Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers, in the City
Hall, on August 20th, 1928, at 7:30 o'clock P.M.

Upon motion by Erickson, swcond by Hicks, the minutes of the
meeting held on August 6th, -1928, were approved. '
President Liddle announced this as being the time and place fixed
for a hearing on the opening of an alley in Block 6.in Rutzky's Addition,
and asked if there ryas any person present who wished to be heard.
There was no person present who wished to be heard concerning the

President Liddle announced this was the time and place fixed for
a hearing on the levIring of special assessments for the construction of a
sanitary sewer in part of Fourteenth Averse Southeast, and asked if there
was any person present who wished to be heard in any matter concerning the

said sanitary sewer.
There was no person present who wished to be heard relative to the
said sanitary sewer,
President Liddle announced this as being the time and place fixed
for a hearing on the grading to an established grade line and to a wickth of
75 feet of Sixth Street Southwest, from the East line of Flather's Addition
and the West City Limits line, and asked if there was any person present
who wished to be heard in regard to the said grading.
There was no person preseht who wished to be heard relative to the
said improvement.
President Liddle announced this as being the time and place fixed
for a hearing on the construction ,of a sanitary sewer in Third Avenue
Southwest, between 95 feet South of the South line of Sixth Street
Southwest, and the diversion manhole at the Sewage Lift Station, and asked
if there was any person present who wished to be heard relative to the said
sanitary sewer.
There was no person present who wished to be heard concerning the
said sanitary sewer.
President Liddle annanneed this was the time and place fixed for a
hearing on the construction of a sanitary sewer and the haying of a water
ain in Second Street Northwest, between Thirteenth Avenue eFthwest, and

hearing on the construction of a combined curb and gutter on Seventh Avenue Southwest,
between the South line of,Sixth Street Southwest, and the North line of Ninth Street

A Vemonstranct against the c �nstruetion of the said curb and gutter was
read, and Presidenti Diddle ordered the same paced on file.
Andrew Halsted was present and solicited that this improvemett be made*

Alderman Schroeder -came in at this time and took his Chair.
President Liddle announced this as being the time and place fixed for a
hearing on the construction of a sanitary sewer and the laying of a water main in
Fifth Street Southwest, commencing at a point 165 feet WQs,t , of the center line of
Fifteenth Avenue Southwest, and running Westerly along the center line of Fifth
Street Southwes�, a distance of 204 feet, and the laying of a water main in the said
part of Fifth Street Bouthwest, and asked if there was any person present who wished
to be heard concerning either of the said improvements.
There was no person present who wished to be heard relative to the said
sanitary sewer or water main.
This being the time and place -fixed for the - opening of proposals for the
oonstruetion of the sanitary sewers and the laying of the water maim, as above described
the following bids were opened and read, and upon motion by Erickson, second by Hicks,
the said proposals were referred to the City Engineer for tabulation:

Dr. Fricke submitted the following petition, which was read, and
on motion by Hicks, second by Erickson, the petition was granted=

We, the undersigned property owners residIAg on the
east side of 8th Ave. SW; south of Ninth St. S.W in the City

the sidewalk to be so constructed .aldng the said east side of
8th Ave; SW, that it will not interfere with -,the large shade
trees and in such a manner that it will correspond with the
sidewalk now under construction on the opposite side of said
8th Ave. SW.

Merton Eastlick again complained about tohe drainage situation at
leventh Avenue Southeast and Eighth Street Southeast, and upon motion by
chroeder, second bk Hicks, his c anplaint was referred to the Street and
lley Committee for further action.
This being the time and place fixed for the opening of proposals
or the construction of curb and gutter on and the grading of First
tree- Southeast, between the East line of Eighth Avenue Southeast and the
est line of Eleventh Avenue Southeast, and on Seventh Street Southwest,

Wm. Sexton made complaint about the assessment against his property for
scavenger service November 9th,1928, being Lot 21 in Block 3 , in Conleyts Addition,
claiming that such service was not rendered, and the City Attorney agreed to inves-
tigate the matter and make report thereon. ,

a balance on hand of $1313.16 was read, and President Liddle ordered the

The report of the Clerk of the municipal Court for the week eliding
August 6th,192A, showing criminal fines collected $36,45, civil fees received
$.85, and court costs charged to Olmsted County $11.20, was read, and
President fiddle referred the same` to' the City Attorney.

and upon motion by Erickson, second by Aemmon,` the said petition was referred to
the Sewer Committee.
A petition that a sidewalk be constructed along the North side of Eighth
Street Southwest,, ,fr,om Eighth Avenue Southwest to Tenth Avenue Southwest, and that
the same be constructed at the curb line now in place, was read, and upon motion
by Schroeder, second by Erickson, the said petition was referred to the Street &
Alley Committee.
Alderman Erickson introduced the following7resolutior_, which was read:
"Whereas, a petition of property owners residing on the east side of 8th
Ave. SW. in the City of Rochester,, has been filed with the Common Council of said
laity requesting that a sidewalk running south on the east side of said`8th Ave. SW.
from the south line of 9- h St, SW, be constructed ±so as not to interfere with shade
and ornamental trees just outside of the property line on the east side of 8th Ave.
Sw, and so as to correspond with the sidewalk now under construction on the west
side of said 8th Ave. SW, running south from said 9th St, SW;
Therefore f Be it and ,it is hereby resolved by the said Common Council of
the City of Rochester, tMinnesota:
That the said sidewalk be so constructed that the west end outside line
thereof shell be along a line which is 19) feet west of the east side of said 8th
Avt. SW., and that the same when extended shall be constructed in prolongation of
the said line to the north side of loth St. SW, in said City of Rochester."
Upon motion by Lemmon, second by Rommel, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.

center line of Fourth Street Northwest ten feet West of the East line of
Eleventh Avenue Northwest and running West across Eleventh Avenue Northwest
forty-six feet tol a point ten feet East of the West line of Eleventh
Avenue Northwest thence South parallel with the West line of Eleventh
Avenue Northwest to a point five feet south of the Northeast corner of Lot
one in Block five {in Cascade Manor, and commencing at a.point in the center
line of Fourth Street Northwest, if extended west to a point ten feet East of

Alderman Schroeder introduced a resolution accepting the bid of
m. C. Fraser and Son for the construction of a sanitary sewer and the laying
f a water main in part of Eleventh Avenue Northwest, as above described,
nd fixing the amount of the bond 10 be given by the said contractor %t the

Upon motion by Hicks, second by Schroeder, that the said resolu-
ion be adopted as read, and all voting in favor thereof, President Liddle
eclared the said resolution duly passed and adopted,

19283, feel that to make the City Assessor's valuations for 1928
equal for everybody it would be more than cruld be expected of this
roard, as such would amount to a full re -assessment Of all property
in this City; our findings having proven to us that unless such is
done there is no way of telling how many descriptions may go through
without any valuations hoeing placed on them and how many cases of
excessive taxation will be paid due to'the fact that the City Assessor
has taken no consideration of lot depths when compared with abutting
property having greater depth, nor row many split descriptions will
go through without valuation of buildings on one of them when it should
have been divided, nor how many inequalities there will be as to
assessment of buildings of equal valuation.

Consequently we make respectful recommendations that
your Honorable Body make the necessary arrangements for a `re -assess-

Alderman Lemmon introduced a resolution ordering plans, profiles,
specifications and estimate of cost for the construction of a sanitary
sewer in Fifth Street Southwest, commencing at a point 165 feet West
of the center line of Fifteenth Avenue Southwest, and running; westerly
along the center line of Fifth Street Southwest a distance of 204 feet and
the laying of a water main in the s^,id part of Fifth Street Southwest,
ordering that the s^,id improvement be made and done and that the cost
thereof be paid for by special assessments levied as provided by law,
which wo,s read.
Upon motion by Hicks, second by Lemmon, that the said resolution
be adopted asread, and all voting in favor thereof, President Liddle
Ifdeclared the said resolution duly passed and adopted.
Chas. H. Armstrong, City Engineer, submitted, plans, profiles,
specifications and estimate of cost for theabove described sanitary SLVer
and water main in part of Fifth Street Southwest, the said estimate of cost
being a total of �476.95 .
Alderman Hicks introduced a resolution adopting the above mentioned
plans, profiles and specifications for the construction of a sanitary

line and to a width of 75 feet of Sixth Street Southwest, between the east
line of Flather's Addition and the West City Limits line, ordering that the

Avenue Northwest, and Southwest, from the South line of First Street Northwest, to
the North line of Second Street Southwest, the said estimate of cost being ":')1760.00.
Alderman Rommel introduced a resolution ,adopting the above mentioned plans,
profiles and specifications for the construction of a combined concrete curb and
gutter alonr; moth sides of Thirteenth Avenue Northwest and Thirtee•izth Avenue Southwest,
between the South line of First -Street Northwest and the North line Hof Second Street
Southwest, the said concrete gutter to be 36 inches wide and the said curb to be six
inches wide and set to a distance of 30 feet between the inside faces, and the gradin6
to an established grade line and to a width of 31 feet of the se,id part of Thirteenth
Avenue Northwest, and Southwest, ordering that the same be placed on file, ordering
