Meeting; called to order by President Weeks. f ' Roll Call.' Present: Weeks, Erickson, Hicks, Miller, Ronmel, Schroeder. Absent: Adler. The call for the special meeting was read; said meeting being called for the purpose of action on request of Board of Education of Independent School District e !To. 8, that the c?uestion of the issuance of 4�',2oo,000.00 bonds be submitted to the electors of s^.id City, and any other business that the said Common,Council might deem proper. The following certified copy 'of resolution, was -read, and President Weeks orderedthe s me placed on file: "The following; resolution was offered by Mr . Chadwick who moved its adoption: Resolved by the Boyd of Education of Independent School District No. 8 of Olmsted County, otherwise known as the Board of Education of the City of Rochester, at a duly balled meeting thereof, legally held on the 20th day of December 1927, a quorum being present, that in its opinion it is expedient to issue to the State of Minnesota the bonds of said Independent School,District No. 8'of Olmsted County to the aggregate amount of $200,000.00 for the following purposes: $130,000.00 for the purpose of defraying the expenses to be incurred it the construction and installation of a heating plant for the High School and Central School buildings; 070,000.00 for the purpose of defraying the expenses to be incurred in remodelling,, repairing, and constructing an addition to,,,the HawtHorne School buildin to bear interest at the rate of four and one-fourth (44) per centum per arinum, to mature and to be of the respective numbers and amounts as hereinafter set forth; 1. One bond for the sum of 035,000.00 payable July 1st, 1'941;` 2. One -bond for the sum of Ar,35,000.00 payable July 1st, 1942; 3. One bond for the sum of 4$30,000.00 payable July lfft, 1943; 4. One bond for the sum of $30,000.00 payable July 1st, 1944; 5. One bond for the sum of $$259000,00 payable July 1st, 1945; 6. One bond for the sum 'of $$25,000,00 payable July let, 1946; 7. One bond for the sum of , $20, 000.00 payable July is t, 1947 : That the, proposition of issuing said bonds be submitted' to the electors of said school district at a special election to be held therein on the 18th day of January A. D. 1928 between the hours of 9 o'clock A.M. and 7 o' aoek P,M. and that due notice thereof be given as required by lag. This motion was duly seconded by Mr. Fiegel a member of the Board of Education, and being put to a vote,�prevailed: five yeas, no nays. On motion by Mr. Chadwick duly seconded by Mr. Waldron, the following resolution was adopted, all of the members voting in favor thereof: Whereas the Board of Education of Independent School D_L' strict 'To, Of of OYmsted County, ate a regular meeting,of said Board duly held on December,.20, 1927 adopted a resolution wherein it stated that it' was of the opinion of said board of Education that.it was expedient to issue to the State of Minnesota -the bonds of said xchool district to the aggregate amount, of 4$200,000.00 for the purpose of defraying the expenses to be incurred in the construction and installatdon of a heating plant I; 2126 `Y for the High School and Central School buildings and in remodelling, repairing and constructing an addition to, the Hawthorne School building; said bonds to bear interest at the.rate of Sour and one-fourth per centum per annum and to mature and to be of the respective numbers and amounts as in said resolution stated and that the pro.position of issuing said bonds be submitted to the electors of said district at a special election thereof to be held on the 18th day of January 1928 between the hours of 9 i e' clock A.M. and 7 0' clock P.M.; Now, therefore, be it resolved bhat a copy of said resolution and of this resolution be transmitted by the ClOrkCQf,this Board to the Common Council of the City of Rochester and that said Common Council be, and it hereby is, requested to call a special election of said school district to' be held at the time hereinbefore stated fori,the purpose of submitting said proposition to -the electors, of said District. Chadwick, Clerk of the Board of Education of independent School District No. 8 of Olmsted County, do hereby certify that I have compared the foregoing extract from the minutes of a regular meeting of said Board held on December 20t1027, which extract -shows the action:of said Board upon the proposition ,of Issuing the bonds of said District to the amount of `�200,000.00, with the minutes of such meeting and that the same is a true and correct copy thereof and of the whole thereof. .�� Witness my hand this 20th day of December 1927. The report of the Clerk of the Municipal Court for the week ending December s 5th,19272 showing criminal fines collected.in the amount of $250,00, civil fees receiv �4.35, and court costs charged to Olmsted County t1$18,40; for the week ending December 12th3, 1927, showing criminal fines collected $11.009 civil fees received 87.102 court costs charged to Olmsted County 65.801, and for the week ending December 19th,19273, showing criminal fines collected 112.00s civil fees received $7,35, and court costs charged' to Olmsted County ?IF11.80, were each read, and F'resident Weeks ref erredthe swme to the City Attorney. read: The following applications to hold,give and conduct public dances, were C .''Li Stewart for Forester Tea& for Woodman Hall, Deeerrb er 23rd, 1927; Fred Blattner for Woodman Hall, December 20th,1927. and The applications of Claude L. Bogart, H. C. Woodruff,/Ray Hellenbolt, for 1928 driver's licenses, were each read, and upon motion by Schroeder, second by Roi-me licenses were granted. The following resignation and Appointment were read, and President Weeks ordered that the same be placed on file: " Rochester, Minnesota, December 21,1927. Honorable 6Y0mm0n Council, City of Rochester. - Minnesota* Gentlemen: This is to inform you that effective December 18th, '1927, Albert M. Ruth resigned as Patrolman in the Police Depart- ment of said City, and that I have accepted his resignation. Respectfully submitted, W. M. WET-XS � Acting Mayor of said City. "Rochester, Minnesota, December 2101927. Honorable Common Council, City of Rochester, Minnesota. Gentlemen: Effective December 22nd, 1927, I have appointed Henry C. Lindberg as a Patrolman in the Police Department of said City, r he to hold office until the second Monday in'April, 1928, unless sooner removed. Respectfully submitted, W. M. Weeks Acting Mayor of said City. " The official bond of HenrytC. Lindberg as l'!otrolman, with the Fidelity & O'asualty Company of New York, as surety thereon, was read, and upon motion by Hicks, second by Schroeder, said surety was accepted, the said bond was approved and it was ordered that the same be placed on file. The following copies of resolutions passed and adopted by the P-iblic Utility Board were each read, and President Weeks ordered that the same be II placed on file: "Be it and it is hereby resolved by -the Public Utility Board of the City of Rochester, Minnesota that the Hon. Common Council of the Said City be and is hereby requested to authorize the said Board to enter into a contract with the Price Electric Company of St. Paul, Minnesota for the furnishing to the said City of Rochester of the following transformers- 2-5 KVA; 2-15 KVA; 4-25 KVA; 4-372 KVA and 4-75 KVA, all in accordance with specifications and as per the bid of the said Price Electric Company dated December 14th 1927 at a price of THIRTY ONE HUNDRED AND SIXTY SIX DOLLARS AND NINTY CENTS ($3156,90), the said Price Electric Company being the lowest responsible bidders and -said prices being F.O.B. cars Rochester, Minnesota." " Be it and it is hereby resolved by the P*lie utility Board of the City of Rochester, Minnesota that the'Hon.Common Council of the said City be and is hereby requested to authorize the said Board to transfer the amount of THREE THOUSAND FIVE HUNDRED FIFTY TWO DOLLARS AND SEVENTY THREE CENTS ($3552.73) from the Publla-Utility Fund to the Sinking Fund of the said City the same to be used to pay balance necessary for the retirement of City • of Rochester, Minnesota 5% Electric Light Bon Nos. 151 to 160 in the amount of Ten Thousand Dollars, the addition1447;27 being available in said Sinking Fund after giving effect to December 1927 transactions therein." "Be it and it is hereby resolved by_the,,Pub13e Utility Board of the City of Rochester, Minnesota that the Hon., Common..Council of the said City be and is hereby requested to authorize the said Board to transfer the amount of FIVE THOUSAND DOLLARS (05000.00) from the Public Utility Fund'to the Sinking Fund of the said City, the same to be used for the retirement of City of Rochester, Minnesota Water Works Bonds Nos. 16 to 20 inclusive." The following communication was read,`and President Weeks ordered that the same be placed on file: "MINNESOTA DEPARTMENT OF HEALTH t Old Capitol Building St.Paul December 13,1927 City Council, c/o Mx: A.F.Wright, City Clerk, , Rochester, Minnesota, Gentlemen: We have your letter of December 6 in which yoil request f a copy of the report on the stream pollution investigation at Rochester which was undertaken by our Division of Sanitation) on July 20, 1927, ' Four copies of this report were sent to Mr. Armstrong, your city engineer, on August 4, 1927. " I T A communication from the Dodge Lumber and Fuel Company calling attention td the necessity for better protection of the Chicago Great,Western Railroad Company crossings on Second Street Northeast, was read, and President Weeks ordered the same placed on file, A citation from kffistrict Court to the City of Rochester, Minnesota, relative to the unpaid 1927 motor vehicle tax on the Buick automobile which was ..rebuilt for use in the Fire Department of said City, fixing a hearing in the matter for 10:00 o'clock A.M. January 16th,1928, was read, and upon motion by Erickson, second by Rommel, the matter was referred to the City Attorney. Upon motion by Adler, second by Miller, it was ordered that the City Engine and Street and Alley Committee go before the Highway Commission with request that "as is" Stat they accept the return/of the:. , %-aned Pierce Arrow Truck, which has been loaned to the City of Rochester-, Minnesota. In the Matter of the Apppintmen.t of a Board of Freeholders in and for the city of Rochester, in the County of Olmsted, and State of Minne s ota, District Court, Third Judicial District. WHEREAS on July 1st, A.D. 19231, the Hon. Charles E. Callaghan, Judge of the District Court of the Third Judicial District of the State of Minnesota, did by an order dated on said day and filed with the Clerk of the District Court in and for said Olmsted County, appoint a Board of Freeholders for the purpose of framing a Charter for the bity of Rochester, in the County of Olmsted, and State of Minnesota AND WHEREAS, the term of office of each and all pf the, members of said Board( so appointed, has expired,% 1 NOW, THEREFORE, by virtue and in pursuance of the authority in us vested by the laws of the State of Minnesota in such case made and provided, we too hereby appoint the f ollowing,named persons, who are free -holders of said City of Rochester and who now are, and for five years last past have been qualified voters in said City of Rochester, to -Wit: H.T.Banks, John J. Gentlemen: The matter of the application of the Purity Diner Company, a corporation of WiAona, Minnesota,. for a license, br permit (if such should be required) to place on a lot in the fire limits one Jerry o'Mahoney dining car having been referred:* to my office for attention with the request that I give an opinion as to whether or not such a dining car ,in the fire limits would be a violation of the building code of ' the city -of Rochester, I beg to report as follows: it is my opinion that this type of dining car, as I understand its construction and maintenance, is not in viola- tion of our building code even when the same is placed on a lot or premises within the fire limits of the city of Rochester. j is-eo Respectfully submitted, James T Spillane " CI ty Attorney. Warranty deed given by the Rochester Ice & Fuel Company (formerly Rochester Artificial Ice Company) to the City of Rochester, Minnesota, cover- ing lands for an addition to Soldier's Dield, was read, and upon motion by Erickson, second by Schroeder,.the said Warranty deed was accepted, and it was ordered that the same be placed on -record. The following commlunication was read, and President Weeks ordered the same placed on file: " Rochester, Minnesota. December 15th, 1927. Hon. W. M. Weeks, Alderman at Large., Rochester, Minnesota. Dear Mr, Weeks: Section 32 of the Charter of the City of Rochester provides in part as follows: "Duringthe absence of the Mayor from the. City, or �n ease of his disability for any reason to discharge his duties, the Alderman at Large shall, !1 31 for the time being, exercise all the powers and discharge all the duties of the Mayor." Upon motion by Rommel, see .ond by Hicks, that the said resolution be adopted t as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted, Alderman Erickson introduced a resolution granting Public Dano a permit to C. L. Stewart for the Forester Team, for the Woodman Hall, Dece�iber 23rd, 1927, 0 and fixing the fee at $5,00, which was read. Upon motion by Hicks, second by Adler, that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the Said resolution duly passed and adopted. Alderman Rommel introduced the f ollowing resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of 1�5,000,00 be and the said sum is hereby appropriated from the General Fund and paid to Mr*s. Amelia H. Witherstine as the January 1st, 1928, payment under contract for deed dated November 28th,1925, for the purchase of the North of Lot 5, and all of lots 6 and 7 in Block 13 in Original Plat. The Acting Mayor and City Clerk of said City are hereby authorized and directed to draw a warrant upon the City Treasurer for said amount and cause said payment to be made. Alderman Rowel introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of 0750*00 be and the same is hereby appropriated from the General Fund of said City for payment to Mrs. Amelia H. Witherstine for interest due January 1st, 1928, on,contraet'for deed dated,Noyember 28th,1925, for the purchase of North -2 of lot 5 and all of lots 6 and 7 in Block 13 in Original Plat. `The Acting Mayor and City Clerk,of said City are hereby authorized and directed to draw•a warrant upon the City Treasurer for said amount and cause said payment to be made." Upon motion by Adler, second by Hicks, the said resolution was adopted as read,by all voting in gavor thereof, except Alderman Schroeder, who voted "Nay". 32 �K Alderman Hicks introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum of $6000.00 be and the said sum is hereby appropriated from the General Fund for payment to Christopher Graham,and Blanche B. Grahaiy his wife, as being the January 1st, 1928, payment to apply on mortgage dated April llth, 1927s Igiven by the City of Rochester, Minnesota, covering the property commonly known as Soldier's Field, The Acting Mayor and City Clerk are hereby authorized and directed to draw a warrant upon the City Treasurer of said City, in accordance here- with, and cause said payment to be made. " Upon motion by Erickson, second by Adler, that the said resolution be adopted as read, and all voting in favor thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Hicks introducedthe following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, , Minnesota: , That the sum of $666.66 be and the same is hereby appropriated from the General Fund of said City for payment to Christopher Graham and Blanche B. Graham,,his wife,for interest due January 1st, 1926, on mortgage dated April llth, 1927, covering property commonly known as Soldier's Field. , 1, The Acting Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treasurer in accordance here- with, and cause said payment to.be made.-" Upon motion by Hicks, second by Rommel, that the said resolution be adopted as( read, and all voting in favor 'thereof, President Weeks declared the said resolution duly passed and adopted. Alderman Adler introduced a resolution appropriating $202,62 from the Fire Protection Fund and ordering payment made to Dodge Lumber & Fuel Company for 50350 pounds coal for use at the,Central Fir e Station, which was read. Upon motion by Rommel, second by Miller,. that the said resolution be adopted as read, and all. voting in favor -hereof, President Weeks declared the said resolution duly passed and adopted. Alderman Erickson introduced the following resolution, which was read "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the sum -of $483,16 is hereby Appropriated from the General Fund of said City, and,paid to Wm. T. McCoy Post No, 92 American,Legion for partial payment of refundment due them for expenditures in conrn ction with the main- tenance, improvement and equipping Soldier's Field; the said amount being that which is left for- ,.of.$1,000.00 balance agreed upan, per minutes of this Common Council, August 1st, 1927, after the deduction of $61.04, paid by the City of Rochester, as the last one half of 1926 tax againdt the said property - for sanitary sewer and sprinkling, and the deduction of the �455,80 Graham claim made under date of November 7th,1927, as shown in the minutes of this Common Council for a meeting held November 21st, 1927.
