Minutes of a regular meeting of the Common Council of the
Rochester, Minnesota, held in the Council Chambers, in the City Hall,
in said City on September 3rd, 1929, at 2:00 o'elOok P. M.
Meeting Called to order'by President Liddle4
Roll Call. Present: Liddle, Hicks, Miller, Schroeder, Vihstadt,
Absent: Erickson, Rommel.
IIpon mot ion by Schroeder, second by Vihstadt, the minutes of the
meeting held on August 19th,19299 were approved.
President Liddle;.,announoed this as being the time and place fixed for
a hearing on the grading to an established grade line and to a width of 50
feet of Third Street Northeast, between the East line of Hendricks and
Postier's Addition, and the East line of Fifteenth Avenue Northeast, and
asked if there was any person present who wished to be heard relative to
this improvement.
There was no person present who wished to be heard concerning this
grading.
President Liddle announced this as being the time and place fixed
for a hearing on the laying of a four inch water main in Ninth Avenue
Southwest, inside the West curb line from the water main in Eighth Street
Southwest to a point inside the said curb line, which is 50 feet South of
the North line of Block 37 in Head and McMahon's Addition to the City of
Rochester, Minnesota, and asked if there was anybbdy, present who wished
to be heard relative to this improvement •
There was no person present who wished to be heard concerning the said
water main.
President Liddle announced this as being the time and place fixed
for a hearing on the construction of .a sanitary- sewer in Seventh
Avenue Southeast, between the center line of Twelfth Street Southeast
and the center line of.Thirteenth Street Southeast, and asked if there was
any person present who wished to be heard regarding the said sewer.
There was no person present who wished to be heard relative to the
said sanitary sewer.
Alderman Rommel came in at this time and took his Chair.
The Chief of the Fire Department, Wm, E. Cudmore , brought up the
matter of the demand JP-SnCity equipment for andwering.calls to fires outside
of the City limits, and made it.colear that the City equipment cannot
efficiently be used at, fires outside of the City in that water
sufficient for the pumps is never available,And further that the local

equipment is not constructed to stand the abuse of a fast drive over a country
road, and suggested that Olimated County, Minnesota, purchase special equipment for
use in answering calls to fires within'a reasonable'radius of Rochester, which
equipment might be,housed and maintained at•and operated from the local Central
Station, with a small charge for the services involved,

President Liddle referred the above situation to the Fire Department Committee,
and the Chief of the fire Department, with instructions that the ! report thereon
be made at the next meeting of this Common Council.

A motion by Schroeder, second by yihstadt, carried, that the Chief of the Fire
Department' answer no more calls t'o fires outside of the limits of the City of
Rochester, Minnesota, 'txcept that fire hydrants are available where.called. i

,This being the time and place fixdd for the opening of proposals for the
purchase a.nd removal of the, barn on, the so-called Witherstine property the bids of
Einar E. Nelson and B. J. Plumley, each 'offering $105.00, were opened and read, and j
upon the flip of a coin the bid 'of Einar E'. Nelson, was accepted.
This being the time and place fixed for the opening of proposals for the
painting, varnishing, etc., of the inside and outside of the City Hall, the
prpposal of Gordy and Wagsehal $866.y55, and of Be Amundsen, $890,00, were opened
and read, but as neither bid was, accompanied by a certified check a motion by
Hicks, second by Rommel carried that both bids be rejected because no certified
check accompanied either of them, and .theCity Clerk was instructed to prepare
specifications and estimate of cost for this improvement to be acted on at the

next meeting of this Common Council.
Upon motion by Hicks, second by Rommel, it was ordered that the certified

check. of B. J. Plumley bidding for the Witherstine barn, be returned to him.
This being the time and place fixed for the opening of bids for the construe-
tion of a surface drainage sewer in Seventh Street Southeast, from 18 feet West of the

Avenue Southeast, for the, construction of a surface drainage sewer in Eighth Street

Upon motion by Rommel, second by Schroeder, the above quoted
proposals for the construction of surfaoe drainage sewers were referred
to the City Engineer for tabulation and his recommendations.
The City Engineer's trial balance for disbursements ::-,by;! his
department during July,1929, was read,, and President Liddle ordered that
the same be placed on file.
The report of the Health Officer for the City Farm for the month of
July,1929, showing receipts in the amount of $3899.83, disbursements in the
amount of $5722.20, and a balance on hand in the amount of .1132.02, was
read, and President Liddle ordered that the same be placed on file.
The report of the City Engineer for the month of August,192 9, showing
expenditures for labor, from the General Fund in the .amount of $854.93, from
the Strest'arid 41ley Fund 968.20, from the Sewer Fund $266,93, and from
the Bridge Fund $2.20, was read, and President Liddle ordered that the same
be placed on file.
The report of the Milk Inspector for the month of August,1929, was
read, and President Liddle ordered that the same be placed on file,

The repopt of the Clerk of the Municipal Court for the week ending
August 19th,1929, showing criminal fines collected 142,00, civil fees received -5.20,
and court costs charged to Olmsted County $7.45, and for the week ending August
26th,1929, showing criminal fines collected $225,00, civil fees received 14*60,
Olmsted County Check for July,1929,for local Municipal Court fees %176.15, court costs
charged to Olmsted County $$7.70, and' fines collected due to Olmsted County $11.60,
were ei,eh read, and President Liddle referred the same to the City Attorney.
Upon motion by Hicks, second by Miller, the sum of $11,60 was appropriated
from the General Fund and it was ordered that the same be paid to Olmsted County.,

ere read, and upon motion by Rommel, second by Hicks, licenses were granted.
The application of John M. Holland, for another solicitor's lieense,was
read, and upon motion by Rommel, second by Hicks, his application was referred back
to him, with instructions that if he wants' more locations for soliciting, he shall
make another application for a solicitor's license, which shall carry authorities for
all of the .locations at which he intends to solicit, with the condition that the old
solicitor's license shall be reoalidd and revoked in the event that the new one is
rated and issued.

The auctioneer's license bond of Albert Hopfe, with .the United States
;'Fidelity and. Guaranty Company as surety there on in the amount. of 5,000.00, was

petition was referred to the Sewer Committee, and the Water Committee.
The -following Committee report relative to the opening of an
extension of Ninth Street Southwest, was read, and President Liddle ordered
that the same be placed on file:

that there is not a majority of the property owners petition-

Upon motion by Rommel, second by Hicks, it was ordered that the certified
!checks of Wm. C. Fraser & Son, which accompanied thefr proposal for the construction

of the above described surface drainage sewers. -be returned to them.
President Liddle declared an executive session of the Common Council for
conference with the Reid -,Murdoch and Company officials relative to the unsanitary
;condition created by the affluent from their canning factory being dumped into
.Bear Creek, and after a full discussion of the situation, President Liddle called
the Common Council to regular session.
Upon motion by Hicks, second by Miller, the Reid;Murdooh,Company were
instructed to confer with the State Board of health relative to a remedy for the
i
,above mentioned condition, and that they abide by the recommendations received.
A petition asking for the grading of Sixth Avenue Southeast, between

;Eighth Street Southeast, and Tenth Street Southeast, was reed, and upon motion by
';Schroeder, second by Rommel, the said petition was referred to the Street, and Alley
!; C ommitt ee , and the City Engineer, with instructions that they make report
!; at their convenience.

Gentlemen:
We hereby request permission to close the south end of the alley
between First and Center Streets in rear of the Kahler Hotel, The North
end of elley will be open giving access for in and out traffic to the
Kahler,Curie and Botsford Lumber Yard.
The closing of the alley is made necessary for the operations in connec-
tion with the drilling of a new deep -well to increase our water supply. The
alley to be closed from Sept. 1st to the completion of the well drilling,
approximately 60 days.

A remonstrance signed by business men in that locality, asking for

the removal of the sign board at the West bridge approach of the, Fourth
Street Southeast bridge over the Zumbro River and on the North side thereof,
was read, and upon motion by Miller, second by Vihstadt, it was ordered
that the .said sign board be removed back to the street line and the City
Attorney was instructed to notify the owners accordingly.
The appointment by the Mayor of Roger L. J. Kennedy, as Park
resigned,
Commissioner for the First Ward,to fill the unexpired term of Dan Macken,/
was read, and upon motion by Hicks, second by Schroeder, the said appoint-
ment was confirmed.
The following communication to the City Engineer and his notation
thereon, was read, and President Liddle ordered that the same be placed on

Mr. Chas, H. Armstrong,
City Engineer,
Rochester, Minnesota,
Dear Mr. Armstrong:
You have requested our opinion regarding the installation
of a sedimentation unit preceding the other forms of treatment now
installed at the Rochester sewage treatment .works. You informed
us that the unit would have a minimum holding period of one hour
based on the maximum flow of sewage. It is our opinion that this
sedimentation unit would be of material assistance in relieving
the overload on the present plant. The work undertaken by Mr. Holst
of the Mayo Foundation, in cooperation with you, during the past
year also indicates that this sedimentation unit would be a desir-
able adjunct to the present plant.
During our conversation a few days- ago you told me that
you had prepared some sketches of the unit you propose to install,
and that you will arrange to come to Minneapolis to discuss them;
with Mr. Rogers and me. It so happens that Mr. Rogers will be in
Rochester in about two weeks, and I have asked him to see you, since
you might wish to discuss matters pertaining to the design of this
unit with him., We will notify you in advance as to the exact time
he will be there. It is possible that I may be in Rochester at the
same time, and, if so, we can all talk the situation over together.

A. H. Clemens presented a proposed ordinance.prohibiting the use of
apparatus which interfers with the use of radio re4eptlon - and providing for
penalty of violation thereof, and explained its conditions, which ordinance
President Liddle referred to the City Attorney for his report thereon at the next
meeting of this Common Council,
Alderman Hicks asked that he be allowed to withdraw! an ordinance
granting to the Chicago Great Western Railroad Company, its successors, and
i
assigns, the right fit to construct and, for 20 years, to operate and maintain a
i
sidetrack across Broadway Street South, and Fifth Street Southeast, in the City of j
Rochester, Minnesota, which had its first reading July lst,1929, and its second
reading August 5th,1929, and upon motion by Schroeder, second by Miller, and all
voting in favor thereof, his request was granted, and accordingly the said
ordinance was withdrawn.
The following communication from the Mayor, was read, and accordingly
motion by Hicks, second -by Schroeder carried ,that soft drink dealer's license
No. 334, heretofore granted and issued to Jab Jimmerson be revoked:

requested to authorize the said Board to enter into a contract with the Dodge
Lumber and Fuel Company for the furnishing to the said City of from 7000 to 10000
tons of Wasson 2" Harrisburg Screenings, in accordance with specifications and with
their bid dated August 29th. 19290 at a price of $4696 per, ton F.O.B. Cars -Rochester, ,
Minnesota.;the maximum amount of said contract being $49,600.00."
"Be it and it is hereby resolved by the Public utility Board of the City of
Rochester,Minnesota that the Hon.Common Council of the said City be and is hereby
requested to authorize the said Board to enter into a contract with the Westinghouse
Electric and Manufacturing Company for the furnishing to the said City, in accordance,
with plans and specifications and with their bid dated Aug.28 1929, of
two (2) 24 Kv.-a induction feeder regulators, equipped as specified and Four
(4) 36 Kv-a induction feeder regulators, equipped as specified together with
auxiliary equipment as tabulated in speoifications and in their bid -at a
total contract price .of EIGHT THOUSAND AND NINTY FIVE DOLLARS. ($8095.00)

The application of Margaret L. Anderson, Health. Office Stenographer,
for a ten day vacation beginning September l6t h,1929, was reed, and upon
motion by Rommel, second by Schroeder, such vacation was granted.

The following appointment was read, and President Lidd.le ordered that
the same be placed on file:

The claim of Ryth R. Bernard $48.40 for public liability and
property damage and fire insurance on the Graham truck, was read, and
IIPresident Liddle referred the same to the Insurance Committee.
Upon motion by Schroeder, second by Miller, the sum of 032.92,was
!appropriated from the Park Improvement Fund and it was ordered that the
'same be paid to Hiram Van Dusen, for final compensation for injury covering

;;the period August 19th,1929, to September lst,1929, inclusive, and the
sum of $80.00 was appropriated from the General Fund and it was ordered that
the same be paid to Mrs. Catherine Fritsch, as compensation for the death of
Mr. Christopher F.Ffitsch, covering the period Augustd,1929, to August
2 9th,1929, Inclusive.

Upon motion by Rommel, second by Schroeder, the sum of $10.00 was
appropriated from the General Fund and it was ordered that the same be paid to
D. L. Williams, Postmaster, for stamps for use of the City Clerk.
The claim of Marie Sargeant, $1*27.50, for use of personally owned
automobile, while Acting Visiting Nurse during the period June 15th,1928 to
February 2,8th,1929, at $1.5.00,per month, ways read, and upon motion by
Hicks, second by Vihstadt, the said sum was appropriated from the General
and it was ordered that the same be paid to Marie Sargeant for the
ses stated.

The claim of Miner Martino 1.50, for the cutting of weed s on the property
of William Rosenkranz, was read, and upon motion'by Rommel, second by Miller, the

,said sum was appropriated from the General Fund end it was ordered that the same be
paid to Miner Martin for the purposes stated.
Upon motion by Rommel, second by Miller, the sum of $50.00, was appropriates
fr om the General Fund and it was ordered that the same be paid to the League of
Minnesota, Municipalities, for the City of Rochester, Minnesota,dues for the year
commencing September lst,1929.
The following claims were read, and upon motion by miller, second by
Vihstadt,the some were allowed and it was ordered that the Mayor and City Clerk
draw warrants upon the Street and Alley Fund on the City Treasurer and make payment

Upon motion by Hicks, second by Miller, the City Engineer was instructed to
secure the necessary labor and materials and remove the raised crossings at the
intersection ofSixth Avenue Southeast and Fourth Street Southeast, at Eleventh Avenue
Southeast and Fourth Street Southeast, and at Eleventh Avenue Southeast and Second
Street Southeast ,, anf further that he remove the extra sidewalk width at the
Northeast corner of the intersection of Broadway Street South and Fourth Street

Southeast.
The following recommendations of the majority of the Street and .Alley
ICommittee and the City Engineer, was read, and President Liddle ordered that the

The City Engineer's estimate in favor of the Columbia Products Company
showing the sum of $789.75 as being due the said Company for the furnishing of
27 tons of calcium chlotide, was read;'-'&hd-President Liddle ordered that the same

The City Clerk reported that the new City Assessor field cards
;!have been completed as to property descriptions and ownership, and suggested

;!the early preparation of the proposed code for the assessment under a
cubical contents basis, and accordingly motion by Schroeder, second

by Rommel carried that the Equalization Board be named as a Committee for
that purpose, with instructions that they work out a cubical contents j
basis for local assessment purposed, and that they confer with the Minnesota
State Tax Commission for approval before the said basis is put into
effect for use on the 1930 real estate assessment.
Alderman Vihstadt, introduced a resolution accepting the bid and j

sewer in Ninth Street Southeast., as above described, and quoted, and fixing

Upon motion by Vihstadt, second by Miller, that the said resolution
