Minutes of en:ad-Burned regular meeting of the Common Council
of the City of Rochester, Minnesota, held in the 061dAell :Chglibers, in
the City H&11, in said City, e6t 7:30 o'clock P.M., on February 26th,1930.
Meeting called to order by President Liddle.
Roll C&11.. Present: Liddle, Erickson, Flicks, Miller,
Rommel,, Schroeder, Vihstadt . Absent: None.
Upon motion by Rommel, second by Schroeder, the minutes of the
meeting held on February 17th,1930,_and on February 21st, 1930, were
i each 'approved .
Mr. Hanson, Manager of the Marigold Dairies Company, asked for
authority to construct a sanitary sewer in the boulevard on the North
side of Fourth Street Northeast) between Broadway Street North and First
Avenue Northeast, and upon motion by Schroeder, second by Vihstadt, such
permission was granted with coedit ion that the said sanitary sewer .shall
considered as a private sewer, the property of the said company, which
construction shall be under the supervision of the City Engineer, they
to pay the cost of construction and all future maintenance, which agree-
ment they shall confirm accordingly by written acceptance of such
conditions for to be filed in the records of the City df Rochester,
Minnesota,
A. E. Gates presented a petition, which was read, asking
for the opening and extension of Third Place: Southeast, between
Thirteenth Avenue Southeast, and Fourteenth Avenue Southeast, at which

motion by Erickson, second by Miller, carried that the said petition

4 be referred to the Street and Alley Committee, and the City Engineer
fo their investigation and recommendations in the matter.
This being the time and place fixed for the opening of
i proposals for the purchase of+�17, 000100 City of Rochester 4 sewage

Disposal Plant Bonds and $15000,00 City of Rochester 41-� (New Central
Fire Station) Improvement Bonds, the following proposals were opened and
read:

101.70 and accrued interest from February 1st ,1930, to February 27th,
1930, for the $15,000.00 Improvement Bonds and 106.15 and accrued interest '
? from December lst,1929, to February 27th,1930, for the 1,17000,00 Sewage
Disposal Plant Bonds;

` Wells -Dickey Company; Ipar and a premium of $685.00 plus accrued interest
to date of delivery for the 117000.00 Sewage Disposal Plant Bonds, and par plus accrued
interest to date of delivery, less 1110.00 to be paid to them for printing blank bonds;
and for the opinion of their attorneys,, for the 915000.00 Improvement Bonds. j
Alderman Hicks introduced the following resolution,which was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
V That the bid and offer of Sinking Fund Commission of Rochester, Minn. for .
$179000.00 City of Rochester, Minnesota, 4r/, Sewage Disposal Plant Bonds, dated September
1st, 1924, which were at this meeting offered for sale, bring17000.00 as the prin-
cipal on the said bonds, $1.045.50 as premium on the said bonds 'and A154.77 as accrued j
interest from December lst21929, is deemed to be the most favorable proposal for the
said bonds, and
Be it further. resolved by the said Common Council: That the- said bonds
';are hereby awarded and sold to Sinking Fund Commission of Rochester, Minn., and that
;;the same be delivered to them upon them paying into the City Treasury of the amount
�'of the said bid therefor; said bonds herewby awarded and sold are described as being
;'numbered: 267 to 290 inclusive, 307 to 310 inclusive, 327 to 330 inclusive, 346 to
j!350 inclusive, all dated September 1st, 1924, and having the June 1st ,1°30, and all
,,subsequent interest coupons attached, the maturities of the said bonds being four
(thereof on th- first day of December in each of the years 1941, 1942, and 1943, and

Be it further resolved by the said Common Council: That the Mayor and
City Clerk of said City are hereby authorized and directed to duly execute the said ;
bonds and the City Treasurer of said City is hereby directed to deliver the said
bonds to the said purchaser upon the payment into the City Treasury of the above
mentioned purchase pr ice , and at said payment the City Treasurer will place the
principal and premium collections in ,the Sewage Disposal Plant Fund and the accrued i
interest collection in the Interest Fund."
Upon motion by Erickson; secand by Schroeder, that the said resolution
be adopted as read, and . a,ll voting in: -favor thereof, . Pretident Liddle ..declared the said
resolution duly passed and adopted.

The report of the Clerk of the Municipal Court for the week
lending February 24th,1930, showing criminal fines collected in the amount
'nf 11.3,30, civil fees received in the dmount of$4.25, Olmsted County
Municipal. Court fees .for Jannary,1930, received in the amount of 10154.10,
Pourt costs charged to Olmsted County $3.65, and fines collected due to

the State of Minnesota, and sent direct to the State Treasurer $15.00, was

read, and President Liddlereferred the same to the City Attorney.

j The application of Mrs. J. N. Brand for a soft drink dealex's
license at 43 Fourth Street Southeast, was read, and upon motion by
ihstadt, second by Schroeder, license was granted.

The application of. Sanford Ward, for a public dance permit, at the Woodman
Hall, March 6th,1930, was read.
The following applieaticns for drivers licenses were read., and upon motion
by Hicks, second by Schroeder, licenses were granted to each of the said applicants:

Upon motion by Erickson, second -by Hicks, the Mayor, the Street and
Alley Committee, the City Attorney and the City Engineer, were instructed to make
an appointment for a meeting with the Highway Department for R. riddy,,Pebruary 28th,
193 0, relative to the location of the proposed bridge across the Zumbro River on
Broadway Street South, and accordingly the following telegram was prepared and
forwarded:

Acknowledgement by Senator Shipst,ead of a certified copy of

We, T,, M. Feller and J. W. Feller, doing business as Feller
Brothers, having the contract for the construction of a preliminary
sedimentation tank being constructed for the City of Rochester at
the Sewage Disposal Plant, do hereby formally accept the changes as
noted in the construction of the said tank which are incident to
the change in the arrangement of the Link -Belt sludge collectors,
which changes are shown on a correction sheet for Sheet .No. 2 of
the plans originally submitted by the City Engineer and attached to
Sheet No. 2 .of_ the said plans. , , __ -

Alderman Er ieks on introduced the following resolution which

"WHEREAS, It is deemed that a more efficient arrangement can be made for
he link belt! sludge collectors shown on the plans and profiles adopted January 6th,
930, for the construction and equipment of the preliminary sedimentation tank at the
oeal sewage disposal plant, and
WHEREAS, A blueprint showing the chance in the arrangement of the link
elt sludge collectors, designated as Correction Sheet for Sheet No. 2, has been
repared and su.bmi.tted to this Coranon Council, and
WH,,'REAS, Feller Brothers, the contractors to whom the, contract .fop the
construction and equipping of the said sedime L tat ion tank, - bave agreed to the making
of this change without any cost whatever to the City of Rochester, Minnesota;
SO THEREFORE, Be it resolved by the Common Council of the City of
ochester, Minnesota:
That the said original sheet No.2 is hereby changed and amended insofar
as the details shovm on Correction Sheet for Sheet No.2, are concerned and jt is
ordered that the said correction sheet #or Sheet No. 2, be attached to the original
sheet No. ?, and the details shown thereon are hereby substituted for that part of
the equipment showd on the original sheet No.2. j
Be it further resolved by the said Common Council: That Feller Brothers,
contractors for the construction and equipment of the said sedimentation tank be furnish-
ed with a copy of this resolution for to De attached and become a pact of their i
contract and that a copy of this resolution be attached to and become a part of the
contract for the c omstruction of the said sedimentation. tank which is now on f ile in
the office of the City Clerk of said city.n

Alderman Schroeder introduced a resolution granting public dance permit
to Sknford Ward for the Woodman Hall, March 6th,1930, and fixing the fee at $5.00,
which was read.
Upon motion by Miller, second by Vihstadt, that the said resolution be
adop ued as read, and all voting in favor thereof, President Liddle declared the said
resolution duly passed and adopted.
Alderman Vihstadt introduced the following resolution, which was read:
"Be it.resolved by, the Common Council of the City of Rochester, Minnesota:
That the sum of A5415.95 be appropriated and that the said sum be paid to

the Independent, 011 and Gas Company for gasoline and kerosene furnished during the
period December 3rd, 1929, to February 8th,1930, inclusive; $6.67 thereof to be
from the General Fund, $6.06 thereof to be from the General Fund, and $403,22 thereof!
to be from the Street anu Alley Fund,
The Mayor and City Clerk are' hereby authorized and directed to draw
warrants for the said sum upon the 6ity Treasurer in accordance herewith, and cause said
payment to be made,"

The Common Council canvassed the returns from the Primary Election held
February 25th,1930.
Alderman Erickson introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester;
That the following is a tabulated statement of the number of the votes
cast for, each person at the Primary election held on the 25th day of February,
A. D. 1030, in the City of Rochester, as determined try said Common Council on the
canvass of the returns of the said Primary Election made the 26th day of February
1930, and that said tabulated statement is hereby declared to show the result of the s'
said Primary Election.

Be it further resolved: That Burt Elliott Eaton and Frank G. Newhouse
are hereby declared to be candidates for Municipal Judge of the City of Rochester,
at the Charter Election to be held March llth,1930;
Paul H. Dallman and 0. W. Schroeder are hereby declared to be the
candidates for Alderman of the Third Ward of the City of Rochester,dinmesota, at the
Charter Election to be held March llth,1930.

Election to be held March llth,1930."

resolution be adopted as read, and all voting in favor thereof, President

The following copy of resolution requesting authority was
read, and President: Liddle ordered that the same be placed on file:
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Min.i,esota that the Hon. Common Council be and is
.;hereby requested to authorize the said Board to enter into a contract
with Louis Golod of this city for the sale to him and removal, according
.to - plans and specifications on file and according to his bid, for two
;turbines, condensers and such auxiliary equipme r*, as is c ontained in said
"specifications at a price of SIX HUNDRED AND TWEN2Y FIVE DOLLARS ($625.00),
,,said Louis Golod being the highest responsible bidder."
Alderman Miller introduced the follot.ring resolution,which was
read:
"Be it resolved by the Common Council of the City of
Rochester,Minnesota:
k That the Public Utility Board of saiu City be and it is
- ilhereby authorized to enter into a contract with Louis Golod of said City
for the sale to and removal by him, according to the Glans and specifica-
tions therefor, or two (2) turbines, condensers and such auxiliary
;equipment as is contained in the said specifications, all fbr the sum of
:;Six hundred twenty-five and no/100 ($625.00) Dollars, the said Louis
;Golod being the highest responsible bidder therefor.
Be it further resolved:
That the amount of the bond to be given t o said Board by
;;the said Louis Golod be and the same is hereby fixed at the sum of $,625.00:
Upon motion by Hicks, second by Rommel, that the said resolu-
ion' be adopted as read, and all voting in' favor thereof, President Liddle
eclared the said resolution duly passed and adopted.
Upon motion by Miller, second by Erickson, it, was ordered that
he certified checks which acc :mpanied the proposal of the Wells -Dickey
ompany for the purchase of bonds offered for sale at this meeting,be
returned to them.

Upon motion by Hicks, second by Schroeder, that the said resolution be
p't opted as read, and all voting in favor thereof, President Liddle declared the
aid resolution duly passed and adopted.
<A . B. W. Eaton, representing the Yellow Cab Company, stated that it was the
desire of his company to withdraw-, as maVy Cadillac taxicabs, for replacement by
Chevrolet taxicabs, as may be necessary to take care of the demand for twenty five
cent taxi fares, which arrangement would commence with trxee Chevrolets with an
ltimate total of six, which Chevrolet taxicabs . would be operated by another organiza-
tion controlled by the Yellow Cab Company.
The License Committee and City Attorney submitted the following
ee ammendat ions , which were read:
