referred to the City Engineer for comparison with his, estimate•,and for recommendations in the matter: • b onard and, Eagles: 2477.2 f't combined curb and Butte"r, '18.3 square yards, concrete crossing; 17.17 square yards sidewalk; and 20 square yards concrete gutter, for a total sum of $2375,00. McDonald and Anderson: Combined curb and gutter, cents p: r lineal foot; Concrete crossing, $20 00 per yard; sidewalk, $1050 per yard; 20 square yards concrete gutter at $2.20 per yard. Faller rothers: Combined curb and gutter, $.90 per foot; concrete crossing �2.00 per yard; sidewalk, w1.50 per yard; concrete gutter, $�2.00 per yard* H. A. Huney, as Chairman of the Finance Committee of the Board of Education of School District No. 80 asked that action be taken to require the Treasurer of Olmsted County to File an official bond as Treasurer of said School District, as provided for in Section 298 of the Charter of the City of Rochester, Minnesota, and after a discussion of the matter he was referred to the City Attorney for instructions as to how to proceed. A representative ,of the American -La France Fire Engine Company called atten- tion to the need of repairs for the American -La France engine which is now in use in .the Fire Department, and he was requested to file an estimate of the approximate cost necessary to put this equipment in the proper condition. Mrs. Thomas Kinsella remonstrated against the petition for the construction of a concrete curb and gutter on Fifth Avenue Northwest. The report of the Health Officer for the City Farm for the month of August, 1923, showing receipts in the amount of l'1924*84, disbursements in the, amount of 111'1920.999 and a balance on hand, in the amount of 02596.38t was read, and motion by e Lemmon second by Cook carried that the same be accepted and placed. on file. The report of the Health Officer for the month of August, 1923, was read, and President Weeks ordered that the same be placed on file. The application of J. J. Marshall for a_ driver's license was .read, and motion by Newhouse second by Roeder carried that such license be granted. The general balance sheet of the City of Rochester, Minnesota, as at August 31st, 1903, prepared_by the City. Clerk, was submitted,' and motion by Lemmon second by Newhouse carried that the same be accepted and placed on file Balance sheet, income statements, etc., of the Public Utility Department, as at August 31st, 1923, prepared by the Secretary of the Public Utility Board, were submitted, and motion by Newhouse second by Roeder carried that the same be accepted and placed on file, the said income statements showing a net profit in the Lighting Department for the month of'August, 1923, of $4,196.39, and a total profit for the five months of this fiscal year of 0310570.45, and a net profit in the Water Department r for the month of August, 1923, of $39251,93, and a total profit for the five months of this fiscal year of $15,690.47. 2 r Motion by Lemmon second by Cook carried that the Public Grounds Committee be instructed to secure the necessary labor and materials and repair the City Hall roof. A petition. signed by J. S. Case, Arthur. H. Wurtele, William Fri edell, E. E. Howe, Oscar Hanson, Wm.� N. Herrick, J. A. Pierce, Pd. A, Hutchins, The Kahler Corporation, Nellie Hines, Mary Hines, L. A. Decker, William Schultz, J. T. Collin, L. G. Schroeder and C. P. Fjerstad asking for standard curbing acid' the surfacing with gravel of Third Avenue South- wIest between Third Street Southwest and Center Street West, was read, and during the discussion the need of the surfacing with gravel of Third Avenue Southwest between Fourth Street Southwest and Sixth Street Southwest was mentioned, at which motion by Newhouse second by Lemmon carried that each of the above mentioned matters be referred to the Street and Alley Committee and the City Engineer for investigation and report to this Common Council at the next meeting thereof. The following report of the Street and Alley Committee was read, and motion by Newhouse second by Cook carried that the same be accepted and placed on file: "Rochester, Minnesota, September 5th, 1923. Honorable Mayor and Common Council, City of Rochester, Minnesota, Gentlemen: We have investigated the matter of sign to be erected on the Penny Store, and have entered into an agreement with the Manager, Mr. Rood, that he will erect the sign under the supetvision of the Building Inspector and comply with all future ordinances, Respectfully submitted, STREET AND ALLEY col MITTEE, ` By Fred R. Witzke, Chairman." The following report of the Finance Committee was read, and motion by Cook second by Roeder carried that the'same be accepted and placed on file: "Roche st er, Minnesota, " September 10, 1923. Hon. Mayor and Common Council, City of Rochester, Minne qpt a. Gentlemen: The Finance Committee upon investigation finds a misunderstand- ing of the prices of the various types of fans at the time of the purchase of the oscillating fan for the Policewoman's office, and in view of the fact the said fan has been in use for some time with consequent accumula- tion of rental charge if 'returned we respectfully recommend that the same be paid for at the price billed $30 00, Respectfully submitted, 9 -73 Finance Committee, By J.'-T. Lemmon, Chairman:" The following report of the City Engineer upon the above mentioned bids for the construction of a concrete curb and gutter, was read, and motion by Lemmon second by Newhouse carried that the same be accepted and placed on file: "September Tenth, Nineteen Twenty -Three. rr Ronorable Mayor hnd Common Council, Gentlemen: I herewith report tabulation of bids for combined curb and gutter as follows: McDonald and Anderson, $2459.70 ,Leonard and Earle 2375*00 Feller Bros; 2331.84 The bid of Feller.Broso is $53, 5'7 below the estimate of cost filed with plans and specificationsa r Respectfully submitted, C. H. ARMSTRONG, CITY ENGINEER." A petition of Carl F. Kuehn, W. J. Mayo, Ylargrete Jorgenson and Michael Slatterly that a sanitary sewer be constructed in Fourth Avenue Southeast from the center -af Thirteenth Avenue SoutY�east to a point 300 feet East, was read, and motion Y by Newhouse second by Roeder carried that said petition be granted. The, application of the, Ladies of Columbus, by Nellie Kennedy, for permit to hold, give and conduct a public dance in Saint John's School Hall on the 14th day of September, 1923, was read: .Alderman Newhouse introducgd a resolution granting permit to the Ladies of Columbus to hold, give and conduct a public dance in Saint John's School Hall -on the 14th day of September, 19.23, and fixing the fee at the sum of $laOO, which was read. Upon motion by Newhouse second by Cook, and all voting in favor thereof, President Weeks declared said resolution duly passed and adopted. The following recommendations: of the Lighting Committee were read, and motion by Lemmon second by Roeder -carried that the same be accepted and placed on file, and that the City Clerk be instructed to notify the Public Utility Board to make installations accordingly: "Robheste'r, -Minnesota, September loth, 1923. To the Honorable Mayor and Common Council, t Gentlemen: The Lighting Committee recommend the installation of a street light at the intersection of Sixth Avenue Southwest and Eleventh Street Southwest; and one at the intersection of Second Street/ Northeast and Thirteenth Avenue Northeast., Respectfully submitted, LTG7TTNG CO1-q.1TTTEE, 4 274 c By John J. Ald$rman Rneder introduced the following resolution which was read: Be it resolved by -the Common Council of the City of Rochester, Minnesota: That all former resolutions .relative to the construction of a concrete curb and gutter on Fourth Avenue Northwest between the north line of; Center Street. West and the tracks of the C.U.W.R.R. Co. be and the said resolutions are in all things hereby adhered to. Upon motion by Roeder second by.Lemmon, and all voting in favor thereof, President Weeks declared said resolution duly passed and adopted. Alderman Roeder ,introduced the following resolution which -was read. Be it resolved by the Common Council of the City of Rochester, . Minnesota: t That the bid of Feller Bros. for the construction of a concrete curt] and gutter on Fourth Avenue Northwest between the north line of r. Center Street ,:lest and the tracks of the CiG-W.R.R Co., said gutter to be 24 inches aide and said curbing to be' 6 inches wide, and set to a r distance of 30 feet between the inside faces, according to the plans, Profiles.,and specifications for said curb and gutter now on file in the office of the City Clerk of said City, at the following prices to -wit: 2477.2 ft& combined curb and gutter 0 $ 90 per ft. $2229,48 1803 sqe yd4 concrete crossing 2.00 per yd. 36.GO l7a17 sq, yda sidewalk 1*50 " " 25.7E 20.00 "' " concrete gutter 2j00 4000 Total 2331*84 r be, and the same is hereby accepted. The Mayor and City Clerk of said City are hereby authbrized` and directed to execute in behalf of the City of Rochester, a contract with r _ said contractor for the above mentioned improvement. The amount of the bond to be given by said contractor is hereby fixed at the sum of �;�2400W00. Alderman Kitzman introduced the following resolution which was read: Be it` RESOLVED by the Common Council of the City of Rochester, Minnesota: r That the sum of 0185311 be and the said sum is hereby a ppropri at ed from the. Light4ng Fund ' of said City and ordered paid to the Public Utility Fund for September 1, 19232 billing for the August, 1923, lighting at the Armory, Sewage Lift Station, Fire Hall No,. 2.9 Mayo Park, City Park House, East Fifth Cluster, First Street Southwest, Fourth Street Southeast, North Broadway Clusters, Fourth Street South- west, Fire Hall, City Warehouse, City Hall, Public Library and Police Matron's Offices, totalling 0604 48, and $1248.63 to apply on the bill- 275 Ii ing for general street. >:ghting for the said Period. Alderman Lemmon introduced a resolution appropriating g527.76.from the General ' b+'und - and ordering payment made to tie Bulletin Publishing, Company for official publications and printixg for=the period' -June 20thf 1923; to August'30th, 1923, in - elusive, in accordance with sworn billing made by G•.'S.'Witherstine, under date of September 8th, 1923, which was read. Upon motion by Lemmon second by Newhouse, and all voting in favor thereof, President Weeks declared said resolution duly•passed and adopted. Alderman Cook introduced the following resolution which was .read: VffT-EREAS,.The Common Council of the City of Rochester deem it expedient and necessary that a local public''improvement, the cost and expense of which shall be paid by special assessments, levied as provided by law, be made in said City of Rochester, said improvement consisting of the construction of a's8nitary sewer commencing at a point in the center of Third Avenue Southwest ninety- three (93) feet south of the south line of Sixth Street' Southwest, and running soi;th along the center line of Third Avenue Southwest one hundred ninety-seven (1.ti7,,) feet, thence southwesterly to a point thirty-seven (3-7) feet East and forty-five (45) feet south of the Southeast corner of the intersection of Fourth Avenue Southwest and Seventh Street Southwest, .PHEREFORE, De it resolved by the Common Council of the City of Rochester: That a public hearing of all persons and parties interested in said im- w Y orovement will. be held at 8 o'clock P.M. on September 24th, 1923, at the Council Chambers, in the City Hall, in said City, at which time and place all persons and parties interested in said improvement may appear and be heard by said Common Council in relation to said improvement: The City Clerk is hereby ordered and directed to cause to be published in. the official paper of said City a notice to all i,ntere gted,persons and parties of the time, place and purpose of said meeting and hearings Upon motion by Newhouse second,by Cook,' and all voting in favor thereof, President reeks declared said resolution duly passed and adopteds Motion by Lemmon second by Newhouse carried that the sum of ,P'150400 be appropriated from the General Fund and paid to the Treasurer of the Civic League for Vlomen's Rest Room expenses for July, August and September, 1923. The following claims were read, and motion by Lemmon second by Newhouse -arried that the same be allowed, and that the Mayor and City Clerk be authorized and directed to draw warrants upon the City Treasurer and make payment accordingly: From the General. The claim of the Rochester Motor Car Company in amount of $16.90 for labor and repairs on fire truck and for re-o:inding of armature, was read, and motion by Lemmon second by Cook carried that the said claim be placed to their credit and that after the deduction of the $3.30 account which the City of' Rochester, %nne sot a, has against them, then an appro- priation of A'13,;60, the balance due them, be made from the Fire Protection Fund, and that the.Mayor and City Clerk be authorized and directed to draw a warrant upon the City Treasurer for the said sum of 013*60 and make_ �r payment accordinglyi fh I.
