Millutes of an adjourned regular meeting of the Common Council of the
Cit;Y of Rochester, Minnesota, held in the Council Chambere, in the City Hills
in said Ci ty, on October -17th,1927, at 7:30 o'clock -P.M.
Meeting called to order by President Weeks, '
Roll Calla Present: Weeks,'Adler, Erickson, Kicks,'Miller, '
RoTmuel, Schroeder. Absent: None,
President Weeks announced'that this was the time and place fixed for
a hearing'on'the levying of special assessments for the sprinkling and
flushing with water, and the treating with calcium chloride of streets and
avenues within said City during the season oP the year,1927, and asked if
there was'any person present who •,wished'to'be heard concerning the said
sprinkling, flushing br treating._'

President Weeks' announced that ' this ,was the time and place' f ixed for
a hsaring on'the construction of sanitary"sstrers and the laying of a water
main described as follows, and. asked if there was an person present who
wished to be heard relative to either or any of the said proposed improve-
ments:
. The construction of a sanitary sewer in Fifteenth Avenue Southwest
from the center of Fifth Street Southwest to the center of Sixth Street
Southwest;
The construction of a sanitary. sewer in Fourth Avenue Northwest from
the center of Ninth Street Northwest to 100 feet. North of the. North line of
Eighth Street Northwest;
The construction of a sanitary sewer.in Thirteenth Street Northwest,
described: Commencing at e, point in the center of Thirteenth Street North-
west 30 feet West of the. Center line of Broadway Street North and running
thence West along the center line of Thirteenth.Street Northwest to a point
3 feet West of the East line of Lot 17 in Block 27 in Northern Addition;

The construction of a sandtary sewer commencing at the center of the
intersection of Sixth Avenue Southeast and Tenth Street Southeast and
running East along the center line of Tenth Street.Southeast to the center
of Seventh Avenue Southeast, and thence South along the center bine of
Seventh Avenue Southeast to the center ,bf Eleventh Street Southeast and
also commencing at the center of the intersection of Seventh Avenue Southeast
and Tenth Street Southeast and running North along the center line of Seventh
Avenue Southeast to a point 135 feet South of the South line of Ninth Street
Southeast, and the laying of &.water main in the said parts of Tenth Street

and asked if there was any person present who wished to be heard relative to either
or any of the said improvements:
The grading to an established grade and to a width of 30 feet of Fourteenth
Avenue Northeast between the North line of Center Street East and a point 300 feet
North;
The grading to an established grade line and to a width of 30 feet of
First Street Northwest between the West line of Twelfth Avenue Northwest and the
West line of Thirteenth Avenue.Northwest, also thirteenth Avenue Northwest between
the North line of First Street Northwest and Cascade Creek and also Second Street
Northwest between the West line of Twelfth Avenue Northwest and .the East line of
Thirteenth Avenue Northwest;
The grading to an established grade line and to a width of 50 feet of

South line of Eleventh Street Southeast.
There was no person present who wished to be heard relative to either or
any of the above described improvements,

The construction of a sanitary sewer commencing at the center of the inter-
section of Seoond Street Southeast and Twelfth Avenue Southeast, if extended, and
running thence North on a line with the center line of Twelfth Avenue Southeast to
a point 135 feet South bf the South line of Center Street East;
The construction of a sanitary sewer commencing at a point in the c8nter of
Fifth Avenue Southeast and Tenth Street Southeast, and running East in the center
of Tenth Street Southeast to the center of Sixth Avenue Southeast and Tenth Street
Southeast and thence running South along the eenter line of Sixth Aveme Southeast: t
the center of Eleventh Street Southeast, and also commencing in the center of Tenth
Street Southeast and Sixth Avenue Southeast and running North along the center line
of Sixth Avenue Southeast to a point 136 feet South of the South line of Ninth
Street Southeast, and the laying of a water main in the said parts of Tenth Street
Southeast and Sixth Avenue Southeast;
The construction of a sanitary sewer commencing at a point in the -center of
Tenth Street Northeast, 48 feet West of the West line of Second Avenue Northeast and
running thence Southeasterly to a point 10 feet,East of the Northeast corner of Lot
1 in Block 40 in Northern Addition and thence South 65 feet Para ilel with the West
line of Second Avenue Northeast and there ending;
The construction of a sanitary.sewer in Third Avenue Southeast
commencing at the center of the intersection of Tenth Street Southeast and
Third Aveme Southeast and running thence Southeasterly 35 feet to a point
13 feet West of the East line of Third Avenue Southeast and ten feet North
of the South line of Tenth Street Southeast, and running thence southerly
along a line 13 feet West of the East line of Third Avenue Southeast t•o the
intersection wi* the center line of Thirteenth Street Southeast;
The construction of a sanitary sewer in Sixth Avenue Southeast commen-
cing at the center of the intersection of Sixth Avenue Southeast and Ninth
Street Southeast and running North along the center line of Sixth Avenue
Southeast to a point 50 feet south of the North line of the Southwest 4 of
Section 1 in Township 106 North of Range 14 West.
Upon motion by Schroeder, second by Rommel, further proceedings
in the levying of special assessments for the above described sanitary sewers
and laying of a water main were, with the exception of the sanitaryasewer in
Sixth Avenue Southeast, from Ninth Street Southeast and North, adjourned and
continued to the meeting of this Common Council which is to be. held on
December 5th,1927, at 2:00 o'clock P.M.
The City Clerk reported,that there had.been no bids received for
the resurfacing of the paving, base on Fourth Street Southeast between the
East line of Third Avenue Southeast and a point 14811i•feet West of the West
line of First Place Southeast, and upon motion by Adler,.second by Schroeder
the City Engineer was instructed to secure,the necessary labor, materials..
etc., and resurface the said part of Fourth: Street Southeast in accordance
with the plans, profilesand specifications therefor(..
Chas. Postier, as agent for the owner, offered the Allis property
t Oronoco, Minnesota, at a price of 022,000.00, which property includes
40 acres of land, the resevoir.spece, the mill rights and the present flour
upon matter

Geo, B.-Knowlton, as President, -of the Olmsted County Tax Payer's

Association, asked for an opportunity -to discuss the proposed 1927 tax levy

of Rochester, Minnesota,,rthat the on..Common Council of the said -City be and is
hereby requested to authorizedthe said Board,to enter into contract with the Hayes -
Lucas Lumber Company of this Cityfor'the furnishing to the City of Rochester,
Minnesota, in accordance with specifications and with their bid dated October 13th,
1927, of from 4000 to 7000 tons of Wasson 2" Harrisburg Screenings at a price of

The following copies of resolutions passed and adopted by the Commissioners
of the Sinking Fund, were read, and upon motion by Schroeder, second by Erickson,
the actions set forth therein were approved and'it was ordered that the said copies
of resolutions be placed on file:
"Be it resolved by the` Commissioners of the Sinking Fund of the City of
Rochester, Minnesota:
That the sum of .1831.03 be appropriated from the Sinking Fund of said
city and it is hereby ordered that -the same be paid to Lane, Piper & Jaffray, Inc.,
for �Boo,00 Fourth 44 per cent United States Liberty loan bonds, due October 15th,
1938, optional 1933; $800,00 thereof being principal on the said bonds $30.75 thereof
being premium on the said bonds, and..28 ,thereof being interest on the said bonds
October 15th,1927, to October 18th,1927, inclusive. "
"Be tt resolved by the Commissioners of the Sinking Fund of the City of
Rochester, Minnesota:
That the sum of $313.36 be and the said.sum.is hereby appropriated from
the Sinking Fund of said City and it is ordered that the same be paid to the Sewage
Disposal Plant Fund of said City for to take - up part of the overdraft in the said
Sewage Disposal Plant Fund, "
Easement given by Frank Thornton and Annie Thornton, his wife, to the City
of Rochester, Minnesota, covering right-of-way for the proposed Twelfth Avenue
Southeast sanitary sewer ,was read, and upon motion by Rommel, second by Erickson,
the sail easement was accepted and it was ordered that the sarA be placed on record,
and the sum of$50400 was appropriated from the.Permanent Improvement Revolving Fund,
which said sum was ordered paid to Drank' Thornton and Annie Thornton, his wife, for
said easement.
Alderman Rommel introduced a resolution confirming th6 sprinkling assessmen

adopted as read, and ' all voting in favor thereof, President Weeks declared the said

"WHEREAS, The Common Council of the City of Rochester, Aaiinnesota,
at a meeting held on October 3t.d, 19270 dial pass and adopt a resolution
declaring it expedient and necessary that a sanitary sewer be constructed
and a water main laid, described:

The construction of a sanitary sewer commencing at the center of
the intersection of Sixth Avenue Southeast and Tenth Street -Southeast and
running East along the centerline of Tenth Street Southeast to the center
of Seventh Avenue Southeast, and thence South along the cen ier line of
Seventh Avenue Southeast to the center of Eleventh Street . Southeast and
also commencing_ at the center of the intersection of.Seventh Avenue South-
east and Tenth Street Southeast and running North along the center line of
Sevfinth Avenue Southeast, to a point 135 feet .South of the South line of
Ninth Street Southeast and the laying of a water main in said parts of
Tenth Street Southeast and Seventh Avenue Southeast, and ordering that a
public hearing of all persons interested be held at 7:30 o'clock P-.M.,
October 17th,1927,-in the Council Chambers, in the City Hall, in said
City, and directed the City Clerk to cause notice of the time, place and
purpose of said hearing to be published as required by law and said resolu-
-tion was approved and signed by the Mayor of said City of Rochester, and
WHEREAS, said City Clerk did duly and in due time pu!Xlish a notice
of the time, place and purpose of said public hearing in the official
newspaper of said City, to -wit: - in the Rochester Post -Bulletin, published
October 4th,1927, and
WHEREAS, on Octobe 17th,1927, at 7:30 o'clock P.P.Q., said Common
Council duly met at the Council Chambers, in the City Hall, in said City,
pursuant to said resolution and notice and said public hearing was then
and there held and all persons interested in tpe said sanitary sewer
and water main who were present were heard before said Common Council
concerning and relating to the said sanitary sewer and water main, and
.said Common Council having duly eonsidered.the.matter of. the construction
or the said sanitary sewer and water main and the arguments and reasons
for and against the same and deeming it expedient and necessary that the
said sanitary sewer and water main be constructed; .
THEREFORE, Be it and it is hereby resolved by -said Common Council:
That a sanitary sewer be a onstructed• c ommene ing at the center of
the intersection of Sixth Avenue:Southeast and Tenth Street Southeast and
running East along the eenter'line of Tenth Street Southeast to the center
of Seventh Avenue Southeast, and therc a South along the center -line of
Seventh Avenue Southeast to the center of Eleventh Street Southeast and
also commencing at the center of the Intersection of Seventh Avenue South-
east and Tenth Street Southeast and running North along the center line
of Seventh Avenue Southeast to a point 135 feet South of the South line of
Ninth Street Southeast and the laying of a water main in said parts of
Tenth Street Southeast and Seventh Avenue Southeast.
Be it further resolved by the said Common Council: That the
aforesaid improvements be made and done in the manner hereinabove set
forth and that the whole cost and expense of the said improvements shall
be paid by special assessments levied as provided by law;
Be it further resolved by said Common Council: That the sewer pipe
used in the sanitary sewer shall be eight (8)..inches inside diameter,
that all said pipe shall be salt glased.vitrified clay pipe of standard
thickness, that all , joints in pipes shell be filled with Portland cement,
that all manholes shall be constructed of good quality of brick and covered
*ith cast iron cover and ring, together with weighing not less than 380 pounds,
and the "Y" branches shall be placed on the.said sewer for house connections
at such intervals as the site of the abutting lots may require; and the said
water main shall be standard mono -cast centrifugal cast iron pipe, class 1503,
guaranteed at 150 pounds working pressure;
Be it further resolved by said Common Council: That the City Engineer of
said City.be and he is hereby directed to'make and furnish to said Common Council
an estimate of the cost and expense of constructing thesaid sanitary sewer and
the laying of the said. water main as above described and to prepare and file in
the office of the City Clerk of said City, detailed plans, profiles and specifica-
tions for the said sanitary sewer and water main as;herein described.
Hon motion by Schroeder, second by Rommel, that the said resolution be
adopted as read, and all voting in favor thereof, President Meeks declared the said
resolution duly passed and adopted.
Alderman,Millor introduced the following resolution, which was read:
"WHEREAS, The Common Council of the City of Rochester, Minnesota, at a
meeting held on October 3rd, 19270 did pass and adopt a resolution declaring it
expedient and necessary that sanitary sewers be constructed described:
The construction of a sanitary sewer in Fifteenth Avenue Southwest from
the center of Fifth Street Southwest to the center of Sixth Street Southwest; the
construction of a sanitary sewer in Fourth Avenue Northwest from the center of
Ninth Street Northwest to lc!0 feet .North of the North line of Eighth Street North-
west; and the construction of a sanitary sewer in Thirteenth Street Northwest,
described: commencing at a point in the center of Thirteenth Street Northwest 30
feet Nest of°the center`line of Broadwe.-y Street North and running thence West along t
center line of Thirteenth Street Northwest to a point 3 ,feet West of the East line of
Lot 17 in Block 27 in Northern Addition, and ordering that a public hearing of all
persons interested be held at 9.:30 o'clock P.M;, on October 17th,1927, in the Council
Chambers., in the City Hall, in said City, and directed the City Clerk to caaxse notice
of the time, place and purpose of said hearing to be published as required by law and
said resolution was approved and signed by the Mayor of said City of Rochester, and
'WHCiRRAS, said City Clerk did duly and in due time publish a notice of the
tide, place and purpose of said public hearing in the official news paper of said
City, to -wit; - in the Rochester Post -Bulletin, published on October 4th,1927, and

duly met at the Council Chambers, in the City Nall, in said City, pursuant to said

Common Council concerning and relating to the said sanitary sewers, and said Common
Council having duly considered the matter of the construction of the said sanitary
sewers and`thu arguments and reasons for and against the same and deeming it expedien
and necessary that the said sanitary sewers be constructed;

That a sanitary sewer be constructed in Fifteenth Avenue Southwest from
the cen ;er of Fifth 'Street Southwest to the center of Sixth Street Southwest;
'What a sanitary sewer be constructed -in Fourth Avenue northwest from the
center of Ninth Street Northwest to 100 feet North of the North line of Eighth
Street Northwest;
That a sanitary sewer be constructed in Thirteenth Street Northwest, det-
cribed: Commencing at a point in the center of Thirteenth Street Northwest 3u feet
West of the center line of Broadway Street North and running thence West along the
center line of Thirteenth Street Northwest to a point 3 feet West of the East line
of Lot 17 in Block 27 in Northern Addition.
Be it further resolved by the said Common Council: That the aforesaid
improvements be made and done in the manner hereinabove set forth and that the
whole cost and expense of the said improvements shall be paid for by special
assessments levied as provided by law;
Be it further resolved by the said Common Council: That the sewer pipe

read, and President Weeks ordered that the same be placed on file:..

SW. beg to report and recommend as follows:
That the.sidewalk be ordered l6id_at the east curb line
of 8th. Ave. 'S.W. between 4th'and 6th Sts..S.W., when constructed
and to extend' eastward from said curb line the full width of the
customary sidewalk in 'residential portions of the City, providing the
owners of the Sutherhill Apartments furnish a .bond for 19000.00 to
.the City indemnifying it against any,.damage caused thereby.
