Minutes,of an adjourned regulq6r meeting of theCommonCouncil of

Motion by Cook second by Kitzman carried -that the minutes.of
the meeting h61d on November 5th, 19234'berapproved.
`'President Meeks' annouf eed that this was' the time anal `place fixed
for a hearing on the construction of a sanitary sewer in Fburth Avenue
Southwest from the center of Third Street Southwest to a point 100 feet
north of the north line of Fburth Street Southwest, and asked if there was
any one present who Wish6d to be heard in any niatter concerning the said
sanitary sewer.
There was no person present who wished -to -be heardat
This'being the time and place fixed'for the opening of bids for
the construction' of the above described sanitary- sewer, the, bid of- elm. Cs
Fraser and Son was'opened and read; said bid being 8" vitrified pipe seder
1.10 per foot; 6" on 8"n Y connections,- $1e0O each; Manholes, $60*00, eac4.;
300se rock excavatilonq $5.00 per cubic yard; sand rock excavation, $3.00
per cubic yard; solid rock excavation, 07.00 per cubic yard; as
concrete pavement replaced, $3,00 per cubic yard.
Alderman Cook introduced a resolution adhering to all former
resolutions in the matter of the above described sanitary sewer, which was
reed.

thereof, President Weeks declared said r-esolution .d.uly passed and adopted.,
The reports of the Milk Inspector for the weeks ending October
20th, October 27th, and, November 3rd, 1923, were each separately read, *and
President ?leeks ordered that the same be placed on file.
The report of the City Treasurer for the month of October, 1923,
showing $273, 241e74 as being on hand, was read, and President Weeks order-
ed that the same be placed on filei
The general balance sheet of the City of Rochester, Minnesota,
as at October 31st, 1923, prepared by the City Clerk, was read, and motion
by Lemmon second by Newhouse carried that the same be accepted and placed
on files
Balance sheet, income statements, etc., of the Public Utility
Department of said City, as at October 31st, 1923s, prepared by the Secret-
ary of the Public Utility Board, were laid before the Common Council and
were considered by them, the said income statement showing a net profit
in
the Electric Department for October,
1923, of
$7650*03,
and
a total
net
profit in the Light Department for
the seven
months of
this
fiscal
I
year of $g2,941,53, and a net profit in the Water Department for the month of October,
1923, of. $2761.04, and a total net profit in the. Water Department for the seven months
of this fiscal year of $229877:60,.
Motion by Lemmon second by. Cook carried that the above.mentioned balance
sheet, income statements, etc., be accepted and placed on file.
The report of the Health Officer for the City Farm for the month of October,
1923s showing receipts in the amount of $1300,749 disbursements in the amount of
$2268.67, and a balance on hand in the amount of $2578.91, was read, and President
Weeks ordered that the same be -placed on file,
The report of the Health ,.Officer for the month of October, 1923, was read,
and President Weeks ordered that the same be.plaoed on files
The report of the, Clerk of the Municipal Court'for the ,week ending.November
12th, . 1923, showing fines collected in the amount of `/+5.00 and civil fees, collected
in the amount of $2,85 ; and the report of the Clerk of the Municipal Court for the
week ending November 19th, 19231 showing fines collected in the amount of $30w009 were
each separately read, and President Weeks ordered that the same be referred to the
City Attorney.

Alderman Cook introduced a resolution accepting the above mentioned bid of
?m. C. Fraser and Son for the construction of a sanitary sewer in Fourth Avenue South-,

west, as above described, and fixing the amount of the bond to be given by said con-
tractor at the sum of p'5000-00, which was read:
Upon motion by Newhouse second by Roeder, and all voting in favor ;thereof,
President ?leeks declared said resolution duly passed and adopted.
The application of Mrs. Edith Brintnall for a taxi license was read, and
motion by Newhouse second by Roeder carried that license be granted.
The application of Maass and McAndrew Company for a license to connect with
sewers and drains was read, and motion by Newhouse second by Witzke carried that
license be granted.
The application of John E. Stanton, as Secretary of the Knights. of Columbus,
for permit to hold, give and .conduct a public dance in the Masonic Temple on November
,
27th, 1923, and the application of the Brotherhood of American Yeomen, by Alfred C.
Giere, for permit to hold, give and conduct a public dance in the Modern Woodmen Hall
on November 28th, 1923, were each separately read.
Motion by Newhouse.second by Lemmon carried th" at the City Clerk be instruct-
ed to order that James Kelly, City Assessor, shall cooperate. with the City Attorney
and the Chief of Police in the enforcement of the local ordinance to provide for the
licensing of transient dealers in goods, wares and merchandise, by assisting them to
get a check on such dealers as have not had their stock of goods tasted in the City of
Rochester, Minnesota, for the currect fiscal year.
The following appointment was read, and motion by Lemmon second by ;Newhouse
carried that the same be approved and placed on file:

The Building and Electrical Inspector submitted a list ' o'f all the
signs and canopies which extend over public stbeets and alleys ' crithin said
City, and motion by'Newhouse second by Roeder carried that the City Clerk
be instructed to check' up the said list and notify each person that they
will be required to secure a permit for the said sign,
The reports of the City Attorney to the effect that he had checked
the reports of the Clerk of the !,_'-ulllc.ipal Court for the weeks ending Octob-
er, 29th, 1923, and November 5th, 1923, and found same to be correct, were
each separately read, , and motion by Newhouse second by Cook carried that
the said .reports of the City Attorney be accepted and' placed on file, and
that the said reports:of the Clerk of the MunicipalF Court be accepted and
placed on file.
The license bond of Maass and McAndrew Company covering license

was .read, and motion by Cook second by Newhouse carried that the said sure-
ties be accepted, and that the said bond be approved and placed on filei
The City Clerk reported that warrant No. • 6138, dated June 20th,
1923, and drawn payable to the order of Wm, E. Cudmore, in the amount of
034.65 for expenses of attending Firemen's Convention at Bemidji, Minnes-
ota, June 12th to 14th, 19239 being railroad fare, $18 15, and board and
room, 2116.50, has been lost by Mr. Cu.dmore, and motion by Lemmon second by
.Newhouse carried that payment be stopped on the said original warrant No.
6138, and that the Mayor and City Clerk be authorized and directed to draw
a duplicate thereof:
The following copy of resolution passed and adopted by the Com-
missioners of the Sinking Fund of the City of Rochester, Minnesota, was
read, and motion by Newhouse second by Roeder carried that the action set
forth therein be approved, and that the said copy of resolution be placed
on file: '

Alderman Newhouse introduced a resolution granting permit to the Brother-
hood of American Ygoman, by Alfred C. Giere, to hold, give and conduct a public dance
in the modern Woodmen Hall on November 28th,.1923,. and fixing the amount of.the fee
at the sum . of $100, which was ready
Upon motion by Cook second by Roeder, and all voting in favor thereof,
President Weeks declared, said. resolution duly passed and .ado,pted..
Alderman Newhouse introduced a resolution granting "Permit to the Knights
of Columbus, by John E. Stanton, to hold, give and conduct a public dance in the
Masonic Temple on November 27th, 1923, and fixing the fee at the sum of 'q�1.00, which

'In your request for an opinion as to paying the L. P. Wolfe bill, and as
to what Rind it should be paid from, would say that the Council have the right to pay
this out of the general fund, but in my opinion the proper place to charge this ex-
pense to would be the Public Utility Fund. I would advise that the same be paid
out of the Public Utility Fundi

intention of the Sinking Fund PCommission to purchase $98, 000.00 of City of Rochester,

ested that the Common Council will approve the sale of the $,65,000.00.
Third 44 Liberty Loan Bonds, now owned by Sinking Fund investments, at
that time at 90.25 and the purchase, with that money and $33,000:00 of r '
Public Utility Funds, of $98,n00t0Q 'of the above described Electric Light
Bonds on a 4.�0 basis; and further that in making these' purchases, the

said bond brokers will at once report 'each purchase they may make or!
option that they may secure, as the Common Council and Sinking Fund
Commission, to protect against a too adverse market, resdrve the right to'
terminate such agreement at and time by instructions given bar `registered
mail, 'and 'of course the taking upon January 1st, 1924, of, such bonds as

Final estimate, prepared by Charles H. Armstrong, City Engineer
in favor of the Purington Paving Brick Company, showing the sum of
$765.76 as being due the 'said contractors for furnishing 31100 brick at
$32.52 per thousand, less $:h 45.62 freight paid on the said brick, was
read, and motion by Lemmon second by Newhouse carried that'

Utility Fund to the Interest Fund of the City of Rochester, same being semi-annual
interest due on Electric Light Bonds Nos. 1 to 650 inc, in the mount of $16,250,00
plus $8.00 exchange charges on bank draft less the amount of 83074.41, which amount
repr.esents.the interest accruals on Sinking Fund Investments less indebtedness of the
Public Utility Fund to the said Sinking hind.'

Alderman Newhouse introduced a resolution levying special assessments for
cleaning privy vaults and removing filthy material and rubbish, which was read.

r ` Motion `by Lemmon second by Cook carried that the ' City Engineer
be authorized and directed to go to the Twin Cities at the expense of

the City 'of Rochester, Minnesota, and purchase the structural steel and
' re-inforcing steel necessary in the construction of the -City Warehouse
addition at the lowest figure -that he can ' secure. -
Motion by Witzke second by Newhouse carried that the City
Engineer be instructed -to grade Thirteenth Street Northeast -sufficient to
outline the street boundaries.
This being the time fixed for final action in the matter of
.•--the local gas rates, motion by Witzke second by Roeder .carried that the
motion passed by this Common Council on September 24th, 1,923, relative

to this matter be and the said motion is hereby in all things adhered to.
