Minutes of an adjourned regular meeting of the Gommon Council of

the City of Rochester, Minnesota, held in the'Council Chambers in the City
II Rey i.l in Said City on September 13th, 192r4 at 77:30 o'clock P.M".
Meeting called to order by president Weeks,;
Roll Call: Present: Weeks, Adler, Bach, Hicks, Kitzman, Postier,
Absent: Schroeder.
Alderman Schroeder came in at this time and took his Chair.
On motion by Bach second by Adler the minutes of the meetings held
on AuZust 30th, 1926 and Septe:.Iber 7t:h, 1926 were each approved,
T111s being the time and place fixed for the opening of proposals
for being desigMAted as depositories for City money, proposals by the
First State Bank and Trust Company, The First National Bank, The Uni.on
National Bunk, The Rochester Loan Qc Trust Company,and the Olmsted County
T3ank 11, Trust Company, were each opened and reads each of said proposals
being identic4l except that the second paragraph of the proposal made by the
First State Bank "• Trust Comparty carried theCollowing additional wording:
"We will pay to the City of Rochester, interest on.daily
balances on open accounts deposited with us at the rate of one
half of one percent per annum."

The First Nationa•1 Bank of Rochester, Minnesota,,
applies for designation a-nd appointment as a depository for
moneys and funds belonging; to the City of Rochester, Minnesota,
and in case it is so a?;poi.nted will furnish as security for
such funds a good and sufficient bond to be approved and ac-
cepted by the Common Council of the City of Rochester, Minne-
sota.
We will pay on certificates of deposits for not
less than six months time at the rate of two per cent per
annum, but if withdrawn before si,_ months at the rate of one-
half of one per cent, per annum, We will pay on savings accounts
ip for not less than s. months time at the rate of two per cent per
annum but on accounts withdrawn be r ore six months, at thy: rate of
one-half per cent per anninn.
All funds and accrued interest so placed on deposit
with this bank shrill at all times be subject to check of the
duly authorized officials of the City of Rochester and payable
on demand,

said Income statements showing ttet profit in the Light Department for the month
of August, 1926 ,' of $81436.791 and a net profit for the five months of this fiscal
year of 146, 587.09 and a net profit i.n the Water Department for the month of
August, 1926 of $4,024,08 and a net profit in the Water Department for the five
months of this fiscal year of 1,1�11,899.47;
General Balance Sheet, Trial Valance, Unexpended BudrIet Appropriation
Statement, Statement of Supplies on Hand, Statement of Sinking IFund Investments,
etc., of the City of Rochester, IMinnesota.,as at Au,rust 31st, 1926, prepared by
the City Clerk of said City, v:!ere read before the Common Council and President Weeps
ordered that the same be placed on file. ,
The following commdni6ation was read and on motionby Postier second
by Schroeder the City Attorney was instructed to notify the Rochester Oil Company
that they shall remove the canopy objected to and that they shall stop the storage
of oils, greases and other service station equipment on the sidewalk at the loca-
tion protested a rainst:

Gentlemen:
We', Uhe' undersigned tax payers in the City of
R och.ester,hereby petition your honorable Body to notify
the Rochester Oil Company to remove the canopy, which the
company is building over two of its pumps in front of the
Meredith & Metzerott ge,rage on First Avenue Southwest in
t#Ae City of Rochester*,
or the reason, that, We believe this is unfair competition
and contrary to the laws of the city.

A recommendation by the License Committee that the application
of Oscar Glasby for a Junk Dealer's License be not grantedswas read and on
motion by Schroeder second by Bach the said report of the ]License Committee was
accepted and it was ordered that the same be placed on file, and the said appli-
'cation for license was not granted,
Alderman Postier introduced a resolution designating the Union
National Bank as a depository for City funds in an amount not to exceed $509000.00
which was read&
Upon motion by Bach second by Kitzman that the said resolutionbe
accepted as read and all voting in favor thereof, President Weeks declared the
said resolution duly passed and adopted.
Alderman Schroeder introduced a resolution designating the First
National Bank as a depository for City funds in an amount not to exceed $100,9000.E

Alderman Bach introduced a, resolution designating The Rochester
boan and Trust Company as a depository for City funds in an amount not
to exceed 60,000.00, which was read;- �
Upon motionby Kitzma.n second by Nicks that the said resolution be
adopted as read and all voting in favor thereof, President Weeks declared
the said resolution duly passed and a,doptedo
Alderman Kitzman introduced a resolution desi�msting the First State
Bank & Trust Company as a derosit-ory for City funds in fin amount not/t%seed

Upon motion by Schroeder second by Adler that the said resolution
be accepted as .read ar..d all voting in favor thereof, President Weeks declared
the said resolution duly passed and adopted;
Alderman Bach introduced a, resolution appropriating "205.00 from the
r r�-rk Improvement Fund and ordering payment made to Ormond y, Feller for labor
and materials uded'in raising and building.up abutments for the foot bridge
aerosql Zumbro River in ?kayo Park,which was read;;
Upon motion by Bach second by Hicks that the said resolution be
adopted as read and all voting in favor thereof, President Weeks declared
the sp-Ad resolution.duly passed and adopted.
Alderman Adler introduced a resolution appropriating "0205.28 from
the General fund and ordering payment made to the Rochester Post -Bulletin
for official publications and printin7 during Augmet 1926, which was read,
Upon motion by Kit, -man second by Bach that the said resolution be
adopted. as .read and all voting in favor thereof, President Weeks declared
the said resolution duly passed and adopted,
Alderman Hicks introduced the following resolution "Which was read:
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the sum of `'?868.89 be appropriated and paid to T.F.
Kennedy, Agent, for compensation insurance premium during the
period June 1st, 1926, to August 701st, 19269 inclusive, 12$7.83
thereof to be from the Street and Alley Fund, 1233.04 . to be. from

the General Fund, 166.03 to be from the Park Ij,inrovement Plin.d.,
�t,11.38 from the Permanent Improvement Revolting Fund, 1¢ from
the _Bridge Fund, `�20.44 from the Sewer Fund, w3.37 from the

Fund. -
The Mayor and City Clerk are hereby authorizedand directed
to draw a warrant for the said su 0s upon the City Treasurer in

Alderman Hicks introduced a resolution appropriatin!l $523.50 from the
Sewer Fund and ordering payment made to the Permanent Improvement Revolving Fund
(Job 943), being for 415 feet of 10" Sewer pipe laid at 90/ per.foot, $375.50;
two manholes at 160.00 each, A120"00;and two inlets at 115.00 each, 1130.00Pin

Upon motion by Ttitzman second by Kies that the said resolution be
adopted as read and all voting in favor thereof, Presider_c Weeks declared the
said resolution duly passed and adopted.
Alderman Kitzman introduced a res`olution.fixing 7:30 o'clock P. Ma Septem-
ber 27tr, 1926.as the time for hearing on the proposed resurfacing of the paving
base on Fourth Street Southeast between the Fast line of Broadway Street South and
East line of Third .Avenue Southeast with 3" or 2'" vertical fiber out., . vitrified
clay or shale, non -repressed andespecially burned for street paving brick,to a wid

the said part of Fourth Street Southeast, which was read:
Upon motion by Adler second Oy Postier that the said resolution be adopted

Alderman K_itzman introduced the following resolution which was read:
"Be'it resolved by the Common Gouncil of. the City of

That the of 'the three operators to ,be �ejAployed by
the .City Engineer for the -operation of the local Sewage Disposal
plant be, and ,the said. wages are hereby fixed ,at ,thesum of
0_140.•00 per month for each of said operators during the pe]±od
ending on the second Monday in April, 19274 • I
Be it, further resolved by the said Common Council:
That the said wages during the above mentioned period•shall
ba p,�•!Te,ble; from the Sewer Fund in semi-monthly installments, one-
half of the monthly rate, the firs-t one-half thereof being due
a.nd payable on th 16th dais of ea.er month durin�p the above mention-
ed period and the last half thereof being due on the last d'ay of

The Mayor and City Clerk of said City being hereby auth.orie-
ed and directed to draw warrants .from the Sewer Fund on the City
Treasurer and make payment accordingly; the sa,id salaries to
commence effective with the employment by the City Engineer of
the above mentioned operators which said employment shall continue
at the pleasure of the sp.id City Engineer,"
Upon motion by Adler second by Hicks that the said resolution be
adopted as read and all voting in favor thereof, Preside l.t Weeks declar-
ed the said resolution duly passed and adopted,.

Alderman Schroeder introduced the .following resolution, which was
"Be it revolved by the Common Council of the City of
Rochester, vlinnes6ta.

That the Public Utility Board of said City be and the said
Board is hereby authorized to lay :eater mains in the City of
Rochester as follows, to wit: ,
In Seventh Street Northwest from Si:,-th Avenue Northwest to
a point 792 feet East of Eleventh Avenue Northwest, and
In Broadway Street North from the South side of Thirteenth
Street Northwest to a point 670 feet North of the North line of
Thirteenth Place Northwest."
Upon motion by Schroeder second by Adler that the said resolution
be adopted as read and all voting in favor thereof, President Weeks
declared the said resolution duly passed and adopted,

by Adler the same were allowed and the Mayor and the City Clerk were
authorized and directed to draw warrants upon the City Treasurer a.rrd
