Motion by Kitzmaa second by Wright carried that the minutes of the
meetinepheld on August loth, 1925, and August 13th, 1925, be each approved.

UTHE'REAS, at an election duly called and holden in the City of
Rochester, Mlinnesota, after notice thereof duly given , for the time and in the
manner required .by law, more thhn three fifths (3/5) of the legal voters of
said city voting at said election declared in favor of the issuance of the City
.of Rochester Sewage Disposal ,Plant Bonds in the amount of Three Hundred rilfty
Thousand Dollars ($350,000.00), and approved the Resolution of this Common
Council adopted -July 210: 1924, and
WHEREAS, it is deemed necessary and expedient that the form of such
bonds be preseribed and adopted. by this Common' Council,. and that it.is necess-
ary and for the best interests of.the city to sell -.and issue at this time Fifty
Thousand Dollars (450,000 00) par value, of said bonds so authorized.

BE IT. RESOLVED BY THE COWON CO'WNCTL OF THE CITY O F RO CHESTER AS
FOLLO WS :
Section1. That under the authority of the election aforesaid. and
the Resolution of this Common Council of July �21st; • 1924, so approved and
adopted by.the legal.voters, there is hereby authorized the issuance of said
Three Hundred ITifty`Thousand Dollars ($3509000.00)-of City of Rochester Sewage
Disposal Plant Bonds, the said bonds to 'be of the denomination of One Thousand
Dollars (01000.00) each, numbered from one upward, in numerical consecutive
order to the highest number from time to time issued, all dated September 19
192+, .to become due and payable in their numerical order as follows: Fifteen
(15) thereof on the First day of December of each of the years.1925 to 1930,
both inclusive, eighteen (18) thereof on December First of each of the years
1931 to 1940, both inclusive, and. twenty (20) thereof on December First of each
of the years'1941 to'19449 both inclusive.
Said bonds to bear interest. at the rate of -'Four: and three-quarters
Per Cent (4J%) per annum, payable semi-annually"on June and December 1st of eac
each year during the life of said bonds, except .that the first interest shall
be for a three months! period from September 1, 1924, to D.ecembef- 1, *1924,' both
principal and interest payable at the office of the City Treasureriin the City.
of Rochester, Minnesota, the proceeds of. said bonds to be used for the purpose
of establishing and building a Sewage Disposal Plant and a trunk line sanitary

IT IS HEREBY. CERTIFIED AND RECITED, '-that all acts, conditions and things
required to' be done precedent to and in the issuance of this bond have been done,
have happened and been performed in regular and due form and time, as required by
law, and that the total indebtedness of `the City of Rochester, including this bond,
does not exceed any statutory or eharter.'limitations.
THE FULL FAITH, CREDIT AND RESOURCES of- the •.City o f Rochester.. Minnesota.,
are hereby irrevocably pledged for the punctual payment of the principal and interest
of this bond at maturity.
IN TESTIMONY WHEREOF, The Common Council of the City of Rochester, lfinne-.

.Section 3. That said bonds, when duly prepared in the form aforesaid,
shall be held by the City Treasurer of said City, and when= a block or portion thereo
is, by this Common Council, determined to' be sold and issued, the same shall be

atteched to each, and -the coupons attached to each of said bonds authenticated
by the facsimile 'sitatur.e of the City Clerk, and, when so executed, the cou-
pons of all. of se:id. bonds then to be placed. upon the market, Rrhich have matur-
ed and become past due shall. be cancelled and detached :from the bonds before
the same shall be delivered to the Imrchaser or purchasers thereof.
Section 4. That it Is determined to be necessary and for the best
interests of this .City that there shall be, at this time, issued and sold bonds
of said issue in the amount of Fifty Thousand. 15ollars (p'50,000.00), par, being
fifty (500 bonds, all dated September 19 1924; '`and to become due and payable
in -their n.11herical order as follows: Three (3) thereof on the First day. of
December of each of the years 1925 to 1930, both inclusive,. two (2) thereof
fon December Ist of each of the years 1931 t'o 1940, both inclusive," and three
�I (3) thereof on December Ist of each .of the years 1941 to 1944, both inclusive
all matured and past due coupons to and including June I; 19'25, to be detached
from each of said bonds and cancelled.

lish notice of the meeting of the. Common Council of said City. wffiich is direct-
ed to be held in the Council Chambers, in the City Hall, mf the City of
Rochester, Yinnesota, on .t:Ze 4th day of September, 1925, at 8 o'clock As M.,
for the purpose .of opening and considering bids ' for. said bonds, in the Roch-s-
t er Post -Bulletin.,- a legal newspaper printed and published in said City, and
the official newspaper thereof, in which such notice shall be published as
.required by law. ,
Section 6. That said, advertisement .for bids shall be substantially �

The Common Council of the City. of Rochester, minnesota, will meet in
its Council Chambers, in the City Hall, in said City, on the 4th day. of
September, 19259 at 8.o'clock A. M.., to open and consider sealed bids for.
Fifty Thousand Dollars ($501,000.00) of City of Rochester Sewage Disposal Plant
Bonds, then to be issued and sold,being' part of an issue of Three Hundred
Fifty Thousand_ Dollars ($350,000.00), authorized by the electors of said city
to be for the purpose of .establishing and building a Sewage Disposal Plant
and a'trunk line sanitary sewer connecting therewith, within and for said City.
All of said bonds will be of.the denomination of One Thousand Vbllars
1$1000.00) each, dated September. 1, 1924, and mature as follows: Three (3)
thereof ors the N-Irst.day of December of each of the years 1925 to 1930, both
inclusive, two (2) thereof on December Ist of each of the years 1931 to 19409
both inclusive, and three (3) thereof on December Ist of. each of the years
3.941 to 1944, both inclusive, with interest until paid at the rate of F@ur
and Three -Quarters Per 'Cent (443b) per annum, }payable semi-annually on the
First day of June. and December of each year. ( All coupons maturing on or be-
fore. June 1, 19259 will be detached and :'eanaelled.) Both .principal.. and inter-
est of the bonds will be made payable at the office of the City Treasurer irx
the City of Rochester, A!innesot.a. All bids must be, addressed to the under-
signed City Clerk at .Rochester, Minnesota, and be accompanied by a duly certi-
fied check for Tv.o Per Cent (2�) of the. principal of -the bonds bid for, pay-
able, without any condition, to the order -of the City Treasurer of Rochester,
?,Finnesota, which Two Per. Cent (2�-,). will,' if the* bid is accepted, be applied
to the .purchase price. of the bonds, otherwise to be returned to the unsuccess-
ful bidder or bidders.
The successful bidder will be• entitled to receiver the written approv-
ing opinion of J. ?". Martin, Attorney, of Minneapolis, Ifinnesota, approving
the legality of said. issue, and such successful bidder will be required to

Upon motion by Cook second by Wright that the said resolution be adopted
as read, and all voting in favor thereof, President Weeks declared the said resolu-
tion duly passed and adopted.
Chas. H.. Armstron'g,..City Engineer,. submitted specifications and estimate
of cost -for l90,000 to 200,000-37.vertical fibre _cut 'paving brick and 40 tons of
asphaltic pacing cement fillers -which were considered•by the Common Council, said
estimate of cost being $8500.00.
Alderman Cook. introduced the .following -resolution, .which was read:

expedient and necessary that 200,000 3i vertical fibre cut paving: brick and 40 tons o
asphaltic paving fillc� be..purchased for use in the paving and re -paving of Second
Avcnue Southwest from the South line of Center Street West to the North line of Third
Street Southwest, and

and estimate of cost for the said materials;

That the said specifications be and the Name are hereby adopted as the
specifications for the said. materials and are hereby 0-dered placed on file in the
o '['ice of the City Clerk of.said• City, and the said estimate of cost is hereby order-
ed• placed on file in the office of the City Clerk of said City.
Be it further.resdlved by :the Common Council of the City of Rochester,
I!innesota: That the City Clerk of said City be and. he is hereby authorized 4.d
directed to advebtise for bids for the furnishing of the above mentioned materials

cil to to held in the Council Chambers, in. the City ball, in said City, on August
31st, 1925, at 8 o'clock PToM.
Each bid must be accompanied by a certified check upon some reputable -bar
d.ravvn payable to .the Mayor of the City of Rochester, ?Tinnesota, for at least ten (10)
percent of the amount of the bid, which check and the mount of money specified therf
in shrill be, forfeited. to. the said City of Rochester as liquidated damages if the
bidder upon the letting of the contract to him shall fail to enter into the contract
so ?.et, and the said Common Council reserves the right to reject any and all bids. "
Upon motion by Wrtght second by Adler that the said resolution be adopted
as read, and all voting in favor thereof, President Weeks declared the said resolu-
tion duly passed and adopted. '
Motion by Cook second by %'right carried that the Ctty Clerk be instructed
to cause the above mentioned bond sale notice to be published once in " The Bond.
Buyer ".
A suggestion from the Builders Exchange of St. Paul, that a set of the

. Aland and specifications for the local Sewage Disposal Plant be placed on
file v,-ith thee, was read, and motion by Postier second by Adler carried that,
the City Clerk be instru.eted to furhish the Builders Exchange mrf St. Paul.,
with a set of the plans, profiles., speclfieations, etc., for. the local ScvracTe
Disposal Plant, con(litioned- that the same shall_ be returned. in good condition
