City, on November loth, 1924, at 8 o'clock P.M. President Weeks being absent on account of the illness of himself, motion by Kitzman second by Wright carried that Plderman Cook act as President Pro Tem, and Alderman Cook accordingly took the Chair as such. President Pro Tem Cook called the meeting to order. Roll Callv Present: Cook, Kitzman, Lemmon, Newhouse, Roeder, Wright. .AAD,sent: Weeks. r Motion by Roeder second by Newhouse carried that the minutes of the meeting held on November 3rd, 1924, be approved. President Pro Tem Cook announced that this was the time and place fixed for a continued hearing and adjourned action on the proposed construction of a sanitary sewer in Third Avenue Southwest, commencing at the manhole in the South side of the Sewage Lift Station, and running to a point 93 feet South of the South line of Sixth Street Southwest, and asked if there was any person present whd wished to be heard relative to the said proposed sanitary sewer. There was no person present who wished to be heard upon any matter concern- ing; the said sanitary sewer, and motion by Lemmon second by Newhouse carried that the hearing be continued to and the action adjourned to November 28th, 19249 at 8 o'eloelj� P.M. and that in the meantime the City Engineer and the City Attorney shall attempt to secure a Right -of -Way easement from the owners of the private property through which this sanitary sewer will be constructed. The general balance sheet of the City of Rochester, Minnesota,as at October 31st, 1924, prepared by the City Clerk, was laid before the Common Council, and mo- tion by Newhouse second by Wright carried that the same be accepted and placed on file. The balance sheet, income statements, etc., of the Public Utility Department as at October 31st, 192419 prepared by the Secretary of th'- Public Utility Board, were laid before the Common Council and motion by Lemmon second by Roeder carried that the same be placed on file, said income statements -showing a net profit in the Light Department for the month .of .October 1924, of $12,683.78, and a total net profit in the Light Department for the seven months of this fiscal ,year of $659773.379 and a net profit in the Water Department for the month of October 1924, of $2008.03, and a total net profit in the Water Department for the seven months of this fiscal year of $179795:124 The report of the City Weighmaster for the month of October 1924, showing fees collected in the mount of $51.20, was read, and motion by Kitzman second by Wright carried that the said report be referred to the Finance Committee. The report of the City Treasurer for the month of Octoberl9249 showing $2919620.719 as being on hand, was read, and President Pro Tem Cook ordered that 764 the same be placed on file. The report of the Clerk of the Municipal. Court for the week ending November 3rd, 1924, showing fines collected in the amount of $110,059 and civil fees received in the amount of $fi6.35, and the report of the Clerk of the Municipal Court for the 'i^eek ending November 10th, 1924, showing fines collected in the amount of $832.00, and civil fees received in the amount of $$2.60, were each separately read, and President Pro Tem Cook ordered that the same be referred to the City Attorney. The report of the wealth Officer for the City Farm for the month of October 19249 showing receipts in the amount of $1409.11, and dis- bursements in the amount of $4278,60, and a balance on hand in the .amount of $5607.11, was read, and President Pro Tem Cook ordered that the same be placed on file, , The report of- the City Engineer for the month of October,192-4t showing expenditures for labor from the General Fund of $395.80, from the Street and Alley.!�Vnd of $3568.041 From the Sewer Fund of $105.859 from the Permanent Tmprovenent.Revolving Fund of $546.80 and from the Permanent Sm- provement Fiend of $57.000 was read, and motion by Newhouse second by Wright carried that the same be referred to the Street and Alley Committee. The report of the Milk T.nspector for the creek ending November 8th, 19249 was read, and President Pro Tem Cook ordered that the same be plac- ed on file. The application of Mike Pierce for license as producer of cream, was read, and motion by Kitzman second by Newhouse carried that license be granted. The application of E. Root for permit to place and maintain a sign on the building known as 114-gl Broadway Street. South, was read, and motion by Kitzman second by Roeder carried that the said permit be granted. The following applications for permits to hold,. give and con- duct public dances, were each separately read: Harold Cooke, at the Woodman Hall, November 15th, 22nd, and 29th, 1924. The Fi fty- Fifty Club,- at the A. 0. U. W. Halls every second and fourth Wednesday in each month hereafter:: -Until April Ist, 1925. Halcyon Chapter, No. 8, R. A. If., at the Masonic Temple, November. 28th, 1924. The Verry 'Rakers' Club, at the Woodman Hall, November I,lth, and 18th, 1924. To the Honorable Council: Gentlemen: I am given to understand that many ob jeetions are be Ong made to the site proposed for a new`City Hall and Auditorium near the Great Western Station, on the ground that the noise of switching trains would be detrimental to the project as an Auditorium, and that it would be necessary - to cross the tracks which are often obstructed by trains, ordinance to the contrary notwithstanding, in order to get to the building. r. 766 T offer to the city, the Teapot Tavern, a beautiful plot of ground, ..:comvrts- ing nearly a quarter of a block, which is in the exact geographic center of Rochester, and is but half a block from the Court House, which is a factor of considerable importance. And another matter to be considered is that the property is situated on a quiet street#. T am told by a prominent architect that while the buildings on this place are of considerable value, much of tb t'ne material could be utilized in new construction. Chase To Granger. " The recommendation of the Water Committee that a water main be laid in Tenth Street Southeast from Eig-.hth Avenue Southeast to Ninth Avenue Southeast, and in Ninth Avenue Southeast from Tenth Street Southeast to Eleventh Street Southeast and in Tenth Place Southeast from Ninth Avenue Southeast to a point 175 feet. West of the Vest line of Lot 34 in Auditor's Plat "A", and in Eleventh Street Southeast from Ninth Avenue Southeast to a point 175 feet West of the West line of Lot 34 in Auditor's Plat "A"'; was read, and motion by Lemmon second by Wright carried that the same be placed on file. . Alderman Kitzman introduced a resolution granting permit to Harold Cooke, to hold, give and. conduct public dances in the Woodman Hall on November 15th, 22nd, and ?9tji, 19249 and fixing the fee at the total sum of I'W15.009, which was read.. Upon motion by Leis mon second by Roeder that the said resolu- tion be adopted as read, , and all voting in favor. thereof, President Pro Tem Cook declared the said,resolution duly passed and adopted. -Alderman Kitzman introduced a resolution granting permit to the TTaI cyon Chapter, No. S. Hall, on November 12th and 26th, 1924, and fixing the fee at the total sum of 9''.00, which was read. Upon motion by Roeder second by Newhouse that the said resolu- tton be adopted as read, and all voting in favor. thereof, President Pro Tem Cook declared the said .resolution duly passed and adopted. 4lde4man Kitzman introduced a resolution granting permit to the 'Merry Maker's Club to hold, give and conduct public dances in the Woodman Hall on November llth, and 18th, 1924, and fixing the fee at the total sum of $10,00, which was .read.. A, lderman Newhouse introduced a resolution authorizing and directing* the Public. Utility Board of said City to lay a water main in Tenth Street Southeast from Ei,hth Avenue Southeast to Ninth Avenue Southeast, and in Ninth Avenub Southeast from Tenth Street Southeast to Eleventh Street Southeast, and in Tenth Place South- east from Ninth Avenue Southeast to a point 175 feet West of the West line of Lot 34 in Auditor's Plat "A", and in Eleventh Street Southeast from Ninth Avenue Southeast to a point 175 feet West of the ;Test line of Lot 34 in Auditor's Plat wA", which was .read. Crawford, Architect, in favor of Hugo Schroeder, on contract for construction of public comfort station in Mayo•,Park showing the sum of $2009,60 as being due to said contractor, was read, and motion by Lemmon second by Kitzman carried that the said estimate be placed on file. Alderman Newhouse introduced a resolution appropriating fl200A.60 from the Fermanent improvement Fund and ordering payment made to Hugo Schroeder, for final estimate on contract for construction of public comfort station in Mayo Park, which was read. Upon motion. by Newhouse second by Roeder that the said resolution be adopted as read, and all voting in favor thereof, President Pro Tem Cook deolared the seid resolution duly passed and adopted. Alderman Lemmon introduced a .resolution appropriating $1015.89 to the Bulletin Publishing Company for official printing and publications, in accordance with sworn billing made by Glenn S. Witherstine, under date of November 1st, 1924, which was read. Upon motion by Wright second by Roeder that the said resolution be adopted as read, and all voting.in favor thereof, President Pro Tem Cook declared the said resolution duly passed and adopted. Alderman Wright introduced a resolution' appropriating $295.63 from the Street and Alley Fund and ordering payment made to the Dodge Lumber and Fuel Company for 420 sacks of cement and lumber and battens, in. accordance with sworn billing made by Alice M. Dodge under date of November 3rd, 1924, which was read. 1T.gon motion by Roeder second by Newhouse that, the said resolution be adopted as read, and all voting in favor thereof, President Pro Tem Cook declared the said resolution duly passed end adopted. Chas. H. Armstrong, City Engineer, submitted plans, profiles, specifications and estimate of cost for the construction of a sanitary sewer in parts of Fburth Street Northeast and Second Avenue Northeast, which were considered by the Common 768 Council; the said estimate of cost being a total of 85008.00, Alderman Roeder introduced the following resolution, which was read: "WHEREAS, The Common Council of the City o f Ro the st er, Minnesota at a meeting thereof duly held on August 4th3, 1924, after due notice given and hearing had as provided by law, did duly pass and adopt a resolution ordering that the following sanitary sewer be constructed in the following named streets and avenues of the City of Rochester: That a sanitary sewer be constructed commencing at the center of Fourth Street;, Northeast and First- Avenue Northeast. and running, East in Fourth Street northeast to a point ten (10) feet East and ten (10) feet North of the Northeast corner of Block 62 in Original Plat, thence South in Second Avenue Northeast to a manhole in center of Second Avenue Northeast and. the North line of the Right -of -Way of the C. & N. We Ry. Co., and also be- ginning at a point ten (10) feet East and ten (10) feet North of the Northeast corner of Block 62 in Original Plat and running thence South sixty degrees East across the Zumbrd River and intersecting the East Side Sanitary Sewer. 191 feet North o f manhole in North side of Rig ht-of-o:'ay of the C. €- N. 117. Ry. Co,,; and in said resolution directed the City Engineer of said City to pre- pare and file in the office of the City Clerk of said City detailed plans, profiles and specifications for said improvementand to report to said Common Council an estimate of -the costs -and expense of said improvement, and said City Engineer pursuant to said direction, did, on the 4th day ,of:'Xovem.ber19249 duly file in the office of the City Clerk detailed plans, profiles and speci- fications for the said improvement and did report to the said Common Council an estimate of the cost and expanse of said improvement; TFERF.FORE, Be it and it is hereby resolved by the said Common Council of the City of Rochester: That the plans, profiles and specifications for the improve- ment above described so filed J.n the office of the City Clerk by the said. City Engineer as aforesaid, be and the same are hereby adopted as the plans, profiles and specifications for the said improvement; and that the estimate of the cost and expense of the said improvement report to said Common Council be and the same is hereby accepted and ordered filed in the office of the City Clerk. Be it further resolved by the said Common Councilh: That the whole cost and expense of constructing of the said sewer in the said parts of the above mentioned streets and avenues, in the manner above mentioned, according to the plans, profiles and specifications for the same on file in the office of the City Clerk, shall be assessed against each lot, piece and parcel of land benefited by each said improve- ment,'r. espectively, to -wit: Against each lot, piece and parcel of land abutting upon each said improvement, without regard to the cash valua,tison.of said lands, ratable and in proportion to the special benefits conferred upon each said lot, piece and parcel of land by the said improvement. Be it further resolved by the said Common Council: That a meeting of the said Common Council will be held at 8 o'clock-?.M. on November 28th, 1924, at the Council Chambers, in the City Hall, in said City, at which meeting all personsinterested in said improve- ment above described may appear and be heard before said Common Council in relation to the said improvement, or to the mode of assessment for the cost and expense thereof, or any other. matter or objection relating to said im- provement, or any of them, upon which they may desire to be heard. The City dllerk is hereby itiitbeted to prepare lists which shall contain a description of each and all. of the properties abutting upon each of the said improvements and the names of owners of said properties so far as the sarle are known, which lists, to;_;ether with a notice of the time and place of the meeting and hearing, above mentioned, he shall cause to be published once in the official paper of said City at least ten days prior to the date of said meeting and hearing. Be it further resolved by said Common Council: 769 That the City Clerk , of said City be and he is hereby ordered and directed to advertise for bids 'as provided by law for 'furnishing 'all materials and doing all the work for m4king said ,improvement. Bids ,for the said improvement will be- received and opened by said Common Council at a public meeting thereof to be held at 8 o'clock P.M. on November 28th, 1924, at, the Council Chambers in the ,City Hall, in said City. Each bid must be accompanied by a certified check for at .least ten (10) percent of the amount of the bid: The -right is 'reserved, to reject any and, al]_ bids. Schwartz and Company, for the furnishing of all ,labor, tools, materials,. etc., for the complete construction of a concrete dame -and headwor.ks on the site of the present Rochester Milling Company's lower da., at •a consideration o•f $9700.000 ' 'The amount of the bond to lie given by the' said Contractor is hereby fixed at the sum of "700,00, " . Upon motion by Newhouse second by Wright that the said resolution be adopted as read, and all voting in Favor thereof, President- Pro, Tem. Cools declared the said resolution duly prassed and' adopted. I t' AYdermah Lemmon introduced the following resolution, which was 'read: "Be it resolved by the Common Council of the City of Rochesterg'vinnesota: That the sum of '$5b0.00` be and the said sum is hereby appropriated from the .General .Fond ,of said City and drdered paid to Pauline S. Kuehn for payment on her band contract with the City, dated May 18th, 1923. The Mayor and City Clerk are hereby authorized and directed to draw warrant for said sum "upon the City Treasurer in wocordanee herewith, and cause said payment to be made. Upon motion by Newhouse second by Wright that the said resolution be adopted as read, and all voting in favor thereof, President Pro Tem ,Cook declared the said resolution duly passed and adopted.
