Meeting called to order by President Weeks.& Roll -Call.- Present: Meeks, Cook, Kitzman, Lemmon, Newhouse, Roeder, Witzke; Absent:' None. Motion by Witzke secoiid4 by Roeder carried that the minutes of the meetings held on October 1, 19239 and October 8, 19239 be each approved. President Weeks announced that this was,the-time and place -fixed for a hearing on the confirmation of the assessments for ,the cost - and ex- pense of the sprinkling of the streets within the said City during the season -of the year 1923, and asked if there was any one present who wished to be heard �n any matter concerning the said sprinkling. Mrs. F. H. Gimbert, .W:.V. Newlin and Rasmus Larson -asked for information 4s to .why there aredifferent costs per 100 square feet on ,diFffgrent streets, and the .City Engineer explained that this is because -of the fact of the different amounts of work done on the different.streets. 41derman Roeder introduced a resolution confirming the assess- ments made October 8th, 1923, for the cost and expense .of .sprinkling during the season of the year 1923s, which was read;o Ujpon motion by Witzke second. by Cook, and all voting ,in f4vor thereof,. President Weeks declared said resolution duly passed and adopted. ,President Weeks announced that this was the time and place fixed for a hearing on the construction of a sanitary sewer in Fourth Street Southeast commencing at the center of the intersection of Fourth Street Southeast and Thirteenth Avenue Southeast and running thence East along the center line of Fourth Street Southeast to a point 400 feet Eadst, and asked if there was any one present who wished to be heard in this matter. Rasmus Larson inquired if this was a trunk line sewer, and stated that if such was the case he expected that one-half of the cost would be paid by general taxation. He was advised that it is not to be a trunk line sewer but simply an extensiLtm4:�the present Fourth Street Southeast sewer, and consequently the whole cost and expense will be charged to the property concerned. There were no other persons present who wished to be heard in any matter concerning the said sewer. President Weeks announced that this was the time and place fixed for a hearing on the levying of special assessments for the cost and ex- pense of repairing sidewalks during the year 19239 and asked if there was any person present who wished to be heard. Co, and asked 'if there was any one present who wished to be heard in any matter concerning the said concrete curb and gutter. There was no person present who wished to be heards President Weeks announced that this was the time and place fixed for a hear- ing on the proposed construction of a concrete curb and gutter in Ninth Avenue North- west between the north line of Center Street West and the south' line of First Street I. k� Northwest; in Third Avenue Southwest between the south line of Center Street West and: the north line of Tnir& Street Southwest; in Third Avenue Southwest between the south �{ line of Fourth Street Southwest and the north pine' of Sixth Street Southwest; in Sixth Avenue` Southwest between the north line of Second Street' Southwest and the south line of Center Street West'; in Sixth Avenue Northwest between the north line of Center Street West and the C.G.W R R.Co. tracks;`in Third Avenue Northwest from the north line of Center Street West to the south line of Fourth Street Northwest; in Fifth Avenue North- west between the north line of Center Street West and the south line of Second Street Northwest; and in Fifth Avenue Northwest between the north line of Second Street North- I west and the C.,G*W-R.R*Coi tracks, and asked if there was any one present who wished to be heard in any matter concerning either or any of the said proposed improvements. Mrs. Thomas Kinsella opposed the proposed curb and gutter for Fifth Avenue t Northwest between Center Street West and Second Street Northwest. There were no other persons present who wished to be heard in any matter concerning the said proposed curb and guttera Alderman Witzke introduced a resolution ordering that concrete curb and gutter be constructed as above described, and ordering the City Engineer to prepare plans, profiles,' specifications and estimate of costs for the said improvements, which was read. Upon motion by Newhouse second by Roeder that the said resolution be adopted as read, and Aldermen Cook, Kitzman, Lemmon and Roeder voting "Nay", and Alderman Newhouse and Witzke voting "Aye", President Weeks declared the said motion::to adopt as being lost: A motion by Alderman Witzke that the motion to adopt the above mentioned resolution be re -considered, received no second: Alderman Cook introduced a resolution determining to adhere to all former resolutions in the matter of construction of a sanitary -sewer in Fourth Street South- east, as above described, which was read: Upon motion by Lemmon second by Cook, and all voting in favor thereof, President ?'Peeks declared said resolution duly passed and adopted. Alderman Newhouse who left the Council Chambers t George W. Granger, as Attorney for the Board of Education of School District Noe 89 explained their proposed budget for the 1923 tax lever. Alderman Newhouse returned to the Council Chambers and again took his Chairo President Weeks announced that this was the time and place fixed for a public hearing on the proposed budget for the 1923 tax levy for general purposes, and asked if there was any one present who wished to be heard. C: Domaille for two sight-seeing automo- bile licenses were each separately read, and motion by Newhouse second by Roedet carried that such licenses be granted, but granted with the pro- vision that the said automobiles shall not be used in local taxi or jitney service. Motion by Newhouse second by Lemmon carried that the City Attorney be requezted to furnish a written ruling as to whether the local ordinance requiring licenses upon automobiles using the streets of the • City of Rochester, Minnesota, in carrying passengers to and, from surround- ing cities, towns end villages, .conflicts with the State law in regard to licensing of motor vehiclese A petition asking for the installation of a street light at the intersection of Fourth Street Northeast and First Avenue Northeast, ,was read, and motion by Witzke second by Lemmon carried that the same be re- ferred to the Ligiting Committee. The general balance sheet of the City: -of Rochester, Minnesota, as at September 30th, 19239 prepared by the City Clerk, was laid before the Common Council, and motion by Roeder second ,by Newhouse carried that the same be accepted and placed on file:. Balance sheet, income statements, etc, of the Public Utility Department, as at September 30th, 19239 prepared by the Secretary of the Public Utility Board, were _laid before the Common Council, and motion by Lemmon second by Cook carried that the same be 'accepted and placed on file ; the said income statements showing a net profit in the Light Department for the month of September, 1923, of $39721;;05, and a total net profit for the six months of this fiscal year of $329291 50; and a net profit in the Water D ep artment for the month of September, 1923, of $4, 426, 09, and a total net profit for the six months of this fiscal year of $20,11&50. Motion by Lemmon second by Witzke carried that two old Council Room chairs be transferred from Council Chamber Equipment to Fire Depart- ment Equipment for use at the Central Fire Station, and that one old Council Room chair be transferred from Council Chamber Equipment to Street and Alley Equipment for use at the City Warehouse, and that 'the City Clerk r be instructed to make transfers upon his records accordingly. 327 The following communication was read, and motion by Cook second by Lemmon carried that the same be referred to the Water Committee: "CITY ELECTRIC LIGHT ;AND WATER DEPORTMENT,. Rochester, Minnesota,; Octil5, 1923, The Mayor and the Hon. Common pouncil, City of Rochester, Minnesota. Gentlemen- R Relative to your resolution of October first authorizing and directing the Public Utility Board to lay a Water Main in Ninth Street N.Wk from Fourth Avenue North- west to Fifth Avenue Northwest, the said Board will give this request due considera- tion upon the .assurance that a number of customers will connect with this mains Respectfully submitted, Public Utility Board, a A. Reports of the City Attorney, to the effect that he had checked the reports t ' of the Clerk of the Municipal Court for the weeks ending September lath, September 24th, and October 1$t, 1923, and found the same to be correct, were each separately read, and President Weeks ordered that the said reports of the City Attorney be placed on file, and that the said reports o f . the Clerk. of the Municipal Court be placed on fi 1 e. Gentlemen r The last two or three years the people living north of the City ron what is called "The River Road" have been asking for grading and improvement of that road, but in the past we have had no money with which "to do, this work, however, we have sufficient money on hand at present, and I recommend that this work be done at this time* _Respectfully submitted, Fred R. %tzke, Chairman, STREET AND ALLEY COMMITTEE4" Final estimate, prepared by Charles H.
