Pfinutes of a Special Meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, in the City Hall., in said

Meeting called to order by President Weeks.

The call for the Special "eeting was .read, the said meeting being
called. for the purpose of meeting with the Oronoco Township Hoard rclati.ve to
the " Kurth Road % and any other businews that the said Common Council. might
„ deem proper.
The report of the Clerk of theIunicipa.l Court for the week ending
October 12th, 19259 showing fines collectEd in the amount of IP50.70 and civil
f
fees .received in. the e,moian.t of $.75 and the report fo-r., the week ending Octobe."

civil fees received in the amount of 94.25, were each separately reezd, and on
motion by Cook second by Postier the same were .referred to the City Attorney.
The application of the Sun shine Club for Permit to hold, give &nd con-
duct public dances in the A.O.U.W. Hall, November 2n.d, 16th and 30th, 19259
was read.
i Alderman Kitzman came in at this time end took his chats.
The application of Wm. Ti, Williams for a driver's license was .read,
and on motion by Postier second by Wright license was granted.
Copy of requisition on St. Mary's Hospital for Isolation Hospital
services in the establishing, maintaining and releasing of quarantine in the
case of Robert Oviatt, as a poliomyelitis patient, was read, and .on motion by
Kitzman second by Cook, was ordered filed.
A communication from

was read.,
and on motion by Kitzman second by Postier the City Clerk was instructed to
'; reply that the decision of this Common Council was not to accept the above
mentioned offer as the eaxly need for more money in the Sewage Disposal Plant
Fund. makes possibility of investment for Sinking I+iinds from next issue of
Disposal Plant Bonds.
The regnest of the Public TT+,iI ity Board that the Common Council com-
mence condemnation proceedings on the Henry Kiester property, knocm as Lotrs
5 and 6, in Block_ 50, in Original Plat,, was read, and on motion by Wright
second by Cook the seme was ordered placed on file.
An application from the Yellow Cab Company asking that the ownership
on taxi -cab license No. 8, heretofore issued to the said Company be changed to
show the ov.m.ership as the Red Top Cab Company, that automobile license No,16

on the part of the City of Rochester, Minnesota.
Alderman Bach introduced a resolution appropriating $9331.89 from the Street
and Alley Fund and ordering payment made to the Tennessee Tool Works for one model B
Ault traffic line marker, which was read.
Upon motion by Bach second by Wright that the said resolution be adopted as
read., and all voting in favor thereof, President Weeks declared the said resolution
drily _passed and adopted.

Upon motion by Cook second by Bach that the said resolution be adopted as ;

Alderman Cook introduced a resolution appropriating $1371,88 from the
Street and Alley Fund and ordering payment made to the Barber 11sphal.t Company for
50,014 lbs. of elenasco liquid asphalt @ $54.86 per ton, which was read.
Upon motion by Wright second by Kitzman that the saiu .res,;lui;l.un be adopted

Alderma•n. Writ;ht introduced the following: resolution. which was read.:
"Be it, RESMVED by the Common Council of the City of Rochester, Minne-
sot a:
That the sum ofn3000.00 be and the said sum is hereby appropriated
- from the Sewa!7e Disposal plant Find of said City and ordered p,2-id to Chas. A.
Armstrong, City Engineer, for extraordinary services in connection with the
local. Sewage Disposal. Plant, being payment in full for such services to April
1st, 1926. -

The Mayor and City Clerk are hereby authorized and directed to draw
a warrant for said sum upon the City Treasurer to accordance herewith, and
cause said payment to be made. "
i Upon mtition by Wright second by Cook that the said resolution be
adopted as read, and all voting in favor thereof, President Weeks declared the
said resolution duly passed and adopted.
Alderman Cook introduced a resolution granting a dance permit to
the Sunshine Club to hold, give and conduct public" (?Vices in the A.O.U.�-..
Fall, on November. 2nd, 16th and 30th, 1.925, and. .fixing the fee at the sum of
$3.00, which was read.
Upon motion by Postier second by Kitzman that the said resolution bf
adopted as read, and all voting in favor thereof, President, Wee'cs declared the
said resolution duly passed and adopted.
C. H. Armstrong, City Engineer, submitted plans, profiles, specifi-
cations and. estimate of cost for the construction of a surface drainage s.�wer
in Seventh Street NorthvjeGt from Broadway Street North to the alley neat F.'est
and in Eighth Street Southeast from Third Avenue Southeast to fourth Avenue
Southeast, which were considered by the Common Council, the estimate of cost
for the surface drainage sewer -in Seventh Street Northwest being ";"250.00 and
for that in Eighth Street -Southeast `i485.20.
Al.clerman Bach introduced the :following resolution, which was read:
IIWTTEREAS, the Common Council of the City of' Rochester, A,Tinnesota,
deem it expedient and necessary that surface drainage sewers be constructed in
Seventh Street Northwest, from Broadway Street North t.o the alley next West
and. in F_ ghth Street Southeast, Third Avenue Southeast to Fourth Avenue - L)outh-
east, and
MEREAS, C. F. Armstrong, City Engineer, has prepared and submitted
plans, .profiles, specifications and estimate of cost for the said surface
ci.rainage sewers, and.
MTEREAS, the said estimates of cost do not exceed the Charter limita-
tions relative to advertisement for bids;

and Cirected to secure the necessary labor, materials, etc., and cause the
said surface drainage sewers to be constructed. in accordance with the Said
plans, profiles and specifications. "

Upon motion by Cook second by Wright that the said resolution be adopted
as read, and all voting in favor thereof, President Weeks declared the said resolu-
tion duly passed and adopted.
The following olaims were read, and on motion by Kitzman second by Cook
the Name were allowed and the Mayor and City Clerk were authorized and directed to
draw warrants upon the City Treasurer and make payment accordingly:

On motion by Cook second -by Wright the sum of72.Oo was appropriated from
the Street and iJley liViid and ordering payment made to Fred S. Brown as compensation
for injury to and includilig October. 19th, 1925.
Irving L. Eckholdt as Attorney for Chas. Kurth ,end Andrew Raker and Fred
Rucker as a majority of the Township Board. of Oronoco Township, agreed, that although
the preference of Mr.. Kurth is for a lake shore roadway, they would accept a road
for Air. Kurth which would run Northerly from his property and connect up with the
joint Township road on the boundary
line between Olmsted County and
Wabasha
County.
In the discussion of the
matter the Oronoco Township Board
offered
to
construct a roadway, which would satisfy I+nr. Kurth, for the sum of $5800.00.
The City Attorney ruled that ?.fir. Kurth has not the right to specify where
this road shall. be, end during the further consideration of the question Andrew
Daker, one of the Township Board members, served informal notice that unless the
flashboards are taken off the Posner Dam, the Township of Oroneco will brim; suit
against the City of Rochester, Minnesota, to compel the building of a bridge at the
Krause Fbrd, and said ;that the j�.�cigrne.nt against the City of Fochester, Minnesota.
will not be released until the suit for damages brought by Mr. Kurth has been settled
at which Eckholdp for his client gave assurance that if the road is built as

above proposed, without unnecessary delay, the damage suit will be dismissed.
Motion by Cook second by. Wright carried instructing; the City Engineer to
survey a two road cartway :from the property of Chas.Kur^tH Easterly and Northerly to
connj9ct up with the West end of -the joint to?mship .road now under construction on the
boundary .line between Olmsted County anc Wabasha County, and that he submit the same
to the Township Board of Oronoco Township for their approval.
C. F. Armstrong, City Engineer, submitted plans, profiles, . specifications
and estimate of cost for a foot bridge over the Zumbro River at Third Avenue Southea-.
which were considered by the Common Council, the said estimate of cost being
$3407.50.
Alderman Bach introduced the following resolution, tkhich was read:

That the said plans, profiles and specifications for the said bridge
be adopted and placed on file and that the said estimate of cost be placed on
file;
+ Be it further resolved by said Common Council:
That the City Clerk of said City be and he is hereby ordered and
I directed to advertise for bids, as provided by law, for the furnishing o.f all
of the materials, and doing all of the work necessary for the construction of
the said bridge above described, said bids to be received and opened by said
Common Council at a public meeting thereof to be held at 7:30 o'clock P.M., on
November 9th, 19P5, in the Council Chambers, in the City Nall, in said City,
Each bid must be accompanied by a certified check for. at least ten percent of
the amount o:i' the bid, and this Common Council reserves the tight to reject any
and all bidse h
Upon motion by Postier second. by Cook that the said resolution be
adcpted as read, and all voting in favor- thereof, Pres id.ent Meeks declared the

Votion by Cook second by Wright carried that the City Clerk be in-
structed to ma'-�e published notice to those who care to pay special assessments,
that they must do so on or before October 313t, 1925, as on. November. P-ncl, 1925,
certifie-d papers for this year's collections through taxes will have been clos-
ed and placed in the hands of the County Auditor of Olmsted County.
A notice from the Merchants Trust Company of St. Paul, Tiinnesota,
cal linc, :attention to the maturity on December 1st, 19?_5, of 10,000. permanent
Improvement Revolving I.'und Bonds and $1320. interest, was read, and on motion
by Kit?mun second. by Cook the City Clerk was instructed to notify th^ said
Company that the money for these maturities will be in their hands on the 0-ay
then they become due and in makingsa;hpayment the City of Rochester will not
be obliged to pay any disbursement, charge and further that if the said Company
sloes not wish to pay these bonds and coupons without disbursement charge they
Will notify accordingly and the disbursement for them will be taken care of
through the office of the City Treasurer.

ation and Thos. T.,. Phelps, Secretary of tho- said. Association, asked for the
