Meeting called to order by President Weeks. Roll Call: Present: leeks, Adler, Bach, Cook, Kitzman, Postier, Wright. Absent: None. Motion by Kitzman second by Wright thrried that the minutes of t#e meetings held on .September 8th, 1925, September. 15th, 1925, and September 21st, 1925, be each approved. President weeks announced that this was the time and place fixed for a hearing on the levying of special assessments for the following described improvements and asked if there was any person present who wished to be heard relative to either or any of toes: Curb and gutter on and the grading of Fifth Street Southeast from the West line of Third Airenub Southeast to the West line of 3irst Place Southeast; Curb and gutter on Second Avenue, Southeast from the South line of Fourth Street Southeast to a point 22� ft. South of the North line of Fifth Street Southeast; Curb and gutter on and the grading of Fifth Avenue Southeast from the South line of Sixth Street Southeast to the North line of Tenth Street South- east; A sanitary sewer in parts of Second Street Southeast and Sixteenth Avenue Southeast; A sanitary sewer in Eighth Avenue Southeast from the center of Fourth Street Southeast to a point 250 ft. South; A sanitary sewer commencing at.the center of the intersection of Fifth Street Northwest and Sixth Street Northwest and running thence North and Northwesterly along the center line of said Sixth Street Northwest to a point Opposite the center of Lot 18 in Block 2 in Conley's Addition; A snAltary sewer in Tenth Street Southeast. from the center of Fifth Avenue Southeast and running West to a point 77 ft. East of the center line of Fourth Avenue Southeast: There was no person present who wished to be heard relative to either or any of the above described public improvements. A petition asking that the center parking of automobiles be not abol- was read ished, aligned by many local business men$ the wording of the said petition ' being: "To the Mayor and Common Council, City of Rochester, Minnesota: We, the undersigned, do hereby petition you not to abolish the center parking of automobiles on the streets and avenues now being used for that purpose. C. Fraser and Son, being the lowest responsible bidder. " Alderman Bach introduced a resolution authorizing the Public Utility Board to enter into contract with the L. A, Kepp Electric. Company for the above des- 442 cribed ornamental lighting at a' cost of $6681:78; grid fixiflg the bond to be given by the said contractor at the sum of $668:.00, which was read.: Upon motion by Bach second by Adler that the said resolution be adopted as read., and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Adler introduced a resolution authorizing the Public Utility a Board to enter into contract With Wm. C Fraser and Son for the construction of water main extensions as above described at a cost of $2900.00, and fixing the amount of the bond to.be given by the said contrabtors at the sum of $290000, which was read. Upon motion by Cook second by Kitzman that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted.. Upon motion by Cook second by Wright that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Wright introduced a resolution levying special assessments for the construction of a sanitary sewer commencing at the intersection of Fifth Street Nort west and 'Sixth Street Northwest and running thence North and Northwesterly along the center line of said Sixth Street Northwest to a point opposite the center of Lot 18 in Block 2 in Conley's Addition, which was read. Upon motion by Cook second by Kitzman that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resoluti duly Passed and adopted. II 4f 446 Alderman Kitzman introduced a resolution levying special assessments for the construction of a samktary sewer in Second Street Southeast from the center of Fifteenth Avenue Southeast to the center of Sixteenth Avenue South- east and in Sixteenth Avenue Southeast from the center of Second Street South- east to a point 100) feet North. of the North line of Fourth Street Southeast, j `which alas read. Upon motion by.Cook second by Kitzman that the said resolution -be adopted -as read, and all voting in favor thereof, President Weeks declared the � I said resolutiondilly passed. and ' adopted: ° Alderman Adler introduced a resolution levying special assessments for the 'construction of combined concrete curb and gutter along both sides of 1 j Fifth Street Southeast from +the West line of Third Avenue Southeast to the West line of `First Place Southeast, the said gutter to be twenty-four (24) inches wide and the said curb to be -six (6) inches wide and set to a distance of Thirty (30) feet between the inside faces, providing however, that the curb and gutter fine shall conform to the present curb in place, and that the said part of Fifth Street Southeast be graded to an established grade line and to a width of twenty-six (26) feret, which was read. Upon motion by Wright second by Cook that the said resolution be adopted as read, and all voting in favor thereof,.President'Weeks declared the said resolution duly passed and adopted*. Alderman Cook introduced a resolution levying special assessments for the construction of a combined.concrete curb and gutter along both sides of Fifth Avenue Southeast from the South line of Sixth:Street Southeast to the North line of Tenth Street Southeast, said gutter to be twenty-four (24) inches wide and the said curb to be six. (6), inches wide and set to a distance of thirty (30) feet, between the inside faces, and that the said part of Fifth Avenue Southeast be graded to an established grade line and to a width of twenty-six (26) feet, which was read.. Upon motion by Wright second by, Postier that the said resolution be adopted as read, and all voting.in favor thereof, President Weeks declared the said resolution duly passed and adopted - Alderman Bach introduced a resolution levying special assessments for the construction of a combined concrete curb and gutter on Second Avenue Southeast from the South line of Fburth..Street Southeast to a point t 22- feet South of the North line of Fifth Street Southeast, with the face of the said. curb toward the center of the street to be 15t_ ni from -the -center line of the street, which was read. Upon. motion by Adler second.by Wright th4t the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the i said resolution duly passed and adopted. : 447 The report of the Justice of the Peace of the First Ward for the period December lst,.1924, to August 31st, 1925,.inclusive, was read, and on motion by Kitzman second by Wright the.same was referred to the City Attorney. The monthly reports of the City Hustice ,from December 1924s to August 1925, inclusive, were each apparately read., and on motion by Postier second by Wright the same were neterred to the City Attorneys - The. application of the Winona Oil Company for permit to. place and maintain a sign on the boulevard at the Northwest corner of the intersection of Second Street Southwest and Eleventh Avenue Southwest, was read, and on motion by Postier second by Kitzman, permission was granted. The following applications for permits to hold, give and conduct public dances tare each separately read: The Fifty -Fifty Club at the Woodman Hall, Sept. 29th, Oct. 13th and 27thil 1925; Taylor Cutshall, at the Woodman Hall, `October 3rd, 1925; The Sunshine Club, at A.D.U.W. Hall, Oct. 5th, 19th and 29th, 1925; A petition asking that a street light 'be installed at the intersection of Third Avenue Northwest and First Street Northwest, was re)4d, and on motion by Cook second by Wright the same was referred -to the Lighting Committee. Papers served in the condemnation by Independent School District No. 8 of Olmsted County of Block 7 in Wm. McCullough's Addition, for use as a school .site were read, and on motion by Cook second by Bach the s�me were referred to the City Attorney. The appointment by the Mayor of E.-S. Ferguson as a Special Patrolman in at.the Woodman Hall, to hold, office until Mr. Fordham is able to resume his duties was read, and on motion by Cook second by Kitzman the same was ordered placed on file. Statement rendered by Mr.I Gilbert Utz of the Mayo Clinic showing a deficit in the operation of the Board of Health of $10,501.50 during the period of the year. 1913 toy and including March 31st, 1925, was read, and on motion by Cook second by Wright the same was referred to the Special Committee which was appointed for the audit of this deficit. On motion by Postier second by Cook the City Clerk was instructed to re - least and return the cancelled public liability and property damage insurance policy No. APL. 6468309 which was issued to George Lund doing business as the Rochester Cab Company, . and later, cancelled by the Insurance Company on account of non-payment of premium, the said policy having been filed as required in the Ordinaned covering the operation of automobiles lend taxi -cabs for hire. Y` On motion by Postier seoondr byttWright the City Clerk was authorized to return the $50400 deposit which was made'to secure a set of the Sewage Disposal Plan plans and specifications for the use of the Simplex Ejector, Company of Chicago, Illi - ois, and allow them to retain the set which they .have until the completion of the delivery of the Sewage Disposal. Plant equipment which they are to furnish. . An agreement with the Winona Oil Company wherein if the purchases by the City of Rochester of gasoline during the month of September 1925, exceeds 750 gallons there will be a rebate of one-half cent per gallon, if tt exceeds 2000 gallons.three-fourths cent ;per gallon, 3000 gallons &ne cent per gallon and 6000 gallons one and one-half cents per gallon, was. read, and on motion by Cook second by Kitzman, the Mayor and City Clerk were authorized and direct- ed to execute such an agreement on the part of the City of Rochester, Mine- sot a. Motion by Kitzman second by Adler the sum of $10.90 was appropriated from the General. Fund and ordered payment made to Olaf Weiberg as balance in full for contract and extras for the decoration,etc., of.a part of the interior of the City Hall. ,The report of the City Attorney to the effect that he had checked the reports of the Clerk. of the Municipal Court from June 1st, 1925, up to and including September 21st, 1925, was read, and on motion by Cook second by Wright the said report of the City Attorney was ordered placed on file, and the said reports of the Clerk of the Municipal Court were ordered placed on file. The recommendation of the Water Committee that a water main be laid in Fourth Street Northwest from Fourth Avenue Northwest to Fifth Avenue North- west and in F ttt Street Northwest from Eleventh Avenue Northwest to Twelfth Avenue Northwest, was read, and on motion by Cook second by Adler the same was ordered placed; on file, and the 'City Clerk was instructed to prepare a resolu- tion directing the Public Utility Board to make installation accordingly. The recommendations of the Sewer Committee and the" Water Committee that a sanitary sewer and water main be laid in Sixth Street Northwest mom the end of the present sewer and water main tb a point 50 feet East of the East line of Eleventh `Avenge Northwestv was read, and on motion by Wright second by Cook.the same was ordered placed on file, and the City Clerk was instructed to prepare a resolution directing the Public Utility Board to make installation of a water main accordingly and prepare,a resolution fixing a hearing on the construction of a sanitary sewer in the said part of Sixth Street Northwest. The City Clerk reported that the Nawkeye Oil COmpany claimed to have lost warrants Nos. 1041, 1042, and 10439 drawn to their order and dated July 16th, 1925, and on motion by Kitzman second by Wright the Mayor and City Clerk i were authorized and directed to draw duplicates of these warrants. and stop% pay-. ment on the originals. Estimate No. 1 prepared by C. H. Armstrong, City Engineer, in favor of the Purington Paving Brick Company, showing the sum of $1530.98 for the furnishing of 539400 paving brick on their contract for same after $589.53 freight deduction, was read, and on motion by Cook second by Wright the same 01 I L 9 was ordered placed on file. First and final estimate prepared by Chas.-H. Armstrong, CityfEngineer, in favor of Wm. C. Fraser and Son for the construction of a sanitary sewer in parts of Second Street Southwest and Fifteenth Avenue Southwest, showing the sum of I I 41545.80 as being due to said contractors ,. and first and final estimate in favor of Wm. C. Fraser and Son for the construction of a sanitary sewer in part . of Second Avenue Northwest showing the sum of 0822,76 as being due to the said contractors, were each separately read, and on motion by Cook second by Adler the said estimates were ordered placed on file. Upon -motion by Kitzman second by Cook the said two sanitary sewers were each accepted as having been completed aecordigg to contract therefor. A certificate from the City Engineer showing the sum of $1088.10 as being due to the Texas Company for 80,600 lbs. of No: 39 paving. filler @ $27.00 per ton, was read, and on motion by Wright second by Kitzman the same was ordered placed on file: r: Alderman Adler introduced a resolution granting permit to the Fifty" Fifty diub to hold, give and conduct public dances in the Woodman' Hall on September 29th, and October 13th and 29th, 1925, and fixing the fee at the total sum of $3.009, which bras . read. Upon motion by Adler second by Cook that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolu- tion duly passed and adopted. 0 Adderman Adler introduced a resolution granting a public dance permit to Taylor Cutshall, to hold, give and_. conduct a public dance in the Woodman Hall on October, 3rd, 1925, and fixing the fe4 at the sum of $5.00, which was read.. Upon motion by Bach second by Adler that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolu- tion duly passed and adopted. Alderman Bach introduced a resolution.granting permit to the Sunshine Club to hold, give and conduct public dances in the A. 0. U. W. Hall on October 5th, 19th, and 29th, 19251, and fixing the fee at the total sum of $3.009 which was read. Upon motion by Cook seco;td by Kitzman that the said resolution be adopted as read, , and all voting in favor thereof, President Weeks declared the said resolu- tion duly passed and adopted. Alderman Postier introduced a resolution fixing 8 o'clock P.M., October I (_ : 12th, 1925, as the time for the levying of special assessments for the .grading to an estat?li shed grade line of the. East. and West alley , running through Block 1 in Head and-McMahon's Addition, and the grading to an established grade line of Tenth Street Northeast from the East line of, First Avenue Northeast to the West line of Second Avenue Northeast and providing for notice of a public hearing thereon at that time, �� which was read. , 4f 450 Upon motion by Wright second by Codk that the said resolution be 1 adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Kitzman introduced a resolution appropriating $2000.00 from the Permanent Improvement Revolving Fund for use of the Street and Alley Com- mittee, of sAi.d City, which was read. Upon motion by Wright second by Kitzman that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Kitzman introduced . a resolution appropriating $1530.98 from the Permanent Improvement Revolving Fund and ordering payment .made to the Pur- ington Paving Brick Company for the furnishing of 539400 No. 1 paving brick $2120*51 less $589.53 freight paid, in accordance with estimate No. 1 on the contract for the said brick, which was read.
