Present: Liddle, Erickson, Miller, Schroeder, Vihstadt. .kbsent: Hicks, Rommel, At the completion of the roll call Aldermen Hicks and Rommel came in and ook their Chairs. The following petitions., each signed by Elmer Halling, George H. Reymore nd Maria A. Manley, Estate, by Alice Mt. Lampman, M. S. Brooks, Max Brumm, Carlton kite, and Alice M. Lampman, were each read, and President Liddle ordered that the same be placed on file; "What a sanitary sewer be constructed in Ninth Street Northwest, between Ninth Avenue Northwest and Eighth Avenue Northwest, and in Eighth Avenue Northwest betweenNinth Street Northwest and Seventh Street Northwest (Assessments to be spread over a two year period)) " "That a water main be laid in Ninth Street Northwest, between Ninth Avenue Northwest and Eighth Avenue Northwest and in Ei #th Avenue Northwest between Ninth Street Northwest and Seventh Street Northwest, and that the same be done under assessment proceedings with agreement that the cost thereof be refunded pro-rata to each and every lot as soon as water service is used for that particular lot; the irregularity of proceedings for water main assessments being hereby waived by us and we hereby jointly assume the costs for the water main past the property ,that is not on this petition, with the understanding that if said property ever connects to this water main the owner thereof will first make payment according to what his property represents as to the water main cost, based on property frontage plus 6% interest on money involved to that date.(Assessments to be spread over two year period)" Alderman Schroeder introduced a resolution fixing 7:30 o'clock P.M., September 23rd,1929, as the time for a hearing on the laying of a 6 inch water main in Eirlith Avenue Northwest, between Seventh Street Northwest., and Ninth Street orthwest, and thelaying of a 4 inch water main in Ninth. Street Northwest, between ighth Avenue Northwest, and Ninth Avenue Northwest, which was read. Upon motion\by*Erickson, second by Schroeder, that the said resolution adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Miller introduced a resolution fixing 7:30 o'clock P.M,, eptember 23rd,1929, as the time for a hearing on the construction of a sanitary ,sewer commencing at the center of ,the intersection of Seventh Street Northwest and ,Eighth Avenue Northwest, and running Northerly along the center line of Eighth !Avenue Northwest, to the center of the intersection of Eighth Avenue Northwest and Ninth Street Northwest, and running thence Westerly along the center line of Ninth Street Northwest to a point 60 feet East of the East line of Ninth Avenue Northwest, which was read. t 118 8 Noon motion by Miller, second by Schroeder, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. j E. C. Jorgengon and R. Rasmussen made complaint about the disorderly !I conduct of the occupants of the Hans Carstens property at the Northwest j corner of the intersection of Third Street Southeast and Third Avenue Southeast, and suggested that the City of Rochester, Minnesota buy this property and use it as an approach and liarking space for Mayo Park, and A,. R. Nachreiner, President of the Park Board, presented a sixty day option to purchase Lots 30 and al and Lot 29,, less the East 33 feet thereof, all in O Block 20 in Moe and Old's Additionifor $3,000,00, which option had been given to him by Hans Carstens upon the personal payment. of n25.00. Attention of Mr. Lentfer 1' Gentlemen: i Refering:to your letter of July 11,1929 regarding the.interconnec- tion between the City plant and the Franklin Heating Station for the ! Common interchange of electrical energy. Your superintendent,Mr.Cowles,has informed us that you desire the !; following changes which we hereby accept. ! 1. That such a connection would be mutually beneficial to both parties,the City of Rochester and the Franklin Heating Station. 2. That the flow of electrical energy shall j1p .metered and the differential charged to the receiving party at the existing I) City power rate. — 0 . 5 3. That the necessary work to be done on this agreement shall be the: a- Installation of new cable from the City Light plant thru their underground eablewx ,,;to the manhole at the rear of the Commercial Club., b- Installation of an underground cable -way and a cable from • • the rear of the Commercial Club to the City manhole at the rear'of the Franklin Heating Station. c- Installation of cablefrom the point B to the dis- connecting panel of, the Franklin Heating Station. d- 'Installation of the disconnecting panel. with synchronizing and uetering equipment in the Fra-..klin Heating Station. 4. That the cost will be borne by each party as follows: Article -a Franklin heating Station 1/2, City 1/2. Article-b,c,& d. ::,eh one 1/2. , Any additional cable line or cable run at this time between the two City pullbpxes shall be paid by the City. Upon the acceptance and signing of these articles of agreement by the secretary of the Utility Board and secretary of the Franklin Heating Station this shall be considered bihdfng by both parties. Cowles " Alderman Hicks introduced the following resolution, whihh was read: "WHEREAS, The Public utility Board of the City of Rochester, Minnesota., '!has made request to this Common Council that authority be made to them allowing j'an interconnection between the City of Roehester,Light Plant system and the Franklin !;Heating Station in Rochester Minnesota; and ' i 'I WHEREAS, It is deemed for the best interest of the City of Rochester., , !Minnesota, that such authorization for the comon interchange of electrical energy be granted; SO WHEREFORE, Be it resolved by the Common Council of the City of !Rochester, Minnesota: That the Public utility Board of said City be and the said Board is ihereby authorized to enter into contract with the Franklin Heating Station of ��ochester, Minnesota, for theabove mentioned interconnection for the common inter- ;!change of electrical energy, conditioned that the flow of electric energy be metered and that the differential be charged to the receiving parties at the existing City !of Rochester power rate,' that the installation of new cable from the City of Rochester ;Light Plant through their underground cable way to the manhole at the rear of the ICommercial Club shall be done at 2 cost to the City and 2 cost to the Franklin Heating, ;Station, as shall bethe installation of the underground cableway for the cable from ;;the rear of the Commercial Club to the City of Rochester,Light plant manhole at the I of the Fran. clin Heating Station, the installation of the cables from the said !City manhole at the rear of the Franklin HeatingStation to the disconnecting panel of ,the Franklin Heating Station and the installation of disconnecting panel with synchron- izing and metering equipment in the Franklin Heating Station, and further that any additional cable line or cablb running at this time between the two City pull boxes h 1Shall be paid for by the City of Roehester,Light Department; contract authorities to be separate from this interconnection matter." 7 r �� R 20 Upon motion by Rommel, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The Public Utility Board were before the Common Council, and L. A. Cowles, Superintendent oft the Electric Light Plant, for them, made request that this Common Council authorize the Public Utility Board to appropriate funds necessary for the investigation into the feasibility of the construe- tion of a hydro -electric power plant on the Zumbro River at the old Oronoco dam site, funds for securing the necessary options,ete., during which Mr. Cowles gave the information that the estimated cost of the project is 180,000.00,which may be influenced by the result of test hole drillings,, and further that the engineerswho made the estimate of cost have no iii authentic flowage measuresexcept those that have been taken at the Red Bridge; from which the flowage at the Oronoco dam site has been computed by taking the Red Bridge flowage rate and applying drainage area, etc., to it. Alderman Rommel introduced the following resolution, which was read: 1 4 "Wheread, The Public Utility Board of the City of Rochester, Minnesota is deairous of having a survey made at the old Oronoco Dam Site and surrounding territory for the purpose of determining the advisability of constructing a dam and hydro -electric station at the old dam site for the generation of electric energy and has requested authority from the Common Council of said City to expend not to exceed the sum.of Six hundred and no/100 ($600.00) Dollars for options on the said dam site, mill reservation' and flowage lands which would be required in the event it would be. found practical to construct said station; and to expend not to exceed the further sum of Two Thousand(.12000.00) Dollars for an Engineer'ssurvey and drilling test holes; Therefore, Be it resolved by the Common Council of the City of Rochester,Minnesota: That the Public Utility Board of said City be and it is hereby authorized and empowered to expend the said sums as above set forth or so much thereof as may be necessary for the said purposes and to obtain such options as may be available and necessary for the said purposes." Upon motion by Hicks, second by. Miller, that the said resolut ion be adopted as reed, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted* The report of the Clerk of the Municipal Court for the week ending September 2nd,1929, showing criminal fines -received $148*00, civil fees received 97.05, court costs charged to Olmsted County $12450, and fines collected due to Olmsted County -�17.95, and for the week ending September 9th,1929, showing criminal fines collected 1,221,00, civil fees received $5.20, court costs charged to Olmsted County $21.15, and fines collected due to Olmsted County $16,20, were each read, and President Liddle referred the same to the City Attorney. 121 U Upon motion by Erickson, second by Hicks, the sum of 134.15, was appropriat from the General Fund and it was ordered that the same be paid to Olmsted County, Minnesota., for local Municipal Court fines collected, due to Olmsted County. The report of the City Treasurer for the month ending August 31st,1929, show-ing1265,458,78 as being on hand, was read, and President Liddle ordered that the same be placed on file. The report of the Health Officer for the City Farm for .the month of August, 19291, showing receipts in the amount of d$949.99, disbursements in the -amount of $1031.22, and a balance on hand in the amount of 50.79, was read, . and President Liddle ordered that the some be placed on file. The application of Mrs. Robert Merz, for a soft drink dealer's license at No.307 Center Street East, was read, and upon motion by Rommel, second by Vihstadt , license was granted. The application of Orville , 5ester Snyder and of Roy Schlief, for driver's licenses, were read, and upon motion by Hicks. second by Miller, licenses were granted The application of Fred W. Oesterriech for e, pool and billiard license, covering six pool and billiard tables at 322 Broadway Street South, was read, and upon motion by Hicks, second by Schroeder, license was granted. i Certificate by the City Engineer in favor of the Purington Paving Brick lCompany of Galesburg, Illinois,, showing the sum of $13122,16 asbeing due the said Company for the furnishing of 888,000 paving brief, carrying his recommendation that this amount be paid for from the November,'1929, tax settlement, as has been i i agreed upon by the Puringto n Paving Brick Company, was read, and upon motion by !Miller, second by Hicks, it was ordered that the said certificate be placed on i file and that the City Clerk be authorized and directed to create an account payable In the General Ledger of the City of Rochester,Minnesota, for this ;certificate; $683,00 of the said amount being for 20,195 brick furnished to Job 1455; . 10068,89 being for 297,720 brick furnished to Job ,1458,and 02370.27 being for 70085 brick furnished to Job 1459. The following copy of resolution passed and adopted by the Commissioners of the Sinking Fund, was read, and upon motion by Erickson, second by Rommel, the action get forth therein was approved and it was ordered that the said copy of 1; re s olut ion be placed on file: "Be it resolved by the Commissioners of the Sinking Fund of the City ol" Rochester, Minnesota: That.the sum of $4103,41 be appropriated from the Sinking Fund and paid to the First National bank of Rochester, Minnesota, for ``14,000.00 Balaton,Lyon County,Minnesota,School District 5% bonds due July lst91937; "$4000.00 thereof being principal on the said bonds, $64.52 thereof being premium on the said bonds and I 122 11$38.89 thereof being accrued interest on the said bonds to September llth, 1929, the said bonds having been purchased from Wells -Dickey Company of Minneapolis, and forwarded through the said First National Bank." The following communication was read, and upon motion by Erickson, .second by Miller, the City Attorney was instructed to prepare the necessary papers for the transfer of the property concerned to School District No.8; " ROCHESTER CITY SCHOOLS Rochester ,Minnesot a G.H.Sanberg,Superintendent Sept. 69 1929 Mr. A.F.W)right City Clerk i:! ! Rochester, Minnesota V Dear Mr. Wright: I have been instructed by the Board' of Education !!!ii to return the claim presented by the city amounting to $523.99 for grading Sixth Street Southwest as in- dicated on the statement. It is the opinion of the- attorney for the school district that so long as the land has not been con- veyed definitely to the school district, nor has any action been taken by the Board to accept the land, that it is not incumbent upon the district to reimburse the City for the grading done as specified on the st at emtnt . . The City Clerk reported that as yet neither the Interstate Power Company, nor the Rochest( 1 er Bus Line have filed the required financial statements, etc., as to their business for the calendar year. ending December 31st,1928, at which President Liddle referred the matter to the City Attorney,with instructions that he serve notice upon these concerns k that unless they file the required statements prior to October lst,1929, he will present an ordinance cancelling their franchises in this city. Specifications and estimate of cost for the painting, varnishing, etc., of the inside and outside of the City Hall, were presented. Plans, profiles, specifications and estimate of cost for the laying of a 4 inch water main in the West side of Ninth Avenue Southwest, between Seventh Street Southwest and Eighth Street Southwest, were laid before the Common Council, the said estimate of cost being .p483i;00. 123 A Alderman Miller introduced the following resolution, which was read: "WHEREA90 It is deemed expedient and necessary that the inside and outside of the City Hall of Rochester, Minnesota, be,'painted, varnished, etc.,and WHEREAS, Specifications and estimate of costs have been prepared and submitted for the said improvements; SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesotat That the said specifications be adopted for the said improveme nt and that the same be placed on f ile in t he offs as of the City Clerk of said City, and that the said estimate of cost be placed on file in the office of the City Clerk, and Be it further resolved by the said Common Council: That the City Clerk be and he is hereby authorized and directed to 'advertise for proposals for the furnishing of all labor and materials necessary for the making of the said improvements, ;in accordance with the specifications for the same, which said sealed proposals skill be received and opened at a meeting of this Common Council which is to be held at 7:30 o' cloak. P.M. , September 23rd,1929. Each bid must be accompanied by a certified check upon some reputable bank drawn payable to the Mayor of the City of Rochester, Minnesota, for at least 10 percent of the amount of the bid, WhIch check and .the amount of money specified therein shall be forfeited to the said City of Rochester, Minnesota, ' as liquidated damages if the bidder upon the letting of the contract to him shall fail to enter into the contract so let; the said Common Council reserving the right,to reject any and all bids." Upon motion by Erickson, -second by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Schroeder introduced the following resolution, which was read: "WHEREAS, The Common Council of the City of Rochester, Minnesota, at a 1; meetirig 'thereof held on September 3rd,1929, after due notice given and hearing had j as provided by law, did duly pass and adopt a resolution ordering that a 4" water �i main be laid in Ninth Avenue Southwest, inside the West curb line from the water main in Eighth Street Southwest to:. -:a point inside the said curb line which is 50 feet South of the North line of Block 37 in Head and McMahon's Addition to the City II of Rochester, Minnesota, and in said resolution directed the City Engineer of said f City to prepare and file in the office of the City Clerk, detailed plans, profiles ;land specifications for the said water main and to make and report to said Common ';� Council an estimate of the cost and expense of the said water main, and said City ,Engineer pursuant to said directions did on September 10th,1929, file in the office j of the City Clerk of said City, plans, profiles, and specifications for the said ';water main and did report to the said Common Council an estimate of the cost and :!expense of the laying of the said water main; THB093FOP,E, Be it and it is hereby resolved by the said Common Council i; of the City of Rochester, Minnesota: i� That the plans, profiles and specifications for the said water main so filed by the said City Engineer in the, office of the City Clerk be and the it same are hereby adopted as the plans, profiles, and specifications for the said !:water main, and that the said estimate of cost of the said water main, reported to ' i the said Common Council be and the same are hereby accepted and ordered filed in the i; office of the City Clerk.` i� Be it further resolved by the said Common Council: That the whole cost i1and expense of the construction of the said water main shall be assessed as provided by law, against each lot, piece and parcel of land benefited by the improvement, 'i t o-wit : - Against each and every lot, piece and parcel of land abutting upon the said Iiwater main without regard to cash valuation ratably and in proportion to the special benefits conferred by the said water main respectively, upon each lot, piece and ;;parcel of land; Be it further resolved by the said Common Council: That a meeting of the said Common Council:will be held at 7:30 o'clock P.M., September 23rd, ,1929, in the Council Chambers, in the City Hall, in said City, at which ;,meeting all persons interested in the said water main may appear and be heard before the said Common Council in relation to the said water main or to the mode of the assessment for the cost and expense thereof or any other matter. or objection relating to the said water main upon which they may desire to be heard; Be it further resolved by the said Common Council: That the City Clerk of said City is hereby ordered and directed to prepare a list which will contain a description of each and all of the properties abutting upon the said water main above described, and the names of the owners of the said properties so far as the same are known, which list,together with a notice of the time and place and purpose of the said meeting and hearing above ;mentioned, he will cause to be published once in the official newspaper of the 94id City at least ten days prior to the date of the said meeting and hearing; Be it further resolved by the said Common Council: That the City iClerk of said City be and he is hereby ordered and directed to advertise for bids, as provided by law, for the fiarnishirig of all the materials, and doing all of the work necessary for the construction of the said water main, kabove described, said bids to be received and opened by the said Common ;'Council at a public meeting thereof to be held at 7:30 o'clock P.M., (on September 23rd, 1929, in the Council Charters, ,in the City Hall, in said City. Each bid must be accompanied by a certified check for at least ten percent of the amount of the bid, and the said Common Council reserves `the !I right th reject any and all bids; the said water main costs to be reimbursed i after installation of service connections." Upon motion by Schroeder, second by Rommel, that the said resolution ,'be adopted as read, and all voting in favor thereof, President Liddle declared the, said resolution duly passed and adopted. Alderman Hicks introduced a resolution fixing 7:30 o'clock F.M., September 23rd,1929, as the time for a hearing on the proposed grading to an established grade line and to a width of 50 feet of Sixth Avenue Southeast, between the South line of Eighth Street Southeast, and the North line of ,Tenth Street Southeast, which was read. Upon motion by Hicks, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof,, 'President Liddle declared !the said resolution duly passed and adopted. Alderman Erickson introduced a resolution appropriating .$132,04 from .;the General Fund, and ordering payment made to J. T. Lemmon, Mayor, for use in his Contingent Fund, which was read. Upon motion by Rommel, second by Erickson, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution ,duly passed and adopted. Alderman Rommel introduced the following resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, innesota: That the sum of $211.17 is hereby appropriated and it is ordered that the same be paid to Skelly Oil Company for gasoline, kerotene, etc., 125 furnished during the period August 5t1h to August 13th,1929,' inclusive; "3.b3 thereof to be from the General, Fund and $15,7.64 •,thereof to be from the Street and Alley Fund, - The Mayor and.City Clerk are hereby authorized and directed to draw warrants upon the City Treasurer and make payment accordingly." Upon motion by Schroeder, second by' Vihstadt, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Schroeder introduced the following -resolution, which was read: "Be it resolved by the Common Council of the City of Rochester,Minnesota: That the sum of $201,85 is hereby appropriatedand it is ordered that the I same -be paid to the Olmsted County Oil Company for gasoline,' kerosene, etc., furnished during the period August 26th,1929, to September 5th,1929,inclusive; A56.35 'the'reof 'to be from the General Fund and A143.50 thereof to.be from the Is and Alley Fund. The Mayor -and the City Clerk are hereby authorized and directed to draw warrants upon the City Treasurer and make payment accordingly." , Upon motion by Rommel, second by Miller, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed, and adopted. a I , The following report of the City Attorney, was read, ,and President Liddle ordered that the same be placed on file: " Rochester, Minnesota. Gentlemen: • I have examined the ordinance recently presented for the elimination of interference in radio reception and find same to satisfactory from a jej�al standpoint, I have been informed that other cities have an ordinance designed to produce..the same result as ,the ordinance referred to me for an opinion. . Upon motion by Miller, second by Vihstadt, the City Engineer was authorized �i to'expend not to exceed d)125.00 in the purchase and installation of a secondhand gasoline service tank and pump. Upon motion by Rommel, second by Hicks, the City Engineer was instructed to prepare plans, profiles, specifications and estimate of cost for the construction of a bridge over Mayo Run on Twelfth Avenue Southeast.
