President Liddle announced this as being the time and place fixed a hearing on the construction of a sanitary sewer, commencing at the ;� for g center of the intersection of Seventh Street Northwest, and Eighth Avenue Northwest, and running Northerly along the center line of Elghth Avenue Northwest to the center of the intersection of Eighth Avenue Northwest, and rTinth Street Northwest and running thence Westerly? along i the center line of Ninth Street Northwest to a point 60 feet East of the East line of Ninth Avenue Northwest., and asked if there was any person ed t o be heard relative t o this improvement . present who wish John F. Ste ham, Wm. C. Sawinski, and Leo Ranfranz, opposed the i construction of the sanitary sewer. Alderman Rommel came in at this time and took his Chair. President Liddle announced this as being the time and place fixed i! for a hearing on the laying of a 6 inch water main in Eighth Avenue i,i Northwest , between Seventh Street Northwest and Ninth Street Northwest , and i the laying of a 4 inch water main in Ninth.Street Northwest, between Eighth Avenue Northwest and Ninth Avenue Northwest, and asked if there was any person present who wished to be heard concerning this improvement, The above ment ioned _Stephan, Sawinski, and Ranfranz, opposed the laying of a water main as above described. President Liddle announced this as being the time and place fixed for a hearing on the grading to an established grade line and to a wisth of 50 feet of Sixth Avenue Southeast between the South line of Eighth Street Southeast and the North line of Tenth Street Southeast, and asked if there was any person present who wished to be heard concerning this grading. There was no person presenthwho wished to be heard. President Liddle announced this as being the time and Place fixed for a hearing on the laying of a 4 inch water main in Ninth Avenue Southwest, inside the West curb line from the water main in Eighth I Street Southwest to a point inside the said curb line, which is 50 feet South of the ! ;� of Block 37 in Head and McMahon's Addition to the City of Ro cisester, North line � and asked if there was any person present who wished to be heard concerning the said water main. j A'here was no person present who wished to be heard. There was no person present, who wished to be heard. President Liddle announced this .as being the 'time and place 'fixdd for a hearing on the grading to an established grade line and to a vvidth of 42 feet of Second Street Northeast, between the East line of Eleventh Avernie Northeast, and i the West line of Fourteenth Avenue Northeast, and asked if there was any person i present who wished to be heard, after which Charles Carroll talked in opposition to the grading of Second Street Northeasti, as above described, and also against the grading of Fourteenth AvenneNortheast�, as proposed, and presented a remonstrance signed by property owners abutting, which was read, and President-Liddle ordered that the same be placed on file, President Liddle announced this as being the time and place fixed for a j hearing on the grading to an established grade line and to a width of 50 feet of le enth Avenue Northeast, and the Third Street Northeast, between the East line of E i East line of Fifteenth Avenue Northeast, and eAked if there was any person present who i i� wished to. be heard. ' I A remonstrance against this improvement signned by property owners abutting, was read, and President Liddle ordered that the same be placed on :Mile. President Liddle announced this as being the time and place fixed for a hearing on the grading to an established grade line and to a width of 32 feet of Fourth Street Northeast, between the East line of Eleventh Avenue Northeast and the East line of Fifteenth Avenue Northeast, and asked if there was any person present who wished to be heard concerning the said improvement, There was no person present who wished to be heard relative e ,to the grading of Fourth Street Northeast President Liddle announced this as being the time and place fixed ; # 1.for a hearing on the grading to an established grade line and to a width of i ,. 'i32 feet of Fourteenth Avenue Northeast, between the North line oft he Chicago & Northw4stern Railway Company right-of-way and the north line of Fourth Street Northeast, and asked if there was any person present who ;wished to be heard concerning the said improvement's There was no person present who wished to be heard,but the above ; ;;mentioned remonstrance -ss�.•tb(:the grading of Second Street Northeast, also .Carried objection to the grading of Fourteenth Avenue Northeast. Burt W. Eaton presented an ordinance granting to the Chicago ' Great Western Railroad Company, its successors and assigns, the right to i construct, and for 20 years, to operate and maintain a sidetrack across is ;Broadway Street South, and Fifth Street Southeast, in the City of Rochester, t ;Minnesota, and explained the need for this authority, which was supported by ;Harry j. Harwick, and C. A, Chapman. i E. H. Sehlitgus read a petition from the bus mess ,men of theCity ` 'iof Rochester, Minnesota, asking that this sidetrack authority be granted, and also read a petition from seven persons who formerly had signed a ;remonstrance, asking that they be drawn from the remonstrance and be i . E considered as in favor of this project, and President Liddle ordered that ii I '!both of said petitions be placed on file. W. C. Dickenson presented the petition of approximately 400 ''milk producers, headed as follows, which was=read, and President Liddle �i ordered that the same be placed on file: „To the Common Council of the City of Rochester: We are producers of miX who sell our product to Rochester Dairy Company and to whom it pays each year about 11,000,000.0 , which is spent by us in your community. We are anxious that it have = IF 1� every facility which will assist it to operate economically and efficiently as it will thereby be able to pay us better prices for our milk. We are familiar with the methods of shipment in use by the largest concerns in the industry and are convinced that it is necessary that it be able to load its products on cars at its doors, without trucking. Whilq we have no voice in the city government, the various associations of burliness men have long assured us that the city has the welfare of the farmer at heart and is desirous of co-operating with him and we feel that this is a time to put such promises to the .test and show that they mean what they say. We therefore respectfully request that you grant the pending petition for a sidetrack to the plant Dated August 14th,1929." A communication from Dyer H. Campbell, Secretary of the Commercial Club, called attention to the findings of the special committee, sent to this Common C ounc it on April Bth,1929, which was read, as was the remonstrance of numerous j A residents of this City protesting the passage of the above mentioned ordinance, and President Liddle ordered that each of these papers be placed on file. Matt Fitzpatrick and Julius Reiter talked in opposition to the granting of the above mentioned previlege and both suggested that the oppos.it ion be given ;,, an opportunity to express their views at a public meeting in larger quarters, and both suggested the submitting of the question for referendum at the next City election. Alderman Hicks introduced the,said ordinance granting to the Chicago Great Western Railroad Company, its successors and assigns, the right to construct, and, for 20 years, to operate and maintain a sidetrack across Broadway Street South, and Fifth Street Southeast, in the City of rochester, Minnesota, which was givda its first reading. James H. Starkey asked that Dr. George J. Anderson, Milk Inspector, be granted a leave of absence, September 30th,1929, to October 3rd,1929, inclusive, i so that he might accompany the local American Legion Drum Corps to the National Convention at Louisville, Kentucky, and upon motion by Erickson, second by Vihstadt, such leave of absence was granted. ' Paul Priebe, W. F, Lenz, and L. A.•Kepp, talked on the subject of making r ' r` a lake in North Rochester bydaming- of the lumbro River just East of the North r Broadway Bridge, and President Liddle referred the matter to the Public Utility Board and the Park Board for consideration and recommendations. } A. R. Nachreiner, President of the Park Board, read the following copies j of resolutions passed by the Board of Park Commissioners, and explained the need for these purebaces: 132 I� �I "Be it resolved by the Board of Park Commissioners of the City of Rochester, Minnesota: That the said Board deem it expedient and necessary that the following property be taken and condemned for park purposes in the City of Rochester, to wit: The Nort heaz�t quarter of Block 80, less the west 60 •feet thereof and the Southeast quarter of said Blods 80, less the west 50 feet thereof, all in Block 80, Original Plat of the City of Rochester. The above described property is necessary for the proper develop- ment of Mayo Park and should be acquired, either by condemnation of pur- ehasetfrom the owners thereof. This being the time and place fixed for the opening of proposals for the painting, varnishing, etc., of the inside and outside of the City Hall, the following proposals were opened and redd: aKI i 0. E. Paschke: Outside $390:00, Inside $577:00; Mergens & Son: Outside 1325-00, inside 1470,00; Gordy & Wagsehal: Outside $448.00, inside 8667,00; Danewick & Larsen: Outside $540.00, inside $372.00, with notdtion that that price for the inside work did not include machine sanding; B. Amundsen: Outside $4350-00, inside4$655.00. Upon motion by Hicks, second by Rommel, the said proposals were referred t the City Engineer for tabulation. This being the time and place fixed for the opening of proposals for the construction of a sanitary sewer in Seventh Avenue Southeast, as above described, the following bids were opened,and read: Martin Paulson: 8" vitrified,pipe.sewer $1.00 per foot, 6" on 8" Y c onnect ions 4$1.00 each, manholes $60,00 each; Wm. C. Fraser & Son; 8" vitrified pipe sewer 441.00 per foot, 6" on 8" Y connections $1000 each, manholes $60,00 each. Upon the, flip of a coin the contract was awarded to Wm. C. Fraser & Son as the above mentioned proposals were a tie. This being the time and place fixed for the opening of proposals for the r laying of a water main in Ninth Avenue "Southwest, as above described, the following bids were opened and read: Wm. C. Fraser & Son: 4" water main $1.25 per foot, paving repaired $6.00 per square yard, loose rock excavation 03.00 per cu. yd., sand rock $5.00, solid rock 18.00; Martin Paulson: $1.45 per ft for water main, paving repaired t4.00 per square yard (this bid was unsigned but came in an envelope on which was endorsed the fact that it was the bid of Martin Paulson) Upon motion by Hicks, second by Erickson, the above mentioned proposals for laying of water main were referred to the City Engineer for his tabulation. Upon motion by Rommel, second by Schroeder, further proceediTigs for the grading of parts of Second Street Northeast, Third Street Northeast, and Fourteenth I Avenue northeast, were abandoned, and it was ordered that the proposals filed for the : i doing of these improvementsbe returned ungpened. This being the time andplaee fixed for the opening of proposals for I the grading of part of Fourth Street Northeast, as above described, the proposal of Mattson and Anderson, ©-Efering to do this grading at54 cents . per cubic yard was opened and read. i This being the time and place fixed for the opening of proposals for I the grading of part of Sixth Avenue Southeast, as above described, the proposal of Mattson and Anderson, offering to do the earth excavation at 54 cents per cubic I. yard and the earth embankment at $5 cents per cubic yard, and of Kris Nielson V u •j 60 cents for earth excavation.,and 60 cents for ,earth embankment, were opened and read. , This being the time ,and place fixdd ,for the opening of proposals for { the grading of part of Seventh Avenue Sout4east, as above described, the proposal of Mattson and Anderson, offering to do the earth excavation at 54 cents per cubic yard and the earth embankment at 60 cents per cubic yard, ' and of Kris Yielson 60 cents for earth excavation and 60 cents for earth embankment, were opened and read, , President Liddle r6ferod thesaid proposals for grading to the City Engineer for his tabulation. General Balance sheet, trial balance, statement of funds, unexpended budget appropriation statement, etc., for the City of Rochester, Minnesota, prepared by the City Clerk,as at August 31st ,1929, were laid before the I Common Council, and President Liddle ordered that the same be placed on file. i, The report of the Clerk of the Municipal Court for the week ending September 16th 1929, showing criminal fines collected $198,00, civil fees received $4.35, court costs charged to Olmsted County ,$6.05, and fines collected due to Olmsted County 821.30, was read, and President Liddle referred the same to the City Attorney. • Upon motion by hicks, second by Schroeder, the sum of 021.30, was appropriated from the General Fund and it was ordered that the same'be paid to Olmsted County, riMinnesota, for local municipal court fines collected due to Olmsted County. The report of the Building and Electrical Inspector for the montli of August,1929, showing building inspection fees collected in the amount of $173.00, and electrical inspection .fees collected in the amount of e44.75, was read, and.President Liddle referred the same to the Finance Committee. The applieat°i.ons of the Martin Hotel, Calhon Company, and the Sanitary Barber Shop, for p'ermits to place and maintain signs, ,Pere read, and upon motion by Rommel, second by Erickson, permits were granted. The application of Fred W. Oesterreich for a soft drink dealer's license at No.322 Broadway Street South, was read, and upon motion by Schroeder, second by Hicks, license was granted. The application of the Knights of Columbus Lodge, for a public dance permit at the Masonic Temple for Septemberl8th,1929, was read. The application of Orville Cooper for a driver's license, was read, and upon motion by Rommel, secondby Eftekson, license was granted, 1 A petition asking that a street light be installed on Sixth Avenue Southeast between Eighth Street Southeast,, and Ninth Street Southeast, was read, and President Liddle referred the same to the Lighting Committee. A communication from 0, E. Alderman Rommel introduced the following resolution, which was read: r; "Whereas, the Board of Park Commissioners Of the City of Rochester, Minnesota, has passed and adopted a resolution deeming it expedient and necessary that the following described properties be acquired by said City for use as park property and as extensions to Mayo Park in said City; Therefore, Be it and it is hereby resolved by the Common Council of said City: i; That the following properties be acquired for said City, a description thereof being as follows, to wit: The N.E.4 of Block 80, less the west 60 feet thereof, and the S.E. 4 of said Block 80, less the West 50 feet thereof, all in the Original Plat of the City of Rochest-er, Minnesota, for the sum of $12,000.00 payable $4900.00 on.July lst,1930 and the sum of $2000 payable on July 1st of each year following until paid, with interest at.the rate of.5% per annum on all deferred installments from date of ccntract. I The report of the City Attorney to the effect that he had aheicked the reports of the Clerk of the Municipal Court commencing with the week of March llth,1929, and ending with the week of August 12th,1929, and including the special report of' May 27th,1929, and found the same to be correct, was read, and President Liddle ordered that the said report of the City Attorney be placed on file, andthat the said reports of the Clerk of the Municipal Court be placed on file. The appointment by the Mayor of James F. O'Conno`r,' as Special Policeman for duty upon the grounds of Saint Mary's Hospital, to serve without pay and to hold office until the second Monday in April, 1930, was read, and President Liddle ordered that the same be placed on file. Pagenhart, showing the sum of $1437024 as being due the said contractor, for the eonstruot.ion of curb and gutter on Second Street Northwest, between Thitteenth AvenueNorthwest , and Sixteenth Avenue Northwest, was read, and President Liddle ordered that the same be I placed on file. The following report of the Insurance Committee, was read, and President Liddle ordered that the same be P14ced on file: " Rochester, Minn, September,23,1929. To the Common Council of the City of Rochester; Gentlemen; We the undersigned Insurance CommItte hereby recommend that the Insurance Policies that have been renewed and not paid be paid out of their rbspective Funds. Rommel." 4 i) read, The following recommendations of the Lighting Committee, were and President Liddle ordered,that the same be placed on file: i "The Lighting Committee. hereby recommend that 'a street light be installed'on the North side of First .Street Northebstt on the electric light, pole which would be in an extension of the alley East of Broad*Y, Further recommendation is made that the locations of lights in the alleys East of Broadway Street North and South between Third Street South- east and Third Street Northeast, and on the West side of Broadway Street " North and South between Fifth Street Southwest and Third Street northwest, be checked as to the efficiency of the locations and that new lights be installed where needed, after a check-up made by the Lighting Committee and the Superintendent of the Licit Plant or his representative. Also that a street light be installed at the corner of Fourth Btreet and Fourteenth Avenue Northeast." Upon motion by Schroeder, second by Miller, request was made that the Public Utility Board comply with the above recommendations. The appointment by the Mayor of Chris . Erickson, as a Special Police- man for duty at the Edison School, to serve without pay, and to hold office until the second Monday in Apri1,1930, unless sooner removed, was read, and President Liddle ordered that the same be placed on file. The City Clerk presented warrant No.3092, dated September llth91929, drawn to the Quality Print Shop in payment for a portable vault, furnished for the Health Office, and asked that this warrant be cancelled, as payment had been previously made on September 4th,1929, which error came from the i Health Office Putting their approval on a second billing for this equipment, and upon motion by Schroeder, second by Rommel, it was ordered that the said Warrant No.$092 be cancelled and returned to the General Fund in the City Treasury, The following repoist.61by the City Engineer, were read, and President Liddle ordered that the same be placed on file: 1 " 9-23-29 Honorable Mayor and Common Council.
