Minutes of a regular meeting of the Common Council of the City of Rochest Minnesota, Yield in the Council Chambers, in the City Hall, in said City, on Septem— ber 8th, 1925, at 2 o'clock P.M. Adler. Meeting called to order by President Weeks. Roll' ' Call: Present: Weeks, Bach, Cook, Kitzman, Posti er, Wright. Absent: Alderman Adler cane in' at this time and took his Chair. Motion by Postier second by Wright carried that the minutes of the meeti held on September 4th, 1925, be each approved* This being the time and place fixed for the opening of bids for the furnishing and installing of three automatic traffic control signals, the one bid of Signal "• n the Griswold Safety/Company agreeing to furnish and install three American Bobby Traffic Signals complete, for the sum of $1913.00, was opened and read. Si P. Boshnyak offered:'one. of his traffic control signals, wh,ick was recent- ly -patented under No. 14955719 free, if the City would pay for the cost of manufactu j anal installation, and on motion by Bach second by Adler his proposal was referred to the City Attorney. This being the time and place fixed for the opening of bids for the furni ing of a complete asphalt . mixing plant, the two bids of the Warren Bros. Company wer opened and read, they offering one standard portable asphalt paving plant for $$11,525.00; one of the same type without engine, boiler or trucks $109425.00; one of the same type without trucks, kettles, boiler or engine, $8,625.009 with a deduction of $400.00 if the City furnishes the concrete foundations, $300.00 if the City furnishes the common labor for erection and "t$475.00 if the City moves the plant from the railroad and places the plant and kettles on concrete foundations, and a propos to furnish one Junior portable asphalt paving plant complete and ready for operation for $-7500.00; one of the same type without engine, boiler or trucks, $6475.00 and one of the same type without trucks or boiler $6928000 and with a deduction of y$300.0 if the City constructs the concrete foundation, $250.00if the City furnishes the common labor fdr erection and $3750-00 if the City moves the plant from the railroad and places the plant and kettle on concrete foundation. Motion by Cook second by Bach carried that the above mentioned proposal for the furnishing of an asphalt mixing plant be referred to the City Engineer for tabulation and .recommendations in the matter, and after further discussion of the above offers motion by Cook second by Wright carried that the said motion be reedn— sidered and that the Aids of the Warren Bros. Company for the furnishing of an aspha miming plant be rejected and that their certified check be returned to them, and th a resolution be prepared which will provide for readvertisement for bids for that equipment. Alderman Cook introduced the following resolution, which was read: E1 420 I 4 "WHIEREAS, the Common Council of the City of Rochester, Minnesota, deem it expedient and necessary thAt a complete asphalt mixing plant be pur- chased for 71se of said City, and WHEREAS, Chas. H. Armstrong, City Engineer, having prepared plans, specifications and. estimate of cost for a complete asphalt mixing plant; SO THEREFORE; Be it resolved by the said Common Council: That the' said plans and'specifications be adopted as the plans and specifications for the said asphalt mixing plant and that the same be.placed on file in the office of the Vity Clerk of said City, and that the said esti- mate of copt be placed on file in the offfiee of the City Clerk of said City; Be it further resolved by the said Common Council: That the City Clerk of said City be and he is hereby authorized and directed to advertise for bids for the furnishing of the said asphalt mixing plant in accordance with the above mentioned plans and specifications, the said bids to be opened at a public meeting of this Commmn Council which is to be held at 8 o'clock P.M., on September 21st, 3.925; proposals to be solicited on the various types of machines. Each bid must be accompanied by a certified check upon some reputable bank -drawn payable to the Mayor of the City of Rochester, Minnesota, ' for at least ten (10) percent of the amount of the bid, which check and the amount of money specified therein shall. be forfeited to the said City of Rochester as liquidated damages if the bidder upon the letting of the contract to him shall fail to enter into the contract so let.' The said Common Council reserves the right to reject any and all bids. Upon motion by Cook second by Wright that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the i i said resolution duly passed and adopted. Alderman Adler introduced a resolution accepting the above mentioned bid of the Griswold Safety Signal Company for the installation of three automat- ; is traffic control signals and fixing the amount of the bond to be given by the said contractor at the sum of $1950.00, which was read. Upon motion by Wright second by Adler that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Motion by Postier second by Cook carried that the City Engineer be instructed to procure a conduit for the future fire alarm system wiring and lay the same in Second Street Southwest and Center Street West at. the same time that the installation of the traffic control signals (is' made, the said con- duits, etc., to be paid for from the Fire Protection Fund. The report of the Clerk of the Municipal Court for the week ending August 31st, 1925, showing criminal fines collected in the amount of $112.00, _ land civil fees received in the amount of $6.35, and for the week ending Septem- ber 7th, 1925, showing criminal fines collected in the amount of $19500 and `;civil fees received in the amount of $6.00, were each separately read, and on ;motion by Kitzman second by Wright the same were referred to the City Attorney., Balance sheet, income statements, etc., of the Public Utility Depart- ment as at August 31st, 1925, prepared by the Secretary of the Public Utility .Board, were laid before the Common Council, and on motion by Wright second by Adler the same were ordered placed on file, the said income statements showing a profit in the Light Department for the month of August 1925, of $67 7'7.07 and 421 a total net profit for the five months of this fiscal year of $38,794.88, and a net profit in the Water Department for the month of August 1925, of $2279.12 and a total net profit in the Water Department for the five months of this fiscal year of $7666033. . General balance sheep,, -trial balance, unexpended budget appropriation statement, etc., of the City of Rochester, Minnesota, as at August 31st, 1925, pre— pared by the .City Clerk, were laid before the Common Council and on motion by Cook second by Wright the same were ordered placed on file. The report of the Milk Inspector for the month of August 1925, was reed, ordered and on motion by Bach second by Wright the same was/placed on file. The application of Co. C. 205th Inf. Minnesota National Guard for permit to hold, give and conduct a public dance in the National Guard Armory,.on September 15th, 1926, was read: e a The application of Bemel Brothers for a junk dealers license was read, and on motion by Postier second by Adler the same was referred to the License Committee. f The following appointment was read, and on motion by Cook second by Bach the same was approved an& Placed on file;--`• " September 8th, 1925. Honorable Mayor and Common Council, City of Rochester, Minnesota. Gentlemen: Subject -to your approval I hereby appoint Mary V. Porter as Deputy City Clerk for the period September loth, 19259 to September 21st, 1925s inclusive; this appointment being made subject to her filing with and a bond in the amount of $500.009 indemnifying me for my, responsibility -in her administration of the office of the City Clerk under and through the above mentioned appointment. " Requisttion by the Health Officer on St. Mary',s lospital for Isolation Hospital services in the establishing, maintaining and releasing of quarantine in the case of Pauline Day as a diphtheria patient, was read, and on motion by Cook second by Wright the same was ordered placed on file. Motion by Cook second by Wright carried that the City Blerk be authorized !!to turn over three sets of Sewage Disposal Plant plans and specifications to G. j Schwartz/n oneo to the Dorr Company and one set to the F. T. Hildred & Co., one set to the Building and Electrical Inspector and two sets to the City Engineer. - Motion by Cook second by Wright carried that the matter of the delinquent r land unpaid taxes on the Pauline' Keuhn property purchased by the ' City of Rochester, I Minnesota, for use as a Tourist Park, be referred to the City Attorney and the Mayor, with request that they appear before the County Commissioners of Olmsted County with !; an appeal that theee above mentioned taxes be abated. I 0 41/ 422 On motion by Cook second by Adler the City Engineer find the City Clerk were designated as a Committee for the preparation of the 1925 sprinkl- ing assessments as provided for in Section 263 of the Charter of the said City. Statement of account showing $858,83 as being due Frederic Bass to make full payment for his services as Consulting Engineer in, the preparation of plans, etc., for the local. Sewage Disposal Plant , was read. Alderman Back introduced the following resolution, which was read "Be it RESOLVED by the Common Council of the City of Rochester, M- inne- sot a: That the sum of $858,83 be and the sAi.d sum is hereby appropriated from the Sewage Disposal Plant, Fund of said -City and ordered paid to Frederi c Bass as balance for services as Consulting Engineer in the preparation of plans, profiles, specifications and estimate of cost for our local Sewage Disposal Plant and the canvass of the bids therefor, being the balance for the full amount of three percent of $27605%60, or $8302.67. ' The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the "City Treasurer in accordance herewith, and cause said payment to be made. Upon motion by Cook second by Adler that the said resolution be adopt- ed as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Adler introduced a resolution appropriating $10,96108 From the Sewage Disposal Plant Fund and ordering payment made to the Sewer Fund for the reimbursement of the said Fund for tests, surveys, easements, real- estate, consulting engineer services, etc., in the preliminaries to the con- struction of the local Sewage Disposal Plant, which was read. Upon motion by Wright second by Cook that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said reisolution duly passed and adopted. i The following communication was read, and on motion by Kitzmanosecond by Codk the same was ordered Placed -on file: ," " Sept. 8th, 19251 To the Mayor and City Council, City of Rochester, Minn. Gentlemen: i Having complied with the city charter and advertised i for bids on the administration building for the new Tourist Pa rk we received bids today and find the bid of Zuehlke & 'Christopherson to be the lowest $2691.00, Two Thousand six hundred and Ninety one Dollars for a completed building Plumbing and Electrical work in- cluded according to the plans prepared by Harold Crawford the Arch- itect which I am inclosing. Inclosed find a certified check for $275.00, as required by the City Council for at least 10% of the bid, and we ask you that you allow us to enter into a contract with the above firm, having the City. " I M 423 Alderman Kitzman introduced a resolution authorizing the Board of Park Commissioners to enter into contract with Zuehlke and Christopherson for the con- struction of an administration building and equipment thereof for the New Tourist at ' Park/ the cost of $2691.009 and fixing the amount of the bond to be given by the said contractor at the stun of $2700.00, which was read. Upon motion by Cook second by Wright that the said resolution be adopted as read, and all voting in.favor thereof, President Weeks declared the said resolu- tion duly passed and adopted. First and final estimate prepared by Chas. H. Armstrong, City Engineer, in favor of John J. Kerr, showing the sum of $580.80 as being due to the said contractor for the construction of a concrete curb and gutter on Fourth Avenue Southwest from Fifth Street to Sixth Street, was read, and on motion by Bach second by Cook, the 1 same was order6d placed on file. li Alderman Bach introduced a resolution appropriating $580,80 from the Permanent Improvement Revolving Fund and ordering payment made to John J. Kerr, for first and final payment on contract for the construction of curb and gutter on Fourth Avenue Southwest from Fifth Street to Sixth Street, which was read. Upon motion by Bach second by Wright that the said resolution be adopted asrread, and all voting in favor thereof, President Weeks declared the said resolu- tion duly passed and adopted. A report of the Health Officer in the matter of the remonstrance over the condition of the barn located on the property of Dr. Chas. T. Granger, on Third Street Southwest, was read, and- on motion by Bach second by Wright it was ordered i placed on file. The report of the Finance Committed that they had examined the report of the Building and Electrical Inspector for the month of August 19259 and found the same to be correct, was read, and on motion by Cook second by Bach, the same wan ordered placed on file, and the said report of the Building and Electrical Inspector was ordered placed on file. An. Ordinance to amend an Ordinance entitled " An Ordinance establishing j jl fire limits and providing for all matters regulating the construction, maintenance, �j alteration, demolition and removal of buildings and other structures erected of to j: be erected within the City of Rochester", was given its second reading. I Alderman Wright introduced a resolution appropriating $296.62 from the jj General Fund and ordering payment made to the Public Utility Fund for water furnished I for sprinkling and flushing,$163.90 being for flushing and $132.69 being for sprinkle II irg, arhieh was read. ii Upon motion by Cook second by Kitzman that the said resolution be adopted 424 A as read, andcall voting in favor thereof, Pres -dent Weeks declared the said resolution duly passed and adopted. a Alderman Adler introduced a resolution appropriating $147.96 from the General Fund and ordering payment made to the Olmsted -County Oil Company for gasoline and grease used in sprinkling and flushing, which was reid. Upon motion by Wright second by Adler that the said resolution be - adopted as read, and all voting in favor thereof, President `Weeks declared the said resolution duly passed and adopted. i Alderman Cook .introduced a resolution appropriating $178.24 from the Street and Alley Fund and ordering payment made to the Olmsted County Oil Com- pany, for gasoline, grease, etc., furnished, $100.35 being for Job 403, $20.49 being for the Dmdge automobile, 018.47 for gravel pit operation, $1.1.1 for concrete mixer .operation, 031.07 miscellaneous and $6.75 for items furnished to the City Warehouse, which was read. i Upon motion by Cook second by Bach that the said resolution be adopt- ed -as read, and all. voting in favor thereof, President Weeks declared the said i resolution duly passed and adopted. Alderman Postier introduced a resolution granting permit to Co. C. 205th Inf., Minnesota National Guard, to hold, give and conduct a public dance i in the National Guard Atmory on September 15th, 1925, and fixing, the fee at the sum of $1.00, which was read. Upon motion by Wright second by Postier that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resol'dtioh duly passed and adopted. Alderman Postier introduced the-: following resolution, which was read: "Whereas, The Common Council of the City of Rochester, Minnesota, has heretofore agreed with the Olmsted County Public Health Association to re-im- i burse the said Association for money advanced by it to the State of Minnesota to be used in part payment of the salary of a public health nurse in said. City, and Whereas, the said agreement as herein mentioned is no longer in effect and whereas, the said City of Rochester desires to carry on the said work;' Now, Therefore, be it resolved by the Common Council of the City of Rochester, Minnesota: That Grace B. Hanson be and she hereby is placed on the payroll of the City of Rochester at a salary of $125e per month in addition to the sum of 025.00 heretofore appropriated towards her said salary, the said payment of $125. per month to be made to her on the last day of each and every month dur- ing the term commencing with the month of July, 1925, and continuing for 9 months. The installments for the months of July and August, 1925, now past due to be made immediately to the said Grace B. Hanson. Upon motion by Bach second by Cook that the said resolution be adopt- ed as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Postier introduced the following resolution, which was read: 425 Be it resolved by the Common Council- of the_ (.I.ty of Rochester, Minnesota: That Frederic Bass be and he is hereby engaged as Consulting Engineer in ll'! the construction of the Sewage Disposal Plant for the said City of Rochester. Be it further resolved: That hiss-tompensation be and the same is hereby fixed by agreement with him at the sum of $60-00 per day, plus expenses, for each and,. every day his services are rendered as such Engineer, with the underttanding and agreement that he is to render services in the construction of said disposal plant only at such times when he is called in by Chas. H. Armstrong, City Engineer of said City of Rochester and not otherwiseand the City Engineer is hereby authorized to !-incur the said expense whenever it is deemed advisable by him to do so. Be it further resolved: That the total sum paid out for -Engineer's fees as herein set forth shall in no event exceed a sum equal to one (1%) percent of the total cost of the Said Sewage Disposal Plant. Upon motion by Cook second by Wright that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolu- tion duly passed and adopted. The claim of St. Mary's Hospital for Isolation Hospital services in the establishing, maintaining and releasing, of quarantine in the case* of Catherine Moore of Port Arthur,.Texas,as a typhoid fever patients eleven days at $2.50 per day, was reads and on motion by Cook 6ecOnd.by Bach the same was referredto the City li Attorney. " Motion by Bach second by Adler carried that the 'Chief of the Fire Department be authorized to attend the National Convention of Fire' Chiefs at { Louisvil le, Kentucky, commencing September 28th, 1925, at the expense of the - `� City of Rochester. ' !� Motion by Adler second by Cook carried that the City Clerk be in- structed to transfer $1.19.42 from the miscellaneous division under the General Fund budget appropriation and place the same in the miseellaneouaPPolice ex- pense division as being the return for the expenditure made for painting and Il decorating the Police Station, which was heretofore charged against- the mis- cellaneous Police expense division. i On motion by Bach second, by Cook Council adjourned to September 21st, 1925, at 8 o'clock P.M.
