Poll Call: Present: VGeeks, Cook, Kitzman, Lemmon, Newhouse,

Alderman Roeder came in at this time and took his Chair.
Motion by Newhouse second by. Coak carried that Irving L.
Eckholdt be appointed City Attorney Pro 'Tem, during the absence .of Thdmas
Fraser, City rttorney.
President Weeks'announced that this was the time and place
fixed for a hearing on the proposed vacation of Third Street Southeast between
the East line of Third. avenue Southeast and the' right bank of the Zumbro
River, and asked if there was anyone present who wished to be heard in any
matter concerning the vacation of the said part of Third Street Southeast.
There was ho person present who wished to be heard.
f President Weeks announced that this was the time' and place fix-
�Ied for the levying of special assessments for the construction of a. sanitary
sewer commencing, at point on the center line of Fourteenth Avenue South-
West a
west 73 ft. South.of.the,North line of Sixth .Street Southwest and running
Southerly along the center line of.Fburteenth Avenue Southwest to a point
9 fts South of the'North line of Seventh Street Southwest, thence Easterly
along a line parallel to and 9 ft..South of the North line of Seventh Street
Southwest to a point 230 ft. best of the West line of Head and McMahon's
Addition and asked`if there was any person present who wished to be heard

Belmont Addition and asked if there was any one present who wished to be

President Weeks announced that this was.the time and place
fixed for an adjourned and continued hearing and action on the proposed
j construction of a sanitary sewer in Third Avenue Southwest, commencing at
the manhole in the South side of the Sewage Lift Station and running to a
point 93 ft. South of the South line of Sixth Street Southwest, and asked if

Motion by Lemmon second by Newhouse caftied that further hearing and
action on the said proposed' sanitary sewer be -adjourned emd continued to October,

To the Common Council of the City of Rochester., in the state of Ifinnesota
Take notice that on the 18th.day of September, A. D. 1924, Gordon Baddgor,
a son of the' undersigned, was killed by coming in contact --,with a chain charged with E
high electric cur-ent and attaehed to an electric light Bole belonging to the City
of Rochester..
The accident occurred in the city of Rochester in the evening of the 18th
day of September, A. -T)..-1924, :at an electric light . ;dole belonging to the city of
Rochester which stands on the north side of Seventh Place South East in the city of
Rochester, and which is the second electric light pole standing on the north side
of said Seventh Place South East and west of the sidewalk on the west side of Third
kvenue South East, in said city of Rochester,
The said Gordon Baddggr and other children were playing near the said
electric light pole when the said Gordon Baddgor ran up to said electric light- pole
and touched it and the chain thereto attached with his hand and was instantly killed
by an electric current passing through his body from said chain.
The undersigned who- are his next of :tin claim compensation from the city
of Rochester in the sum of 07500 because the said city of Rochester carelessly and
hegli -ently maintained said electric light pole and chain in a dangerous condition
and thereby unlawfully caused the death=of the said Gordon Baddgord

Alderman Kitzman.introdueed a resolution granting permit to the '.ferry j
