Roll Call. Present: Liddle, Erickson, Hicks, Miller, i ';Rommel, Schroeder, Vihstadt. Absent: None. ! Upon motion by Schroeder, second by Vihstadt, the minutes of 'the meeting he id January 27th,1929, were arproved. ` The matter of the application of J. C. Adams, for four taxi-, ;;cab licenses, was discussed;bl'-.those in favor of and by those opposed to a ;pit. Copy of a letter written. by Mr. G. B. Bjornson of the ;;Minnesota Tax Commission to James Kelly,City Assessor; concerning a i y speeoh, which Mr. Kelly made before the Kiwanis Club of this City on January 30th,1930, was read, and President Liddle ordered that the same 1be placed on file. i 0,C.Rasmussen from the City of St .Paul and County . ofRamsey Assessor's office, selected by the Iinnesota Tax Commission to make the .;requested check on the local City Assessor's work, was before the Common Council for instructions, and he was told to check the work of the local ,,Assessor and make report and recommendation from his findings, and it was liagreed that he should submit his report %nd recommendations to the Common ;;Council Tax Committee,. who, if they deemed it necessary, would call a ;special meeting of this Common Council for tb^:reoeive-the said report and c ,Ire a ammendat ions. I ! Mr. G. A. Smalley, local C.G.W.R.R.Co. Agent, asked !permission that the flagman at the Second Avenue Northwest crossing be r � ;moved to the Second Street Northeast crossing, but no action was taken on i ihi s request. The application of Albert G. Berndt for permission or license .,to move the Lawrence Hotel from its present location Westward on Second .i ;!'Street Southwest to Third Avenue Southwest, and thence South on Third :!Avenue Southwest across Third Street Southwest to the East 85ft: of -Lot 4, the South 2 of Lot 5, in Block 13, of the Original Plat, that is to a o cat ion next South of the so-called Witherstine Property, erssL read, and resident Liddle ordered that the same be placed on file. Upon motion by Hicks, second by Vihstadt, the City Atitorney instructed to take the necessary steps to amend the local building code i i } ! 1Iso as to place the priviledge of moving buildings under the Common Council as to the j'granting of such permissions, which amendment shall be conditioned for a sifficient, bend to save -the City of Rochester harmlies from any damage to persons or property account of the moving of any such building, and further to guarantee the payment cz� ion i ( of costs in connection with the moving of utility services, etc. j A recess was taken for the purpose of considering the J.C.Adams taxicab License applications, and upon the return of the Common Council to regular "15. 1motion by Erickson, second by Hicks, carried that the said license application matter be referred to a later meeting of this Common Council. The Mayor submitted proposed Charter amendments,being Amendment No.l to amend Sections 33 and 343, Amendment No.2, to amend Section 179, and Amendment INo.3, t t o amend Sed ion 293, and read- the said amendments and explained the provisions of the same, i r it At 6:30 o'clock P.M., on February 3rd,1930, motion by Erickson, second by Rommel carried that this Common Council adjourn to 7:30 o'clock P.M., February 3rd, �4 1930. j At 7:30 o'clock P.M., February 3rd,1930, pursuant to adjournment this ' � Common Council again convened and were called to order by President Liddle, all j me tubers being present and andwer ing to roll call as their names were called. ii Alderman Schroeder introduced S::resolution ordering the publication of ' `!the above Charter Amendments, and ordering that the said amendments be submitted for ratification to the qualified voters of said City at the Charter Election which is to ! A !!be held in said City on Tuesday, March llth,1930, between the hours of 9:00 o'clock �.M., and 7:00 o'clock P.M., which was read. Upon motion by Miller, second by Vihstadt, that the said resolution be j •; ladopted as read, and all voting in favor thereof, President Liddle declared the said ` res olut ion duly passed and ad opted. ?t I` 12he report of the Milk Inspector for the month of January,1930, was read, ' ! andPresident Liddle ordered that the same be placed on file. The report of the City Engineer for the month of January,1930, showing i 11 expenditures from the General Fund, for labor in the amount of $252.60, from the li !'Street and Alley Fund �'3124.78, from the Sewer Fund $585,85, from the Bridge Fund j! .30, was read, and President Liddle ordered that .the same be placed on file. The report, of the glakk of the Municipal Court for the week ending !!February 3xd ,1930, showing criminal fines collected130iOO, civil fees received 2.00, court costs charged to Olmsted County $4.65, was read, and President Liddle ,b l!ordered that the same be placed on Pile. y The application of Ella S. Nutting for license to sell soft drinks was read, and upon motionby Schroeder,, second by Hicks, license was granted. i The application of Gerry Thompson (Sunshine Club) for a public dance permit at the Woodman Hall, February 12th, and 26th,1930, was ready The petitions of Barbara Worth, for the establishing of a .grade and the grading to an established grade line of Tenth Street South - 'west, from its intersection with Ninth Avenue Southwest to the northwesterly ,line of Lot 9 in Plummer's Replat "A" and for the construction of a .sanitary sewer and the laying of a water main in the said Tenth Street Southwest, so that the said services will connect with Lot 7 in the said Plummer's Replat"A", were each read, and upon motion by Erickson., second ;by Miller, the petition relative to the establishing of a grade and the ;grading to an established grade line was referred to the Streetand Alley ,;Committee and the City Engineer. Notice from the Railroad and Warehouse Commission in the :i .matter of the petition of the Chteago Great Western Railroad Company for 1authority to discontinue lct,s�.,passenger trains numbers 23 and 24, between. :!Randolph,Minnesota, and Rochester, Minnesota, fixing the heating at 2:00 !;o' clock P.M., Thursday, February 13th,1930, at the Commercial Club in the Clt.9 of..Rochest.er, Minnesota, was reed, and president. T,16ile ordered 0 A that the same be placed on file. The appointment, by the Mayor of Chester R. Fellows, as a Special Patrol- men, from January 29th,1930, to February 4th,1930, inclusive, was read and President Liddle ordered that the same. be placed on file. President Liddle at this time excused Alderman Erickson, who left the Council Chambers,. An ordinaneepreseribing the wages which shall be paid for skilled and unskilled labor, upon,public works by contractors, where .performing such work for the City of Rochester, and by the City, when performing such work not under contract, was given its second reading. An ordinance providing for the issuance of, rpsldent identifycation cards by the City Clerk of the City of Rochester, and requiring that, any person performing work for a contractor or working for the City of Rochester shall have such a card, was given its second reading, The quotation of G. M. Orr & Company for engineering services in connee- Lion with the so-called Silver Lake Power Project, was read, and President Liddle ordere that the same be placed on file. Upon motion by Miller, second by Schroeder, the eum of 080.00, was appro- priated from the General Fund and it was ordered that the same be paid to Mrs. f Catherine Fritsch as compensation for the death of #r. Christopher F.Fritsch during the period January 3rd,1930, to January 30th,1930,inelusive, and the sum of 4,.k29.?O i was appropriated from the Street and Alley Fund and it was ordered that the same i be paid to Wayne 4yhood for supplemental final compensation on account of a recurrence of the infection on account of his injury 'August. 15th.1929, which said j amoung is for compensation for the period November,llth,1929, to November 20th,1929, in ulus ive . The following ruling mace by the City Attorney was read, and President Liddle ordered that the same be placed on file: • "Rochester, Minnesota. February 3rd,1930. Honorable Common Council, Rochester, Minnesota, Gentlemen: The matters of the Bill of the Standard Oil Company for 8565,88 and the Manhattan Rubber Mfg. Co, for seven invoices amounting in the aggregate to $1200000 hQ6ving been submitted to me for an opinion the following is submitted: The two items above mentioned were approved by the officers in charge of the two departments involved and assuming that the material mentioned and described therein was actually received and used by those departmentp it is .s the opinion of the writer that, they must be paid by the City as rendered. This is the rule regardless of the legality of the purchases, at the timethey were made. Respectfully submitted, James T. Spillane City Attorney." Alderman Miller introducedthe following resolution, which was read: "Be it, resolved by the Common Council of the City of Roches- ter: That the sum of$565,88 be and the said sum is hereby approprV,, :! aced from the Street and Alley Fund of said City. and ordered paid to the !Standard Oil Company (Indiana) for 325 drums Stanolind Raving Filler @ $23.10 per ton F.O.B. Rochester,F Minnesota as per Invoice dated Oct. J31, 1929. The Mayor and City Clerk are hereby authorized and directed to draw a warrant for said sum upon the City Treapurer in accordance herewith, and cause said payment to be made. Alderman Vihstadt introduced a resolution appr opr iat ing �11 1120.95 from the Park Improvement , Fund and ordering payment made t o . '':the Mayo Trust Fund for payrolls for labor during the period of the weeks fending January 3rd, lOt h., 17t h, 24th, and 31st , 1930, in accordance with 7jsworn billing made by Wm.Enke,Secretary of the Board of Park Commissioners, ;under date of February lst,1930, which was read. !j Upon motion by Rommel, second by Miller , that the said resolution be adopted as read, and all voting in favor thereof, President, 'Liddle declared the said resolution duly passed and adopted. v r• . f Alderman Schroeder introduced is resolution providing for the issuance and ;sale of 117000,00 Sewage Disposal Plant Bonds to be sold at a meeting of this Common Council, which is to be held at. 7:30 o' elo ek P.M. on the 26th day of February, 930, which was read. Upon motion by Schroeder, second by Rommel, that, the said resolution be i opted as read, and all voting in favor thereof, President Liddle declared the said re esolution duly passed and adopted., Alderman Rommel introduced a resolution prescribing theform of the 50,000.00 City of Rochester, Minnesota, Improvement (Central Fire Station) bonds uthori.zed by the voters of the said City January 7th,1930, and providing for the seance and sale of $15,000.00 thereof, and authorizing the execution and delivery +• .of the said bonds to be sold at a meeting of this 8ommon Council, which is to be ld at 7:30 o'clock P.M., on February 26th,1930, which was read. i Upon motion by Rommel, second by Hicks, that the said resolution be d opted as read,, and all voting in favor t here .t. President Lidd.le declared the said solution duly passed and adopted. Upon mot ion by Hicks, second by Miller, the City Engineer was authorized to attend the convention of Engineers in the Nicollet, Hotel at Minneapolis, Minnesota. ebruary 25th, 26th, 27th, and 28th,1930. 11 Upon motion by Miller, second by Rommel, the City, Engineer was instructed jto cause the City street equipment to be cleaned, painted,and repaired. The Chief of the Fire Department recommended that an ordinance be ; dopted providing for the inspection of oil burners and the licensing :of. instal. - I leas of such equipment, and also recommended the amendment of the ordinance covering ion picture theatres which will prev6 t congestion in the foyers or. lobbies of local theatres, and upon motion by Miller, second by Schroeder, the City Attorney 4 1� as instructed to draw an ordinance and an ordinance amendment in accordance with !'the Fire Chief's recommendations. Upon motion by Rommel, second by Miller, the City Engineer and City Attorney were instructed to confer with Wm,- A. Fitzgerald relative to having deeds executed for the lots necessary in the opening of, the proposed Sixth Street Southwest, between First Avenue Southwest and Broadway Street South, and also that they shall attend to having a.11 street locations designated,which matter shall be ready for submitsion to the Common Council as soon as possible. John S. Reed proposed an amendment, to the above mentioned ;i ordinance prescribing the wages which shall be paid for skilled and i - unskilled labor, upon public works by contractors, where performing such ,;work for the City or Rochester, and by the City, ,when performing such work not under contract, which amendment would provide that the conditions of the said ordinance shall not apply to regular employAiest. of the City of i Rochester, hied and employed by the month or ,year, and he was told that ,!to include such an amendment . it would be necessary to withdraw the original ordinance and have it redrafted with that provision in it, and his attention �Iwas also ,called to the fact that the ordinance providing for the issuance of resident, identification cards by'the City Clerk of the City of Rochester, and requiring that any person performing work for a contractor or working.for the City of .Rochester shall have such a card, was not drawn in proper ordinance form. if Mr. Reed asked that these two ordinances be withdrawn for. ,correction and Alderman Schroeder, who introduced them, made a similar ;request . �i A motion by Hicks, second by Rommel., carried b all voting y of g !in favor thereof, that Alderman. Schroeder be ,allowed to withdraw the said two ordinances, and adcord ingly the said two ord inanceswere withdrawn and handed to Alderman Schroeder. Upon motion by Hicks, second by Rommel, the Street & Alley Committee, and the City Engineer, were instructed to ingest igate the cost '.. for the installation of permanent street signs. Alderman Erickson returned to the Council Chambers and again took his Chair. Alderman Hicks introduced a resolution granting public ;dance permit to the Sunshine Club (Gerry Thompson) for the Woodman Hall ebruary 12th, and 26th,1930, and fixing the fee at $10.00, which was ead. 21 Upon motion by Schroeder, second by i Vihstadt, that the said resolution .�1.
