'Minutes of an adjourned regular meeting of the Common Council•of the
City of Rochester, Minnesota, held in the Council Chambers,. in the City Hall,
in said City, on September 21st, 1925, at 8 o'clock P.M.
Meeting called to order by President 'Reeks.
Roll Call: Present: Weeks, Adler, Bach, Cook, Kitzman, Postier,

Wright, Absent: None.
President Weeks announced that this was the time and place fixed for
a hearing on the construction of a concrete curb and gutter on Sixth. Street
Southeast from Third Avenue ,So-gthea$t to Fo-}rth Avenue Southeast, and asked if
there was any person present who wished to be heard relative ,to .the said im-
provement.. ,
There was no person present who wished to be heard:in regard to the

said curb and gutter.

H. A. Johnson of the Mayo Clinic requested consideration tending to
a reimbursement for a deficit of approximately $119,000000 between the various
appropriations made by the City of Rochester, ,the 'profits of the City Farm and

the expendituresi :made by the Health Department 'for public health purposes.
A motion by Postier second by Adler carried that the Chair appoint a

Committee to meet with the Mayo Clinic acconntant.. for as audit of the above

mentioned account, at which President Weeks appointed. the City Clerk, Alderman
Postier and Alderman, Kitzman. as. a Committee for ;that work.

This being the time and place fixed for. the opening of bids for the
construction of combined concrete curb and gutter on Sixth Street; Southeast
from Third Avenue Southeast to Fourth Avenue Southeast, the one bid of John J.
Kerr was opened and read, the said bid being completed grading 70 cents per

cu. yd:, completed combined curb and gutter 90 cents per lineal foots
Alderman Cook introduced a resolution determining to adhere to all
former resolutions passed and adopted in the proceedings relative to the con
struction of the above mentioned outb and gutter, which was read.

$7315.00, ,with a deduction of $1100.00 if the 1500 gallon melting kettle is not taken
and $150..00 if the vertical. boiler is not taken and $450 .00 if the engine is not
taken, or one standard portable asphalt paving plant $11,255.00 with a deduction
of $1650.00 if the two 900 gallon kettles and piping are not taken,.$950.00 if the
engine is not taken, and $1100.00 if the boiler is not taken;

Motion by Cook second by Adler carried that the Chair appoint a committee
for joint consideration with the City Engineer of the above mentioned bids, at w1ioh

President Peeks appointed the Street and Alley Committee and the Chairman of the
Finance Committee as a' Committee for that purpose, r

The following Committee recommendations were read, and on motion by Po stie
second by Wright the same were accepted and ordered placed on file:

The City Engineer reported the quotation of Melding and Shepley/that
they would agree to repair the asphalt concrete pavement for $1.50 per sq. yd.
providing that there would be 2000 yds. to be repaired.
Alderman Cook introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester,' Minne-
sota: ,
That the proposal of the Barber Asphalt Company for the furnishing of
a complete asphalt mixing plant in accordance with the specifications therefor
which are on file in the office of the* City Clerk of said City, viz:
One Iroquois Rapid Mixers, complete with all necessary small
tools, delivered =and set up at the City of Rochester's plant
site for the sum of $ 1800.00
be and the said proposal is hereby accepted.
The amount of the .bond to be given by the said contractor is hereby
fixed at the sum of $1800.00. "
Upon motion by Cook second by Wright that the said resolution be
adopted as read, and all voting in favor thereof, President Weeks declared the
said resolution duly passed and adopted.
On motion by Cook second by-Kitzman the certified checks of the
unsuccessful bidders on the furnishing of a complete asphalt mixing plant were
ordered returned to them.
The report of the Clerk of the Municipal Court for the week ending
Sept ember 14th, 1925, sho wing criminal fines collected in the 'amount of $210 000
and civil fees received in the amount of $2..00, and for the.week ending
September 21 st,1925, showing criminal fines collected in the amount of $134.00
and civil fees received in the .amount of $4.35,, were each separately read, and
on motion by Kitzman second by Wright the sale were referred to the City Attor-

A petition asking that a water main be laid in First Street Northwest from
Eleventh Avenue Northwest to Twelfth Avenue Northwest,.was read, and on motion by
Cook second by Wright the same was referred to the Water,Committ6e.
A petition asking that a sanitary sewer be constructed in Sixth Street
Northwest from the end of the recently constructed sanitary sewer to a point 50 feet
East of the East line of Eleventh Avenue Northwest, and that a water main be laid
in

the South line of First Street Southwest and the North line of Second Street Southwe

Alderman Adler introduced the following resolution, which was read:
"WHEREAS, the County of Olmsted in the State of Minnesota, and Independent
School District No. 8, of Olmsted County, Minnesota, have presented to the Common
Council of the City of Rochester, Minnesota, their petition praying for the vacation
of Fourth Place Southwest (formerly Court Street) iboahthe south line of First Btreet
Southwest (formerly Fourth street) to the north line of Second Street Southwest (for-
merly Zumbro Street) ; and
WHEREAS, It is deemed expedient that the matter should be proceeded with;
NOW THEREFORE, Be it resolved by the Common Council of the City of Roches-
ter.: That said petition be filed of record with the City Clerk and that the Common
Council of said City hear and consider the same in the Council Chambers, in the City
Hall, in said City, on Monday the 2nd day of November, A. D. 1925, at 2 o'clock P.M.,
and that the City Clerk be, and he hereby is, directed to give notice thereof as
required by the Charter of said City. "

The following copy of resolution passed by the Public Utility Board was
read, and on motion by Cook second by Adler Ahe same was ordered placed on file:
"Be it and it is hereby resolved by the Public Utility Board of the City
of Rochester, Minnesota, that the contract for the furnishing to the said City of

enter into contract accordingly.
Alderman Wright introduced a resolution authorizing the Public Util-
ity Board to enter into contract for the above mentioned chlorinator and
11 equipment at a price of $928.00, and fixing the amount of the bond to be given
by the said contractor at the sum of $928001, which was read.
Upon motion by Crook second by Bach that the said resolution be adopt

patient, was read, and on motion by Cook second by Wright the -same was ordered
placed on file.
A communication from John Henchel relative to the. condition of the
alley at the rear of his property Ut Belmont Addition was read, and on motion
by Bach second by Wright the same was referred to the Street and Alley Com-
mittee and the City Engineer.
Motion by Cook second by Wright carried that the sum of $5400 be
appropriated from the Street and Alley Fund and paid to Fred S. Brown as .com-
pensation for injury during the period September 1st, 1925, to .September 21st,
19251, inclusive
On motion by Cook second by Wright the City Clerk was instructed to
request of the various department heads that they file with him for Common
Council action their estimate of the needs of their, department for the coming
year, which said estimates are to be for incorporation in .a tentative budget
of the 1925 tax levy, the said estimates to be filed on or..before October.lst,
1925, in order that they may be compiled and have public consideration before
the time for the , aftual making of the tax levy arrives:
The claim of Olaf Weiberg in the amount of $195,190, being $160.00
balance on his contract for the decorating, etc., for the interior of the City
Hall, $5.00 for oiling the floor in the Municipal Court Room, $4.75 for var-
nishing the gas testing machine case, $12.00 for extra sign work, $5.40 for
setting window glass in Police Station and $8:75 for'cleaning and varnishing
seven chairs in the Municipal Court Room, was read, and on motion by Kitzman
second by Wright the sum of $185:00 was appropriated from the General Fund and
ordered paid to Olaf Weiberg, the said appropriation being $160.00 balance on
contract, and payment for the above mentioned items with the exception of
$10.90 on the extra Sign work, the same being held under consideration until

such time as it is decided whether the contractor or the City shall pay for the dis-
connecting and reconnecting of the City Clerk's telephone in order to get his desk
out for varnishing, whether the contractor or the City shall pay for 90 cents elec-
trician servicesw4ghthe City Engineer contracted in order to get his desk light
connected up and until it is decided as to whether or not the Building and Electrical
Inspector shall be required to put back the original wording on= the Council Chamber
doors, he having unofficially ordered the contractor to paint thereon " Inspector of
Buildings ", instead of Building and Electrical Inspector which were there originally.
The following report was read, and on motion by Adler second by Wright
the same was ordered placed on file and the permission therein mentioned was granted:

Alderman Cook introduced an, ordinance regulating traffic within the City
of Rochester, providing for the operation.and parking of vehicles and designating
arterial Sighways in said City, which was given its first reading. i
Motion by Cook second by Adler carried that the -rules be suspended and that

the said ordinance be given its second reading, and it was given its second reading

accordingly.
Motion by Adler. second by Cook ti)Lrried that the -rules be suspended and the
said ordinance .be given its third and final reading, and it was given its third and
final reading accordingly.
Upon.motion by Postier second by Wright that the said ordinance be adopted
as read, and all voting in favor thereof, President Weeks declared the said ordinance
duly passed and adopted.
On motion by Postier second by' Adler the City Engineer was instructed to
secure the necessary labor and materials and mark the newly designated parking spaces
at once:

prepare. specifications and estimate of cost for the necessary arterial highway signs.

and estimate of cost for the construction of a sanitary sewer in Sixth Avenue South-
east from the center of Eighth Street Southeast to a point 200 feet South of the
center bf Eighth Street Southeast which were considered by the Common Council, the

Alderman Wright introduced the following resolution, which was read:

contract for the construction and making of the following described local pub -
lie improvement, in said City, the cost and expense of which said public im-
provement shall be paid by special assessments levied in.a manner provided by
law, to -exit:
( That Second Avenue Southwest from the South line of Center Street
West to the North line.of Third Street Southwest be paved and re -paved with
three inch (3") vertical fibre cut vitrified clay* or shale, non -repressed, and,
especially burned for street.paving, brick, to a width of fifty (50) feet, and
hhat a cement concrete curb be constructed along both sides of the said paving,
and that the intersecting streets and. alleys be paved and re -paved to the side-
walk line*
TFEREFORE, .Be it and it is hereby resolved by the Common Council of
the City of Rochester, Minnesota:
That the said Common Council will meet at 8 o'clock P.M., in October
12th, 1925, in the Council Chambers, in the. City Hall, in said. City, and will
` at said time and place levy special assessments for the cost and expense of
the, making and constructing of the improvement. above described, according to the
resolutions heretofore passed and adopted by the said Common Council determin-

Alderman. Wright,introduced a resolution appropriating $15.64 from the
Sewage Disposal Plant Fund and ordering payment made to the Rochester Post -Bulletin
for official printing and publi cations in connection with award of contract fot the
construction of the local Sewage Disposal Plant and for the sale of $50,000.00 of
Sewage Disposal Plant Bonds, which was read.

$158.00 thereof being for the cost of printing 350 Sewage Disposal Plant Bonds
and 98 cents thereof being for the express charges in the delivery of the - said

of cost for 25 tons of Genasco liquid asphalt, which were considered by the
Common Council, the said estimate of cost being4$1450.00.
Alderman Postier introduced the following resolution, which was read:

"Whereas, the Common Council of the City of Rochester, 1innesota, deem
it expedient and. necessary that Twenty-five (25) Tons of Genasco Liquid Asphalt
he purchased for use in the repair of streets in said City, and
Whereas, Chas. H. Armstrong, City Engineer, has prepared plans, specifica-
tions and estimate of,: cost therefor;
Now Therefore, Be it resolved.by the said Common Council:

That the' said plans, and specifications be adopted as the plans and speci-
fications for the said Genasco Liquid Asphalt and that the same be filed in the
office of the City Clerk of s4id City, and that the estimate of cost be placed on
file in the pffice of the said City Clerk;
Be it further resolved by said Common Council:
That the City Clerk of said City be and he is hereby authorized and direct-
ed to advertise for bids for the furnishing of the said Genasco Liquid Asphalt in
accordance with the said t9lans and specifications, the said bids to be opened at a
public meeting of this Common Council which is to be held on the.5th day of October,
1925, at 2 o'clock P.M.
Each bid must be accompanied by -.a certified cheek'upon some reputable bank
drawn payable to the Mayor of said City of Rochester, Minnesota, for at least ten
(10%) percent of the amount of the bid,lwhich check and the amount of money therein
specified shall be forfeited to the said City of Rochester as liquidated damages if
the bidder upon the letting of the contract to him'shall fail.to enter into the
contract so let. The Common Council reserves the right to reject any and all bids.'
Upon motion by Postier second by Wright that the said resolution be adopt-
ed as read, and all voting in favor thereof, President Weeks declared the said
resolution duly passed and adopted.
Upon motion by Kitzman second by Bach Council adjourned to September 28th,
1925, at 8 o'clock P.M.
