'Gentlemen:

I have investigated the rights of the Interstate Power
Company, formerly the Rochester Gas Company, under the ordinance
passed June 3rd, 1903, and having had the matters of an advance
I
deposit and a minimum monthly charge as demanded by the Company
referred to me, Beg to report as follows:
It is my opinion that the Interstate Power Company can
legally demand an advance deposit by any one desiring -connection
with its mains.

It is my opinion that the Interstate Power Company cannot

legally demand .a minimum -charge for gas from its custamers since the
rate to be charged by it is fixed ,by ordinance,

The local manager for the Interstate Power Company gave the information

that his Company will, at the Council meeting to be held on October 19th, 1925,
formally present an amending ordinance and ask for its passage, which will allow
them tinder their `franchise, amended accordingly, to make a minimum charge for gas
service. f

WHEREAS, the Common Council of -the City of Rochester, Minnesota,,
has made special assessments for sprinkling streets in said City during the
season of the year 1925, which assessments are now before said Common Council;
THEREFORE, Be it and . it is hereby resolved by said Common Council

That said special assessments are hereby ordered filed in the office of
of the City Clerk of said City, for the inspection of all persons who may be
interested in the, same.
Be it further resolved':
That a public=meeting of- said Common Council will be held at 8 o'clobk,P.AA.
on October 19th, 19259 at the Council Chambers, in the City Hall, in said City,
ands at said time and place the Common Council will consider and act upon said assess-
ments and each o,f them and will then and there hear any and all objections which
persons or parties interested in said assessments, or either or any of them, may
desire to make or offer thereto.
. The City Clerk is hereby ordered to publish in the official newspaper of
said City a notice to all persons Snd parties of the time and place of said meeting
and of the purposes for which the same is to be held.
Upon motion by Wright second by Bach that the said resolution be adopted
as read, and all voting in favor thereof, -_President Weeks declared the said resolu-
tion duly passed and adopted.
The Common Council compiled a tentative budget for the 1925 tax levy and
upon motion by Cook second by Adler the City Clerk was instructed to give the result
to the local newspaper with information that the same would have public hearing on
October 19th, 1925, at 8 o'clock P.M.; the result of the said compilation being -
Wi,420, for the General Fund, $15,450, for the Street and Alley Fund, $52,600.
for the Sewer Fund, $3500, for the.Bridge Rind, $17,000* for the Park Improvement
Fend, $1180, for the Lighting Fund, $10,625, for the Library Fund, $10,0004 for the
Permanent Improvement Fund, $5000* for the Musical Entertainment Fund, $3500, for
the Interest Fiend, $2500, for the Sinking Fand, and Ine-tenth of one mill for the
Firemen's Rtlief Rind..

Alderman . Cook reported that he had not received warrant No. 1696, dated
September 30.th, 1925, and drawn to his order in the amount of $100, 00 for salary
as Alderman and Chairman of the Street and Alley -Committee for the quArter ending
September.30bh, 1925, at which motion by Bach second byPPostier carried that the
Mayor and City Clerk be authorized and directed to draw a duplicate warrant and stop
payment on the above mentioned original,
On motion by Bach second by Cook Council adjourned to Oct. 19th, 1925, at
II. 8 o'clock P.M.
