' 1f - - - 409" ,1, Minutes of an adjourned regular meeting; of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City at 7:30 o'clock P.M., September 26th,1928. Meeting called to order by President Liddle, Roll Call, Present: Liddle, Erickson, Hicks, Lemmon, Miller, Rommel, Schroeder, Absent: None. Upon motion by Rommel, second by Schroeder, the -minutes of the meetings held on September 4th,1928, and.September 17th,1928, were approved. President Liddle announced this as being the'time and tl ace fixed for a hearing on the levying of special assessments for the constrA6tion`of a trunk line sanitary sewer in First Street Northwest, between -Twelfth Avenue Northwest and Thirteenth Avenue Northwest, and asked if there was any person present who wished to be heard, There was no person present who wished to be heard concerning the above described trunk line sanitary sewer. President Liddle announced this as being -the time and'plaee fixed for a hearing on the levying of special assessments for the grading of Tenth Avenue North- east., between Third Street Northeast and Fifth Street Northeas�,'and asked if there was any person present who wished to berheard concerning said grading. There was no person present who wished to be heard concerning the said imps ovement. President Liddle announced this as being the time and place filed for a hearing on the levying of special assessments for the construction of a sanitary sewer in part of Br %Adway Street South. There was no person present who w1shed.to be heard concerning the said impr ovement. President Liddle announced this as being the time and place fixed for a hearing on the levying of special assessments for the construction of a sanitary sewer and the laying of a water main in Fifth Street Southwest, from the center of Fifteenth Avenue Southwest to the center of the alley next West, and asked if there was any person present who wished to be heard concerning the said sanitary sewer or water main. There was,no person present who wished to be heard concerning either of the said improvements. President Liddle announced this as being the time and place fixed for a hearing on the levying of special assessments for the construction of a sanitary sewer and the laying of a water main in Sixth Avenue Southeast, between Twelfth Stre 9,nd Thirteenth Street, and asked if there was -any person present who wished to be i heard concerning either of the said improvements. There was no person present who wished to he heard relative to the above mentioned sanitary sewer or water Main. , Julius Ausen, Secretary of the Olmsted County Fair Association, was before the Common Council with the oral rega est that cancellation be made of the claims which the City of Rochester have against the said Fair Association for electric light services, labor,sprinkling services, etc., totaling $686,69; 0441*50 thereof being claimilfrtU Electric Light Department,fand $245,19 thereof being for sprinkling services, water furnished, etc., and mentioned that Olmsted County has been levying a tax for th v aid of the Fair Association in meeting their delinquent bills. After consideration of Mr. Ausen's request, 1 otion by Rommel, second II by Mille- carried that the City Clerk be instructed to render itemized i statements for these claims and submit the same to the Honorable Board of i IlCounty Commissioners of Olmsted County,Minnesota, with solicitation that the i II amount $686,69be included in the Olmsted.County Budget for the 1928 tax i levy. Ee H. Sehlitgus, Secretary of the Olmsted County Business Men's Association, as a member of the Committee for that purpose, solicited early action on the preparation of plans for and the submission of the bond question for the proposed new municipal building, as did Clarenge Stearns. Mr. SchliTgus read resolutions which were passed,,one at the annual meeting of the Business Me n's Association, one by the Kiwanis Club, and one by the local National Association of Power Engineers. A copy of the above,pe-ntioned resolution by the National Association of Ppwer Engineers was read by the City Clerk, and President Liddle ordered that the same be #laced on file. Theapplications of the Town Taxi (Yellow Cab Corporation of Minnesota)It for four taxicabslicensew, were read, and;a motion by Hicks, second by Schroeder carried that the said licenses be not granted, The following reports of cost were read, -, and President Liddle ordered thatthe same be placed on filet "September 26,1928. The report of the Building and Electrical Inspector for the month of August 1928, showing $315,00 collected as Building Inspection fees, and $34.75 toll teted as Electrical Inspection fees, • was read, and President Liddle referred the same to the Finance Committee. Balance sheet, income statements, etc., of the Public Utility Departments as at August 31st,1928, prepared by the Secretary of the PublicUtility Board, were t laid before the Common Council, and President Liddle ordered the same placed on file; the said income statements showing a net profit in the Light Department for the month t < of August 1928, of $13,433,61, and a total net profit for the five months of this fiscal year of $60,275,84, and a net profit in the Water Department for the month of Aumst 1928, 9Jft .3,726.42, and for the five months of this fiscal year of $130431.17. The report of the Health Officer for the City Farm for the month of August 19`?8, showing receipts in the amount of $1,8�35.�8,disbursements in the amount of $1,433,12, and a balance on hand of $1,765,24, was read, and President Liddle ordered the, same placed on file, The General balance sheet, trial balance, unexpended budget appropriation statement. -statement of funds, statement of account with the Treasurer of Olmsted County, etc., of the City of Rochester, Minnesota, prepared by the City Clerk, as of August 31st,1928, were laid before the Common Council, and President Liddle ordered the same placed on file. The report of the Clerk of the Municipal Clourt for the week ending Septembe 3rd, 1928, showing criminal fines collected in the amount of $53.00, civil fees received $2,70, court costs charged to Olmsted County $13,60;-for the week ending September lOth,1928, showing criminal fines collected $80.00, civil fees received f!.�2.95, court costs charged to Olmsted County $23,45, for the week ending September 17th,191�81, s "ing<criminal fine9 collected 053,65, civil fees received $9.55, court costs charged to Olmsted County $.60; and for the week ending September 24th,1928, showing criminal fines collected 0195.00, civil fees received $.50, were each read, and President Liddle referred t)ze same to the City Attorney. A report from the Division of Sanitation of the Department of Health of the St&keoof Minnesota, on the City of Rochester, Minnesote,, Milk supply, was read, and President Liddle ordered thatthe same be placed on file. The application'of 'John L. Stewart for a drivers license, was read, and upon motion by Hicks, second by Erickson, license was granted. The application of Hienry L, Doepke for a House Mover's License, was read, and upon motion by Hicks, second by Schroeder, license was granted. 414 Upon motion by Lemmon, second by Schroeder, the matter of the m - ii� amendment and revision of the present ordinance governing the moving of buildings was referred to the City At torney for his consideration and x1ecommendations. The application of Upham B. Harris for an Auctioneer's license �i was read, and upon motion by Lemmon, second by Erickson, license was granted effective as of September 24th,1928, III The Auctioneer' flicenSe bond of Upham B. Harris with the Contin- ental Casualty Company as surety thereoh in the amount ofb00�,0(� , =as read, and upon motion by Brickson, second by Hicks, the said surety was accepted, the said bond was approved, and it was -ordered that the same be placed on file. A petition that a sanitary sewer be con$tructed and a water main laid in Eighth Avenue Southeast, between Twelfth Streetand Thirteenth, Street, was read, and,upon motion by Lemmon, second by Schroeder, the said petition was referred to the Sewer Committee an¢ the Water Committee. The application of Myrtle Remington Gleason, for appointment as a Visiting Nurse, was -read, and President Liddle,ardered that the same be placed on 'file. , 2 The following appointment was read, -,and Presbdent Liddle ordered that the same be placed on file: t "September 26,1928, • . Glabe, County Auditor, to the effect that he has 'r received the City Assessor's assessment booksfor the Year 1928, was read, and President Liddle ordered that the same be placed on file. T$e matter of the action taken by the+County Board of Equalization on the vF 1928 valuation of the E. L. Lyman property at Sixth Street Southwest and Ninth Avenue Southwest, came before the Common Council for their action, and upon motion by Nick$, second by Schroeder, the City Clerk was instructed to communicate with the Minnesota, State Tax Commission in remonstrance against the reduction which the Olmsted County Board of Equalization made on this property. A copy of the summons and complaint in Vivian Connors as Special Administra trix of the estate of Leo F. Connors, deceased, versus the City of Rochester, Minneso ta, was read, and upon motion by Erickscn, second by Rommel, the same was referred to the City Attorney. The following copy of resolution passed and adopted by the Public Utility Board, was' read, and 'President Liddle ordered teat the ,same be placed on file: ",Be it aAd it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that theHon. Common Council of the said City' be' and is hereby requested to authorize the said Board to transfer the amount of TWENTY SEVEN THOUSAND NINE HUNDRED FIFTY FOUR DOLLARS AND FIFTY FIVE CENTS ($27,95,.55) from the Public Ttility Fund to the Sinking Fund for Water Works Extensions to be invested for the purposes stipulated in the resolution creating such fund." Certificate by the City Engineer in favor of the Pu rington Paving Brick Company, showing the sum of $2,637.96 as being due for the furnishing of 78000 brick for the resurfacing of the intersections on Broadway Street South, was read, and President Liddle ordered the same placed on Pile.
