City, on November 17th, 1925, at 7:30 0clock P.M.
Veeting called to order by President [Weeks.
Roll Call: Present: Weeks, Adler, Bach, Hicks, Postier., Wright.
Absent: Kitzman,

The call for the special meeting was read, the said meeting being
cal.l.ed for the purpose of authorizing the Public Utility Board. of said City to
appropriate $6749.91 as full settlement of the Philip H. Volz death claim, and
suet other business as the Common Council might deem proper.
The following copy of resolution was read, and on motion by Postier
' second by Wright the same was ordered placed on file:
"Be it md it is hereby resolved by the Public Utility Board of the
City oR Rochester, r-Tinnesota, that the amount of $$6749.01 be paid to the
Rochester Loan and Trust Company as Trustee for Mrs. Florence Volz and minor
childred, $6599.91 of said amount being the amount stipulated by the State
Industrial Commission as f).11 compensation due as a result of the accidental
death of Philip H. Volz while in the employ of the City. of Rochester and paid. in
accordance with Section 4286 G.S. 192, said j$6599.91 being the total award- of
$7500.00 less interest deduction of 4 Wp for a lump sum settlement plus the
amount of $150.00 for funeral expenses also in accordance with above statute and.
al.l in accordance with Findings of Fact and Award of Compensation and Order
Directing Payment of Lump Sum to Trustee of the State Industrial Commission
,' dated Nov. 12, 1925, and
Be it and it is hereby further resolved by the said Public Utility
Board that the Hon. Common Council be and is hereby asked to authorize the above
payments "
Alderman Kitzman came in at this time and took his Chair.
Alderman Wright introduced the following resolution, which was read:

sota, has made request of the Common Council of said City, that the said 113oard .
i be authorized to pay to thl Rochester Loan and Trust Company, as Trustee, for
A, -fro. Florence Volz and minor children, the sum of $6749.91 as full and complete
settlement for compensation due as the result of the accident^:1 death of Philip
H. Volz, while in the employ of the City of Rochester, Minnesota, and
WtIERLAS, the said tequest having been fully considered by this Common
Council, and it is the. decision that such authority be given;
SO THEREFORE, Be it resolved by the Common Council of the City of
Rochester., Uinnesota: .
That the said Public Utility Board be and the said Board is hereby
authorized to pay the sum of $6749.91 to the Rochester Loan and. Trust Company of
Rochester., �.finnesota, as Trustee for Mrs. Florence Volz and minor children, as
full compensation due as a result of the accidental death on July lst, 1925, of
Philip H. Volz, while in the employ of the City of Rochester, Txi-nnesota, which
said sum is to be paid in accordance with Section 4286 General Statutes 1923 and.
with the Findings of Fact and Award of Compensation and Order Directing Payment
of Lump Sum to Trustee of the State Industrial Commission, dated November. 12th,
1.925, said sum of $67!9.91 being '06599.91 as the total award_ of $7500*00 less
interest deduction of 441% for a lump sum settlement, plus the amount of 1$150.00
for funeral expenses, as provided for in the above mentioned Statute. "
Upon motion by Wright second by Bach that the said resolution be
adopted as read, ::nd all voting in .favor. thereof, President Weeks declared the
said resolution duly passed and adopted.

On motion by Hicks second by Postier warrant No. 966 previously drawn to
Florence Volz on the Public Utility Fund in the amount of $190 -00 being for two week:
compensation at $20.00 per week, $�40.00. on account of the accidental. death of Philip
H. Volz, and 3150.00 for funeral expenses, be cancelled and returned to the Public
TTti`lity Fund on accolxn.t of the above providdd for lump sum settlement.
The trial balance, general balance sheet, unexpended budget appropriation
statements, etc. ,of the City of Rochester, Ifinnesota, as at October 31st, 1925,
prepared by the City Clerk, were laid before the Common Council, and on motion by
Bach second by
Adler
the
same
were
ordered placed on
file.
The
report
of
the
Clerk
of the Municipal
Court for the week ending Novem-
ber pith, 1925, showing criminal fines collected in the amount of 037.00, and civil
fees deceived in the 'amount of $2.35, was read, and on motion by Kitzman second by V
Wright the said report was referred to the City Attorney.
The report of the City Treasurer for the month ending October 31st, 19,25,
showing $330,979.1.3 as being on hand, was read, and on motion by Kitzman second by
Wright the same was ordered placed on file.
The report of the City Weighmaster for the month of October, 1925, show -
ink,. fees col?.ectcd in 'the amount of $45.90, was'read, and on motion by Bach second
Wri,,,:.ht the same was referred to the Finance Committee.

The report of the City Justice for the month of' October, 1925, which sho
seventeen cases which were terminated before that Court during; that period, was read,
and on motion by Kitzman second by Wright it was referred to the City Attorney.
The report of the Justice of the Peace of the First Ward of the City of
Rochester, Ifinnesota, which shows that there were no cases instituted or terminated
before that Court during that period, was -read, and on motion by Kitzman second by
Wright it was referred to the'City Attorney.
The report of the Health Officer for the City Farm for the month of

October 19253, showing receipts in the amount of $C6018.47 and the disbursements in the
amount of 06421.57 and a balance on hand in the amount of 4'51_18&27, was read, and on
motion by Kitzman second by Wright the same was ordered placed. on file.

ii,g that the public dance permit heretofore issued to them for. November 26th, 1925,
at the Armory,be transfer -red tQ November 19th, 1925, was read, and on motion by Bach
second by Postier such transfer was granted.
The following applications for permits to hold, give and conduct public
dances were each separately read:

Library site, and on motion by Adler sec(::.,nd. by VTright their request was referred to
the Public Grounds Committee with instructions that thedsaid Committee make full
investigation and report their findings and recommendations to this Common Council at
the next meeting thereof.
The claim of Richard Ryan in the amount of 0310.00 beini , for services in
extra time as Assistant Fire Chief, during the absence on account of illness of
Elmer. J. Farcier, Assistant Fire Chief, September. llth, 192.5, to November llth, 1925,
two months at 5'155.00, was read, and was -considered by the Common Council, after
.rhieh on motion by Kitzman second by Wright the said clQiM Qvas .laid on the table;

The official bond of John J. Cook as Assistant City Engineer, with Irving

by Bach second by Wright the said sureties were accepted and the said bond approved

Ixotion by Kitzman second by hicks carried that the City Attorney be in-
structed to order that F. F. Holloway .remove the residence that he now has built in
I-ifth Street Southeast just West of Ninth Avenue Southeast.

Copies of three different communications from Frederic Bass, Consulting
Engineer, to Chas. IT. Armstrong, City Engineer, relative to compensation for ?fir.
Bass for malting inspection trips during; the construction of the local Sewage Disposal
Plant, were each separately read, and after consideration of them, motion by Postier
second by 1-right carried that Mr. Bass be instructed and requested to ma';e an inspec-
tion of the local Sewage Disposal Plant twice each month, during the course of its
construction,at a daily per diem of 160.00 plus expenses, and. as much oftener as the

City Engineer may see fit,; the said extra trips to bd subject to the conditions of
a resolution heretofore passed and adopted on September 8th, 1925,
Alderman Postier introduced a resolution granting public dance permit to
the Veterans of Foreign Wars to hold, give and conduct a public dance in the NationE
Guard Armory on November 26th, 1925, and fixing the fee at $1.00, which was read.
Upon motion by Wright second by Bach that the said resolution be Etdopted
as read, and all voting in favor thereof, President Weeks declared the said resolu-

Alderman Postier introduced a resolution granting a public dance permit to
Taylor Cutshall and John Cutshall to hold, give and conduct public dances in the
Woodman ?Tall, on November lath, 21 st, 24th and 28th, 1925, and fixing the fee at
the total sum of $20.00, which was read*
Upon motion by Bach second by 'Idler that the said resolution be adopted as
read, and all voting in favor thereof, President Weeks declared the said resolution
duly passed and adopted.
Alderman Postier introduded a .resolution granting a public dance permit to

Alderman Kitzman introduced the following resolution, ..which was read:

That the sum of $335.13 be and the said sum is hereby ar.)pr. opriated
;from the Sewage Disposal Plant Fund of said City. and ordered paid to Frederic
Bass for five days service (it ''t60.00, and expenses in accordance with sworn
billing made by him under date of October 22nd, 1.9259 t+,he said service and ex-
pense having been contracted and approved by C. H. Armstrong, City Engineer,
'under and in accordance with the resolution passed and adopted., September 8th,
1925,
The Trayor and City Clerk are hereby authorized and directed to draw
a warrant for said sum upon the City Treasurer in accordance herewith, �nd cause

Alderman Wright introduced a resolution appropriating $375,19 from
the Park Improvement Fund and ordering payment made to the Dodge Lumber and
'Fuel Company for 92, 215 lbs. of coal at $P.05 - $371.17, and 8 - 1 x 10 No.3,
44.02, which was read.
Upon motion by Wright second by Adler that the said resolution be
,adopted as .read, and all voting in favor thereof, President Weeks declared the
'said .resolution duly passed and adopted.
Alderman Postier introduced a resolution appropriating $482.60 from
;the General Fund and ordering payment made to the Lyle Culvert and Road Equip-
ment Company for the furnishing of 44 curb parking limit signs and. 30 through
:street stop signs, which was read.

Alderman Hicks introduced a .resolution appropriating $275.90 s'from the
General Fund and ordering payment made to T. F. Kennedy, as estimated advance premium
on compensation policy No. LC4165, being $262.30 on Policemen, $2.72 on clerical
office employees and 010,88 on Municipal employees, Building Tnspector, Health
Officer, Visiting Nurse, etc., which was read.

Street and Alley Fund and ordering payment made to T. F. Kennedy, as estimated advanc

$100.87 on street cleaning and $6.65 on concrete sidewalks, which was read.
Upon motion by Wright second by Hicks that the said resolution be adopted
as read, and all voting in favor thereof, President Weeks declared the said resolu-
tion duly passed and adopted.
Alderman Kitzman introduced a resolution appropriating 49.30 from the
Park Tmpr. ovement Fund and ordering payment made to T. Y. 14ennedy, as estimated advane
premium on compensation policy No. LC4165, to cover park employees, which was read.

Alderman Bach introduced. a -resolution appropriating $222.00 from the

Alderman Wright introduced a resolution appropriating $8.50 from the
;Permanent Tmprovement Revolving Fund and ordering payment made to the Botsford
;Lumber Company for 2000 lbs. of OB& wood, furnished.. for use in connection Tith
the paving, re -paving and curbing of Second Avenue Southwest, from Center Street
West to Third Street Southwest, which was read.
Upon motion by Bach second by Adler that the said resolution be
adopted as read, and all voting in favor. thereof, President Weeks declared the
said resolution duly passed and adopted.
On motion by Postier second by Kitzman the City Attorney was instruct.-
ed to dradt a resolution providing for the appropriation of $1872,50 to Olmsted
County, 7-Jinnesota, for full settlement of Municipal Court fines withheld# to
and including June 30th,, 1925.
