Meeting called to order by President..Weeks. Roll Call. Present: Weeks, Adler,'Erickson, Hicks, Rommel, Schroeder. Absent: Miller; Alderman Miller being absent on account of the illness of himself. Upon motion by Hicks, second by Schroeder, the minutes of the meeting held on October 3rd, 1927, were approved. t President Weeks announced that this was the -time and place fixed for a hearing on the vacation of the North 153 feet of.the alley running North and South across Block 18 in Head °:McMahon's Addition, and asked if there was any person present who wished to be heard concerning the vacation of the said alley. I T •. Dr. D. M. Berkman was present and solicited that the said vacation be made, n a A communication from the. Purity Diner Company expressing a desire to locat a Jerry O'PMahony dining car on Lot:-12, Block 32, Original Plat, jus t North of No. 24 First Avenue Southwest, was read, and President Weeks ordered that the said emmuunieation be placed on file, after the City Attorney had r.ulbd that this dining car would not come under the restrictions of the local building code. In thd� discussion relative to the njaintenance of the local "Stop" and "Go" signals, a motion by Dicks, second by Adler, carried t4at the future mainten- ance and operation of the. traffic control signals within this Cit•y,be under the supervision and control of the City Engineer„ y The report of the :..Milk Inspector for the months of September 19?7, and October, 1927, were each read, and President Weeks ordered that the same be placed on file, .he report of the Building and Electrical Inspector for the month of Octo- bets 1927, showing building inspection fees collected in the aliiount of 0229,00, and Electrical InspeetIon fees in the amount of h32,75, was read, and President 'leeks referred the said report to the Finance Committee, The report of the City Treasurer for. the month of October, 1927, showing the sum of ��261,429.71 as being on hand, was read., and President Weeks ordered that .the said report be placed on file. The report of the City Engineer for the month of Oetober,1927, showing expenditures for labor from the General Fund of $274 04, from the Street and Alley Fund 01831,43, from the Sewer Fund 83141,75, and from the Permanent Improvement Revolving Fund A80.75, was read, and President Weeks ordered the same placed on file. The application of the Sea Food Shop for permit to place and maintain a sign, was read, and upon motion by Rommel, second by Schroeder,plermit was granted. 766 The application of the Wm. T. McCoy Post No.92, American Legion, for public dance permit at the Armory November .11th, 1927, was read, Upon motion by Rommel, second by Adler, the matter of the drafting of an ordinance making the owners of canopies, area -ways, curb pumps, and other obstructions in public streets and alleys, become'responsible for the possible damage suits to arise from such obstructions, was referred to the City Attorney. ` The application of Vine H.'Kendall for permission to install a curb pump in the boulevard in front of the property known as Lot 4 in Block 261 Northern Addition, was read. Upon motion by Adler,,.second by Sc2W:oeder, the same was.referred to the Street and Alley Committee. The application of Chase Youngman and Chas. A. Risberg, for license to operate three pool tables and one billiard table at 326 Broadway Street South, was read, and upon motion by Hicks, second by Adler, license was grant- ede The application of Chas. A. Risberg for license to sell soft drinks at 326 Broadway Street Sduth, was read, abd upon motion by Adler, second by Hicks, license was. granted Alderman Adler introduced a t6solutivn vacating the North 156 feet of the alley running North and South across Block 18 inIHead & McMahon's Addition, which was read, Upon motion by Erickson, second by .Adler, that the said resolution be' adopted as read, and- all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. The claim of A'. H. Mienkle, in the amount of $6.00 for inspection of boilers at the Central Fire Station, and the City Hall, 3.00 each-, was y upon motion b3r. Adler-, second by Erickson, returned to him under the City Attorney's ruling that he has not the ri;;ht to collect an inspection fee for the inspection'of heating boilers,' A warranty deed given by Fred Altona, and Ole Sanderson, as, trustees for the estate of Maggie Alseth, deceased,"and S. 0. Sanderson, and Maude E. Sanderson; his wife, to the City of Rochester, Minnesta, covering a piece of property thirty-three ($3) feet North and South and two hundred eighty (280) feet east and west, laying next West' of IMteenth Avenue Southwest, and to be the South one half of Fifth Street Southwest, and a warranty deed given by the above mentioned parties to the.City of Rochester, Minnesota, covering the so- oA.11ed "School -.Block", were each read, and upon motion by Hicks, second by d 0 4 Schroeder, the same ;:ereaacepted and it was ordered that the said Warranty Deeds be placed on record. The following; copy of resolution passed and adopted by the Commissioners ' of the Sinking Fund, was read, and upon motion by Rommel, second by Erickson, the action set forth therein, was approved, and it was ordered that the said copy Of resolution be placed on filer "Be it resolved by the Commissioners of the Sinking Fund oP.the City of Rochester, Minnesota: That the sum of 12,222,.96 be appropriated from the Sinking Fund of the said City and paid to Lane,, -Piper & Jaffray, Inc., for $200000 State of Minnesota, Q Rural Credit Bonds due February 15th,1944 on a 3.90 % basis less 1/8 per oent; $2,000000 thereof being for principal on the said bonds, '!$201,06 thereof being premium on the said bands, and $21090 thereof being aocrued interest on the said bonds from 4ugust 15th,1927, to November 8th,1927, inclusive. " It was reported by the City Clerk that Warrant No. 1625, dated June 30th, 192 7, and drawn payable to Herbert Thienell, in the amount of 11.98, had been lost, and upon motion by Hicks, second by Erickson, it was ordered that 11ayment be stopped { on the said warrant and that a duplicate thereof be issued. City of Rochester, City Council, ' Rochester. Minn. Gentlemen: On October 20th, trunk highway No. 2.0 was re-routed upon its new location. On this date all maintenance forces of this department were .withdrawn from over 3rd Avenue Southeast and ':,=enth Street Southeast. In preparing your statement of maintenance to this department for 1927, you will include only that work done prior to October the 2 Oth; after this date the entire cost will be borne by the City of Rochester. Erickson, . the City Engineer was authorized to sell the old wood blocks salvaged from the Fourth Street Southeast paving at ` *40 per square yard, The claim of Ruben Dahl, 0154*00, for coat of 165 feet of server and water main laid in Tenth Street Southeast, east of Fifth Avenue Southeast, was read, and upon motion by.Hicks, second.,by Schroeder, the said claim was referred to the City Attorney. Engineer, A petition addressed tb. the Mayor and members of the Council, asking that Mike Doyle, be appointed as a Fatr.olman jin--the..'Police ;Depar.tment of said City, was read, and President Weeks ordered that the same be placed: on file. } The following communication, was read, and upon motion by Adler, second by $.orogder., the Sewage Hisposal Plant operators, and the City Enginer Stenographe'r, were each granted ten days vacation: "' November 70 1927. Honorable Mayor and Common Council. Gentlemen: The operators at the City' Sewage Disposal Plant and the City Engineer's Secretary are, I believe, each one entitled to at least ten days vacation, . and I beg permission from your Honorable Body to employ such extra held as may be found to be necessary to carry on the work - of this Department, 76g"' Resp eotfully, C. Upon motion by Adler, second by Schroeder, the City Treasurer was authorized to employ a stenographer for compilation sand typing of the unpaid 1927 sprinkling assessments: Pr9ject No. 76 of the Tri-State Telephone & Telegraph Company, under estimate No. 2161, covering underground cable, oonstruction, replacing tool, open wire 11 circuits, -;nd providing additional exchange facilities, was presented to the Qommon Council, e'nd upon motion by Rommel, second by Erickson, the said Project 1-Yo,,76 was approved. The following estimates prep6ted by the City Engineer in favor of the contractors mentioned, were each* separately read, and President Weeks ordered that th same be placed op file: Feller Brothers $1705.00 for construction of sidewalk on North side of brid r. over Cascade Creek at Third Avenue Northwest; 0 Wm, C. Fraser & Son $3082.85..for construction of sanitary sewer and laying of a water main in parts of Tenth Street/Southeast and Sixth Avenue Southeast; Wm. C. Fraser & Son !-1023&84 for construction of surface drainage sewer in Eleventh Avenue Northeast; Wm, C. C, Fraser & Son, 054708, for construction of a surface drainage sewer in Ninth Avenue Northwest, ' Alderman Rommel introduced a resolution providing for the issuance and sale of 2,000.00 City of Rochester, Minnesota. Q per cent Sewage Disposal Plat Bonds fordderin advertisement for bids to be opened November 21st,19271, at 7:30 o'clock which was, read. Upon motion by Adler, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resoluti duly passed and adopted. Alderman Schroeder introduced a resolution appropriating 1705.00 from the, Bridge FuNd a.nd ordering payment made to Feller Brothers for the construction of a sidewalk on the North side of the bridge over Cascade Creek at.Third Avenue N'orth- West, which was read. Upon motion bly Schroeder, second by Erikson, that the said resolution be adopted. as read, and all voting in favor thereof, President Weeks declared the said .:. resolution duly passed and .aldopted, 7M t Aldermen Hicks introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, 'Ainneso ta: That a resolution passed by the Common Council on October 31st, 1927, in which the bid Wf yam, C. Fraser & Son for the construction of a sanitary sewer and water main in Tenth Street c.:and Seventh Avenue Southeast be and the same is hereby amended by striking out thq last paragraph thereof which specified the amount of the bond e:t• the sum of Vj,59509,00, and insert therein, and in lieu thereof, as follows, to -wit; The amount fif the bond to be given by the said Contractor is hereby fixed at the sum of 445000. Be it further resolved by the said Common Council that the bond 'to be given by the said Contractor for the doing of said,work be fixed at the said sum of 14450.*00. " Upon motion by Erickson, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President reeks declared the said resolution duly passed and adopted, Alderman Hicks introduced the following resolution, which was read: "WHEREAS, Proposals have been reoeiyed by this Common Council for the printing of the Ctty of Rochester, Minnesota, ordinances in book form, and WHEREAS, It is deemed expedient/arid necessary that the ordinances Of the City of Rochester, Minnesota, be published in book form for use. bf- Q•ity Officials and interested persons, and WHEREAS, The Quality Print Shop are the lowest responsible bidders for the printing in book form of 300 ordinance books, containing all of the ordinances now in effect, at a, price of <$488, 75. SO THEREFORE*. BE it resolved by the Common C oune i 1 of the City of Rochester, Minnesota, that the pvoposal'of the Quality Print Shop for the furnishing of ordinance books as above mentioned'be accepted and that they are hereby requested to print and furnish 300 ordinance nooks at a price of 488.75." Upon motion by Erickson, second by Hicks, that the said resolution M be adopted as read, and all voting in favor thereof, President Weeks declared, . the said resolution duly passed and adopted.. Alderman Adler introduced a resolution .appropriating $2,000.00 from the Street and Alley Fund fna use of 'the Street and Alley Committee, which was read. Upon motion by Erickson, second by Schroeder, that the said resolu- tion be adopted as read, and all voting in favor thereof, President Weeks declared the, said resolution duly passed` and adopted. Alderman Erickson introduced a resolution granting public .dance Ilpermit to the Wm. T. McCoy Post No. 92, American Legion, for the Armory, Novem- ber llth;l927, and firing the fee at 05.00, which was read. Upon motion by Hicks, second by Adler, that the said resolution be adopted as read, and all voting in favor thereof, President Weeks -declared, the said resolution duly passed and adopted. r4 7'T1 Alderman Adler introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $327 23 be appropriated and that the same be paid to the Rochester'0il Company for gasolene, oil and grease furnished during Oe tober, 1927: $98,02 thereof to'be from the General Fund and $229,21 thereof to be from the Street and Alley Fund. The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sim'upon the City Treasurer in accordance herewith and cause said payment to be- made, " Upon motion by Erickson, second by A_�_ler, that the said resolution be adopted as read, `,and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted, Alderman Erickson introduced a resolution appropriating ^1023.84 from the Sewer Fund and ordering payment made to Wm. C. Fraser & Son for construction of surface drainage sewer in Eleventh Avenue Northeast, which was read,. Upon motion by Schroeder, second by Hick_., that the said resolution be adoted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted, Alderman Hicks introduced a resolution appropriating t'144074 from the S;;wer Fund and ordering payment made to Wm..C. Fraser & Son for construction of a surface drainage sewer in Sixth Street Northeast, which was read. Upon motion by Rommel, second by Schroeder, that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted, Alderman Rommel introduced a resolution appropriating $547,68 from the Sewer Fund and ordering paymeittmade to Wm. Company, the Ole Haugen and the Ralph Leisch properties in .Sou-bnwest Rochester as set forth int,_�*eeommendation and 'request of the Board of Park Commissioners beg to report and recommend ,as follows: We recommend that the city purchase the Rochester Ice & Fuel Company and -the Ole Haugen properties as the sanie are described in gaid request of the Park Board; We recommend that that part of fthe Leisch property as set forth in said request be not acquired as at this time it would..'mean that' the City would have, to purchase the entire farm of Mr. Leisch for .the reason that ,there would not be sufficient land left to be of any use to -Mr. Leisch. The following rgcommendation of the Police Committee was 'read, and President Weeks ordered titre same placed on file: "Rochester, Minnesota. November 7th, 1027. Gentlemen: The Police Committee recommends that permission be r given for the purchase of a heater for the' Police' -Car now in use by the Police Department. " Upon motion by Adler, second by Hicks, the purchasing Committee were authorized to purchase a heater for the Police automobile. The City Engineer submitted plans, profiles, specifications and estimate of cost for the construction of a sanitary sewer .and the laying of a water main in Seventh Avenue Southeast, from Hleventh Street Southeast to Twelfth Street Southeast, the said estimate of cost being $1703,20. - t Alderman Schroeder introduced a resolution adopting the said plans, profile and specifications and ordering the same placed on file, ordering that the said estim ate of cost be placed on file, ordering that the said sanitary sewer and water main be laid and constructed under special assessments levied as provided by law, ordering advertisement for bids to be opened at 7:30 o'clock P.M., November 21st, 19:37, and ordering notice of public hearing for that date and hour, which was read. Upon motion by Schroeder, second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Adler introduced an ordinance Number 330, being an ordinance to amend andinance No.354, the same being entitled"An Ordinance Regulating Traffic Wi the City of Rochester, and 13roviq_ting for the Operating and Parking of Vehicles and Designating Arterial Highways in Said City", which was given its first reading. Upon motion by Adler, second 1}y Erickson, thefrules weresuspended and the said ordinance was given it s second reading. Upon motion by Rommel, second by Adler, the rules were suspended and the said ordinance waas given its third and final reading. Upon motion by Hicks, second by Erickson, that the said ord±nanee be adop to 11 as read, and all voting in favor thereof, President Weeks declared the said ordinance duly passed %nd adopted, The recommendation of the Water Committee that a water main be laid in Fourth Svenue Southeast, between Fourth Street Southeast and Fifth Street Southeast, was read, and President Weeks ordered that the same be placed on file. Upon motion by Adler, second by Erickson, the City Engineer was authorized to arrange for four Permanent men in his Department, during the winter months, at a salary of -25.00 per week; Alderman Rommel introduced a resolution authorizing the Public Utility Board to lay a water mein in Fourth Avenue Southeast between Fourth Street Southeast and Fif-,�h Street Southeast, which was read.
