Ty the matter of the interests of the State of Ifinnesota, for / the Rochester_ State Hospital, St. Yar.,y's Yospital, and. the City of ?Rochester, Vinne sot a, in the cost of the nropo sed Sewage Disposal Plant and its future operation, Chas. n. " Dr. A. F. Kilbourne, representing the State Board. of Control, agreed that the State of Minnesota, for the Rochester State Hospital., will assume their part in any arrangement that will be fair and equitable for all parties, to which John A.kEichinger, for St. ITary's Hospital, also agreed. Motion by Newhouse second by Cook carried that the City Engi- neer be. authorized and directed to secure such materials and assistance as 643 he may deem necessary, at a cost not to exceed 01000.00, and make an actual measure- ment of the sewage flow whi. ch ' i s to be handled through the proposed Sewage Disposal Plant, which data shall be for tithe determination of the interests of those concerned in the construction and future operation of the said Sewage. Df sposal = Plant. Motion by Newhouse second by Roeder carried that the sum of $200.00 be appropriated from the General Fund and paid to Frank Webster for lands for right-of- way for Chas. Xurth .road, the `same being pursuant to option given by him. I; r° The report of the Milk Inspector for the week ending Aurmst 23rd, 19249 was read, and President Meeks ordered thit the same be placed on file. T•h-e report of =the Health, Officer for the month of July 1924, was read, and President Weeks ordered that the same be ;placed on file. } The appointmeptAby the Mayor of Julius Mundt, as a Special Patrolman, in the Police Department of said City, for the period August 21st, 1�)24, to August 27th, 19240 inclusive, was read, and President Weeks ordered thAt the same be placed on file. An easement given by Forest J. Bandel and t;ladys E. Bandel, his wife, to the City of Rochester,. Minnesota, covering right-of-way privileges, over their lands for the transmission line of the Hydro Electric Power Plant, was read, and motion by Lemmon second.by Wright carried that the said easement be accepted and placed on reeprd. A bond given by Forest J. Bandel and Gladys E. Bandel, his wife, in the amount of $1200.000 with Joseph R. Bandel and Ernst IT. Reiter, as sureties thereon, each for the said sum, conditioned for a guarantee of the privileges in the above leases was read, and motion by Lemmon second by Cook carried- that the said sureties be accepted and that the said bond be approved and placed on file. A petition signed by A. B. Boliou, J.. A. Yaeger, G. L. Fellows, Arthur L. Carroll, C. Carroll. and J. Hauck, asking that a water main be laid in Second Street Northeast between Eleventh Avenue Northeast and Thirteenth Avenue Northeast, was read, and motion by Cook second by Newhouse carried thatithe said petition be referred to the Water Committee. A petition signed by Anna Dillon and Peter Rasmussen,asking that a combin- ed curb and gutter be constructed on First Place Southeast from the South line of Fourth Street Southeast to the North line of Fifth Street Southeast, and a petition signed by 111illiam �cConnell, C. F. Olson, A. A. Hicks, W. 11% Lawler, Vary Lawler, ';frs. Anna Dillon, ' idland Lumber and Coal Company, Trott D. Campion and Frank Engel, asking that a combined concrete curb and gutter be constructed on Fifth Street Southeast from the hest line of Third Avenue Southeast to the West line of First Place Southeast, were each, separately ,read, and motion by Lemmon second by Cook carried that the same be placed on file. Weeks for a permit to hold, give and conduct a public Glance in the auditorium of the Rochester State 7ospital on September 5th, 1924, was read. 645.. i t 6 Alderman Newhouse introduced a resolution fixing a hearing at 8 o'clock � P.M. on September 8th, 1924, on the proposed construction of combined curb and gutter on Fifth Street Southeast from the Test line of Third Avenue Southeast to the Test line of First Place Southeast, which was read. Upon motion by Cook second by Kitzman that the said resolution be adopted as read, and all. voting in favor thereof, President Weeks declared the said resolution duly passed Pmd adopted.. Upon motion by Wright second by Roeder that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the sa--i d resolu- tion duly passed and adopted. i Alderman Cook introduced a resolution appropriating $2000,00 from the Street i and Alley Fund for use of the. Street .and Alley Committee, which ?!as read. Harwick, Secretary, have presented to the Common Coun- ciI,-of the City of Rochester, Minnessta, a petition s M- ed by more than three -fourths of .the owners of the property in Blo*ek 13 in Head and Me- Mchon's Addition, asking that a part 'of the -alley running North and South across said. Block 13 described - commencing at the Southwest corner of Lot No. 10 in said Block and running thence North along the -West line of Lots Nos. 10, 9 and 8 156,36 feet, .running thence West: 18 feet to the Northeast corner of Trot No. •11, therein, running thence South to the Southeast corner of said Lot No. 11 and running thence East!'18ofeet to the place of beginning be vacated and discontinued, which said petition wads duly and properly signed by'said parties and duly set forth therein the facts and reasons for the vacation of the said part of the said North and South alley in Block 13 in Head and McMahon's Addition and the same bei.hg also accompanied by Flat of the said part of the .said alley asked to be vacated. and `said petition also bean- certified by the oath of relabel V. M* Weeks to hold, give and conduct a public d,anco in the' auditorium of the Rochester State Hospital on September 5th, 19249 and fixing the. fee at the, sun of ia�.00 9 which was read. _ Upon motion by Cook second by Kitzman that the said resolution be adopted as read, and -all voting in favor .thereof, President Weeks declared the said resolu- tion duly: passed and adopted. 'Voti-on by Lemmon second by Newhouse carried .that the certified check of the Northern Construction Company, as the unsuccessful bidder for the Paving and curbing of Ninth Avenue. Southwest between Seventh Street Southwest and. Eighth Street Southwest, be returned to tk=o Motion by. Lemmon second by Wright carried that, because of the loss of the original, the ?Mayor and City Clerk be .authorized -and, directed to draw a dupli- cate of warrant No. 7s98 and stop payment on the original warrant;. the said warrant. having been dated December llth, 19239 and was drawn payable to the order of The Samaritan, in the amount of 05.00. for renta-1 of polling place for the Second District Third Ward, on December 4th, 1923. The City Clerk 'reported that as yet no report for the month of July 1924, has been made by the Justice of the Peace of the First Ward, Justice of the Peace of the Third Ward, . and the City -Justices and motion by Lemnon second by Wright T carried that the matter be referred to the City Attorney. The report of the Finance Committee to the effect .that they had checked the July 1924 report of the City Weighnraster and found the same to be correct, was read, and President Weeks ordered that the said report of the Finance Committee be filed 1-nd that the said report of the City Weighmaster be placed. on file. Petitions signed by a total of 165 qualified voters of the. First State Bank mid Trust Company, he will. take. the $31,136.88 which is in savings ` account and place it in open deposit account; and at the Union National Bank he will take the $180962.4 which is in open deposit 'account and place it in their savings aepount;- and that lie be further authorized and directed that until further. orders the First State Bank and Trust Company will beL the disbursing bank, they to do all of the disbursing and to receive all of the deposits, by which arrangement the warrants drswn;upon the City Treasurer will be cleared through the First State•Bank and Trust Company, thus eliminating the necessity of each bank sending a messenger to the City Treasurer for collection of warrants on the agreed pad merit dates, and .him having to draw. a check to ,each one of the*, so therefore, lihder this arrangement one messenger's service and one check drawn ;by the City Treasurer will suffice for each said payment date. In the discussion relative to the amount of the official bond to be given by the City Treasurer during this official year, the City Clerk 'suggested that all bonds: which. are property of the Sinking Fund of said City be endorsed as such with the instruction that the transfer of title can only be made by the dndorsement of the Sinking Fund Commission and motion by Newhouse second by Cook carried that the City Clerk -be instructed to notify the Sinking Fund Commission that it is the recommendation of this Common Council that all bonds which are the property of the Sinking Fund of said .91ty be placed before that said Commission for endorsement as follows:- This bond is the property of the Sinking ,Fund of the City of Rochester, Minnesota, and is transferable only by_ endorsement of the Sinking Fund Commission of said City. r 652
