Minutes of an adjourned regular. meeting of the Common Council of
�j the City of Rochester, Vinnesota, held in the Council Chambers, in the
'( City Hall, in said City , at 7:30 o'clock P.A., on ' January 14th,1930 .

j+ Meeting called to order by President Liddle.
IRoll Call. Present: .Liddle, Erickson, Hicks, Miller -Schroeder,

it Vihstadt. Absent: Rommel; Alderman Rommel being absent ,on account of the
Illness of himself.
Upon motion by Erickson, second by Schroeder, the minutes of the
meeting held on January 6th,1930, were approved.
Mayor. Lemmon recommended that this Common Council secure the services
of a' competei'it man from the Minnesota Tax Commission for the purpose of
checking the work of the local Assessor. so that it.may be, known as to
whether or not he is making the proper progress in. the preparations for

the 1930 real estate assessment, and cautioned that he deemed this to be
very -necessary as it will be a good precaution taken to evade a possible,

I? re -assessment of� this City because' if it is fpund that the City Assessor is
not functioning as he should there will yet be time to get,him, into the
i;
proper routine and make him take advantage of the ample time left in which
j to make a proper assessment.
Upon motion by Erickson, second by Miller, with each Alderman
voting in favor thereof, the City Clerk was instructed to write to the

Minnesota Tax Commission asking/. a competent man to check the work
of the local City Assessor and to get a quotationas to what these
services will cost, for a week or ten days.
Quotations made by Toltz, King & Day, Inc., the Power Engineering
Company,

were read,
and
President Liddle ordered
that the same.

they made a
preliminary report
entirely independent of the Cowles report, which would be plus by the
cost of further surveying or sounding; the proposal of the Power Engineer-
ing Company being $390,00 plus traveling expenses and surveying costs,
if any might be .required for the checking of the Cowles report, with no
quotation for an entirely independent report; and the quotation of Louis
P. Wolff was $50.00 per day for time in his office, $6000 per day and
expenses for time in the field together with the cost of assistants plus
an allowance of 25% for overhead, and profit, with a d finite lump sum
;1 price of $350#00, which said quotation is for a report made independent

Upon motion by Miller, second by Schroeder, the City Attorney was
instructed to draft a resolution. providing, authority for the Public Utility Board to
expend
not
to exceed $1250.00 for
a preliminary report by
an independent engineer
after
his
survey of -the so-called
Silver Lake project, for
its electric power
possibilities.
Alderman Erickson introduced the following resolution, which was read:
"WHEREAS, At the special election held on January 7th,1930, the
question of the issuance of $50p000,OO City of Ro chest er.,Minnesot a, 4 Improvement
i3onds for .the purpose of constructing, equipping and furnishing a new central fire
station and the wrecking and removal of the. present central fire station received
the approval of the voters of the City o Rochester, Minnesota, by 2557 -for and 183
against, and
WHEREAS, Preliminary to the said constructing, equipping, furnishing,
wrecking and removal; there must be the appointment and selection of an architect
for the preparation of the plans, profiles, specifications and estimate of cost for
the said construction, equipping, furnishing, wrecking and removal., and
WHEREASs Various architects made proposals and talked -of their qualifica-'.
tions at a meeting of this Common Council held on January 8th11930, at which time
the informal selection and appointment of John McG.Miller, was made, as the architect;
for the above mentioned improvements, etc.,
SO THEREFORE, Be it resolved by, the Common Council of the .City of
Rochester, Minnesota:
That the formal selection and appointment of John McG. Miller, of
Rochester, Minnesota, asthe architect for the above mentioned construction, equipping,
furnishings wrecking and. removal, is hereby made, and his fee,is hereby fixed at the
sum of 5' of the cost on the construction, equipping, and furnishing of a new central,
fire station and the wrecking and removal of the present central fire station
exclusive of the architects fee, which 5% shall be full payment for the preparation
of plans, profiles, specifications and estimate of cost for, and supervision of the
work as it progresses especially as to supervision over the pouring of concrete
which shall be supervisdd at all time while such work is under way, with the

presence of the architect or his representative to be required on the work at least
4 times daily while the other construction work is being done, with provision that
if only the preparation of the �lans, profiles, specifications and estimate of cost

is required, the fee shall be 3�gb of the total cost of the construction, equipning,
furnishing, wrecking, and removal exclusive of the architect fees, for which 3X
f�no supervision will be given by the architect.

Be it further resolved by the said Common.Council: That a further
condition shall enter into the appointment and selection of the said John McG.
Millers as the architect for these improvements, etc., which shall be that in the
event of the adoption of the plans, profiles, specifications and estimate of cost,
for the said work and the advertisement for the same, :.it shall be found that the
bids are in excess of the `, 50,000.00 available for these purposes the said architect
shall amend and revise his plans, profiles and specifications to such an extent
that the contract price shall come within the money avai 1 ab le, for i ch he, the
architect, shall receive no further compensation for the same amendment and
revision other than the 5% for preparation and supervision as arranged for, or
the said 32% if it is deemed that supervision can be dispensed with in so far as
em architect is concerned.
Be it further resolved by the said ,Common Council: That the Mayor and
City Clerk of said City, be and they hereby are authorized and directed to execute
contract for the City of Rochester, Minnesota,;. with the said John McG.Miller, as
architect for the above mentioned construction, equipping, furnishing, wrecking and
removal, in accordance with the above fees and duties, etc. "
Upon motion by Vihstadt, second by Hicks, that the said resolution be
adopted as read, and all voting in favor thereof, President Liddle declared the said

resolution duly passed and adopted.

Alderman Miller introduced the following resolution, which was

read:
"Be it resolved by the Common Council of the City of Rochester,
{ Minnesota:
That the Public Utility Board of said City be and it is hereby
authorized to expend the sum of not to exceed Twelve hundred fifty and
no/100 ($1250.00) Dollars for the purpose of employing an independent
engineer to investigate, make a survey of and report on the power
development possibilities of what is commonly known as Silver Lake in
Rochester, Minnesota."
Upon motion by Schroeder, second by Ifiller, that the said resolution

be adopted as read, and all voting in favor thereof, President Liddle
;i declared the said resolution duly passed and adopted.
The report of the Health Officer for the City Farm for the month of
December, 1929, showing receipts in the amount of$142901, disbursements in

the amount of $988.16, and a balance on hand in the amount of $101G.601, was
.read., and President Liddle ordered that the scene be placed on file.
The City Engineer's-' tfial balance of disbursements in his department
for the month of December, 19291, was read, and President Liddle ordered
that the same be placed on file.
The report of the Clerk of the Municipal Court for the week ending
January 13th, 1930, showing criminal fines eollbeted $236.15, court costs
charged to Olmsted County $5.95, and fines collected due to Olmsted
County $88.309 was read, and President Liddle referred the same to the
City Attorney.
Upon motion by Hicks, second by Schroeder, the sum of $88.30, was
appropriated from the General Find and it was ordered that the same be
Paid to Olmsted County,Minnesota, for local Municipal Court fines collected
due to Olmsted County.
The application of C. We$ughV.. and Ray L. Goodenou % for barber
shop licenses, were read., and upon motion by Erickson, second by Hicks, the
licenses were granted

The applications of J. R. Daly, Mrs. J.E.Cutshall, and Mrs. Ernst

Vannier, for solicitors licenses, were each read, and upon motion by
Hicks, second by Vihstadt, licenses were granted:
The application of E. A. Knowlton Company for reimbursement of the

$5600 license fee p,id for toe barber shop license covering their five
beauty p:�&lor"` AiSrs, was read, and the City Attorney orally, ruled that
when
so-called barber shop ordinance does not include beauty shops except they
have a barber chair as part of their equipment, the ordinance being intended
i to license barber chairst at which motion by Hicks, second by Vihstadt,

carried that, the sum of $5.00 be ,appropriated from the General Fund and it was
ordered that the same be paid to E. A. Knowlton Company as refundment. for the
license fe.e on barber shop license No.13.
An invitation from Cris Hare, Secretary of the Izaak Walton League,
thv,-:t the Mayor, President and members of the Common Council attend the entertainment]
to be given Thursday evening, January 16th,1930, was read, and upon motion by
Erickson, sec and by Hicks, the City Clerk was instructed to convey the acceptance
and thanks of the Mayor and' Common Council for the invitation.
The recommendation of the Lighting Committee that a street light
be installed on Second Street Northwest, midway between Ninth Avenue Northwest and
Eleventh Avenue Northwest, was read, and upon motion by Schroeder, second by
Miller, the said recommendation was accepted and the City Clerk was instructed to
request of the Public Utility Board that installation be made accordingly.
Alderman Hicks introduced a resolution appropriating .19000.00 from
the Street and Alley Fund , and 019600.00 from the Sewer Fund for use of the
Street and Alley Committee, which was reed,
upon motion by Hicks, second by Schroeder, that the said resolution
be'adopted as read, and all voting in favor thereof, President Liddle declared the
s:-id resolution duly passed and adopted.
The following claims were read, and Ripon motion by.Hicks, second by
Vihstadt, the same were allowed, and the Mayor and City Clerk were authorized and
e1rected to draw warrants upon the City Treasurer and make payment accordingly&

I The matter of whether those desiring to make proposals for the
construction of the preliminary sedimentation tank should be required to
Purchase copies of the plans and specifications for their 'use in making
! a proposal or whether they should be required to make a deposit to be

refunded upon the return of the plans and specifications, was ,considered
by the Common Councils and upon motion by Hicks, second by Vihst adt,
`.he City Engineer was instructed to charge $5.00 for a set of plans, and
02.50 for a set of specifications, with the understanding that there is to
be no :fefundment made upon the return of the plans and specifications.
Upon motion by Miller, second by Hicks, the sum of $3.15 was
appropriated from the Street and Alley Fund and $.35 was appropriated from
the General Fund, and it was ordered that the said sums be paid to Mike
Holm, Secretary of State, for ten Tax Exempt license plates for use on City
owned motor driven equipment.
Upon motion by Erickson, second by Hicks, the City Attorney was
instructed to secure a warranty deed in favor of the City of Rochester,
Minnesota, transferring the North forty four (44) feet of Bloch One hundred
three (103) in Willson's Addition.
A communication from the Manhattan Rubber Manufacturing Division,
of Mi;nneapolie, Minnesota,. relative to a $1200.00 account which they have
against the City of Rochester, Minnesota, for fire hose furnished, was
read, and_ upon motion by Miller, second by Hicks, the City Clerk was
instructed to notify the said concern that as yet the City of Rochester
has never received a billing for the fire hose mentioned, and further that
the Mayor and Aldermen knew_ nothing of such a transaction.
Upon motion by Erickson, second by Vihstadt, , Council adjourned, to
7 : 30 o'clock P.M., on January 27t h,1930.
