Minutes of a,regular meeting of the Common Qouncil of the

it City of Rochester, Minnesota, held in the Council Chambers, in the City
Hall, in said City at 7: 30 O'clock P.M,, , on March 12th,1930.
Meeting called to order by President Liddle.
Roll Call. Present: Liddle, Erickson, Hicksy; Miller,

Upon motion by Schroeder, second by Vihstadt , the minutes
r of the meetings held on February 26t h,1930, February 27th,1930, and

fi March 3rd, 1930, were each approved.
Hugo Helm made claim for sixty Buckthorn, shrubs which
were cut, off D.y a snowplow while operating on the sidewalk in front of
his residence at Ninth Street Southeast and Sixth Avenue Southeast., and
President Liddle referred his claim to the City Attorney.
The re jort of the City Treasurer for the month ending

February 28th,1930,,showing $272612.52 as being on hand, was read, and
President Liddle ordered that the same be placed on file.
The report of the Health Officer for the City Farm for the
month of Februar y,1930, showing reee ipt s , in the amount of $192.892
disbursements in the amount of $1160.3019 and a balance on hand in the
amount of•>$744.65, was read, and President Liddle ordered that the same
be placed on file.
The report of the City Weighmaster for.the month of February,
1930, showing weighing fees collected in the amount of $27.60, was
read, and President Liddle Deferred the same to the Finance Committee.:
The report of the City Engineer for the' month of February
1930, showing expenditures for labor from the General Fund in the amount
of $84.31, from the Street arA Alley Fund $9040943, from the Sewer Fund
$702.92, and from the Bridge Fund $11.00, was read, and President
Liddle ordered that the same be placed on file.
The report of the Building and Electrical Inspector for the
month,of February 1930, showing receipts for building inspection in the
amount of 0121.00, and for electrical inspection $14.50, was read, and
President Liddle referred the same to the Finance Committee.
The Yeport of the Clerk of the.Municipal Court for the
week ending March 3rd,19300-showing criminal fines collected $125.00,
civil fees received$2.35, and for the week ending March lOth,1930i,
i showing criminal fines collected in the amount of 135,00,and civil
jfees received 2,00, were each read, and President Liddle referred the
same to the City Attorney.

'The report of the Milk Inspector for the month of February,1930, was
read, and President Liddle ordered that the same be plaeed,on file.
The statistical report of the Public Library for the year ending December
31.st,1929, was laid before the Common Council, and President Liddle ordered that the
same be placed on file.
The application of Sanford Ward for a public dance permit at the Woodman

Hall March 20th,1930, was read.
The application of Theodore Albertson for a drivefs license, was
read, and upon motion by Erickson, second by Rommel, license was granted,
The application of Roy T . Masuda, Manager of the Grand Cafeteria, for
permission to install at least one oil tank and possibly two, for his furnace,
hot water beater and oil range, which installation would be in the sidewalk in front
of his building and in the alley in the rear of his buildinr=;, was read, and
upon motion by Erickson, second by.Hicks, his request was referred to the Street and
Alley Committee, and the Ctty Engineer.

,Southeast, between Eighth Street and Ninth Street during the season of 1930, was
read, and President Liddle ordered that the same be placed on file.
The petition asking for the paving of the alley running North and
j South across Block 25 in Head and McMahohl s Addition with seven inch Pne course
i, steel reinforced concrete -paving, was read, and President Liddle referred the same
Ito the Xtreet and Alley Committee and the City Engineer,

Upon motion by Schroeder, second by Vihstadt, Miss Lillian
R. Sveom, City Clerk's Stenographer, was granted the additional four
days of vacation which she was entitled to during this 6ffIcial year,
viz., March 19th, to 22nd,1930, inclusive, and the City Clerk was-
autliorized to secure the 'services of a substitute stenographer.
A communication from Marsh and McLennan, of Minneapolis,
!Minnesota, asking for the cancellation and return of Pubiic Liability
!I policy No. A-4-870,477, written by the Globe Indemnity Company, covering.
J. C. Auams, dai-ng business as the Town Taxi Company, in his taxicab

'business here, in as much as he is now covered by policy APR-406909, was

read, and upon motion by Rommel, second by Schroeder, the City Clerk was
Instructed to release and return the first mentioned public liability

;!Minnesota, tach talked in favor of the acquisition of the riparian
rights and the other lands necessary for the development of a hydro-
electric power plant on the Zumbro River at Oronoco, Minnesota, with.
the development of the same to come later If it is not possiblo to handle
the financing of it at this time,
Rev. A. R. Zick cautioned that propoganda as to Mrw Allis
not renewing the option for the bulk of the lands required for this
al
project was only a sales trick, and said that, this question ghbuld
Igo before the voters of the City of Rochester for their decision.
j G. Worth questioned the claimed endorsement of the Tax Payers' League I
i on this subject and said that no endorsement had ever been given in any meeting
at which he was present, and insinuated that Mr. Fitzpatrick's domination of the
D.eague meetings made it quite impossible to get a proper expression of opinion,
Mayor T,ercmion recommended the renewal of the option on the Allis lands,
if it is possible to secure one, and then put the necessary questions of the

Oronoco Power project and the Silver Lake development both before the voters of this
i, Cit,y for their decision in the matter of the necessary bond issues.
H. 0. Christdnson, as Attorney for the Allis interests, said that he had
no authority to say whether the present option. could be renewed or not after its
expiration March 20th,1930 .
Upon motion by Hicks, second by Erickson, further discussion of the
Oronoco Power project was deferred to the meetina, which is to beheld March 17th,
1930, and the Public Utility Board was instructed to secure a renewal of the option
I for another 90 days if possible.
Upon motion by Erickson, second by Vihstadt , the sum of $100.00 was
.appropriated from. the General Fund and it was ordered that the same be paid to
i bArs. Catherine Fritsch, as compensation for the death of Mr; Christopher F. Fritsch,
during the period January 31st, to March 6th,1930.
Upon motion by Ro-=iel, second by Erickson, the City Ehgineer was
instructed to publish a notice that March 17th,1930, will be the final day for the
filing of petitions for sprinklin- with water or treating with calcium chloride of
streets and avenues during the season of 1930,
The City Clerk recommended the amendment of the State election laws so
that a person moving from an election distpiet and not having 30 days residence in the
new district on the day(: of the election, should be allowed to vote in the old
precinct, provided that he has made the proper application for the transfer of his
registration, i . e . , the person should riot 'lose their voting privilege in the old
i
precinct until they have gained it in the new, but no official action was taken on the
recommendation, he being informally instructed to attend to it that it be one of the
subjects for discussion at the June 1930 conference of the League ofMinnesota
i
Municipalities at DulutJi, Minnesota.

The following copes of resolutions passed and adopted by the Commissioners
of the Sinking Fund of the City of Roehester,were each read, and upon motion by
Ronnie 1, second by Schroeder, the actions set forth therein were approved and it was

held on March llth,1930, to hold office for two years and until his successor is

Of the Third Ward of said City, which election shall be determined pursuant to
Section 13 of the Charter of said City, bythe casting of lots at a meeting of this
Common Council which is to be held on March 17th,1930�\at 7:30 o'clock P.M.;
That Walter B., Fratzke is hereby declared to be elected to the office of
School Commissioner of the Third Ward of said City, at the Charter Election held on
?March llth,1930, to hold office for two years and until his successor is elected and
qualified,
Be it further resolved bar the said Common Council:
That the number of persons preser ;, and voting at the said Charter -Eleatic
held on march llth,1930, was 3894, of which 1765 voted in favor of the above mention
proposed amendment for Sections 33 and 34, and 1655 voted against the Said amendment
and that there were 484 blank ballots, as shown by the returns of said election as
above set forth;

Be it further resolved by the said Common Council: That the whole
number of pers ..r+s present and voting at the said -Charter elect ion was 3694, and
that it required 2338, votes, or 60 per cent of those who voted at the said Charter
Election to ratify the said amendw.ent and that there were not more than three -fifths l
(3/15) of the total number of votes in favor of the adoption and ratification of the
said proposed ame idment and that -the said amendment did not receive the necessary
three-f ifths' (3/5) of the said total votes and therefore was not ratified and adopted
by the voters at the said Charter Election and therefore did not carry and is not made
a, part of the Charter of the City of Rochester, Minnesota;

proposed amendment for Section 179, and 1349 voted against the said amendment and
that there were 461 blank ballets, as shown by the returns of said election ,as above

required 2338 votes, or 60' per cent of those who voted at the said Charter Election

Alderman Schroeder introduced a resolution appropriating

Post Bulletin for official publications and printing during the
period of February 4t,h,1930, to February 25th,19303, inclusive, which
was read.
Upon motion by Erickson, second by Miller, that the said
resolution be adopted as read, and all voting in favor thereof, President
Liddle declared the said resolution duly passed and adopted,
Alderman Schroeder introduced the following resolution
which was read:
"Be it resolved by the Common Council of the City of Rochester
That the slim of 8566.10 be and the said sum is hereby appro-
priated from the General Fund of said City and ordered paid to the
:i Rochester Post -Bulletin, for publishing Charter Amendments 1',449.82,
Ballots for Charter Amendments !"56,61, publishingSehool Ballots 4, 18.36,
and publishing City Charter Election ballots $41,31, during February
and March,1930.
The Mayor and City Clerk are hereby authorized and directed
to draw a warrant for said sum upon the City Treasurer in accordance
herewith, and cause said payment to be made."

Upon motion by Miller, second by Vihstadt, that the said resolution be
adopted as read, and all voting in favor thereof, President, Liddle declared the said
resolution duly passed and adopted.
Upon motion by Nicks, second by RO_tLmel, the City Clerk was instructed
to bill School District No. 8 for the cost of the ballots and the cost of the
ballot publication .for the election held on ?larch 1lth,19301;
Upon motion by Erickson, second by Vihstadt, the City. Clerk was instructei
to request of the Public Utility Board that the Water Department make a complete
inspection of the City as to curb boxes which may be within the sidewalk lines and
project, above the sidewalk grade, and lower such curb boxes to the sidewalk level.
Upon motion by Schroeder, second by Miller, the Public Utility Board wer
requested to lay suitable water mains in First, Street Northwest between Fifth Avenue
and Sixth Avenue, and also a suitable water main in First Street Northeast between
Second Aveme and the river; the said request to be confirmed by the proper resolu-
tion of this Common Council,
Upon motion by Rommel, second by Schroeder, Council adjourned to 7:30
