This being the time and place fixed for adjourned and continued hear-
ing llz.d action on. the petition for the vacation of Fourth Place Southwest from

�Southwvest, the matter came up for consideration and President Weeks announced.

The following communication was read, and on motion by Postier second,

for not less than six months time at the rate of two per cent per
annum, but if withdrawn before six months at the rate of one-half of
one per cent per annura. We will pay on savings accounts for not less than
six months t-i.me at the rate of two per cent per unnum, but on emounts
withdrawn before six months at the .rate of one-half per cant per annum.
All funds and accrued interest so placed on deposit with this

The report of the Building and Electrical Tnspeetor for the month of
November, 1925, showing building inspection fees collected in the amount of $177.00,
and electrical inspection fees collected in the amount of $18.50, was read, and on
mction by Adler second by Aright the said report was referred to the Finance Com-
Mittee.
Alderman Hicks came in at this time -and took his Ghair.
The following applications for permits .to hold, give and conduct public
dances were each separately read:
Taylor Cutshall,' for Woodman Hall, December_ 12th and 19th, 1925;
M. ICI. A. Lodge for M. W. A. Hall, December llth, 1925.
A communication from Chas. C. I.Iohr asking permission to put up a storm
shed 21 ft. by 3 ft., in front of the Hotel Francis on the property described as a t
part of Lot 10 in Block 10 in Original Plat, was rend, and on motion by Kitzman seco
by Adler his petition was referred to the Chairman of the Street and Alley Committee
and the City Engineer, with power to act in the matter. i

missioners of the Sinking Fund were each separately read, and on motion by
Kitzman second by Nicks the said copies of'resolutiors were ordered'placed. on
file, and the actions set forth therein were approved:

Tndemnity Company to the City of Rochester, which Policy, T understand,
the Company desire's to cancel, and T am writing you at this time to
advise you that the Company will protect the City on. the claim which
occurred on November Ilth when Lewis Claude, an Officer, was injured by

to return the policy,

In the further discussion of the above mentioned compensation insurance
li policy it was found . that as yet, Patrolman Louis Claude has received no compensation
11 from the Tnsurance Company, for his injury November llth, 1925, at which on motion by

insurance policy was reconsidered.
w' On motion by Postier second by VTright the above quoted letter rela-
tive to compensation insurance c°-as ordered placed on file and the City Clerk i
was instructed to return the policy concerned. as soon as the Tnsurance Company
commences the compensation paym;-nts to Patrolman Tiouis Claude.
After con:side!,ation in the matter of assignment of qugr_ter. s, etc.,
for the TTealth Department officials, etc., in the r. ecently acquired I'li_ther. stine
property, a motion by Bach second by Adler carried. that the Chair appoint the
Public rounds Committee and the Mayor with instructions that they conifer with
the Pealth Officer. and the Civic League relative to who shall have offices tmd
occupy the said. property, at which President Weeks appointed the Public rTrounds
Committee and. the Ifayor with those instructions.
Al%!erman Kitzman introduced the following resolution, which was read:
"''XTEREAS, under the terms and. conditions of a resolution. passed by
the Public Utility Board of the City of Rochester, TJinnesota, under date of
October 24th, 1918, there is due on or. before October 16th, 19269 the sum of
$15,000.00, for paymeiht to the Sinking Fund o'f said City for to apply on the
retirement of City of Rochester, Minnesota, 5-t Electric Tjight Bonds, dated.
July 2n.d, 1917, and numbered 1 to 150, inclusive, as provided for in an oru.i-
nuanice passed and adopted by the Common Council of the City of Rochester, Tfinne-
sota, under date of July 7th, 1917, and

Utility Fund of, said City at the close of business November 30th, 1925, and as
there is no known immediate need for a. great share of this money, this Common
Council deems it for the best interest of the City of Rochester, Minnesota,
that at least ';!75,000.00 of this money on hand be appropriated for payment�•of

principal on Electric Light Bonds.
SO THEREFORE, Be it resolved by the Common Council of the City of
Rochester., Minnesota:
That the Public Utility Board of said City be �_;nd the said Board is
hereby authorized and requested to make appropriations from the Public Utility
Fund to the Sinking hind of said City of the following sums for the purposes
stated:
015,000.00 for to apply on the retirement of City of Rochester.,
Vinnesota, 5(/11,, Electric Light Bonds, dated July 2nd, 1917, L.nd maturing July
1st, 1927, numbered 1 to 150, inclusive;
. $60,000.00 to apply on retirement of City of Rochester, Tffinnesota,
5 % Electric Liaht Donds, dated January 2nd, 1919, maturing Jan. 1st, 1939, and
being* optional as to payment of principal on Jan. 1st, 1929, or upon any inter-
est date thereafter before maturityb "
Upon motion by Kitzman second by 77right that the .said resolution be
adopted as read, and all. voting in favor thereof, President Weeks declared the
said resolution duly passed and adopted.
On motion by Tricks second by Kitzman, the City Clerk was instructed
to serve a copy of the above mentioned. resolution on the Public Utility Board
with respectful request that they comply accordingly, and. that he prepare the
necessary proceedings for the issuance and sale December 31st, 1925, at 7:30

bond approved and placed on file.
The official band of A. I% Matzke as Second Assistant City Engineer with
the Continental Casualty Company as surety thereon, in the amount of'Sa500.00, was

said bond was approved and ordered placed on file.

Final estimate prepared by C. H. Armstrong, City Engineer, in favor. of
Wm. C. Fraser and Son, for the construction of a sanitary sewer in part of sixth
Street Northwest showing the sum of $635.08 as being due to the said contractors,
was read, and on motion by Kitzman second by Hicks the said. estimate was ordered
placed on file.
Estimate No. 2 prepared by C. H. Armstrong, City Ehgineer in favor of
G. Schwartz and Company for the construction of local Sewage disposal Plant, showing

the sI.-Im of $18,265e71 as being due to the said contractors, was read, and on motion
j by Kitzman second by Hicks the same was ordered placed on file.
Secondary sheet No. 1 of estimate No. 2 prepared by C. H. Armstrong, City
Engineer, in favor of G. Schwartz and Company for items in connection with the con-
struction of the local Sewage Disposal Plant, showing the sum of 07472.92 as being
due to the said contractors, was read, and on motion by Kitzman second by Hicks, the
same was ordered placed on file.
Alderman Adler introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the Public Ytility Board of said City be and the said Board is hereby
authorized to ap?ropriate the following sums from the Public Utility IiVnd of said
City for payment to the Tnterest Fund. of said City, for the purposes states herein

Alderman Postier introduced a resolution appropriating $7t72.92
from the Sewage Disposal Plant Fund and ordering payment made to G. Schwartz
and Company for payment of items set forth on secondary sheet of estimate No. 2
made and prepared by C. T?. Armstrong, City Eng.i.neer, under date of December

tions, etc., which are incorporated in the said secondary sheet No. 1 of the
estimate No. 2, which was read.

Upon motion by Kitzman second by Postier that they said resolution be adopt

Alderman Postier introduced a resolution granting permit to Taylor Cutshall
to hold, five acid conduct public dances in the Woodmen Hall, on December 12th and
19th, 1925, "arid fixing the fee at the sum of $10.00, which was read.
UL'jon motion by Wright second by Postier that the said resolution be adopted
as read, and all voting in favor thereof President Weeks declared the said resolu-
tion duly passed and adopted.
Alderman-Postier introduced a resolution granting permit to the
Lodge to hold, give and conduct a public dance in the T1f.W.A. Nall, on December 1_lth;!
925, and fixing the fee at 91.00, which was read.
Upon motion by Postier second by Wright that the said resolution he adopted
as read, and all voting in favor thereof, President Weeks declared thr. saidresolup
Lion duly passed and adopted..
The _report of the Finance Corr--anittec the effect that they had checked
the Jovember 1925, report of the Building and Electrical Inspector and found the
s at me to be correct, was read, and on motion by Bachsecond by Wri, ht the said report
of the Finance Committee Was ordered placed on file and the said report of the
Building and Electrical Inspector was ordered placed on file.
