WHEREAS, the Common Council of the City of Rochester by enactment of Resolution 143-
80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive municipal
plan for the City of Rochester, Minnesota, and environs; and
WHEREAS, Rubicon Capital, LLC, initiated an amendment to the Rochester Urban Service
Area Land Use Plan to change the land use designation on approximately 13.3 acres located east
of Forest Knoll Drive S.E., west of St. Bridget Road S.E., from the "Industrial" designation to the
"Medium Density Residential" designation; and,
WHEREAS, the Planning Department recommended the approval of the proposed
amendment to the City's "LAND USE PLAN;" and,
WHEREAS, the Planning and Zoning Commission of the City of Rochester, after published
notice and hearing, recommended the approval of the proposed amendment to the City's "LAND
USE PLAN;" and
WHEREAS, the Common Council, after published notice, held a public hearing in the
Council/Board Room of the Government Center on September 21, 2015, on the matter of the
proposed amendment to said "LAND USE PLAN;" and
WHEREAS, the Council determined that the application did satisfy all of the criteria
applicable to amendments of Land Use Plans based upon the findings of fact proposed by the
Planning Department staff.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that the "LAND USE PLAN" as adopted on March 24, 1980, and as thereafter amended, is hereby
further amended by changing the designation on the following -described property from the
"Industrial" designation to the "Medium Density Residential" designation:
Outlot B and Lot 1, Block 2, all in FLEET FARM ADDITION TO ROCHESTER,
according to the plat thereof on file at the County Recorder's office, Olmsted
County, Minnesota;

That part of Maine Avenue S.E. and Lot 1, Block 3, all in said FLEET FARM
ADDITION TO ROCHESTER, described as follows:
Beginning at the northeast corner of Lot 1, Block 2, said FLEET FARM
ADDITION TO ROCHESTER; thence North 89 degrees 42 minutes 42 seconds
West along the north line of said Lot 1 a distance of 558.02 feet; thence westerly
240.84 feet along a tangential curve concave northerly along said north line,
having a radius of 550.70 feet and a central angle of 25 degrees 03 minutes 26
seconds, to the northwest corner of said Lot 1; thence North 32 degrees 11
minutes 47 seconds East not tangent to said curve a distance of 98.42 feet to
the northerly right of way line of said Maine Avenue S.E.; thence northwesterly
29.51 feet along a nontangential curve concave northerly along said northerly
right of way line, having a radius of 505.00 feet and a central angle of 03
degrees 02 minutes 54 seconds; thence North 32 degrees 30 minutes 43
seconds East not tangent to said curve a distance of 37.42 feet; thence
northeasterly 49.54 feet along a tangential curve concave southeasterly, having
a radius of 100.00 feet and a central angle of 28 degrees 23 minutes 00
seconds; thence North 60 degrees 53 minutes 42 seconds East tangent to said
curve a distance of 469.76 feet; thence easterly 50.34 feet along a tangential
curve concave southerly, having a radius of 100.00 feet and a central angle of
28 degrees 50 minutes 43 seconds; thence North 89 degrees 44 minutes 25
seconds East tangent to said curve a distance of 246.95 feet to the east line of
said Lot 1, Block 3; thence South 00 degrees 15 minutes 35 seconds East along
said east line and its southerly extension a distance of 462.32 feet to the point of
beginning.
Containing 13.3 acres, more or less.
BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained in
the office of the Director of the Rochester -Olmsted Department of Planning and Housing; the office
of the Director of Public Works of the City of Rochester; and the office of the Director of Building
and Safety of the City of Rochester and shall be available for public inspection.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified copy
of this resolution in the office of the County Recorder in and for Olmsted County, Minnesota.
