Minutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota, held in -the Council Chambers, in the City Hall, in said City
on ?November 28th,1927, at 7:30 o'clock P.M.

The report of the Clerk of the ?Municipal Court for the week ending November
21st,1937, showinn criminal fines collected 110�00, civil fees received �'"2.00, and

The application of the R.dinbow Club for a permit to hold, give and conduct
a public dance permit at the Woodmen Hall,on November 9th,1927, was read,,
The appointment by the Mayor of A. E. Gates as a Patrolman,effeetive Novem-
ber 23rd,1927, he to serve until the second Monday in April,1928, unless sooner
removed, and the appointment by the Mayor of J. A. Stoffer as a Special Policemen
on' the property of Finkelstein & Ruben, on First Street Southwest, knot,%?n as the
Chateau Dodge Theatre, he to serve without pay and to hold office until the second
Monday in April, 1928, unless sonner removed, were each Bead, and President Weeks

upon motion by E ickson, second by 'it ... Adler .:, the said surety was accepted, the said
bond was approved and it was ordered that the same be placed on, file.
The following-_�copies of resolutions passed and adopted by the Commissioners
of the -Sinking Fund, were each read, and upon motion by Erickson, second by Adler,
the actions set forth therein were approved and it was ordered that the,said copies
r solutions be placed on file:
"VIII-EFEAS, the Sinking Fund of the City of Rochester, ;Minnesota, for the
payment of principal maturities on Sewage Disposal Plant Bonds of said City, has
not sufficient funds with which to meet the December 1st, 1'9237, maturity of bonds,
and
WITUREAS, thaw has heretofore been transferred funds accumulated for that
purpose, to investrment,in interest bearing securities until such time as the funds
were needed for the payment of principal, and
it is, deemed to be for the best interest of the City of Rochester,
hilinnezota, in so far as. there are - surplus funds for investment from other divisions
of the Sinking Fund, that a sufficient amount of the said Sinking Fund investments b

SO TITITTIREFORE., be it resolved by the Commissioners of the Sinking
Fund of the City of Rochester, Minnesota, that 114,000,00 State of Minnesota
4Pe, Rural Credit Bonds maturing September-15th,1944, be sold from the
SinkinA(Fund Investments of Sewage Disposal Plant Bond Funds to the Sinking
Fund investments of funds for the, ppyment of Electric Light, and Water Works
Bonds of said City, at a price of $3.85%, plus accrued. interest or:.a total
of 1150743.94; .14,000.00 thereof to be for the principal on said bonds,
',)1564.75 thereof to be for premium on the said bonds, and �'s179.19 thereof
to be for°accrued interest on the said bonds,* August 15,1027, to November

Be it further resolved that the sum of 115,743.94 be appropriated

I am to request thatyou purchase a certain acreage., adjoining the
City Hop' Farm and on Higtiway� No. _20. Dx. Mayo deems this advisable
in order to inelrease the acreage. of the Farm, to guarantee free
and good access to the Highway and for the protection of the City
interests.

The following communications were read, and upon motion by Adler, second
by Schroeder, the City -Clerk was instructed to request of tsr. W. W. Churchill,
President of the Library Board, that he appear before the Board of County.Commissioner
at their regular meeting in December, 1927s and ask for the 1927 appropriation of
600.00:

appropriation to the Rochester Public Library, for' the year
1.9ti7, is because no request nas been made for the same to the
Board. Whether or not .the Board would iiiake an appropriation
if requested` to do so, I could not say.

Upon motion by Adler, second by Erickson, the slue of 18o,00 was appropriated
from the General Fund ..nd it was ordered that the same be paid to .Mrs. Catherine Frits h,
for compensation for the death of Mr. Christopher F. Fritsch, for the period October
08th,1927, to November 24th,1927, inclusive.
The following report of the Street and Alley Committee, was read, and Rioesi-
dent Weeks ordered that the same be placed on file:

C. W. Shephard offered $30,000.00 cash for the W'itherstine property
and upon motion by Adler, second by Miller, his proposal was referred to the
Public Grounds Committee with request that they make report at the next
meeting of this Common Council.
Warranty deeet given by Ole Haugen and Annie Haugen, his wife,
to the City of Rochester, Minnesota, covering Lots 1, 2, 3 and 4, in Block
7 in Head £: McM_.hon's Addition, was read, and upon motion by Nicks, second
by Adler, the said warranty deed was accepted and it was orderedthat the
same be pleLced on record.
Upon motion by Adler, second by Miller, the sum of �`61,04 was
appropriated from the General Fund and it was ordered that the same be paid
to the Treasurer of Olmsted County for the last one half of the 1926 sprinkling
tax, and sanitary sewer assessment against Soldier's' Field,- four Seventh Street
agreed as
Southwest; the said 161.04 to be deducted from the Al 000,00/due, the American
Legion in the final settlement relative to Soldier's F'dd�d,

Alderman Erickson introduced the sollowing resolution, which was read:
"iIII:'REAS, the City of Rochester and L. A. Kepp doing business as Kepp
Electric Company entered -into a contract on Mats 28, 1927 for the furnishing of
certain material and kabor in the matter of the installation of police and fire
alarm signal s_yst.em in the City of Rochester;
Whereas, the said City of Rochester has changed -the plans for the said
work in such a manner that' the material purchased by Kepp Electric Company for
the doing of said wor? cannot -all be used in the doin:r= of the said work;.
Whereas, both parties to .the said contract are willing to cancel the said
contract upon the following conditions, to wit: that Kepp Electric Company
execute and deliver to the City of Rochester a bill of sale of all material
purchased by it for, the doing of the said work, a list of whdh is set forth
in the specifications attached to .and made part of the said contract and th_t
Ke,op Electric Company be paid by the City of Roches'ter' the sum of Slix hundred
einhteen and 18/100 Dollars (0618,15)'as one-half payment for the said material
and thi- reels,on which the cable is wound, also the sum of Thirty two and 15/100
Dollars (,,.,32.15) as and for one-half of such labor and work as has been performed
on account of the said agreement to date,,

Upon motion by Schroeder, second by.Hicks, that the said resolution be
adopted as read, and all .voting in favor thereof, President Weeks declared the said
resolution duly passed and adopted.
A 3J.11 of Sale given by Kepp Electric Company for the materials above menti
ed Eves read, and upon motion by Hicks, second ;by Adler, the said Hill of Sale was
accepted and it was ordered that the same be placed on record.

A certificate from Amiel L. Glabe, County Auditor, under date of November
22nd, 1927, showing a total of ?19,67 as refundments granted by the Minnesota Tag
Commission, from the 1926 tax levy, was read, and upon motion by Adler, second by
Miller, the City Clerk -was instructed to adjust his tax records accordingly.
Upofi motion by Schroeder, second by Erickson, the Fire Department Committee,
the Fire Chief and the Superintendent of the ,Electric Light Plant, were named as a
Committee to ;Hake recommendations to this .Common Council relative to the installation
of a police anal fire alarm signah system, which said recommendations shall come to
this Council at the next meeting thereof.
Alderman Adler introduced a resolution granting public dance permit to the
Rainbow Club for the Woodman Hall, November 29th,1927, and fixing the fee at the sum

Capon motion by Adler, second by Schroeder, that the said resolution be
adopted as read, and all voting in favor thereof, President Weeks declared the said
resolution duly passed and adopted,
Alderman Schroeder introduced the following resolution, which was, read;

declared the said resolution duly passed and adopted.
Alderman Schroeder introduced a resolution ^,npropriating, 1,21,1.38
from the Street and Alley Fund and ordering payment made to Fielding &
Shepley, Inc., for 30 tons brtdk filler, 12250 # at $35,00 per ton, which

Upon motion by Hicks, second by Schroeder, that the said resolution
be adopted as read, and all voting in favor thereof, President Weeks
declared the said resolution duly passed -and adopted.
Alderman Erickson introduced a resolution appropriating ."2055;648
from the Musical Entertainment Fund and ordering payment maade. to A. J.
Lentfer., Treasurer of the Rochester Park Band, for furnishing free musical
entertainment to the General Public, being the amount collected for that
purpose in the November 1927, tax settlement, which was react.
Upon motion by Miller, second -by Adler, that the said resolution be
adopted as read, and all voting in favor thereof, President Weeks declared
the said resolution duly paased and adopted.
Alderman Miller introduced a, resolution appropriating .$137.23
from the General Fund and ordering payment made to the Permanent Improvement
Revolving Fund for the said Revolving Fund's share in the tax penalties
collected in the November, 1927, t&x.-settlement, which was` read.
Upon motion by Schroeder, second'by Hicks, that the said resolution
