Minutes of an ad journ'ed regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers, An the City Hall, in said City,
on December lath, 'i623, at' 8 o�clobk'P.M
Meeting called to order by President Weeks.
Roll Call: Present: Weeks, 'Cook, Kitzman, Lemmon, Roeder,' Witzke. Absent:

Motion by Witzke second by Cook carried that the minutes of the meeting
held on December 10th9• 1923, be approved,►

President reeks announced that this was the time,.and place fixed for a
hearing on the levying of special assessments for the Bost and expense of the con-
struction of a sanitary sewer in Fourth Avenue Southwest from the•center of Third
Street Southwest to a point 100'.feet north of the north line of Fourth Street South-
west, and on the levying of special assessments for the cost and expense of -the con-
struction of a sanitary sewer in Fourth Street Southeast commencing at the center of
the intersegtion of Fourth Street Southeast and:Thirteenth Avenue Southeast�fand
running thence east along the center ,line of Fourth Street Southeast to a point 400
feet east, and asked if there was any one present who mished.to'be heard in any
matter concerning the said sanit ary•sewers.
D. IT Eaton appeared in the interest of Mrs. A. E. Rogan and Mrs. Nora M.
Rowley, asking that no assessinent be placed , against their property for, the Fourth
Avenue Southwest. sanitary sewer. ,
..Miss Mabel Root was. before the Common,,Council • in the matter of the Fourth
Avenue Southwest sanitary sewer, and stated. that she felt that the assessment for
this sewer should be levied 'pro rate..
There were no other' persons present who wished to be heard in any `matter
concerning the above described sanitary sewers.
Motion by Witzke second by" Lemmon''carried that the usual procedure be
followed in the levying of the `special assessments for .the `above described sanitary
sewers.
F. Lenz, Paul H: Priebe'and Herman Naass, as a Committee from the North
Rochester Better Improvement Association, appeared before the Common Council and Mr.
Lenz and Mr. Priebe asked that arrangements be made qo that Charter amendments known
as Nos. 1 and 3 can be submitted to the voters of this City at the coming Charter
Election., -
Motion by Witzke second ,by Lemmon car. rind that the ' City Attorney be in-
structed totdraft an initiative petition for th'e North Rochester Better Improvement
Association to circulate among the voters of this City, asking the local Charter
Commission to again submit and propose the- Chartet amendments which were known at
the Special Election held on,Decemter 4th,,.1923, aq Amendments Nose 1. and;3.
Alderman Newhouse came in at this time and took his Chair.
The City Clerk reported that there had been,no bids received for the pur-
chase of -the old nine column Burroughs Adding Machine, formerly in use in his office.
Lotion by Lemmon second by Roeder carried that the;sum of
. $6040 be appropriated, from the General Fund of ,said City and paid to the
Burroughs Adding Machine Company, thus cancelling the allowance for the
r old Burroughs Adding Machine toward the new motor.-drivgn adding machine

The application of J. Fe Swenson fora license as milk producer and milk
distributor of raw milk, was read, and motion by Cook second by Lemmon carried that
license be granted°
The applicationsof F. R.�Wilber and F. L, Adler for taxi licenses were each
separately read, and motion by Newhouse second by Cook carried that such licenses be
granted.
The applications of Claude Bogart and Gerald Kennedy for 1924 drivers'
licenses, were each separately read, and motion by Newhouse second by Roeder carried
that such licenses be granted:
The following applications for permits to place and maintain signs were
each separately read, and motion by Newhouse- second by Roeder carried ,that such
permission be granted: A. G. Teske, M. D. Matteson, Cook Cafeteria Company, Ellis
Machine and Auto Company, Roy Masuda for the Grand Cafe, Roy Masuda for,.the Georgia
Cafe, Gabrell Vincent, Graen Cigar and Novelty Store, Joe Van Kraan.en, Case Auto Co.,
and Weber and Judd Company,,
The application of the.Rochester Oil Company for permission to install two
tanks and pumps in the boulevard on the east side of First Avenue Southwest south of
Third Street Southwest for Meredith and Metzerot't's new garage, was read, and motion
by Newhouse second by Lemmon .,carried. that the same be .referred to the Street and
Alley Committee and the -City Engineer for investigation and recommendations in the
matter°, r �
The,,report,,of the Health Officer for the -City Farm for, the month. -,of Nov-
ember,. 1923, showing ,Meceipts in, the mount of $2533,77, disbursements in ,the amount
of J'P1855.10 and a balance on hand in amount...of $3257.58r, was read, and President
Weeks ,ordered that the same be placed on. file,
The bond of Elmer L. Lee., filed covering the proposed appropriation to him
of the 1922, etc.,. tax, collections for the, Firemen's Relief Fund, was read, and
motion by Lemmon second by Newhouse carried that the same be -returned to him with
the information that the City Attorney will not. approve this bond until ,such time as
the following paragraph is stricken out:
"PROVIDED, .'ITOWEVER, That If the City of Rochester, Minnesota shall- hold in
addition to this bond other security or bonds on behalf of said Elmer Lee, Treasurer
of Rochester Fire •r'epartment Relief Association, "ds' protection for the funds derived
from taxes as provided under Chapter 197, General Laws of Minnesota, for the year
1909, in the event of loss or default on the part of Elmer Lee as such Treasurer,

the liability of this surety shall be limited to the amount that this
bond bears to the total amount of suretyship or security furnished to
the City of Rochester by said Elmer Lee, covering such funds."
The report of the Health,-Officer.for the month of November,
1923, was read, and President, Weeks ordered,that the same be placed on
file.

Balance- sheet,., income statements, etc., of the Public Utility
Department for the ending of November, 1923, prepared by the Secretary

Second Street Southwest paving,''at a price of $15.00 per thousand,
and that he also be authorized and directed to transfer 19942 old
paving brick salvaged from Second Street Southwest,' at, a price of
$1500 per one thousand, paving Job No. 613, to -the building for
the protection of'teams and conveyances at the public hitching
