Witzkes Meeting called to. order by President Weeks: Roll Call: Present: Weeks,=Cook, Kitzman, Lemmon, Newhouse, Roeder. Absent: Motion by Lemmon second by Newhouse carried that the minutes of -the meetings held on October 22, 1923, and October 26, 1923, be each approved. President Weeks announced that this was the time and place fixed for a hear- ing on the proposed construction of a sanitary sewer in Fburth Avenue Southwest from the center of Third Street Southwest -to a point 100 feet north of the north line of Fourth Street Southwest, and asked if there -was any one present who wished to be heard in any matter concerning the said proposed sanitary sewer. There was no person present who wished to be heard. This being the time and place fixed for the opening of bids for the con- struction of an addition to the City Warehouse, the following bids were opened and read: GEORGE W. MASKE: G. SCHWARTZ & COMPAI Y: I $4046.00 5585.00 This being the time and place fixed for the opening of .bids for the con- struction of a building for the protection of teams and conveyances at the Public Hitching Grounds, the following bids were opened and read: GEORGE W. SCHWARTZ & COMPANY: 221200 Motion by Lemmon second by Cook carried that each of the above mentioned bids be referred to the City Engineer for comparison with his estimates of cost and for recommendation in the matters The October, 1923, report of the Building and Electrical Inspector, showing building 'inspection fees collected in the amount of $28AO, and electrical -inspection. fees collected in the amount of $6.00, was read, and President Weeks referred the same to the Finance Committee. The report of the City Weighmaster for the months of September and October, 19239 showing fees collected in the amouat of $36.30, was read, and President Weeks referred the same to the Finance Committee. The October, 1923, report of the City Engineer,showing expenditures from the General Fund for labor in the amount of $440.65; from the Street and Alley Fund in the amount of $2478.35; from the Sewer Fund in the amount of $225.80; from the Bridge Fund in the amount .of $220.45; and from the Permanent Improvement Fund in the amount of $12.50, was read, and motion by Kitzman second by Cook carried that the same be referred to the' Street and Alley Committee,.. The report of the Clerk of the Municipal Court for the week ending October 29th, 19239 showing civil fees collected in the amount of $.85, and September, 1923s 344 Olmsted County fees collected in the amount of $71,80; and the report of th'P. Clerk'of the Municipal Court for the week ending November 5th, 1923, chow- ing fines collected in the amount of $330400 and Civil tees collected in the amount of $3.809 were each separately read, and President Weeks referr- ed the said reports to the City Attorneys r The application of Ralph M. Graen, for C Company, 205 Infantry, M.N.G., for permit to -holds give and conduct public dances in the National Guard Armory,, in said City on Iovember 31 10, • 17, 24 .and 29, 1923, was read The application of Martin St. George, for the American Legion, for permit to hold, give and conduct a public dance,in the National Guard Armory, on November '12th, 1923s was read. Alderman Witzke came in at this time and took his Chair. Zhe application of Mrs. Ellen Crabb for permit to place and main- tain a sign on the building known as 215 Center Street West, was read, and motion by Cook second by Roeder carried that the same be referred to the License Committee. r The official bond of John Ploof, as Patrolman,in -tree amount of $500.00, with the Northwestern Casualty and Surety Company -as surety there- on, was read, and motion by Cook -second by Roeder carried that the said surety be accepted and that the said bond be approved and placed on file. Lentz and Walter E•ckholdt, asking that the City Engineer investigate the condition of Thirteenth Avenue'Southeast with the idea of gravelling the same, was reads and -motion by Lemmon second by Roeder car- tied that the same be referred to the Street and Alley Committee. w A communication from Martha Jorgensen, advising of her inability to accept the..appointmeht as a Director of the Public Library,, was read, y and motion by Lemmon., second b Roeder carried that her refusal. ,to accept the said appointment be accepted. . fi The following communication was read, and motion by Witzke second !f by Cook carried that the same be referred to the City Attorney and the Street and Alley Committee for report at the next meeting .of this Common a Council: "CITY ELECTRIC LIGHT AND WATER DEPARTMENT Rochester, '.Minnesota Nov. 1,. 1923, The Mayor and the Hon. Common Council, f The City of Rochester, Minnesota. ' Gentlemen - The Public IItility Board, at a meeting held on Oct. 30th, 1923, ;passed a motion requesting your honorable body to cause 3rd Street N.E., �► ;;from Broadway to 1st. Avenue N.E., to be closed for the purpose of giving the Municipal Electric Light Plant necessary room to store coal and for �; such other purposes as the growth of the, institution may, demand in,the future. Lentfer-Secretary." 345 The following report of the' Engineer,in the natter of the above mentioned bids for the construction of an addition to the Warehouse and for the construction of team sheds, was read, and motion by Witzke second by Cook carried that the same be accepted and placed on tile: "November Fifth, Nineteen Twenty Three. Honorable Mayor and Common Councils Gent lemen: I herewith report tabulation of bids for construction of Warehouse and team sheds: i WAREHOUSE: ? G. Schwartz and ,Co. 2212.00 George Maske, 2480:00 .I respectfully recommend that both jobs be let to same contractor if at all, and further recommend; that all bids he rejected and the work be done by day labor. Motion by Witzke second by Newhouse carried that the above mentioned bids for the construction of an addition to the City Warehouse, and for the construction of a building for the protection of teams and conveyances at the Public Hitching Grounds, be each rejected, and that the City Engineer be.instructed to secure the necessary labor, materials, etc., and construct..an addition to. the City Warehouse r on the South 26 feet of the East 50 feet of Lot 4, and the North 22 feet of the East 50 feet of bot 3 in Block 102 in Willson's Addition, according to the plans, profiles and specifications for said addition now on file in the office of the City Clerk of said City, and, that the City Engineer secure the necessary labor, materials, etc., and construct a building for the protection of.teams and conveyances at the Public Hitching Grounds on the North 6 feet of the West 15 feet of the East 65 feet of Lot 1, the West 15 feet of the East 65. feet of Lots 2 and 39, the 'Jest 15 feet of the East 65 feet of the South 26 feet of Lot 4, and the South 15 feet of the North 18 feet of Lot 4, all in Block 102. in Willson's Addition,• according to the plans, pro- files and specifications for -said building now, on file in the office of the City Clerk iof isaid City: 14otion by L01mon second by Newhouse carried that the certified checks of the above mentioned bidders 'on the construction of an addition to the City Warehouse, and for a building for the protection of teams -and conveyances at the Public Hitch- ing Grounds, be each returned to theme Alderman Newhouse introduced a resolution granting permit to Ralph M.", een, 346 A for C Company, 205 Infantry, M04G., to hold, give and conduct public dances in the National Guard Armory on November 3, 10, 179 24 and 29, 1923- and fixing the amount of the fee at a, total sum of $540, which was read. Upon motion by Lemmon second by Roeder, and all voting in favor -thereof, President Weeks declared said resolution duly passed and adopted. Alderman Newhouse introduced a resolution granting permit to Martin St. George, for the American Legion, to hold, give and conduct a public dance in the National Guard Armory on November 12th, 19239 and fix- ing the fee at the sum of 4100, which was read. Upon motion by Roeder second by Kitzman, and all voting in favor thereof, President Weeks declared said resolution duly passed and adopted. President Weeks at this time excused Alderman Newhouse who left the Council Chambers At 3:45 P.M4 motion by Witzke second by Roeder carried that this Common Council take recess for a period of thirty minutes: At 4:15 P JA; on November 5th, 1923, pursuant to recess taken Council again convened and were called to order by President Weeks;; r Roll Call: Present: Weeks, Cook,`Kitzman, Lemmon, Roeder, Witzke: absent: Newhouseo The following report was read, and motion by Lemmon second by Witzke carried that the same be accepted and placed on file: To the Honorable The Common Council, Of the City of Rochester, Minn. Gentlemen: The committee, appointed by your body to investigate gas rates for the City of Rochester, hereby respectfully report that the contract and ordinance between the City of Rochester and the gas company provides, tGas used for illuminating purposes, the sum of two dollars ($2.Cb) per thousand cubic feet, and gas used for fuel purposes when controlled by special meter, the sumof one dollar and Iseventy five cents ($l 75) per thousand cubic feet, and discount of twenty five cents per thousand cubic feet from the foregoing prices, provided payment therefor is made on or before the loth day of each month at the o ffi ce of the gas' company for gas consumed during the previous month.' The second division of the sixth section of the ordinance, under which the company is operating, provides for re -adjustment of rates but only for the purpose of lowering below the above figures, -anal says 'all other evidence relevant to the matter shall be final for the next ensuing period of five years, but the rates so fixed shall not exceed the rates fixed by this ordinance, t which is the rate -hereinbefore provided. Your committee "would .respectfully report that they would cdvise granting this maximum rate without hearing and advise that the City enter F 347 w into an agreement at said maximum rate, that is on the b4sis of one ,and fifty one i hundredths, dollars ($1.50) per thousand cubic feet, sub jest -to a penalty if not paid before the loth, and that tho City arrange to make all reasunable tests necessary to see that the gas so furnished is of-stand6-rd quality, pressure and heating capacity. Motion by Lemmon second by Kitzman carried that final action in the matter of the to cal , gas rates be postponed to November ,19th, 1923, at 8 0' clock P.M. The following report of the City Attorney was, read, and motion by Witzke second by Cook carried that the same be accepted and placed on file, and that the Chief of Police be instructed to'govern himself in accordance with the ruling of the F Attorney General in this matter: "To the Honorable The Common Council, Gentlemen: of the City of Rochester, Minn: The question of bus licenses for the ianter-city buses came up and I submit herewith the report of the Attorney General, with no special comments at this time, Respectfully submitted, t Thomas Fraser November 5th, 1923- City Attorney." The following copies of resolutions passed and adopted by the Commissioners of the Sinking Fund of said City, were each separately read, and motion by Witzke second by Roeder carried that the same be accepted and placed on file, and that tb, = action set forth therein be approved: "Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota: ` That, for the purpose of better investment of the funds concerned, {,189000.00 of the value of two United States 4 Treasury Certificates of 4$10,000.00 each, numbered Z6402 and 26403, dated May 15`th, 1923, and maturing March 15th, 19277, each of said Treasury Certificates having March 159 1924, and all subsequent interest coupons attached,` are hereby sold to the Rochester Loan and Trust Company of Rochest- er, Minnesota, for the sum of 018206.37, the said sum being a total of $18000,00 principal, $90400 premium and $116,37 accrued interest from September 159 1923s, to November 3rd, 1923. Motion by Lemmon second by Witzke.carried that the City Clerk be instructed to notify the various bond brokers interested .that this Common Council will, if the market is such at the .time that there will be no loss through the transaction, approve turning into cash on January 1, 1924, of 065,000.00 of three 44 Liberty Loan Bonds of 1928 maturity, now owned as Sinking Fland investments, toward the purchase of $98,000*00 of City of Rochepter, Minnesota,, optional 1929 5% Electric Light Bonds. The following report of the City Attorney was read, and Presid- ent Weeks ordered that, the same be placed on filer To the Honorable The Common Council, r Of the City of Rochester, Minn* - .Gentlemen: , I would respectfully report that the Rochester Milling Company 349 Y has set a price of five thousand- dollars !-(`$5000.00). on their property, which has been talked of for park purposes. The report of the Chairman of the Finance Commi Ltee, to the effect that he had checked the October, 19230 report of the Building and Electrical Inspector and found same to be correct, was read, and President Weeks ordered that the same be placed on file, and that the said report of the Building and Electrical Inspector be placed on file: The following recommendation oaf the Lighting Committee was -reads and motion by 77itzke second by Kitzman carried that the same be accepted and placed on file, and that the City Clerk be instructed to notify the Public Utility Board to make install- ations, accordingly: "Rochester, Minnesota, November 5, 1923• t Honorable Mayor and ` Common Council: Gentlemen: ` The Lighting Committee recommends that street lights be installed as follows: One at the intersection of First Avenue and Fourth Street Northeast; One on Sixth Avenue Southeast, 330 feet south of the south line of Center Street East6 Respectfully submitted, LIGHTING COMMITTEE, By John J. Cook, Chairman." The following Special Committee report was read, and motion by Lemmon second by Roeder carried that `the same be accepted and placed on file: "Rochester, Minnesota, November 5th, 1923. Honorable Mayor and Common Counci14 Gentlemen: The Special Committee,appointed by the Chair for such purpose, recommends that the City Engineer use his own discretion in the matter of allowing Mr. 00 V. Farmer to remove apple trees from FifthStreet Southwest west of Fourteenth Avenue. Respectfully submitted, SPECIAL COMMITTEE, By G. H. Newhouse, Chairman." Alderman Lemmon introduced a resolution appropriating $473*60 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund in payment of payrolls for labor for the weeks ending October 5, 12, 19, and 269 1923, in accord- 350 ahce rieth. sworn billing made -by William Sake, Secretary of the Park Board, under date of November 3, 1923, which was..read. , Upon motion -by Witzke second by Lemmon, and all voting in favor thereof, President Weeks declared said resolution duly passed and adopted. Alderman.Witzke introduced a resolution appropriating S250000 from the rGeneral band for temporary transfer to the K-re ,Protection Fund of said City for use in ;the 'said Fire Protection Fhi*qdj, which was read. ^. Moninger Company for materials furnished, under contract, for the new greenhouse in' Mayo Park, in accordance with their billing of October 99 1923, said billing being a total of $2207.57 with a discount of $44a15 for cash, which was reads Upon motion by Nitzke second by Roeder, and all voting in favor thereof, President Weeks declared said resolution duly passed and &,dopted r; Alderman Kitzman introduced the following resolution which was read: Be it resolved by the Common Covncil of the City of Rochester, Minne sot a: .That the present old north team shed now standing be moved back toward the mill race into line with the south shed, and raised up- to the same elevation, and that ninety (90) feet of new shed be constructed .adjoining the south end of the present team shed. r Upon motion try Roeder, second by Cook, and all, voting in favor thereof,,President Weeks declared said resolution duly passed and adopted. Alderman Cook introduced the following resolution which was ,r a ad: WHEREAS,the Common Council of the City of Rochester, Minnesota, at a meeting thereof held on October 22nd, 19239 duly passed and adopted a resolution declaring it expedient and necessary that a local public improvement to be paid for by special assessments, levi- ed. as provided by law, be made in said City as follows: That a sanitary sewer be constructed in Fourth Avenue Southwest c rr between the center of Third Street Southwest and a point 100 feet north of the north line of Fourth Street Southwesta WHEREAS, said Common Council in and by said resolution ordered that a public hearing be held at 2 o'clock P.M4 on November 5th,19239 at the Council Chambers, in the City Ball, in said City, and directed If the City Clerk to give notice of said hearing as provided by law, to all persons , interested in the said improvement, and said rresoluti,on was approved and signed i by the Mayor of said City, and, WHEREAS, said City Clerk -did duly and in due time, as ordered publish a notice of the time and place of said public hearing and of the purpose for which the same was to be held, in the Rochester Daily Bulletin, the .official paper of said City, on October 24th, 1923, and, WHEREAS, on November 5th, 19239 at 2 otclock P.M: said Common Council duly met at the Council Chambers, in .said City Halls in said City, and said public hearing was then end there held and all persons interested in the said improve- ment,, who were present, were then and therehheard before said Common Council in relation to- the said improvement; and the said Common Council having duly consider- ed the matter of making.the said improvement, and the reasons and arguments for and against the same and deeming it expedient and necessary that the said improve- ment be made:' e f THEREFORE, Be it resolved by said Common Council: That the aforesaid improvement and the whole thereof be made, and done and the same is hereby ordered to be .made and done and that the whole cost and ex- pense of the said improvement be paid, by special assessments, levied as provided by law,j Be it farther resolved by said Common Council:: That the City Engineer of said City be. ;and he is hereby di.recteu to prepare and file in the office of the City Clerk of said City detailed plans, profiles and specift cations for said improvement as herein. , set forth, and to make and report to said Common Council am estimate of the cost and expense of said improve- t me lit e Tipon motion by Lemmon :second by 'Cook, and all , voting in favor thereof, President Weeks declared said res`olutioh .duly passed and 'adopted. Charles R. Armstrong, City Engineer, submitted plans, profiles, specifica- tions and estimate of cost for the construction of a sanitary server in Fourth Avenue Southwest, between the center of Third Street Southwest and a point 100 feet north of the north line of Fourth Street Southwest, which were considered by the Common Council; said estimate. of cost being a total of $393,051 Alderman Cook introduced the following resolution which was rr ead: WHEREAS, the Common Council of the City of Rochester, Minnesota, at a meet- ing held on November 5th, 19239 after due notice given and hearing had as provided by law,. did pass and adopt a resolution ordering that a sanitary server be con- structed as follows: In Fourth Avenue Southwest between the center of Third Street Southwest and a point 100 feet north of the north line :of Fourth Street Southwest, and in said resolution directed the City Engineer to.prepare and file in the office of the City Clerk of said City detail:dd plans, profiles and specifications for said sanitary sewer, and to make and furnish to said Common Council an estimate of the cost of said sanitary sewer; and said City Engineer on November 5th, 1923s pursu- ant to said direction, did file in the office of said City Clerk detailed plans, pro fil es and specifications for the said sanitary sewer and did report to said Common Council an estimate of the. cost,,and expense of said sanitary sewer; 352 THFiREFORE, Be it and it is hereby resolved by said Common Council: That the plans, profiles and specifications so made and filed by said City Engineer be and the same are hereby adopted as the plans, profiles and specifications according to which said sanitary sewer shall be constructed; and that the estimates of the cost of the said sanitary sewer reported by said City Engineer be filed in the office of the City Clerks Be it further resolved by said. Common Oouncil: That the whole cost and enens`e of constructing said 'sanitary sewer, to -wit: In Fourth, Avenue Southwest between the center of Third Street Southwest and a point 100`feet horth'of the north line of Fourth Street Southwest, all according to .the plans and specificat- ions for the same on file in the office of the City Clerk, shall be assessed upon and against each lot, piece and parcel of land benefit- ed by the said sanitary sewer, to -wit: against each and every lot, piece and parcel of land abutting upon the said sanitary sewer,, with out regard to cash valuation, ratably and in proportion to the spec- ial benefits conferred by said sanitary sewer, respectively, i�pon each said lot, piece and parcel of land. - Be it further resolved by said Common Council: That a meeting of said Common Council will be held at 8 o'clock P.V* on November 19th, 1923, at the Council Chambers, in the City, Hall, in said City, at which meeting all persons' interested in said sanitary sewer may appear and be heard before said Common Council in relation to the said sanitary sewer, or to the mode of the assessment for the cost and expense thereof, or any other matter or objection relating to the said sanitary sewer upon which they may desire to be heard* The City Clerk is hereby ordered and directed to prepare a list which shall contain a description of each and all of the pro- perties abutting upon the said sanitary sewer above described and he nacres of the owners of the said. properties so far as the same! are known, which list, together with a notice of'the time and place of said meeting and hearing above mentioned, he shall cause to be pub- li'shed once in the official paper of said City at least ten days before the date of said meeting and hearing: r Be J.t further resolved by said Common Council: That the City Clerk be and he is hereby ordered and directed to advertise for bids as provided by law, for furnishing all mater- ials and doing all work necessary for the construction of the said sanitary sewer above describedr Said bids shall be received and opened by said Common Counbil at a public meeting thereof to be held at 8 o'clock P.M. on November 19th, 1923s at the Council Chambers, in the City Hall, in said City. Each bid must be accompanied by a ,certified pheck for at least ten per cent of the amount ofthe bid. The right is reserved to reject any and all bids: Upon motion by Cook second by Lemmon, and all voting in favor i. thereof, President Weeks declared said resolution duly passed and adopted Motion by Lemmon second by Kitzman carried that the City Engineer be instructed to secure the necessary labor and materials and instal a 36 inch diameter and 40 ft. long corrugated iron culvert in the roadway near the intersection of Third Avenue Northwest and Thirteenth - - r Street Northwest. The following claims were ready and motion by Lemmon second by Witzke carried that the same be al.'lowed,and that .the Mayor aid City Clerk be instructed to draw -warrants upon the City Treasurer and make payment accordingly: ` From the General Fund: Walter H.
