Coop announeed.that this was the time and place fixed for a heating on the grading of Eighth Avenue.Northwest from the North line of Second Street Northwest to the Bridge across Cascade Creek,and asked if there was any person present who rushed 'to be heard. grading. There was no Person present who wished to be heard relative to the said President Pro Tem. Cook announced that this was the time and place for a continued hearing and adjourned action on the construction of a sanitary sewer in Third Avenue Southwest from the manhole in the South side of the Sewage Lift Station to a point 93 feet South of the South line of Sixtb Street Southwest, and asked if there was any person present who wished to be heard relative to the said sanitary sewer. There was no person present who wished to be heard. Motion by Roeder second by Newhouse carried that the hearing be continued and the action ad joDrned on the above described. sanitary sewer to November loth, 1924, at 8 o'clock P.M. Upon motion by Newhouse second by Kit$man carried that the above mentioned bids be each referred to the City Engineer for tabulation_ and recommendation in the matter. The City Clerk reported that there were no bids received for the grading of Eighth Avenue Northwest as above described. was read: Alderman Newhouse introduced the following resolution which "Be it resolved by the Common Council of the City of Rochester, Minnesota: That all previous resolutions adopted by this Common Council in the proceedings relative to the grading of Eighth Avenue Northwest from the Notth line of Second Street Northwest to the bridge aeress Cascade Creek be and each of said resolutions are hereby fully adhered to. " Upon motion by Roeder second by Wright that the said resolution be adopted as read, and all voting in favor thereof, President Pro Tem Cook declared the said resolution duly passed and adopted. The report of the Clerk of the Municipal Court for the week ending October 27th, 1924, showing fines collected in the amount of $55.00, civil fees collected in the amount of $7.00, and Olmsted County fees for the month of September 19249 collected in the amount of $47.45, was read, and President Pro Tem Cook referred the said report to the City attorney. The report, of the Building and Electrical Inspector for the month of October 19240 showing building inspection fees c;:>llected in the amount of $61.00, and electrical inspection fees collected in the amount of $14.25, was read, and President Pro Tem Cook referred the same to the Finance Committee. . The reports of the Milk Inspector for the weeks ending October 757 25th, 19249 and November lots 19241, were each separately read, and President Pro Tem. Cook ordered that the same be placed on file. The appointments by the Mayor of Julius Mundt, as a Special Patrolman in the t Police Department for the period October 30th, 1924, to November 5th, 192-4, inclusive, and of E. G. Larson, ac a Special Patrolman in the Police Department for the same Period, were each separately read, and President Bro Tem Cook ordered that the same be placed on file. The application of Mabel Ulrich, Book and Print Shop, for license to place and maintain a sign on No. 21 First Alrenue Southwest, was .read, and motion by Kitz- man second by Roeder carried that permit be granted. ' Motion by Lemmon second by Wright carried that the sum of $13.40 be appro- priated from the General Fund and paid to the General Fund for the 1924 tsprinkling and flushing costs for the City Hall property. Motion by Newhouse second by Kitzman carried that the sum of $12.01 be appro- priated from the Gdneral Rand, and paid to the General Fund for the 1924 sprinkling and flushing costs around the National Guard Armory and the sum of 111079 be also apprdpriated from the General Fund for the 1924 sprinkling and flushing costs around the local Post- Office. Motion by Lemmon second by Wright carried that the sum of $143.74 be appro- priated frdm the Park Improvement Fhand and paid to the General Fund for the 1924 sprinkling anci flushing costs around local parks. The fdllowing reportr made by the City Engineer relative to the above mention- ed bids an surface drainage sewer, 'ryas read, and motion by Lemmor_ second by Kitzman car^ied that the same be placed on file: " November 3, 1924, Hon. Mayor and ftmmon Council. Gentlemen: I very respectfully report that William C. Fraser and Son are low bidders for the construction of surface drainage sewer in Fourth Street and parts of Fifth Avenue Northwest. The estimate of cost filed with the plan was $1597,70, r:fr. Fraser's bid is $1323.759 which is $263.95 below the estimated cost. T very much desire that this work be done by.day labor,, if you secs fit to allow it as at this time of year it is necessary to begin to l-ay off some of the laboring men. Ellis Giere and Lee Hargesheimer for the Order of DeMolay for permit to hold, give and conduct a public dance in the Masonic RMS Temple on November llth, 1924, was read, as/ also the application of C. Sawyer for the Girls' Get, Together, for permit to hold, give and conduct a public dance in the 7. 758 National Guard .lLrmory on November 7th, 1924, Alderman Kitzman ,introduced a resolution granting permit to the Order of the DeVolay to hold, give and conduct a public dance in the rAasonic Temple on November llth, 1924, and fixing the fee at the sum of $1�00# which was read. Upon motion by Lemmon second by K_itzman that the said resolu- tion be adopted as read, and all voting in favor thereof, President Pro Tem Cook declared the said resolution duly passed and adopted. Alderman .Kitzman introduced a resolution granting permit to the Girls' Get Together to hold, give and conduct a public dance in the National Guard Armory on November 7th, 19241, and fixing the fee at the sum of $1.00, which was read. D ear Sir: The legislative ccmmaittee of the League is now preparing its agenda for the legislative conference which will be held in St. Paul, early in January 1925; At this time legislation affecting cities and villages of this state will be considered. Upon re- ceipt they will be recorded and forwarded immediately to the legislative com- mittee, -'for consideration: The legislative policy of the League has beenwell stated by the chairman of the legislative committee, Mr. Charles F. Hall, City Attorney, of Red Wing, and. former president of the League, as follows: " At the outset M1 759 let it be said that the League, is not interested in any question as a political or party matter, but solely insofar as such question may concern municipal welfare, Nor does the League intend to act upon all proposed legislation. The League is ndt at the disposal of any advocate of any measure, except insofar as " such measure affects directly the interests of the cities and villages of the state. " Alderman Newhouse introduced a resolution accepting the abovd mentioned of hid of Wm. C. Fraser and Son, for the eonstrudtion/a surface drainage sewer in parts of Fourth Street Northwest and Fifth Avenue Northwest and fixing the amount of the bond to be given by the said contractor at the sum of $1323.75, which was read. Upon motion by Newhouse second by Roeder that.the said resolution be adopted as read, and all voting in favor thereof, President Pro Tern Cook declared the said resolution duly passed and adopted. Motion by Lemmon second by Wright carried that, the certified checks of the unsuccessful bidders on the said surface drainage sewer be each returned to them. Walter H. Newsome, Chief of Police, submitted $212.00 for acceptance into the City Treasury, with the information that $46.25 of the same was rewards received by the Police B'+epartment, and that the balance of it was profit on the sale of temporary auto license..tags,and motion by Lemmon second by Kitoman carried that the said sum be accepted in .the General Fund of said City. The following communication was read, and motion by Roeder second by Wright carried that the Mayor be requested to appear At the next meeting of the Public Utility Board in an attempt to adjust matters between the Public Utility Board and the Building and Electrical Inspector: To the Public Utility Board of the City of Rochester, Minn. Gentlemen: PLEASE TAKE NOTICE That the Utility Board should obtain a permit and comply with the building ordinance of the City of Rochester in the con- struction of the water tower being built in the Ctty of Rochester in Head and 1,16 iahon's Addition, Block 41, which ymu are constructing on the west one hundred feet (100) of the south one hundred feet (100) of said blocky This should be done in the orderly way, and if there is a dispute over the license fee, you should take it up with the City Council and arrange for the matter in deciding who should pay it. You will please take steps within the next .five days to see that this request is complied with and that your. building permit is obtained and put on .record with the Building Inspector.. City of Rochester, City Attention: A. F. Wright, City Clerk. Dear Sir: T thought we had. this bill all settled and agreed to, the last time T talked to Armstrong in our building, that it was undoubtedly no fault of otirg that the segver was blocked. Kindly take this up with Mr. Armstrong and T think that after the last investigation he concluded that the sewer was blocked by the Packard Motor Car Company and not ourselves. We object to this bill because it is riot equitable.* We .feel that it is unfair of Mr. Armstrong for our conversation inferred 'as much' several weeks ago. Yours very truly, J. 0. " The report of the Water Committee recommebding that a water main be laid in Eleventh Street Southeast from Eighth Avenue Southeast to Seventh Avenue Southeast, was read, and motion by Kitzman second by Roeder carried that the same be placed on file. Alderman Newhouse introduced a .resolution authorizing and directing the Public Utility Board to lay a water main in Eleventh Street Southeast from Eighth Avenue Southeast to Seventh Avenue Southeast, which was read. Upon motion by Newhouse second by Wright that the said resolu- Lion be adopted as read, and all voting in favor thereof, President Pro �Vem Cook declared the said resolution duly passed and adopted. The report of the Finance Committee to the effect that they had checked the October 1924 report of the Building and Electrical Tnspector and found the sane to be correct, was read, and motion by Kitzman second by Newhouse carried that the said report of the Finance Committee be placed on file and that the said report of the Building and Electrical Tnspector be ' placed on file. Alderman Kikzman introduced a resolution appropriating .2000,00 from the Street, and Alley Fund for use of the Street and Alley Committeep which was read. Upon motion by Roeder second by Newhouse that the said resolu- tion be adopted as read, and all voting in favor thereof, President Pro Tem. Cook declared the said resolution duly passed and adopted. Alderman Roeder introduced a resolution appropriating $11,595..0o from the Permaneht Tmprovement Revolving Fund and ordering payment made to 761 the, Merchants Trust & Savings Bank of St. Paul, Minnesota, for the payment of prin- cipal on Permanent Improvement Revolving Fund Bonds due December 1st, 1.924, and num- bered 364 to 173, inclusive, $109000.001, and for the payment of interest due Fecember Ist, 1924, on,Perm.9nent Improvement Revolving Fund Bonds numbers 164 to 206, inclu- sive; numbers 209 to 213, inclusive, and numbers 214 to 223 inclusive, $1595.001, which was read.. t upon motion by Kitzman second by Newhouse that the said resolution be adopt- ed as read, and all, voting• in favor thereof, � President- Pro Tem Cook. declared the said resolution duly passed and edopted. .. . Aldermen 'Fright,introduced a reolution appropriating $801.74 from the Mayo Trust Fund for pay rolls for labor for the period for the creeks ending October loth, 1924 to October 31st, 19249 inclusive, in accordance with sworn billing made by William Emke, Secretary of the Park Board, under date of November 3rd, '924, which Was read* Upon motion by Wright second by Roeder that the said resolution be adopted as•read, and all voting in favor thereof, President Pro Tem Cook declared the said resolution dilly passed and adopted. The following communication was read, Roeder carried that the same be placed on file: and motion by Newhouse second by " Be it andit is hereby .resolved by the Public Utility Board of the City of Rochester, Minnesota, that the Hon. Common Council of the said City be and is hereby asked to authorize the said Public Utility Board to enter into contract with C. Schwartz and Company for the furnishing of all the labor, tools and materials necessary for the complete construction of a Concrete Dam and Head Works on the sight of the present Rochester Billing Company Lower Dam for a consideration of NINE THOUSAND SEVEN HUNr)RED DOLLARS ($9700.00); said dam to be built in complete accordance with the plans and specifications therefore on file in the office of the said Public Utility Board; said G. " Motion by Newhouse second by Lemmon carried that the Chair appoint a Committee of three to confer with Otto We Riess, relative to the purchase of lands owned by him rota a part of the site for the purposed Sew- age Disposal Plant,and President Pro Tem Cook accordingly appointed the City Engineer, Aldermen Wright and Lemmon as members.of the said Qommittee. Motion -by Lemmon second by Wright carried ti:at the matter of the validity of the local Gas Company's frenehise, be referred to the City Attorney for his investigation and report to this Common Council.
