Chambers, in the City Hall, in said City, on September 4th, 19251, at 8 o' Block A. M. Meeting called to order by.President Weeks. Roll Call: Present: Weeks, Adler, Bach, Cook, Postier, Wright. Absent Kitzman: f Motion by .Cook second by Bach carried that the minutes of the meeting held on August ' 31st, 1925, be approved. President Weeks, announced that this was the time and place fixed for a hearing on the ,construction of, a sanitary sewer in Sixth Avenue Southeast from Center of •Ei,;hth Street Southeast to a point 200 .feet south of the center. of Eighth Street Southeast; and asked if there was any person present who wished to be heard relative to the said sanitary, sewers - There was no person present who wished to be heard relative to the said improvements Alderman Ki:#zman came in at this, time acid took his Chair: President Weeks announced that this was the time and place fixed for a hearing on the -widening of First Avenue Southwest from the South line of Second Street Southwest to the North line of Fifth Street Southwest by adding a ten. (10) foot strip of .seven inch (7") one course concrete on each side of the present ,pav- ing and that the construction of an integral concrete curb on each side of the said paving# and 'asked if there waste one present who wished, to be heard relative to either of the said improvements: There was no person present who wished to be heard in any matter concern- ing the said paving or curbing. The report of the Building and Electrical Inspector fbr the month of August 1925, showing electrical inspection fees collected in the amount of $ll 75, and building inspection fees collected in the amount of $245:00, was read, -� and on motion by Adler second by Cook the -same was referred to the Finance Committee. i The report of the City Engineer for the month of August 19259 showing ex- penditures for labor from the general Fund in the amount of $9150359 from the Street and Alley Fund in the amouht of $2404o51, from the Sewer Fund in the amount of $279030, and from the Permanent Improvement Revolving Fund in. the amount of $772.d60, was read, and on motion by Kitzman second by Bach the same was referred to the Street and Alley Committee. The report of the Health Officer for the City Farm for the month of August 1925, showing receipts in the amount of $$3880849 and disbursements in the amount of $6394i94 and a balance on hand in the amount of $787249, was read, and on notion by Cook second by Wright the 'same was ordered placed on file: The application of E. A. Eckerson for a permission to locate his automobile next to the curb at -the Southeast dorner of the intersection of Broadway Street and Second Street Southeast, for a period of two weeks, for the purpose of advertising and demonstrating an automobile accessory,was read, and on motion by Adler aecond by Deft the application was not alloaveda The application of Fred Sohoenfelder,'for a driver's license, was read, and on motion by Postier second by Wright license was granted. The application of John Cutshall and Taylor Cutshall for a permit to hold, give and conduct public dances in the Woodman Hall on September llth and 25th, 1925s and hhe application of Frank Adair and Ellis Giere for the Order of DeMolay, for permit to .hold, give and conduct a public dance in the -Masonic Temple on September llth, 1925, were each separately read.: The application . of H. L. Thurber for permit to place and maintain a sign on the building known as No0 19 Second Street Southwest, was read, and on motion by Adler second by Kitzman permission was granted. Cmpy of requisition made by the Health Officer on St. Mary' s Ho spit al for Isolation Hospital services in the establishing, maintaining and releasing* of quarantine in the case of Grace Hennessey, a typhoid fever patient, was read, and on motion by Cook second by Wright the same was ordered placed on files A proposed contract agreement between the Turbine Machinery Co., and the City of Rochester, Minnesota, submitted by the said Company relative to the use and ultimate sale of ;a , sewer cleaning machine, was read, and on motion by Kitzman second by Adler said proposed agreement was ordered placed on file. The recommendation of the -Public Grounds Committee that the payment of $300.00 be made to Olaf Weiberg as a part payment on his contract fur the decorating etc., of the City. Hall, was read, and on motion by Cook second by Kit-z*an, the same was accepted and ordered placed on file. Final estimate prepared by C: H. Armstrong, Ctty Engineer, in favor of the Utton Construction Co., Inc., for curb and gutter on Second Avenue Southeast from Fourth Street to Fifth Street, showing the sum of $228162 as being due to the said 412 contractor, and final estimate prepared by C. H. Armstrong, City Engineer, in favor of the Utton Construction Co., Inc., for curb and gutter oh and the grad- ing of Fifth Street Southeast from First Place Southeast to Third Avenue South- i east, showing the sum of $348 -90 as being due to said contractor, were each separately read, and on motion by Kitzlnan second by Wright the same were ordered placed cin file. i Alderman Cook introduced a resolution accepting the above mentioned curb and gutter and grading as having been completed according to the contract, which was read: Upon motion by Wright second by Cook that the said resolution be adopted as read., and all voting in favor thereof, President Weeks declared the J A i said resolution duly passed and adopted. Alderman Kit�man introduced a resolution appropriating $348190 from ' the Permanent Improvement Revolving Fund and ordering payment made to the Utton Construction Co., Inc., for payment of final estimate on contract for curb and gutter and grading of Fifth Street Southeast from First Place Southeast to Third Avenue Southeast, chi ch was read. Upon motion by Bach second by Cook that the said resolution be adopt- ed as read, and all voting in favor thereof, President Weeks declared the said resolution duly -passed and adopteda Alderman Wright introduced a resolution appropriating $228.62 from the Permanent Improvement Revolving Fund and ordering payment made to the Utton Construction Co., Inc., for payment of final estimate on contract for curb and gutter on Second Avenue Southeast from. Fourth Street Southeast to Fifth Street Southeast, which was read Upon motion by Cook second by Kitzman that the said resolution be. i adopted as read, and all votilig in favor .thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Postier introduced a resolution appropriating $300*00 from the General Fund and ordering payment made to Olaf Weiberg as part payment on contract for re -papering, re -varnishing and re -painting of a part of the inter- ior. of the City Hall, and the repairing and refinishing of certain equipment within the City Hall, which was read. Upon. motion by Wright second by Kitzman that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adoptedi Alderman Cook introduced a resolution granting permit to John, Cutshali and Taylor. Cut shall to hold, give and conduct public dances in the Woodman Hall,, on September llth and 25th, 1925, and fixing the fee at the total sum of $10.000 which was read: Upon motion by Cook, second by Wright that t1je said resolution be adopted as read, and ,all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. .11 413 Alderman Wright introduced a resolution granting permit to the Order of DeMolay to hold, give and conduct a public dance in the Masonic Temple, on September llth, 1.9251, aidd fixing the fee at the sum of $1:00, which was -read, i Upon motion by Wright second by Cook that the said resolution be adopted (I as read, and all voting in favor thereof, President Weeks declared the said resolu- 11 duly passed and adopted: Alderman Postier introduced a resolution authorizing the Chief of the Fire ;Department to purchase 300 feet of fire hose, at a cost not to exceed $360.00, for I ;delivery on or about October 15th, 19251 which was read. Upon motion by Cook second by Adler that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution I duly passed and adopted. i Alderman Bach introduced a resolution fixing 8 o'clock P.M., September 2Bth, i 1925, as the time for the levying of assessments for the combined concrete -curb and i ;gutter on and the grading of Fifth Street Southeast from the West line of Third Avenue ;Southeast to the West line of First Place Southeast, and for the combined concrete curb and grutter on Second Avenue Southeast from the South line of Fburth Street South- east to a point twentyitwo and one-half (22--g) feet South of the North line of Fifth 'Street Southeast and fixing the said hour and date for a hearing, thereon, and provid- ing for notice of the said hearing, which was read: Upon motion by Adler second by Bach that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Bach introduced a resolution ordering plans, profiles, specifica- tions and estimate of cost for a sanitary sewer in Sixth Avenue Southeast from the center of Eighth Street Southeast to a point 200 feet South of the center of Eighth Street Southeast, which was read. i; Upon motion by Cook second by Adler that the said resolution be adopted as read., and all voting in favor thereof, President Weeks declared the said resolution it 1�i duly passed and adopted. : C. Armstrong, City Engineer, submitted plans, profiles, specifications and estimate of cost for combined curb and I, gutter on and the grading of Sixth Street Southeast from Third Avenue to Fburth Avenue, which were considered by the Common ij Council, the said estimate of cost being $544a80 I� Alderman Adler introduced a resolution adopting the above mentioned plans, I i:profiles and specifications for concrete curb and gutter on Sixth Street Southeast ''from Third Avenue to Fburth Avenue, and ordering the same placed on file, ordering a ;!notice of hearing thereon for 8 o'clock P-M. September 21st, 1925, and ordering !� advertisement for bids to be opened at 8 o'clock P.M., September 21 st, 1925, which ,;was read. Upon motion by Cook second by Wright that the said resolution be adopted I' j, 414 ascreed, and all. voting in favor thereof, President Weeks declared the. said resolution duly passed and adopted: C. F. Armstrong, City Engineer, submitted plans, profiles, specifica- tions and estimate of cost for the widening of Second Street Southwest from First Avenue Southwest to Second Avenue Southwest , which were con$idered by the Common Council, the said estimate of cost being $4810 8'7. Motion by Bach second by Adler that all further proceedings relative l to the widening of Second Street Southwest as above described be temporarily abandoned. Motion by Bach second by Adler carried that all. further proceedings relative to the widening of First Avenue Southwest from Second Street. to Fifth Street be temporarily abandoned. Rochester, Minnesota, relative to the construction, maintenance and l j operation of the local Sewage Disposal Plant was read, and on motion by Postier second by Cook it was ordered that in Section 5 wherever the word " maintenance " �! appears, there shall be added following the words " and operation " Alderman Bach introduced the following resolution, which was reads "Whereas, the use of the Zumbro River in the County of Olmsted and State of Minnesota for the disposal of sewage has become a menace to the health of the citizens of the City of Rochester and also to many others residing in sections con- tiguous -to said river; and CIhereas, the sewer . from the Rochester State Hospital empties into the said 1 .river along with the sewage of the City of Rochester, and the Board of Control of the State of Minnesota desires to co-operate with the -said City of R(bchester in .the construction and maintenance of a sewage disposal plant for the treat*ent of the said sewage. NOW, THEREFORE, Be it resolved by the Common Council of the City,of Roches ter-, Minnesota: That the Mayor and ` City Clerk of said City be and they hereby are author- ized and directed to enter Into a contract with the said State Board of Control for the construction, completion and future maintenance and operation of the said sewage disposal plant, a copy of which said contract is hereto attached, and made a part htreo f as fully as though set forth herein in detail: " Upon motion by Adler second by Wright that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolu- 416 !' tion duly passed and adopted. Alderman Wright introduced a resolution accepting the bid of G. Schwartz & Co., for the furnishing,of all labor abd materials necessary for all masonry work, cement, screens, settling tanks, aeration tanks, sludge digestion tanks, sludge beds, outlets, mechanical equipment, gradingv etc., for the construction of a Sewage Disposal Plant on part of outlots six (6), seven (7), eight (8) and nine (9), in Northern Addition, according to the plans, out- line drawings, specifications, etc., prepared by Frederic Bass, kn�ineer of Minneapolis, I'linnesota, and- on file in the office of the City Blerk of said City and fixing the amount of the bond to be given by the said contrgctor at the sum of $276,756.00, which was read: Upon motion by Postier second by Wright that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the i said resolution duly 13-assed and adopted: The recommendation of the Lighting Committee that a street light be installed in Eighth Avenue Southeast between Eighth Street and Ninth Street ,!was read, and on motion by Bach second by Postier the same was accepted and ordered placed on file, and the City Clerk was instructed to request of the Public Utility Board that they make installation accordingly. on motion by Postier second by Cook the City Clerk was instructed to ;return the certified checks of the unsuccessful bidders on the construction of the local Sewage Disposal Plant. Motion by Postier second by Wright carried that the G. Schwartz & Com- p any s bond shall be a surety bond. i The City Clerk and the City Attorney recommended the acceptance of the proposal of the Paine, Webber Onkpany for the purchase of $50,00040 441% iSewage Disposal Plant Bonds: • Alderman Postier introduced the following resolution, which was read: "Be it resolved by the Common Council of the, City of Rochester, Minne- sot a: That the bid and offer of Paine, Webber & Company for $509000 00 City of Rochester, Minnesota,. Sewage Disposal Plant Bonds dated September 1st, 19249 at this meeting offered for sale, being $50,00000 for the .principal of the said bonds with a premium of $197040, and accrued interest in the amount of $639.93, from June 1st, 1925, is deemed ---to be the most favorable, and said bonds are hereby awarded and sold to Paine, Webber & Company, and that the same b.e delivered to it upon its paying into the Treasury the amount of the said bid therefor; said bonds hereby awarded and sold are described as being numbered, :1, 29 39 169 179 189 319 329 339 469 473, 489 619 62; 639 76P 779 78s 91, 92, 1099 1109 1279 128, 145, 1469 163, 1�+, 181, 182, 1999 200, 2179 2189 235, 2369 253, 2549 271, 2729 2739 2919 292, 2939 3119312,. 313, 3319 332 and 3339 dated September 1st, 1924, and having December 1st, 19259 and all subsequent interest coupons attached, maturities ofc-said bonds being three (3) thereof on the first day of December of each of the years 1925 to 1930, both inclusive, two (2) thereof on December 1st of each of the years 1931 to 1940, both inclusive, and three (3) thereof on December 1st of each of the years 1941 to 1944, both inclu- sive, said bonds bearing interest at a rate of 4 $ per annum payable setif- annually on the first day of June and December of each year, both principal and interest on the said bonds to be payable at the office of hh.e City Treasurer of said City of Rochester, Minnesota; I 417 Be it further resolved by the said Common Council: That the Mayor and City Clerk are hereby authorized and directed to duly execute the said bonds and the City Treasurer is hereby directed to deliver the said bonds to the said Purchaser upon the payment into the City Treasury of the above mentioned Purchase price. "- Upon motion by Wright second by Adler that the said resolution be adopted as read, and all voting in favor thereof, President Meeks declared the said resolu- tion duly passed and adopted. Alderman Cook introduced the following resolution, which was read: "Be it resolved by the Uommon Council of the City of Rochester, Minnesota: !i That there is hereby created a Sewage Disposal Plant Fund in the City j! Treasury of said City into which the City Treasurer shall place and credit all funds li received from the sale of Sewage Disposal Plant Bonds and the premium, etc., there- on, and from which be shall disburse only for such items as are for the purpose of j establishing and building a Sewage Disposal Plant and a trunk line sanitary sewer connecting therewith, within and for. said City. " Upon motion by Bach second by Cook that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted: . On motion by Cook second by Adler the City Clerk was instructed to return the certified checks of the unsuccessful bidders for the above mentioned $50,000,00 Sewage Disposal Plant Bonds. Motion by Bach second by Wright carried that Frederic Bass be engaged as Consulting Engineer in the construction of the local Sewage Disposal Plant at $60.00 per day plus expenses, when deemed advisable and called in by the City Engineer, hhe total for the said services not to exceed one per cent of the total cost of the local Sewage Disposal Plant. Alderman Bach introduced the following resolution, which was read: "WHEREAS, the Common Council of the City of Rochester, Minnesota, heretofore ordered advertisement for bids for the furnishing of forty (40) tons of paving filler to the said City of Rochester, and } ?"HERLAS, the said bids received were rejected .by said Common Council. NOW ZHEREFORE, Be it resolved by the Common Council of the City of Rocheste if j' That the City Engineer' of said City be and he is hereby authorized and directed to purchase in the open market the said forty (40) tons of paving filler in such quantities and at such times as he may deem necessary. Upon motion by Cook second by Bach that the said resolution be adopted as read, and all voting in favor thereof, President WeeI&s declared the said resolution duly passed and adopted Motion by Cook second by Bach carried that the matter of an estimate of cost for. the installation -of cluster lighting on Second Avenue Southwest from Center Street West to Fourth Street Southwest, on Center Street West from Broadway Street to Second Avenue and on First Avenue Northwest from Center Street West to the C. & N. Wo Ry. Co.
