' President Weeks announced that, this was the time and place fix- ed for a hearing on the•proposed,construction,of a concrete curb and utter a on and the grading of Fifth Avenue Southeast, .from Sixth Street Southeast to Tenth Street Southeast, and,asked if there was any one present who wished to be heard in the matter. There was no one present rTho wished to be heard.. 0 President Weeks announced that this was the time and place fix- ed for a hearing do the proposed construction of a concrete curb and gutter on and the grading of Fourth Avenue.Southwest ffom Fourth Street Southwest to Sixth Street•.�Southwest, and asked if there was any one present whowished to be heard in regard to the said curb and gutter and grading. There was no. person present who 'wished to be heard. The report of the Milk Inspector -for the week ending September 13th, 1924, was read, and.President Weeks ordered that the same be placed on file. B. Clausen asked for $50.00 as damages to his property through the clogging of the First Avenue Southwest .sanitary sewer from the Nelson • Motor Sales Company and the Joy Brothers Garages running the water, sand, mud, etc., from their wash racks into the sanitary sewer. 14otion by Lemmon second by Wright carried that the City Attot- ney be instructed to draft an ordinance amendment prohibiting the running of .water, sand, mud, etc., from automobile wash racks into' the sanitary sewer system and that he shall have the same reedy for the action of this Common Council at the meeting thereof which is to be held on September 29th, 19240i Motion by Wright second by Cook carried that the 050,00 claim of Mr. Clausen, above mentioned, be referred to the, Sewer Committee for their consideration and recommendation. The report of the Health Officer for the month of August 1024, was read, and President Weeks ordered that the same be placed on file.. t The report of the Clerk of the Municipal Court for the week ending September 1st, 1924, showing fines collected in the amount of $128.009 and civil fees collected in the amount of $62.600, and the report of the Clerk of the Yunicipal Court for the week ending September 8th, 1924, showing Rr-r re _'1 673* fines collected in the amount of $117 00 and IIivil fees. collected in the amount of 25• cents, - were each separately read, and President Weeks referred the same to the City Attorney. - • The application: of Frank Kuzel for a license •as Milk Producer of raw milk was r. ead, ..and motion by: Kitzman speopd by Cook carried that license be granted. The petition of Hermf(n Thiem,' .G. ;i. Olson,. V.'S.. Rahm, August H. Anderson, L. 1D. Filson, C. M. Ho.rtoh, Corwin Stoppel and Peter Svendsen that a street light be installed at the intersection of Second Street Southeast and Ninth avenue Sotith- east, was read, and motion by Lemmon second by Kitzman carried that the said petition be referred to the Lighting Committee for their investigation and recommend4tion. The dffieial bond of Mrs. Waterman W. Hendticks, $s Social :Welfare Worker, vrith the Fidelity and Casualty. Company of New York as surety thereon, in the amount of .' 500.00, was read, and motion by Lemmon second by Cook carried that the said surety be accepted and that the said bond be approved and placed on file, condition- ed, however, that the notarialseal of the Notary who took the affidavit of the Attorney for the said Company be placed upon the said bond. The appointment by the Mayor of Julius ?Mundt,as a Special Patrolman in the Police Ddpartment of said City for the period September ll.th, 1924, to September lath, 1924, was read, and President Weeks ordered that the same*be placed on file. The appointment `by A.. F. Wright, City Clerk, of P. J. Scanlan, as Deputy City Clerk, for the period September lath, 19240 to September 27th, 1924, inclusive, read, and motion by Lemmon second by Roeder carried that the: said appointment be approved and placed on -file, The following communication was read, and motion by Lemmon second by Kitzman carried that the same be placed on file: " STATE OF 1(TNNESOTA, Board of Registration, For Architects, Engineers,.?:rand Land Surveyors. Dear Sir: The State Board of Registration for Architects, Engineers, and Land Surveyors is desirous of calling the attention of the various municipalities throughout the state to the Registration Law, and we are sending you, under separate cover, a copy of the annual report of the Board to the Governor of the st lat e, which contains a reprint of the act. Banks, Resident Agent, C.N.W.Ry., Rochester, Minnesota: Dear Sir: . With reference to.your bill #306590, amount $48 00, beg to advise you that in the purchase of the Road. Oil from the Standard Oil Co., the said company furnishes to the City -of Rochester five days flee time in the unloading of all cars. I note by your bill that we are alloclred three days free time, while on the 16th with a rainy day* also the 22nd, -23rd. and 25th, according to our reckoning with' the five days free time, two Sundays and four rainy days, we should be allowed 11 days on -the car, but whether this is ri �ht or not, we have the billing from the St andard0011 Co. charging us demurrage for ten days at 01,50 per day on Union Trunl� Line Car #3186. This is probably the company's charge on their own equipment. I wish you would take the matter up with .the . Stand.ard Oil Eo6 direct as we are expecting to pay the Standard Oil Co. as per their terms of our contract with them. Any further information you may desire will be gladly given. The application of the Rochester Theatre Trust Estate for Permit to place and maintain a sign at No. 5.Broadway Street South, was read, and -motion by Kitzman second by Wright carried that the license be granted.. rM010n by Lemmon second by Kitzman carried that the City Treas- urer be instructed to place 20 cents of Permanent Improvement deposit funds into savings account.in order that all Library Addition funds -may be in sav- ings account. Motion by Lemmon second by Newhouse carried that under and in . accordance with Section 263 of the Charter of the , City o.f Rochester, Minne- sota, the City Clerk and City Engineer shall be the committee for the making of the sprinkfing assessments for the season ofthe year 1924. Motion. by Lemmon' second:.by Wright carried that the sum of $800.00 on the motor.driven power Plusher and sprinkler, $200000 on the horse drawn sprinkling w48ons, $10.00 on the water meter on the said power flusher and sprinkler and .$7.00 +on sprinkling equipment added during 19249 be added to the sprinkling costs- for the season of the year 1924, as depreciationdur— ing that period and that the same be ' credited to the depreciation reserve 675 for sprinkling equipment - The proposed contract between the Rochester ?Milling Company and the City of Rochester, Minnesota, 'relative''to the purchase of their .properties in the North Part of the .City was presented by the City Attorney who requested that the Common Council place their a on it pproval�ui� order that the Public Utility Board. may take further action, - at which motion by 'Roeder second by Newhouse that, the said contract be -approved by this gommon Council lost by the following vote: Ayes: Newhouse, Roeder, Nays: Cook, Kitzman, Lemmon, Wright. A petition signed by Leo C. DeVilliers, W. A. Ifoore, Albert ?.Biller, Oscar A. Maass, William Schellin, C. 'H. ,Priggej and F. H. Mosses asking that Eighth Avenue Northwest be graded to an established grade between the North lifte of Second Street Northwest and the bridge across Cascade Creek, was read, and motion by Lemmon second by.Roeder carried that the said petition be' placed on file and that resolution fixing the first hearing on the said improvement be drafted for action of this Common Council at the next.. meeting thereof. Alderman Newhouse introduced a resolution ordering plans, profiles, spec- s •. ifications, etc., for the' construction of .concrete curb and gutter on and the grading of Fourth Avenue Southwest from the South line of Fourth Street Southwest to the North line of Sixth Street Southwest, which was read. Upon motion by Cook second by Wright that the said .resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolu- tion duly passed and adopted. Alderman Cook introduced a. resolution ordering plans, profiles, specifica- tions, etc., for the construction of concrete curb and, gutter on and the grading of Fifth Avenue -'Southeast, from the South line of Sixth Street Southeast, to the North line of Tenth Street Southeast, witch was read. Upon.motion by Roeder seoond by Wright that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolm- tion duly passed and adopted. Chas. fi . Armstrong, City Engineer, submitted plans, profiles, sp e ci fi c at i o z s and estimates of cost for the above described proposed improvement in Fourth Avenue Southwest, and -Fifth A' venue Southeast, which were considered by the Common Council, the said estimate of cost for thttimprovement of Fourth Avenue Southwest being $1277.00, and the said estimate of cost for .the improvement on Fifth Avenue Southeast being $5208.97. Alderman Kitzman introduced a resolution adopting the above mentioned plans. 66 profiles, Band specifications for the proposed imprqvement in Fifth Avenue Southeast and ordering them and the estimate of -cost. placed on file, order- ing a notice to the .property owners .concerned and ordering advertisements for bids to be opened at 8 o'clock P.M., September 29th, 1924, which was read. Upon motion by Newhouse second by Cook that the said resolution be adopted: as read, and all voting in favor thereof, . President Weeks declar- ed the said resolution duly passed and adopted.. Alderman Lemmon introduced a resolution adopting; .the above mentioned plans, profiles and specifications for,the proposed improvement in Fourth Avenue Southeast and ordering them and. the said estimate of cost placed on file,- ordering; a notice to 'the property owners concerned and ordering advertisement for bids to be opened at 3 o'clock Pelf. September 29th, 1924., which was read. Upon motion by Cook second by, Kitzman that the said resolvtion be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Roeder introduced a resolution fixing October 6th, 1924, at 2 o'clock P.M., as the time, for the levying of -special assessments for the construction of a sanitary sewer in the South side of Seventh Street Southwest from a point seven and one-half (72-) ft. West of'the Northmest cor- ner ipr Lot 106, in Belmont Addition, to a point 200 ft. East *of the East Line of Belmont Addition, which was read. Upon motion by Lemmon second by Cook that the said resc].ution be adopted as read, and all voting in favor thereof, President. Weeks declared the said resolution duly passed and'adopted. Alderman Wright introduced a resolution levying special assess- ments for the cost and expense of making lateral, connections with eater and sewer mains during the year 1924, which was read. Upon motion by Wright second by Roeder that the said resolu- tion be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Wright introduced a resolution': appropriating $423.09_ from the Street and Alley Fund and ordering payment made to the D6dge liu-niber and Fuel Company for 540 sacks of cement $378;00, $1.69 for lumber for Job 402 and 043.40 for lumber for Street and Alley equipment, r7hich was read. Upon motion by Lemmon.second by Wright that the said resolution �I be adopted as read, and. all voting in. favor thereof, President Weeks declared the said resolution duly passed and adopted. S. Witherstine, under date of September 1.3th, 19240 erhich was read: Upon motion.by'Cook second by Newhouse that the said resolution be adopted as read, and all voting -in favor thereof, President Weeks declared the said resolu- tion duly passed and adopted., Alderman Newhouse introduced a resolution appropriating $-745.541from the Permanent Improvement Revolving Fund and MIQ'$ayment made to the Public Utility blind being for materials used in the making of lateral connections for Jobs 745, 746, 748 and 751 to 779, inclusive, in accordance with their sworn billing and the City Clerk's distribution to jobs of the ' said materihls, which was read. Upon.motion by Lemmon second by Roeder that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared. the said resolu- tion duly passed and adopted. Hanson representing the local .baseball club Were before the Common Council and asked for refundment of the $10.00• fee per game which the Park Board has been charging the baseball club for use of Mayo Field, and motion by Lemmon second by Newhouse. carried that the City Clerk be instructed to refer their petition to the Park Board for their consideration. and disposal.
