Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, A4innegota, held in the Council. Chambers, in the City Hall, in said City,
on December '15th, .1924, at 8 o'clock P.M. -
President Weeks being absent on account of the illness of himself, motion

by Newhouse second by Roeder carried that Alderman Cook act as President Pro Tem,
and Alderman Cook .accordingly took the Chair as such.
President Pro Tem Cook called the meeting to order.
Roll Call: Present: Cook, Kitzman, Lemmon, Newhouse, Roeder, Wright.
Absent: Weeks.
Motion by Lemmon second by Wright carried that the minutes of the meetings
held on November 19th, 19249 November 28th, 19249 December 1st, 1.924, and December
5th, 1924, I�e each approved:
President Pro Tem Cook announced that, this was the time and place fixed
for a hearing on the levying of special assessments for the cost and expense of
grading Eighth Avenue Northwest from the North line of Second Street Northwest to the
bridge across Cascade Creek and asked if there was any person present who wished to
be heard in any matter .relative to the said grading.
-There was no person present who wished to be heard.
President Pro Tem Cook annoi:.need that' this wa's the time and place fixed
for the hearing on the proposed construction of a sanitary sewer in Seventh Street
Northwest from the center of Sixth Avenue Northwest to the center of Fifth 4venue
Northwest and asked if there was any person present who wished to be heard concerning
IIthe said proposed sanitary sewer.
There was no person present who wished to be heard. relative to the said
proposed sanitary sewer.
Eugene F. Schwarz, S1.iperintendent of the Water Department, read before the
Common Council a copy of his, report t(of the Public Utility Board made in the matter of
water used in the flushing .and cleaning of the sewers and water used in sanitary sewe-
flush tanks, and motion by Lemmon second by Wright carried that the said report be
placed on file and that the reaommendations, etc., set forth therein be referred to
the Superintendent of the Water Department and the City Engineer, for therr consider-
ation. '
The following communication from the River Side Holding Company was read,
and motion by Lemmon second by Wright carried that the same be placed on file:

The Riverside Holding Company, owners of the property herein
mentioned, by resolution duly passed and adopted April 1st, 1924, ( a copy of which
resolution was delivered to the 11ayor of said City) offered to sell to the -City of
Rochester for 030,000.9 subject to the trust mortgage securing the first bond issue
of $60,000. and interest thereon from March lst, 1924, the real estate in said
resolution described, which property includes land and building commonly known as
the Cooperative Building, In the City of Rochester, Minn.

Said Company has ever since said April lst, and does now,
hold open said offer of sale, and it is willing and does continue said offer in
force until, but not after the 29th9day of December 1924.
Therefor, notice id Hereby given that said offer of sale will
terminate on December 29th, and it is hereby revoked said revocation to take
effect on said December 29th, 19240

Holding Company, a corporation, a 'resolution was adopted authorizing .and
.recommending to -the Board of ni.rectors of said Company that .the real estate of
said company be offered for sale subject to the mortgage bonded indebtedness
thereon, for the price herein specified:
It is hereby resolved by the Board of Directors of sedd River-
` (side Holding Company, that we offer for sale, and we do hereby offer to sell
and convey to the City of Rochester, by deed of warranty, all the real estate
or equity therein of or belonging to said Company, viz: the lands and premises
situate in the County of Olmsted and Stdte of Minnesota and described as
follows, viz:

AlderNan Newhouse introduced a resolution levying special assessments for
the cost and. expense of grading Eighth Avenue Northwest from the North line of
Second Street Northwest to the bridge across Cascade Creek to an established grade
Line and. to a width of thirty (30) feet, which was, reed.
Upon motion by Newhouse second by Roeder that the said resolution be adopt-
ed as read, and all voting in favor thereof, President Pro Tem Cook declared the
said resolution duly passed and adopted.
The November 1924 report of the City Weighmaster showing fees collected in
the amount of $59.20 was, reed, and President Pro Tem Cook referred the said report
to the Finance Committee.
The reports ofI the Milk Y1napector for the weeks ending December 6th, 1924,
and December 13th, 1924, were each separately read, and President Pro Tem Cook orde
ed that the same be placed on file.
The report of the Clerk of the Municipal Court for the week ending December
1st, 1924, showing fines collected in the amount of $288.409 the report of the Clerk
of the Municipal Court for the week ending'December 8th, 1924, shoving fines collect-
ed in the amount of $167.00, and civil fees received in the amount of $2.009 and the
report of the Clerk of the Municipal Court for the week ending December 15th, 19241,
shoving fines collected in the amount of $25.009 and civil fees received in the amc
of $10.05, were each separately read, and President Pro Tem Cook ordered that the
said reports be referred to the City Attorney.
The report of the Justice of the Peace of the First Ward for the months of
August, Septembeft, October, and November, 1924, was read, and President Pro Tem Cook

Alderman Lemmon introduced a resolution appropriating 0948.29 from the

Firemen's Relief Fund ,and ordering payment made to Wilbert McHenry, Treasurer -of the
Rochester Fire Department Re7fief Association, as payment of taxes collected, and
interest on deposit, under Section 1832 General Statutes of Minnesota for 19131,
which was read.
Upon motion by Lemmon second by Wright that the said resolution be adopted
as read, and all voting in favor thereof, President Pro Tem Cook declared the said
resolution duly passed and adopted.

Dear Mr. Armstrong:
T was sorry that,I gFas nod in the office when you called up
the other day. I too am interested in a possible connection with your problem.
The plan you are working on now is one with which I am thor-
our*hly in sympathy I do not believe that I have enough data to add much to
the solution of the problem. How would'it be to asie the Council to authorize
a sum.of money for a preliminary .report on the situation T would be glad to do
this for about $1200. Tt would include a summary of the flow in the river show-
ing the periods when the_ complete plant would be requirddo when the preliminary
treatment only, and the flood periods when treatment might be suspended, {cif
there be such.) It would then be designed on the basics of the data you have
aldeady gathered on the amount of sewage, in connection with the State Board of
Health analyses of the sewage, with an outline of two and possibly three complete
methods of treatment, with the cost of construction for each and the annual. costs
thereafter, I would also study the relative costs of the plants for the city a.!
alone and in conjunction with the state hospital, and make recommendations on the
basis of this ttudy o .i facts*
It seems to me that such a report would make it much easier
for the council to decide what to do• when the time comes to do something. The
members are all busy men and of course do not have time to look into the state of
the art of sewage disposal ' or into the technical details.
Furthermore, in case the city should decide to go ahead with
the project, and should employ me as consulting engineer, I would deduct the
amount paid for this study from my fee for consulting services in the design, so
that nothing would be lost and probably ( I believe certainly) a good deal
gained.
I should be glad to have you present this plan to the Council.
et me know what comes of it, if you think it advantageous to the City of
ochester and do present it.

I am in receipt of your letter of Dec. 2 and note what you have to say
relative to the action taken by the common council at a meeting held Dec.1,1924.

I have noted the subdivisions 5 and 6 in Section 534 of the General Statute
of 1913 and agree with the members of the council that the existing rate of compen-
sation is too low to insure the services required. I will keep your letter for read
reference and when the legislature convenes, I will be pleased to do everythinig in
..My power to make possible the necessary amendment.
There has been considerable discussion and evider}t dissatisfaction with
our present laws for registration as pertaining to cities of the third class. You
will recall that at the last session of the legislature, a permanent registration
law was enacted taking care of cities over 50,000 in population and the question
no a, arises as to whether or not a permanent re' i stration law would not be a good
thing for cities of the second and third class. The .existing law, which affects
Minneapolis, St. Paul, and Duluth, would serve as a pattern, and with the necessary
modifications to fit the .requirements of smaller municipalities, it might have its
advantages.
In view of the fact that our legislature convenes on January 5, 1925, I
would appreciate having you refer this matter to the common council for the purpose
of gaining the viewpoint of its members.

to cooperate in every way possible in working for the best interests of this
municipality and county.
