Minutes of a special meeting of the Common Council of the City of Rochester,

Roll Call: Present: Weeks, 'Lemmon, Newhouse, Roeder, Witzke. Absent: Cook,'
Kitzman.

The call for the special meeting was read; said meeting having been called
;for the purpose of consideration of the request of the Rochester National Bank to be
released. from being a City depository and from the consequent obligations, and such
ct'her business as the Common Council might deem proper.
The following communication was read, and motion by 1,emmon second by Roeder
;carried that the same be placed on file: `
"City of Rochester, Minnesota.
Sept. 18th, 1923
We, the under. signed, having had money deposited with us by the City of
Rochester hereby tender the return of said money with interest on the savings deposits
at four per cent up to date, and on the checking account up until to -day, at one per
cent, and we hereby withdraw as a city depository and request the removal of said
funds and renise to pay interest longer on said deposits.

Alderman Lemmon introduced the following resolution which was read:

Be it resolved by the Common Council of the City of Rochester., Minnesota:
Whereas, the Rochester National Bank, one of the named and qualified deposi-
tories of the public funds of the City of Rochester, having served notice upon
the City of Rochester that it tendered the return of all of the money of the City
of Rochester with interest, on the savings deposits at, Four per pent up to date
and on the checking'account up to date at one per cent, ap agreed upon and with-
draw as a city depository, and requested the removal of said funds and refuses to
pay further interest on said funds; and,
Whereas, it deposited with the. City Clerk of said City,, their check Nos 7308
for v21866.20, check Noa, 7310 for 011,13962.47 and another check No. 7309 for
$917103, all dated September 18th, 1923, representing the!- principal of the de-
posits. with said depository, the Rochester National Bank; and also checks pur-
porting to cover interest up to dates, that is check No. 7306 for $11 63, check
No. 7307 for y�335.2•j and check No. 7303 for 113470.

L Therefore be' it'resolved by the Common Council of the City of Rochester
that the said checks be accepted by the said City of Rochester, , and that upon the
payment of said cheeks to l the City of Rochester upon presentation, that the said
Rochester National Bank be relieved and no longer be a depository for city funds;
and as such city depository their bond given in pursuant to such agreement in the
spring of 1923 be and the same is• hereby discharged&
Be it further resolved that the said funds be deposited in the Olmsted

County State Banks, the sum of $27438.919 First State Bank of Rochester,
Minn., the sum of. $700000, Union National Bank, $5000,00, and the
balance in First National Bank of Rochester, Minn., i in the sum of
$6042,69; and the City Clerk is hereby directed to make such. deposits
and se.e that the said fund is removed from the Rochester National Bank
to the said banks and put to the credit of the City of Rochester to
the accounts to which it properly belongs. F
Upon motion by Lemmon second by Witzke, and. all voting in. favor
i thereof, President Weeks declared said resolution duly passed and adopted..
The application of the Wilber Transfer Company for permit to -
place and maintain a sign' on the boulevard at the southeast corner of the
'! Garden Theatre Building, was read, and motion by Newhouse second by Lemmon

carried that the same be referred to the Street and Alley Committees -
Applications made by J. P. Clarkson for two licenses for auto-
mobiles to be used in carrying passengers for hire between the City of
L ,
Rochester, Minnesota, and surrounding cities, toms and villages, were each
separately read, and motion by Newhouse second by Lemmon carried that such
licenses be granted, with the provision that the said automobiles shall not
be used in local taxi or' jitney servicei
The petition of Mabel C. Root that a sanitary sewer be construct-
ed in Fourth Avenue Southwest from the center of Third Street Southwest to

a point 75 feet north of the north line of Fourth. Street Southwest, and
that a water main be laid in the said part of the said Avenue, was read,

E and motion by Newhouse second by Lemmon carried that the said petition be
i� referred to the Sewer Committee and the Water Committees

The report of the Clerk of the Municipal Court for the week end-
ing September 3, 1.923, showing fines collected in the amount of $112;i40,
if and civil fees collected in the amount of $2.60; and the report of the Clerk
of the Municipal Court, for the week ending September 10, 1.923, showing .fines
collected in the amount 'of $22200, and civil fees collected in the amount
of $7.30, rer'e each separately read., and President Weeks ordered that the
same be referred to the City Attorney.
The matter of whether or not a building -permit shall -be issued
for the remodelling of the Garden Theatre Building,, -was on motion by
Lemmon second by Newhouse, referred to the Pulplie Grounds Committee the
Fire" Department Committee and the Building Inspector for investigation and
recommendation in the, matter.
Arpointments, by the Mayors of John Ploof as a Special Patrolman
in the Police Department of said City for •the p.er.iod September 11, 1.9023, to
September 18, 1923, inclusive, and September 1.8, 1923, to September 24,
19,P'A, inclusive, were each separately read, and President Weeks ordered
that the same be placed. on file=
Summons and complaint in R. H. Goodenough., Plaintiff, vs. the

The following copies of resolutions passed and adopted by the Commissioners
of, the Sinking Fund of the City of Rochester, Minnesota, were each separately read,
and motion by Lemmon second by Newhouse carried than the same .be placed on file, and
that the action set forth therein,bo.approved:'

Recommendation of the Street and Alley Committee that a concrete
curb and gutter be constructed on NinthrAvenue Northwest between Center
St reet West and First .9,treet Northwest, set to a distance of 24 feet between

The condition of the City scales was discussed by a representative
of the Fairbanks-r Morse Company, and motion by Witzke second by Newhous'e.)
carried that the said scales be dismantled and .shipped to Saint Paul for a
complete overhauling and for return as soon as possible, the Fairbanks-14orse
Company being instructed to send an expert herb to make the installation
after the riebairs bre made and 'the scales returned*
Alderman Witzke introduced the following resolution which was read:
• Be it` resolved by the Common Council of the City of .Rochester,
'Minnesota:
That the resolution passed by the Common Council of the City of
Rochester, the 27th day of August Ae Dw 1923s in regard to an agree-
ment with the State Highway Commission to build a sidewalk on Trunk
Highway Noe 599 be' and the4 same is hereby amended to read as follovis:
WHEREAS, The State Highwpy Commission of the State of Minnesota
has offered to build and' construct a-sixfoot sidewalk on each sicle
of their Proposed bridge on Trunk' Highway No* 59, over the Zumbro
River in the City of 'Rochester, in accordance with plans and specifica-
tions therefor on file in the office of the Commi'ssioner of Highways,
which plans and specifications provide for a six foot sidewalk to be
built on each' side of the- said bridge to be built on North Proadway.
The said extra cost for constructing' said sidewalks to be charge

the City of-Rochesters, provided that the said amount shall not exceed

THEREFORE, be its resolved by the Common Council -of the City of Rochester,

That the City enter into said contract for the building of said sidewalks
according to the statute with the said State Highway Commission.
NOW THEREFORE, :The 'said.Mayor and the City, Clerk are hereby authorized and
directed to enter into said contract with said Highway Commission for the con-
struction of said six foot sidewalk on each side of said bridge on Trunk Highway
No. 59, over the Zumbro River, in the City of Rochester, according to the plans
and specifications therefor on file in the office of the Commissioner of Highways,
which contract is in the following words and figures, to -wit:

WT.TrNESSETH, That the Commissioner for and in consideration of the payment or
payments hereinafter specified and to be made by the party of the second party
hereby covenants and agrees to construct State Bridge No. 4138, commonly known as
Broadway Bridge, located on Trunk Highway No. 59, over the Zumbro River in the
City of Rochester, in accordance with the plans and specifications therefor on
file in the office of the Commissioner, which plans and specifications are hereby
made a part of this agreement and provide for a six foot sidewalk to be built on
each side of the bridge, which would not be necessary to accommodate normal
trunk highway traffici
For and in consideration of,the completion of said Bridge No. 4138,
including sidewalks, by the Commission, the party of the second part does hereby
agree tO pay into the Trunk Highway Fund, upon completion of the construction
outlined in the plans for said bridge, the actual cost of the two sidewalks,

provided however that the amount to be paid by the party of the second part
shall in no case ey,,geed 15,000004,
"It is further agreed that the party of the first part shall maintain, keep
in repair, rand when necessary reconstruct said sidewalks and that upon presenta-
tion of the expense thereof to the party of the second part, the party of the
second part shall forthwith pay to the party of the first part the amount of

The party of the second part hereby approves the ,rages shoam on the afore-
said plans and also agrees tp. prov�d'e the necessary right ,of way for the new
structure and approaches �theretoii
Upon motion by Lemmon second by Newhouse, and: all voting in. favor thereof,
President Wee';s declared said resolution duly passed and adopted.
