Reym ore and Mrs. Brooks, were present i and requested that these improvements be made, President, Liddle announced this as being the time and place fixed for is hearing on the grading of Sixth Avenue Southeast, between the South line of ,Eighth Street Southeast and the North line of Tenth Street Southeast, and asked if � .i Othere was any person present who wished to be heard cameerning this improvement. E �, j President Liddle announced this as being, the time and I; I place fixed for a public hearing ®n the petition for the vacation of the South one-half of Third Street Northwest, between Eighth Place Northwest and Ninth iAvenue Northwest, and asked if there was any person present who wished to be heard. Mr. John Hennessey asked that this street vacation be Made in order '. ' ;that he may improve the South half of the said part of Third Street Northwest, as i ii ;an addition to his property;, -� i' E. C. 3orgenson made complaint about the condition of the water in the. t i Zumbro River, between Fourth Street Southeast bridge, and Mayo Park, and President i Liddle referred the m4tter to the Sewer Committee for investigation. .This being the time and place fixed for the opening of proposals for t. ::the grading of a part of Sixth Avenue Southeast as above described, the proposal j r '!of Mattson & Anderson, to do the earth excavation at 54 cents per cubic yard, and 'A I; make the extra earth embankment at 70 cents per cubic yard, was opened and read. a It �I This being the time and place fixed for the opening of proposals for the laying of a water main in parts of Eighth Avenue Northwest and Ninth Street Northwest,, as above described, the following proposals were opened and read: VTm. Upon motion by Schroeder, second by Rommel, the above mentioned ;prcposals were referred to the City Engineer for his tabulation and i,i!r e c ommendat ions. ' �- An ordinance granting to the Chicago Great Western Railroad Company, Its successors and assigns, the right to construct and, for twenty years, ,to operate and maintain a sidetrack across Broadway Street South and Fifth 'Street Southeast- in the City of Rochester, Minnesota, was given its second ;reading. Geo. Wentink talked in opposition to the adoption of this ordinance. The report of the Public Utility Department., prepared by the Secretary of the Public Utility Board -as at August 31st ,1929, was laid i before the Common Council and President Liddle ordered that the same be l i)le,ced on file; the income statements in the said report showing a net profit in the Light Department for the month of August,1929, of 810064,96, and a net profit for the five months of this fiscal year of $67963,43, and a net profit, in the Water Department for the month of August,1929, of 05050.41.1 and a net profit in the ' Water Department for the five months of this .fiscal year of 118089,65. ' The report of the Clerk of the Municipal Court for the week ending September 23rd,1929, showing criminal fines collected in the amount of $23,00, 1 1 /- 1_49 C 0 4 Civil fees received 16.60, Olmsted Count•v Municipal Court fees for August,1929, received in the amount of -S32.85, and court costs charged to Olmsted County $5.05, and is 1` the report of the Clerk of the Municipal Court for the week ending September 3Oth, ! 192.99 showing criminal fines collected in the amount of $191.00, civil fees received i ,9.3011 and court costs charged to Olmsted County 3.60, were each read and President Liddle referred the same to the City Attorney, I Fund Statement and statement of unexpended budget appropriations prepared by the City Clerk as at September 3Oth,1,929, and balance sheet of the Rochester Public Schools, prepared by E. F. 'Degel, Business Manager, for the ending of !' September,1929, were laid before the Common Council, and President Liddle ordered j that the same be placed on file. !� The report of the City Treasurer for the month ending September 3Oth,1929, ! showing $252,799.95, as being on hand was read, and President Liddle ordered that the, same be placed on file, The City Engineer's trigl balance .,of disbursements from his department for ,: August 1929 was laid before the Common Council and President ]Liddle ordered that G i' ;i t'he same be placed on file. The report of the Milk Inspector for September,192, was read, and President Liddle ordered that the ,same be placed on file., The application of Rudolph Hintiehs for a driver's license, was read, and upon motion by Erickson, second by Rommel, license was granted. The application of Joe Manahan for a license as solicitor for the Hotel ;Arthur, was read, and Upon motion by Rommel, second by Vihstadt, license was granted. The application of W. G. Holets for an auctigneer's license, was read, j. and upon motion by Erickson, second by Miller, license, was granted. The Auciiioneer's license bond of W. G. Holets, wft h L. R. Romans, and James Kelly, as suretJagthereon, each in the amount of A500400, was read, and upon motion by Erickson,, second by Hicks, <the said sureties were accepted, the said bond was approved and it was ordered that the same be placed on file. The applications of the Linden Hotel, Town Taxi . Co. , Minute Lunch, and the United Mercantile Store, for permits to place and maintain signs, were each read, and upon motion by Schroeder, second by Vihstadt, permits were granted. The application ct the Capitol Eat Shop No.2, for licem a to sell soft drinks, was read, and upon motion by Hicks, second by. Vihstadt., license was granted. ' The application of J. C. Adams, for a transfer of taxi cab licenses No.21 and 23 to cover Ford Sedan bearing State license No.368895 and Ford Sedan bearing State license No. 368896, respectively, was read, and upon motion by Vihstadt, second' i by Erickson, the said transfer was granted with. all voting in favor thereof,except i_ 50 Alderman Schroeder, who voted "Nay". Certified copy of the report made of the assets, liabilities, property, equipment, income accounts, operating revenues, Operating expenses, etc., made by Florence E. Van Tassel, sole owner of the Van Tassel Bus Lines, to the Railroad and Warehouse Commission of the State of Minnesota, covering the period December 31st,1927, to December 17th,1928, was submitted to comply with the provisions of Section 291 of the Charter 5 of the City of Rochester, Minnesota, and President Liddle ordered that the samb be placed on file. The following cophr of resolutiorD passed and adopted by the Public i Utility Board, were read, and President Liddle ordered that the same be :1 placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester,Minnesota that the Hon. Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the Rochester Plumbing and Heating Company of this city for the furnishing of all the labor, materials,tools and equipment necessary for the construction of an extension to the present Public School Steam line from the end of the said line to the County Jail and Court House , ' all as per plans and specifications, and as per their bid, at a price of �4650.C.0 said company being the lowest responsible bidder." "Be it and it is hereby resolved by the PublicUtility Board of the City of Rochester, ,Minnesota that the Hon. Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the Cedar River Lumber Company of Minneapolis, Minnesota for the furnishing to the said City of Western Red Cedar Poles at the following prices F.O.B.' "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the on. Kepp ElectriecCompany for the furnishing,in accordance with specifications on file, of a!11 the labor, materials, tools and equipment necessary for the construction cf an underground duct system for an inter connection between the City Light Plant System and the Franklin Heating Station Plant at a price of $7282,00." Summons and complaint in C. I. Peterson, vs. the City of Rochester, sedan Minnesota, in suit for $500,00 damages to his Chrysler/automobile, claiming to have been damaged by running into a broken. Notice of claim for damages made by Wm. C. Fieck, father of William " Calvin Fieck, a minor child five ,years of age, in the amount of 12,000.00 1 f A 1 0 15� z 0 P for physician's and surgetn's services and other expenses in connection with the care and attention of the said minor child through having been run over on October 31st,1929, by an automobile driven by Thomas Moran an employee and servant of the City of Rochester, Minnesota, was read, as was notice of claim for damages by Wm. C. Fieck for William Calvin Fieck, a minor child five ,years of age in the amount of25,000.00 for injury to the said minor child throw the accident above mentioned, and upon motion by Erickson,. second by Rommel, the said notices of claims for damages were referred to the City ,Attorney. Mr. N. 'D. Adams, Superintendent of the Franklin Heating? Station and the City Engineer called attention tp the need for the enlargement and extension of the trunk line sanitary sewer system and of the surface drainage sewer system of the City of Rochester, Minnesota, and upon motion by flicks, second by Miller, the matter was referred to the the Sewer Committee and the City Engineer, with instruc- tions that they make a_thcrough survey of the situation and report their recommenda- tions at the first meeting of this Common Council, in January 1930. The following reports of the City Engineer on the above mentioned proposals for the laying of, water mains, construction of sanitary sewer and grading, were read, and President Liddle ordered that the saa a be placed on file: "October 7, 1929 Honorable Mayor and Common Council Gentlemen; j T I, respectfully, report tabulation of bids for construction of Serer and Water in Eighth Avenue and Ninth Street Northwest. " "October 7, 1929 I beg to report that Mattson and Anderson Is low bidder for Grading of Sixth Avenue Southeast ,from Eighth Street to Ninth Street and beg to recommend that the contract be so written that no allowance shall be made for any overhaul. Respectfully submitted, CHA:AD C. H. Armstrong,City Engineer." 152 Alderman Rommel introduced the f. ollowing resolution, which was read: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said Common Council does hereby adhere to all of the pro- visions heretofore passed and adopted in the proceedings for the construc- tion of a sanitary sewer commencing at the center of the intersection. of Seventh Street Northwest and Eighth Avenue Northwest, and running Northerly along the center line of Eighth Avenue Northwest to the center of the inter: section of Fi-ghth Avenue Northwest and Ninth. Street Northwest and thence Westerly along the center line of Ninth Street, Northwest to a point 60 feet East of the East line of Ninth Avenue Northwest." Upon motion by hicks, second by Rommel, that the said resolution be G adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. Alderman Schroeder introduced the following resolution, which was ;i read: "Be it, resolved by the Common Council of the City of Rochester, Minnesota: That the said Common Council does hereby adhere to all of the provisions of resolutions heretofore passed and adopted in the proceedings for the la�fing of a 6 inch water main in Eighth Avenue Northwest, between Seventh Street, Northwest and Ninth Street Northwest and. the laying of a 4 inch water main in Ninth Street Northwest, between Eighth Avenue Northwest, and Ninth Avenue Northwest. " Upon motion by Eriokson, second by Schroeder, that the said resolu- tion be adopted as read, n.nd all voting in favor thereof, President .Liddle declared the said resolution duly passed and adopt-ed. Alderman Miller introduced a resolution tlet.emining to adhere to all of ,j the provisions of resolutions heretofore passed and adopted in the proceed- :, ings for the grading to an established grade line and to a width of 50 feet of Sixth Avenue Southeast, between the South line of Eighth Street Southeast, and the North line of Tenth Street Southeast, which was read. UpQn motion by Rommel, second by Miller, that the, said resolution be adopted as read, and all voting in favor thereof, President Liddle declared �I the said resolution duly passed and adopted. A letter from:2ergens & Son, of. Saint Paul, Minnesota, refusing; to make contract for the painting of the outside of the City Hall, and I demanding the return of their certified check, was read, and President 'Liddle ordered that the same be placed on file. Alderman Hicks introduced the following resolution, which was read: r "WIT ., AS, On September 23rd,1929, the bid and proposal of Mergens Son, (1325.00) for the furnishing of all labor, materials, etc., for the painting, etc., of the outside of the City Hall of the ,City of Rochester, Miiuiesota, in accordance with the specifications for the same, was duly ;accepted, which. said bid and proposal was accompanied by the certified check i A" x. 1 53 Of the Cal.b_on Company, drawn pa.yabl,e to the order of J. T. Leriimon, Mayor, in the amount of ``'79.50, which said certified check,was dated September 21st,1929, nu;-:ibered 11, and payable at the First National Bank 'of Rochester, Minnesota, with the number of the certification as 1159, and tk'R1;REAS., Section 280 of the Charter of the City of Rochester, Minnesota, carries a provision "all contracts shall be executed by the bidder within ten days 9fter the contract is ready for his signature, and if not executed by him in said time he shall be deemed to have abandoned the same", and WHEREAS, The said time limit fixed in the said Section 280 has. expired; SO �'FLEREFORE, Be it resolved by the Common Council of the City of Rochester, Min.esota: That the said award of contract tp Mergens & Son is hereby deemed to be abandoned and the said certified check is hereby declared to be forfeited to become the property of and be placed to the credit of the City of Rochester, Minnesota, it being hereby ordered that the said T79.50 be placed in the General Fund in the City Treasury of said City and that •$47.00 therecP be appropriated from the said General Fund and be paid to the said Iiergens 8: Son as being the balance between 10 percent of the contract awarded $325,00 and the full amount of the certified check, which was filed to cover their proposals on the inside. and outside work, their proposal for the inside work having been rejected at the said meeting on September 23,,,d,1929. Be it further resolved by the said Common Council that the Mayor and City Clerk of said City be and they are hereby authorized and directed to draw a warrant upon the City Treasurer for the said :�47.00 and make payment accordingly. " Upon motion by Erickson, second by Rommel, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted. The City Clerk called attent ion that as yet Tenth Place Sout heast !'en and a Half Place Southeast and Eleventh Street southeast, and Eleventh Place Southeast, laying in Sunnyside A,_ldition,have not been officially named and designated, which matter President Liddle referred to the City Attorney with instructions that he draft an ordinance naming and designating the said public street$. f The matter of the ri 7hts of the present owner of the Grimm slaughter house property for a driveway across -tli.e so-called City Dumping Ground, was called to the ! attention of the Common Council, and motion -by -Hicks, second by Schroeder, carried is that the situation be referred to the Street and Alley Committee, the City Engineer, a abd the City Attorney, with instructions that they attempt to make arrangements to furnish him a road over the local sewage disposal plant property instead. i. AlAorman Miller introduced a resolution accepting the bid and proposal of Wm. C. Fraser Son, for the construction of a sanitary sewer commencing at the i; center of the intersection of Seventh Street Northwest and Eightli Avenue Northwest, and running; along the center of Ei nth Avenue Northwest to the center of; j; the intersection of Eighth Avenue Northwest and Ninth Street Northwest, and thence i! Westerly along ,the center line of Ninth Street Northwest to a point 60 feet East of I � �i i y 4 7 the East line of Ninth Avenue Northwest, and fixing the amount of the bond to be given by the said contractor at the sum of �1,000,00, which was read. Upon motion by Rommel, second by Schroeder, tji.at the said resolution be adopted as read, and all votin�in favor thereof, President Tiiddle declared the said resolution duly passed and adopted. Alderman Schroeder intruduced a resolution accenting the bid of Wm. C. Fraser * Son for the laying of a 6 inch water main in Eighth Avenue Northwest between Seventh Street Northwest and Ninth Street North- west, and the laYing of a 4 inch water main in Ninth Street Northwest, between Eighth Avenue Northwest, and Ninth Avenue Northwest, and fixing tht amount of the bond to be given by the said contractor at the sum of $1250,00, which was read. Upon motion by Hicks, Qecond by Erickson, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle deala.red the said resolution duly passed and adopted. Alderman Miller introduced a resolution accepting the bid and proposal of Mattson and Anderson for the grading t o an establis led grade line and to a width of 50 feet of Sixth Avenue Southeast, between the South line of Eighth Street Southeast and `the North line of Tenth Street Southeast, and fixing the amount of the bond to be given by the said contractor at the sum of 1fi980,00, which was read, Upon motion by Erickson, second. by Hicks, that the said resolution be adopted as read, and all voting in favor thereof, President Liddle declared the said resolution duly passed and adopted, Communication from theTri-State Telephone & Telegraph Company asking for authority to erg ect a telephone toll line . over the route set forth on the accompanying sketch,was read, and President .Liddle referred the same to the Street and Alley Committee and the City Engineer. The proposed 1929 tax levy of the Board` of Education for School District No, 8, of Olmsted County, Minnesota, in the amount of-,'357650.00, 1was read, and President Liddle ordered that the same be placed on file for j further consideration. Upon motion by Hicks, second by Erickson, the sum of $100.00 was !i appropriated from the General Fund and it was ordered that the same be'paid to Mrs. Catherine Fritsch as compensation for the death of Mr. Clir ist opher F. Fritsch covering the period August 7th311929, to October 3rd,1929, inclusive; and the sum of $82,40 was appropriated from the Street and Alley Fund and it was ordered that the same be paid to Fred S, Brown, as N �! compensation for injury covering the period August llth,1929, to October 5th,1929, and' the sum of `':59.40, was appropriated from the Street and Alley Fund e.-_d it was ordered that the same be -paid to Wayne Mayhood as compensation for injury covering the period September 13t,h,1929, to Act©ber 3rd,1929, inclusive. i The claim of $1,95, made by George Toogood, for damages to his automobile through e, collision with the City of Rochester owned No.24 International Truck, was read, and President Liddle referred the same.to,the City Attorney. Aid ordinance to Emend ordinance No.354, of the City of Rochester, f41nnesartat which is "An Ordinance regulating traffic within the City of Rochester, Minnesota; and providing for the operation and parking of vehicles, and designating ,.arterial highways in said City", was given its second reading. !: Recomnendatton' of the Lighting Committee, that a street light, be installed on Seventh Avenue Northeabt, between Center Street East and the Chicago & Northwestern Railway Company tracks, and also that one be installed.on Sixth Avenue Southeast, between Eighth Street and Ninth Street, was read, and upon motion by Miller, seconu by Schroeder, the _ said recommendations were accepted, and the City Clerk was instructed to request of the Public Utility Beard that installations be made accordingly. The following reco�mendatiow of the License Committee, were read, and upon motion by Hicks, second by Schroeder, the said recommendations were accepted and it was ordered that the bond mentioned therein and the fees which accompanied the said applications be returned, all voting in favor thereof except Alderman Rommel$ who voted "Nay"; " Rochester, Minnesota, October 7, 1929, Honorable Mayor and Common Council, City of Rochester,Minnesota. Gentlemen: We, The License Committee of said City, do hereby recommend that the application of. Max Schrdiber for a junk dealer's .license referred to this Committee on May 6th,1929, be not granted as our present, ordinance lice risinn junk dealers does not apply to persons or firms having a business location outside of the City of Rochester,Minnesota, but doing business within the said City, in connection with Which we very respectfully recommend that our present ordinance be amended to the effect that all persons or firms buying junk within the Cit,i? of Rochester, Minnesota, regardless of their business location be required to have a license and put up a bond guaranteeing the conduct, of their business. " Alderman Schroeder introduced the follo*)..aig resolution, which was read: t "WHEREAS, Specifications heretofore adopted for local public improvements to be paid for under special assessment prooedure , have been dated in the cases mentioned with a date fcr completion which is inconsistent and impossible, and in a certain case mentioned no date of completion has been fixed in the specifications, and WHEREAS, It is deemed necessary that the completion date in the specifications named be amended and corrected to a date which will give the contractor the proper time for making the .improvement. SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: i That the completion date in the specifications for the following improvements be changed as follows: Completion date for construction of sanitary sewer in Seventh Avenue Southeast, between Twelfth Street Southeast and Thirteenth Street I' Street Southeast, be changed from September 30th,1929, to Oct. 15,1929, The completion date for the grading of Fourth Street Northeast from Eleventh Avenue Northeast to Fifteenth AvenueNort heast , be changed from October 1st ,1929, to Nov.lst,1929; j That the completion date for the grading of Sixth Avenue Southeast, between Tenth Street Southeast and Eleventh Street Southeast, be changed from October lst,1929, to Nov. 1,1929. �I That the completion date for the grading of Seventh Avenue Southeast between..
