Minutes of an adjourned regular meeting of the Common Council bf '
the City of Rochester, Minnesota, held in the Council Chambers, in the City
Hall, in said City, on December 12th,1927, at 7:30 oclock P.M.
Meeting called to order by President Weeks. '
Roll Call; Present: Weeks, Adler, Erickson., Hicks, Miller, Schroeder.
Absent: Rommel,
Upon motion by Erickson, second by Adler, the minutes of the meetings
hold on November 7th,1927, and November 21et, 1927, were each approved.
The report of tho City Weighmanter for the month of November, 192'7,
showing receipts in the amount of 031*30, was read, and President Weeks
referred the same to the Finance Committee.
The report of "the'Health Officer for the 'City Farm for the month of
November, 1927, showing receipts in the amount of $2985.551, disbursements
$1,322,-38, and, a balance on hand in'the amount of '$9,150,22, was read, aAd
President Weeks ordered that iheAsame be placed on file,'
The following applicationg for permits to hold, give and conduct
public dances were read
Veterans of Foreign Wars, for National Guard Armory, December 26th
and 31st, 1927;
Company C. 205th Infantry,Minnesota National Guard, for the National
1927,
Guard Armory December 1'7t ,and January 7th,1928;
The RaiJkbow alub for the Woodman Hall, December 6th,1927.
The application of the Yellow Cab Company for transfer of their
taxicab licenses No. 13, 14, 26 and 2$, each to a-7,passenger Cedillaa
automobile , was read, and on motion by Adler, second by Schroeder, transfers
were granted.
The following copies of resolutions passed and adopted by the Public
Utility Board, were read, and President Weeks ordered the same placed on file:
"Be it and it is hereby resolved by the Public utility Board of the
City of Rochester, Minnesota that the Hon. Common Council of the said City be
and is hereby requested to authorize the said Board to transfer the amount of
TWENTY THOUSAND ($20,000.00) from the Public Utility Fund,to the Interest Fund
of said City the same being semi-annual interest due on City of Rochester,
Minnesota 5% Electric Light Bonds Nos. 151 to 950 inc."
"Be it and it is hereby resolved by the Public Utility Board of the
City of Rochester, Minnesota that the4Hon. Common Council of the said City be
and is hereby requested to authorize the said Board to transfer the amount of
THIRTY FIVE HUNDRED NINTY FIVE -DOLLARS ($3505.00) from the Public Utility
Fund to the Interest Fund of the said City, the same being $3600.00 interest
(semi-annual) due on City of Rochester Water'Works Bonds less �5,00 overpaid
on previous transfer," . "

The bond of Frank Springer as Treasi.rer of the Rochester .Fire Department
Relief Association in the amount of $2025,00, eovering',4ppropriations by the City of
Rochester, Minnesota, of tax collections for Firemen's Relief, etc., with the New
Amsterdam Casualty scompany, as surety, was read, and upon motion by Erickson, second
by Adler, the•s&id surety'was accepted, the said bond was approved and it was ordered
placed on file.
Upon motion by Adler, second by Miller, the City Clerk was instructed to
charge off the record valuation and depreciation charges on the Isolation Hospital
buildings which were sold to J. V. Murphy, December 5th,1927, and also to cancel the
fire insurance on the said buildings AffAetive on this date.
The following communication was read, and upon motion by Miller, second
by Adler, the City Clerk was instructed to execute a cancellation release, as re-
quested :

The following, ruling of the -City Attorney was read, and President Weeks
ordered that the same be , placed on file:

The opinion of the writer has been asked as to the legality of
appropriations to assist and defray on the cost of holiday street lighting
in the City of Rochester and also forthe purpose of purchasing material and
equipment and employing personnel for tke,operation of a free municipal skat-
ing rink. In my opinion appropriation for holiday `street lighting is legal;
but the question as to whether or,not the City should operate -&-free skating
rink is one of policy although propably a municipality might do so in the ex-
ercise of its power to provide amusement places. Such action on the part of

the City might set a precedent for the establishment of other
free amusements. I_n any event it is the opinion of the writer
that such a m0tgt- should',be'handled exclusively by the Park
Board.

Rulings made by the City Attorney relative to Chapter 373 of the
1927 Session Laws, Chapter 390 of the 1927 Session Laws and Chapter 269 of
the 1927 Session laws, were read, and President Weeks ordered the same placed
on file.
Alderman Rommel came in at this time and took his Bhair.
Alderman *filler introduced a resolution granting public dance permit
to the Whitlock -Sonnenberg Post 1215, Veterans of Foreign Wars, for dances
at the National Guard Armory December 26th and 31st, 1927, and fixing the
fee, at $10.00, which was read.
Upon motion by Adler, second by Erickson, that the said resolution
be adopted as read, and all voting in favor thereof, President Weeks declared
the said resolution duly passed and adopted.
Alderman Rommel introduced a resolution granting a public Dance
permit to the Rainbow Club for the Woodman Hall, Decenb er 6th,19272 and
fixing the fee at. $5.00, which was read.
Upon motion by Rommel, second by Schroeder, that the said resolution
be adopted' as read, and all voting in' favor thereof, President Weeks declared
the said resolution duly passed and adopted.
Alderman Schroeder introduced a resolution granting public dance
permit to Company C. 205th Infantry Minnesota National Guard, for the National
Guard Armory December 17th, 1927, and January 7th, 1926, and fixing the fee
at $10;00, which was read;
Upon motion by Schroeder, second by Rommel, that the said resolution
be adopted as read, and all voting in favor thereof, President Weeks declared
the said resolution duly passed and adopted,
Alderman Erickson introduced a resolution appropriating $401.51 from
the Park Improvement Fund and ordering payment made to Dodge`Lumber & Fuel
Company for 98850 pounds of Harrisburg coal at $8.25 per tonl$397.87, and 140`
feet of lumber $3.70, which was read.
Upon motion by Erickson, second by Miller, that the said resolution
be adopted as read, and all voting in' favor thereof, President Weeks declared
the said resolution duly passed..and adopted.

Alderman Erickson introducdd the following resolutior_, which es run"d:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the sum of $3500.40 be and the said sum is hereby appropriated from
the general Fund of said City and ordered paid to J. F. Volz, for three parcels of
land in'the Northeast quarter of the Southwest quarter of Section 79 Township 1069
Range 13 West in Olmsted County, Minnesota, consisting of three parcels commonly
known and described as follows, to -wit: Ten (10) acres of the H.F.Williamson farm,
ten (10) acres of the J.,E.Mayhew farm and twelve (12) acres of the C.F.Andrews farm,
all of the said property lying south and west of State Trunk Highway No.20 in said
section; also one icehouse 18 x 26 fie and one garage 12 x 18, which first party,
J. F. Volz, agrees to deliver to the City Hog Farm.
The Mayor and City Clerk are hereby authorised and directed to draw a
warrant for said sum upon the City Treasurer in accordance` herewith, and cause said
payment to be made.
U-non motion by Adler, second by Rommel, that the said resolution be adopted
as read, and all voting'in favor thereof, President Weeks declared the said resolu-
tion duly passed and adopted.
Alderman Erickson introduced a resolution appropriating $350.00 from the
GenerN? Fund and ordering payment made to Olmsted County Business Men's Association
for to apply on the cost of street decorations for the 1927 Christmas season, which
was read.
Upon motion by Rommel, second by Adler, that the said•resolution be
adopted as read, and all voting in favor thereof, President Weeks declared the said
resolution duly passed and adopted. `
Alderman *filer introduced a resolution'appropriatiitg S205.55 from the
Park Impr ovement Fund and order in'g payment made to Jac obsen Manufacturing Company for
one power lawn mower, less ' a1lowariee of 070.00 for old Ideal mower, which was read.
Upon motion by Hicks, second by Erickson, that the said resolution be
adopted.as read, and all voting in favor thereof, President,Weeks declared the said
resolution duly passed and adopted.
Alderman Hicks introduced a resolution appropriating $1011,60 from the
Firemen's Relief Fund and ordering payment made to Frank Springer, Treasurer of the
Rochester Fire Department Relief Association, the same being collections on tax
levies for that purpose made during the year. 1927, which was read: '
Upon motion by Schroeder, second by Hicks, that the said resolution be
adopted as read, and all voting in favor thereof, President Weeks declared the said
resolution duly` passed and -adopted*
Alderman Schroeder introduced a resolution appropriating $209.15 from the
General Fund and order ingpayment made to Dodge Lumber & Fuel Company for 48965 pound
coal furnished for use at the City Hall $197,00, and 15440 pounds coal furnished for
$62.15,
use at the Witherstine property, which was read.

Upon motion by Hicks, second by Miller, that the said resolution
be adopted as read, and all voting in favor thereof, President Weeks declared
the said resolution duly passed and adopted,,
Alderman Rommel introduced a resalution-appropriating 5',,306.83 from
the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for
p ayrolils for labor for the weeks ending November 25th,1927, December 2nd, 1927,
and Deeeikber 9th, 1927, which was read.,
Updn motion by Erickson, second by Hicks, that the said resolution
be adopted as read, and all voting in favor thereof, President Weeks declared
the said resolution duly passed and adopted.
Alderman Miller ir}trodueed the following resolution,. which was read:
"Be it resolved by the Cor4ncn Council of the City of Rochester,
Minnesota: -
That the Public utility Board of said City be and the said Board
is he3'eby authorized to appropriate the following'sums for the purposes stated,
from the Public Utility Fund to the Interest Pund:
t$20,000,00 for interest due January lst,1928, on City of Rochester,
Minnesota, Electric Light Bonds No.151 to 950 inclusive;
$3,595,00 for interest due January �lst,1928, on City of Rochester,
Minnesota, 4, % Water works Bonds. "
Upon motion by Rommel, second by Adler, that the said resolution be
adopted as read, and all voting in favor thereof, President Weeks declared
Ithe said resolution duly passed and adopted.
Balance sheet, income statements, etc., of the Public Utility
Departments, as at November 30th,•1927, were laid before the Common ffouncil

showing a net profit in the Light Department for the month of November ,1927,
of 1,,14, 536.26, and a net prof it for the eight months of this fiscal year -of

$138782.75, and a net profit in the Water Department for the month of. November,
1927, of $5651.02and a net profit for the eight months of this fiscal year ,of
34202,43,
Alderman Adler introduced a resolution appropriating .1;1.�377.96 from
e Street and Alley Fund and ordering payment made to the Standard Oil,Company
or the furnishing of 6268 gallons asphalt*oil under contract, which was read.
Upon motion by Adler, second by Erickson, that:the said resolution
e adopted as read, and all voting in.f4vor thereof, President Weeks declared
he said resolution duly passed and adopted.
Alderman Erickson introduced a resolution appropriating $466,42 from
Street and Alley Fund and ordering payment made to the Standard Oil Company
or 7735 gallons asphalt oil, furnished under contract, which was read.

Updn motion by Rommel, second by Adler, that the said resolution be adopted
as read, and all voting in favor thereof, President Weeks declared the said resoluti
duly passed and adopted.
The recommendation of the License Committee that a Junk Dealer's license
be granted to Bemel Brothers, was read, and President Weeks ordered that the same
be placed on file.
Upon motion by Adler,, second by Erickson, Bemel Brothers were granted a
Junk Dealer's license.
TheJunkdealer's license bond of Bemel Brothers, with the American Surety
Company of New York, as sureties in the amount of ,$1,000.00 waE read, and upon
motion by Hicks, second by Erickson, the said surety was accepted, the said bond
was approved, and it was ordered that the same be placed on file.
Alderman Hicks introduced Ordinpm ce No. 381, being an ordinance to amend
anfordinance entitled " An Ordinance Regulating the operation and rates of fare of
taxicabs and automobiles carrying passengers for hire, with -'seating capacity of not
to exceed seven persons, within the•City of Rochester", which was given its first
reading.
Upon motion by Erickson, second by Adler,

Upon motion by Adler, second by Miller, that the said ordinance be adopted
as read, and all voting in favor thereof, President Weeks declared the said ordinance
duly passed and adopted.
Alderman Miller introduced ordinance No. 382, being an ordinance providing
for and regulating the collection of garbage in the City of Rochester, Minnesota,
the disposal thereof, and providing for assessments against property benefited there-
by, which was given its first reading.
Upon motion by Hicks, second by Adler, the rules were suspended and the
said ordinance we,s givan`its second reading.
Upon motion by Erickson, second by Miller, the rules were suspended and the
said ordin-l•nee was given its third and final reading.
Upon motion by Rommel, second by Hicks, that the said ordinance be adopted
as read, and all voting in favor thereof, President Weeks declared the said ordinance
duly passed and adopted.
The following claims were read, and upon motion by Hicks, second by Erickson
the same were allowed, and the Mayor and City Clerk were authorized to draw warrants
upon the City Treasurer, and make payment accordingly:

Upon motion by Adler, second by Miller, the City Engineer, was
instructed to ask the Mayor for an emergency authorization for the purchase
of a 3-2 ton international Truck, with dump body and hoist.
President Weeks appointed the members of the Common Council as a '
Committee for consideration of the sale of the Witherstine property and the
Public Library PFoperty Und the building of a new City Hall.
Upon motion by Erickson, second by Adler, the City Attorney was
instructed to write the Gazmewell Company advising them of the e-neellation of
the uepp contract for installation of police and fire alarm signal wiring, and
•
that it is the intent of this Comi;on Council to delay proceedings for a new
contract until the coming spring.
Upon motion by Schroeder, second by Adler, Coe/ncil adjourned to
