Meeting called to order by President Weeksi Roll Call: Present: Weeks, Adler, Cook, Postier, Wright. Absent: i Bach, Kitzman. Motion by Cook second by Postier carried that the minutes of the greetings htld.on August 17th, 1925, and August 19th, 19259 be each approved. President Weeks announced that this was the time and place fixed for a hearing on the, constructioni of a sanitary sewer .in parts of Second Street i Southwest and Fifteenth Avenue Southwest, and asked if there was any person Present who wished to be heard in any matter concerning the said sanitary sewer. There was no person present who wished to be heard. Alderman Kitzman came in at this time and took his Chair. President Weeks announced that this was the time and place fixed for a hearing on the construction of a sanitary sewer in Second Avenue Northwest along the East side of Cascade Park and between Eighth Street Northwest and Tenth Street Northwest, and asked if there was any person present who wished to be heard relative to the said sanitary sewer. t � i There was no person present who wished to be heard in.regavd.tothe said improvement. President Weeks announced that this was the time and.place fixed for a hearing on the proposed widening to a width of seventy (70) feet of the pav- ing on Second Street Southwest between the West line of -First Avenue Southwest f and the East fine of Second Avenue Southwest, with three inch (3"X vdrtical fibre cut brick and that a stone curb be constructed along bath side of the said widened paving, and asked if there was any person present who wished to u be heard relative to the said proposed improvement. There was no person present who wished.to be heardi j ii President Weeks announced that this was the time and place fixed for a hearing on the proposed widening to - a width of seventy-nine (79) feet of the i j paving on First Avenue Southwest from the South line of Second Street Southwest I . i to the North line of Fifth Street Southwest with seven inch (7") one course steel reinforced concrete and asked if there was any person present who wil3hed ; to be heard relative to the said propozed improvement. There was no person present who wished to be heard but two remon- strances against the said improvement, were read, one of them being signed by W.,t H. H. Greene, Palen & Lohse, J. P. Spencer, Case Auto Company, B. Clausen, i Blanche Harkins and Lizzie Harkins, F. E. Williams, Mary ;L. Croibot, Mrs. Laura Cadwel l and Simon St ensrud and the other was signed by Blanche and Li zzi e Harkins;: 379 l Alderman Bach came in at this time oad took his Chair. Motion by Bach -second by Adler carried that the City Clerk be instructed to'draft a resolution that will provide for a hearing on the improvement described:- I That the paving on First Avenue Southwest from the South line of Second Street i Southwest to the North line of Fifth Street Southwest be widened to a width of sixty (50) feet by laying a ten (10) foot strip of seven inch (7") one course concrete on each side of the present paving on the said part of First Avenue Southwest,. and that i an integral concrete curb be constructed 6n each side of the said part of First Avenue Southwest except at the intersecting alleys and drives; all voting in favor j Hof the said motion except Alderman Kitzman, who voted "Nay". - r Hotion by Cook second by Adler carried that further proceedings in the proposed widening of the paving on First Avenue Southwest to a width of seventy-nine (79) feet be abandoned. • r President Weeks announced that this was the time and place fixed for a hearing on the proposed widening of the paving on Fourth Street Southwest from the Nest line of Broadway Street South to the East line of First Avenue Southwest to a _ width. of seventy-four (74) feet, with seven inch (7") one course steel reinforced concrete and asked if there was any person present who wished to -be heard relative to the said proposed improvement . r - There was no person present who wished to be heard but a remonstrance against the said improvement signed by J. P. Spencer, Chas. C. Mohr, Be Amundsen, B. Clausen, Maass & McAndrew Co., the Service Motor Co., and Mrs. Press Rommel, Senior, was read. Motion by Postier second by Wright carried that further proceedings in the I proposed widening of Fourth Street Southwest as above described, be abandoned. A petition signed by Oscar A. Reiter, A. E. Briese, J. R. Timpayne and Blaine W. Neal, asking that Second Street Southwest between Fburteenth Avenue South- west and Sixteenth Avenue Southwest be treated with calcium chloride, was reed, and motion by Adler second by Bach carried that the City Engineer be instructed to secure the necessary labor, materials, etc., and treat the said part of Second Street Southwest, as petitioned for: A petition signed by Peter Henrikson, C. A. Burbank, Mrs. Mi ch ael Sl at t er- + I John Hinck, Co B. White, Mabel and Edna Bergren, Stoney Van Sickle, S. C. Schnei- der, C. H. Fbster, C. C. Durand, Fred Zimmerman, Those P. Hermanson, Albert Curtis, Fred .Buck, Mrs. W. W. Adams, and Wm. Oswald, asking that Fourth Street Southeast from I Eleventh Avenue Southeast and East thereof be treated ,with road oil, was read, and motion bylKitzman second by Wright carried that the said petition be referred to the r Street and Alley Committee. Motion by Kitzman second by Cook carried that the above mentioned bids be .referred to the City Engineer for tabulation and recommendations. The application of Howard Campbell for a driver's license was read, and on motion by Postier second by Cook carried that license be granted: The City Clerk submitted the oral request of Mrs. Ralph Brintnall that the.'fee which accompanied her two applications for license to operate 'two automobiles in taxi dervice, be returned to her, and after a considdration of the request motion by Bach second by Wright carried that the City Clark be i instructed to return $15.00 of the $20.00 concerned, the other $5:00 toi.,be re.* ` served as three months' taxi privilege on the said two automobiles, as no license was issued and she was compelled to discontinue the taxi business through inability to qualify under the ordinancesW Automobile policy Noe A.P.L.647467 written by the Associated Com- panies 'of Hartford, Connecticu%, issued to Wm. L. Eaton, doing business as the Rochester Yellow Cab Company, covering public liability and property damages on I! 381 twenty automobile$ owned and operated by his company in taxi service, was submitted _with request that it be substituted for automobile liability and property damage policy No. A.T .P.734473, written by the Hartford Accident and Indemnity Company and issued to the Rochester Yellow Cab Co., covering the above mentioned twenty automobiles, and after a consideration of the matter motion by Kitsman-second by Postier carried t. that the said policy Nola A.P.L.734473 be released and returned to the Rochester Yellow Cab Co., and that the said policy No. A.P.T. 647467 be placed on file instead. The following notice of cancellation was read, and on motion by Bach second by Cook the same was ordered placed on file: " Winona, Minn. August 22, 1925: The City Clerk, Rochester, Minnesota. Armstrong, " 382 !� A representative of the Turbine Sewer Machine ..Co., demonstrating a model of their sewer cleaning machine was before the Common Council and mom tion by Wright second by Cook carried that the matter of the purchase of such a machine be held over for one week,in order that due consideration may be given to the matter Alderman Cook introduced a resolution determining to adhere to all former resolutions passed •Ond *adopted in the proceedings relative to the co*- struction of sanitary sewers in parts of Second Street Southwest and Fifteenth Avenue Southwest and in part of Second Avenue Northwest,' which was read: Upon motion by Wright second by Postier that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. ' Alderman Postier introduced a resolution accepting the proposal of Wm - C.- Fraser and --Son for the construction of a sanitary sewer in Second Avenue Northwest along the East side of Cascade Park, described as follows: Commeba- ing at the center of the intersection of Second Avenue Northwest and Tenth !Street Northwest and running thence Southeasterly to a point thirty (30) feet West of the Southwest 'corner of Lot 12 in Block 24 in Northern Addition, thence • Southerly to a point twenty(20) feet West of the intersection of the center ;line of Ninth Street Northwest with the East line of Second Avenue Northwest , .thence Southerly to.a point five (5) feet South and thirty (30) feet West of ;the Northwest corner of Lot 15 in Block 23 in Northern Addition, and fixing ,!the amount of the bond to be given by the said contractor at the sum of $810.00, whi eh was read: Upon motion by Cook second by Adler that the said resolution be adopt- 1 ed= as read, and all voting in favor thereof, President Weeks declared the said ! M., on September 4th, 1.9259 at the Council Chambers, in the City Hall, in said City, at which public meeting and hearing all persons interested in the said improvement may appear and be heard j ,:before the said Common Council in relation to the said improvement. The City Clerk of ;; said <City is hereby ordered and directed to caust to be published in the official j �newspaper of said City, a notice to all interested persons of the time, place and I purpose of said meeting and hearing, a on motion by Bach second by Wright that the said resolution be adopted r as read, and all voting in favor thereof except Alderman Kitzman, who voted "Nay", President Weeks declared the said resolution duly passed and adopted. An article published in the Post -Bulletin on August lath, 1925, under the heading of "Banking Chronicles" written by C. A. Chapman, of the First National Bank, was read, and on motion by Postier second by Wright the City Clerk was instructed to make reply thereto: The following report made in the matter of the proposal of the Rochester j Loan and Trust Company for being designated as a City Depository, was read, and on ;motion by Kitzman second by Wright the same was ordered placed on file: " Rochester, Minnesota, August 24th, 1925. Honorable Mayor and Common Council, City of Rochester, Minnesota. - Gentlemen: Relative to the proposal of the Rochester Loan and Trust Com- pany for being designated as a City Depository which they made under date of :'14y 1-V 18th, 1925, and was referred to me, I will say that this bid was a surprise to me, as the one active in the handling of the Trust Com- pany's affairs had promised me that, because they could not qualify with a surety bond under their bid of April 6th, 1925, if a re -advertisement would be arranged the. Rochester Loan and Trust Company would bid a higher rate of interest and furnish a personal bond, at which I expl'ained the situation to your Honorable Body, and you accordingly advertised for further proposals, at which the said Trust Company came in, as you know, i with the same proposal as the original, under which they now submit a personal bond, and thus, due undoubtedly, to pressure from the local Clearing House Association, did not comply with their agreement with me as transmitted to you for your action. Cook introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minne- sota: That the sureties�on the City Depository Bonds of the Olmsted County Bank and Trust Company of Rochester, Minnesota, for double the sum of $22,500.04 dated August 22nd, 19259 and August 24th, 1925, and August 20th, 1925, .be and the said sureties on the said bonds are hereby accepted and the said bonds are hereby approved and ordered placed on file in the office of the City Clerk of said City; said bonds being submitted, accepted, approved and ordered filed under and in accordance with the proposal of the said Olmsted County Bank and Trust Company dated April6th, 1925, and the designation by this Common Council under date of August 24th, 1925, of the said Bank and Trust Company as a City Depository, with the whole thereof to be governed by Sections 47 and 549 in- clusive, of the Charter of the said City, and such other Sections or parts thereof of the said Charter of said City as may be relative to City Depositor- i e s. Be it further resolved by the said Coon Council: That the City Treasurer shall, subject to the above mentioned Sections or parts thereof which are for the government of the said Treasurer and of said Depositories, and the said proposal and designation, place the 'sum of $22,500000 in the said Bank abd Trust Company in savings account at an interest rate of two (2) percent per annum, as provided for in the above mentioned proposals " Upon motion by Cook second by Wright that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman lVaeh introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sureties on the City Depository Bonds of the Union National Bank of Rochester, Minnesota, for double the sum of $509000.00, dated August 20th, 19259 and August 24th, 19259 be and the said sureties on the said bonds are hereby accepted; and the said bonds are hereby approved and ordered placed on file in the office of the dity Clerk of said City; . said bonds being submitted, accepted, approved and order-o ed filed under and in accordance with the proposal of the said Union National Bank dated April_ 4th, 19259 and the designation by this Common Council under date of August 24th, 1925, of the said Union National Bank as a City Depository, with the whole there— of to be governed by Sections 47 and 54, inclusive, of the Charter of the said City, and such other Sections or parts thereof of the said Charter of said City as may be ! relative to City Depositories. Be it further resolved by the said Common Council: That the City Treasur- er shall, subject to the above mentioned Sections or parts thereof which are for the government of the said Treasurer and of said Depositories, and the said proposal and designation, place .the sum of $50,000.00 in the said Union National Bank in savings account at an interest rate of two (2) percent per annumi as provided for in the above mentioned proposal. " Upon motion by Wright second by Postier th$t the said resolution be adopt— ed as reed, and alb. voting in favor thereof, President Weeks declared the said reso— lution duly passed and adopted. Alderman Adler introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sureties on the City Depository Bonds of the First National Bank of Rochester, Minnesota, for double the sum of $57,800.00, dated August 20th, 1925, 1 and August l8th, 19251, be and the said sureties on the said bonds are hereby accepted! and the said bonds are hereby approved and ordered placed on file in the office of the City Clerk of said City; said bonds being submitted, accepted, approved and ordered filed under and in accordance -with the proposal of the said First National j Bank dated April 4th, 192% and the designation by this Common Council under date of August 24th, 1925, of the said First National Bank as a City Depository, with the whole thereof to be governed by Sections 47 to 54, inclusive, of the Charter cif the said City, . and such other Sections or parts thereof of -the said Charter as may be relative to City Depositories. j Be it further resolved by the said Common Council: That the City Treasur— er shall,. subject to the above mentioned Sections or parts thereof, which are for the government of the said Treasurer and of said Depositories, and the said proposal and designation, place the sum of $571,500,00 in the said First National BAnk:--in sav— ings account at an interest rate of two (2) percent per annum, as provided for in the above mentioned proposals Upon motion by Adler second by' Bach that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolu— tion duly passed and adopted: k Alderman Kitzman introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the.sureties on the City Depository Bond of the Rochester Loan and Trust Company of Rochester, Minnesota, for double the sum of $60,000.009 dated August 24th, 1925, be and the said sureties on the said bond are hereby accepted and the said bond is hereby approved and ordered placed on file in the office of the City Clerk of said City; said bond being submitted, accepted, approved and ordered filed under and in accordance with the proposal of the said Rochester Loan and Trust Company dated May 18th, 1925, and the designation by this Common Council under date of August 24th, 1925, of the said Rochester Loan and Trust Company as a City Deposi— tory, with the whole thereof to be governed by Sections 47 and 54, inclusive, of the Charter of the said City, and such other Sections or parts thereof of the said Char— ter as may be relative to City Depositories. Be, it further resolved by the said Common Council: That the City Treasur- er shall, subject to the above mentioned Sections or parts thereof which are fdr the government of.the said Treasurer and of the said Depositories, and the said proposal and designation, place the sum of $60,000.009 IA the said Loan and Trust Company in savings account at an interest rate of two (2) percent per ai num, as provided for to the above mentioned proposal. Alderman Postier introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minne- �� sot a: That the sureties on the City Depository Bond of the First State Bank and Trust Company of Rochester, Minnesota, for double the sum of $609000.;00, dated August 24th, 1925, be and the said sureties on the said bond are hereby accepted and the said bond is hereby approved and ordered placed on file in the office of the City Clerk of said City; said bond being submitted, accepted, approved and ordered filed under and in - accordance with the proposal of the said Bank and Trust Company dated May 16th, 19259and the designation by this Common Council under date of August 24th, 1925, of the said -Bank and Trust Company as a City Depository, with the whole thereof to be governed by Sections 47 to 54, inclusive, of the Charter of the said City, and such other Sections or parts thereof of the said Charter, as may be relative to City Depositories. Be it further resolved by the said Common Council: That the City Treasurer shall, subject to the above mentioned Sections or parts thereof which are for the government of the said Treasurer and of said Depositories, and the said proposal and designation, place the sum of $60,000.00 in the said Bank and Trust Company in open deposit account at an interest rate of one (1) percent per annum, as provided for in the above mentioned proposal. " Upon motion by Wright second by Bach that the said resolution be Iadopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted: Alderman Kitzman introduced a resolution designating the First - i ' :National Bank of Rochester, Minnesota, as a depository for City mono.* during the i year beginning August 24th, 1925, and fixing the limit of funds to be deposited under the said designation as the sum of 0579500„001, which was read*. The City Charter prOvides. in part as follows: Section 281. - - - - - - - - - - - - - - - After receiving a bid, or bids, - -- - - - - - the Common Council or Board magi either abandon the proposed contract or cause the proper department of the City to procure the necessary com- modities, implements, machinery, labor and service and carry out the proposed improvement, work or other purpose. and Section 282 provide* in part as follows: In Case the Common Council or Board shall determine that any commodities or service are to be procured in open market, the same shall be procured or done by the proper depart- ment or officer in accordance with such general directions as 'the Common Council or Board may give. Your letter states that the Council ordered a resolu- tion for the advertisement of the brick , filler and cement for the proposed contract.
